Gass NYSEG Representative - Dennis Mastro Members of the Public : Walt Sczepanski , Peter & Alice Supa, Thomas Schickel Affidavit of Neighbor Notification received June 19 , 1996 Public Hearing Declared Open : Chairperson Horst declared the public hearing open at 7 : 32 P . M . and read the following "Notice of Publication" "NOTICE IS HEREBY GIVEN, that a Public Hearing will be held by the Planning Board of the Town of Danby on Wednesday, June 19, 1996 at 7 : 30 P . M . , Danby Town Hall , 1830 Danby Road, Ithaca, New York, 14850 . Purpose of hearing is to Consider Approval of the Proposed Subdivision of a 1 . 72+\- acre parcel from Town of Danby Tax Parcel No . 1 . - 1 -24 , 75 acres total , with said 1 . 72+\- acre parcel located west of Comfort Road and north of Jersey Hill Road. Ursula VanDeman, owner, CNG Transmission Corporation, applicant; Gregory S . Gass, agent for applicant. All interested parties will be given the opportunity to be heard either in writing or in person. By order of the Planning Board Chair Carol W . Sczepanski , Town Clerk Dated : June 11 , 1996 Published : June 13 , 1996 " Gregory Gass, representative for CNG Transmission Corporation, addressed the Board and gave a brief description of the services that CNG provides . He said the project that they are requesting subdivision approval for is to provide a delivery point to New York State Electric & Gas (NYSEG) I ;. Corporation. It is a 1 . 72 acre parcel located on their three (3 ) existing transmission pipelines and a � I`'` mobile product line . The site will become a utility substation metering and regulating equipment will be placed at it. There will be two (2) or three (3 ) buildings placed on this site . There are three (3 ) existing pipelines on the existing corridor. { � Dennis Mastro from NYSEG - said one of the reasons for approval , by the Public Service Commission was the economic development for natural gas . The State of New York has required utilities like NYSEG to promote aggressively the use of natural gas because of the continued decrease dependence on foreign oil . Pete Supa - Johnson City - said he challenges whether there is really a need for this pipeline . .MI= 3 u 3 2 Planning Board Minutes Public Hearing - CNG June19, 1996 Dennis Mastro - responded that Mr. Supa was correct on some points . A part of the process of deregulating utilities in the State of New York requires utilities to purchase all private energy generation whether there is a required need or not. The State of New York at the present time, from an energy stand point, is that we do not have enough energy . Walt Sezepanski - East Miller Road - asked if the Public Service Commission has determined the route the pipeline would take through this area and which of the five possible routes described at a recent meeting with landowners between East Miller Road and Hornbrook Road would be the pipeline route . He also asked when the twenty (20) day response period would begin . Dennis Mastro - said that the Public Service Commission today approved the certification of NYSEG and approved the Danby Route . Individual specific land use issues, specific routing, crossing individual land owners , is to be done through the negotiation process . Soil boarings and environmental studies must be completed so that they can develop the EMCP and the route will depend on a variety of data. The response period will start when the EMCP is filed . Susan Beeners reported that in reviewing the application for subdivision, the Planning Board needs to deal with SEQR review of the proposed subdivision . She asked if SEQR was one part of the larger Environmental Management Construction Plan . Dennis Mastro said that the Planning Board would have access to the Environmental Management Construction Plan. All public documents on the process from the beginning are on file in all libraries . Chairperson Horst - asked if the Planning Board would have access to the Environmental Review. Joel Gagnon - said that part of the job of the Planning Board in reviewing the application for subdivision is to consider the environmental implications and they can ' t approve it and look at it later. We have to treat it as a separate action with it ' s own environmental review or we have to have access to the information before we act . Mary Lou Hardesty said that she understands that CNG must have a Perk Permit and asked if it had been received . Dennis Mastro said that NYSEG ' s Environmental Management Construction Plan which deals with the pipeline construction would be on file very soon and that CNG would be providing information on the subdivision . Gregory Gass - replied that CNG has applied for a Perk Certificate and it is being reviewed . The PERK Certificate is contingent upon the archaeological studies, wetland delineations, and environmental studies . A docket number for the certificate has not been assigned at this time . Dennis Mastro - reported that there would be a thirty (30) day public comment period beginning when the EMCP is filed . • Mary Lou Hardesty - said she would like the Planning Board g oar to defer decision and adjourn this hearing on the CNG Subdivision Proposal until after there has been a Board of Zoning Appeals Decision regarding variances related to this project. Chairperson Horst said that the Zoning Board must address this issue before the Planning Board can act. Nancy Weitzel - commented that the proposed NYSEG Pipeline is not showing on the map and asked where it would tie into the regulating station. Dennis Mastro - explained that when the Public Service Commission approves a route that is believed to be the general route. Motion to Adjourn Public Hearing - CNG A motion was made by Mary Lou Hardesty and seconded by Arch Dotson to adjourn the Public Hearing to Wednesday, July 17 , 1996 at 7 : 30 P . M . June 19, 1996 PRESENT : Chairperson Kenneth Horst Planning Board Members : Arch Dotson, William Farrell , Joel Gagnon, Mary Lou Hardesty, Nancy Weitzel • ABSENT : Ralph Wilbur (Excused) Others Present : Code Enforcement Officer - Susan Beeners Secretary - Carol Sczepanski Members of the Public : Gregory S . Gass, Walt Sczepanski, Peter & Alice Supa, Thomas Schickel , Dennis Mastro , Richard & Ruth Walker Chairperson Horst opened the regular meeting of the Planning Board at 8 : 25 P . M . PRIVILEGE OF THE FLOOR: Walker Proposed Subdivision Richard Walker resides at 1000 Coddington Road at the end of a 3 ,000 foot driveway. He explained to the Board that he would like to sell some of the property at that location with an easement of less than 150' for his driveway to his existing home . Ruth Walker asked if it was necessary to retain more that sixty (60) feet of road frontage for access to their home . They do not want to retain more road frontage than is necessary for the driveway. The Board reviewed a rough draft plan submitted by the Walkers of the proposed subdivision of the property . After much discussion the Board the Walkers were asked to submit an application with a sketch plan and enough information for the Planning Board to consider the proposal . Motion for Later Discussion A motion was made by Bill Farrell and seconded by Nancy Weitzel that the Planning Board discuss the Walker proposal after other business has been discussed . Carried Unanimously Angelheart Designs - Final Site Plan Review Tom Schickle addressed the Board and reported that the Town Board approved the General Site Plan ® for the expansion of Angelheart Designs, Inc . He explained the Final Site Plan submitted for the expansion and asked the Planning Board to approve the plan . Susan suggested that the Planning Board approve the plans as presented tonight with the Septic Option No . 1 and with the condition that before any of lands in the low density zone on the remainder of the property that the driveway become part of the Planned Development. There will be a need for Angelheart Designs to apply for a variance for the sewing room on the north side of the building to retain the thirteen ( 13 ) foot setback. Susan recommended that the Planning Board approve the project as presented and as shown on the Site Plans on drawings 1 , 2 , dated June 7 , 1996 and 3 , dated June 19 , 1996 subject to pertinent provisions of Local Law No . 1 of 1996 and with conditions A and B of Proposed Resolution "Consideration of Final Site Plan Approval - Angelheart Designs, Inc . " 2 Planning Board Minutes June 19 , 1996 RESOLUTION NO . 19 of 1996 - Approved APPROVAL OF ANGELHEART DESIGNS, INC. FINAL SITE PLAN By Joel Gagnon : Seconded by Arch Dotson WHEREAS, Angelheart Designs, Inc . Located at 303 Gunderman Road in the Town of Danby has requested approval of General and Final Site Plans for a proposed addition to the existing building and associated site improvements ; and WHEREAS, the Town Board on June 10 , 1996, acting as Lead Agency in environmental review of this Unlisted action, made a negative determination of environmental significance ; and • WHEREAS , the Town Board on June 10 , 1996 approved the modified General site Plans for Planned Development Zone 10 as requested by Angelheart Designs, Inc . , and adopted Local Law Number 1 of 1996 , entitled "A LOCAL LAW TO AMEND THE ZONING ORDINANCE TO MODIFY THE BOUNDARIES AND ESTABLISH A MODIFIED GENERAL SITE PLAN FOR PLANNED DEVELOPMENT ZONE 10, COMPRISED OF A PORTION OF TOWN OF DANBY TAX PARCEL NO . 9 . - 1 -9 . 12 , LOCATED ON THE SOUTH SIDE OF GUNDERMAN ROAD WEST OF COMFORT ROAD" ; and WHEREAS , the Planning Board on June 19 , 1996 has reviewed the plans which have been submitted in application for Final Site Plan approval , now, therefore, it is RESOLVED, that the Planning Board grants Final Site Plan approval for the project as presented and as shown on plans entitled, " Site Plan of Planned Development Zone 10 , Drawing No . 1 " , and "Site Plan of Engelhart Property, Drawing No . 2 " , dated June 7 , 1996 ; and " Site Plan of Engelhart Property Indicating Septic Layout Drawing No . 3 " , dated June 19 , 1996 ; for Angelheart Designs, Inc . , by Schickel Architecture, subject to pertinent provisions of the aforesaid local law, and further subject to the following conditions : A . No further development of the remaining lands of Tax Parcel No . 9 . - 1 - 12 outside of the Planned Development Zone shall be permitted until a General Site Plan is submitted and approved for the lands included within and abutting the proposed new driveway located to the east of Planned Development Zone 10 . B . The proposed septic system for the current addition project shall be located within Planned Development Zone 10 unless a General Site Plan for a further modified Planned Development Zone which boundaries would include the septic system is submitted to and approved by the Town Board . She said that the Town Attorney has reviewed the proposed regulations . The draft of June 14, 1996 is the one to be considered for recommendation to the Town Board . A vote on the motion resulted as follows : Five Members voting Aye One Abstained Carried Other Business : Planning Federation Meeting Arch Dotson reported that he attends the Planning Federation Meetings and has found them to be very constructive and very helpful . One practical product from the last meeting was a three (3 ) page manual on the whole environmental review process of the SEQR (an eight step process) . This manual would be useful to the Board . There is a practical workshop "Design and Site Development", on June 25 , 1996, 6 : 30 - 9 : 30 P . M . at the Holiday Inn . ADJOURNMENT : On a motion the meeting adjourned at 915 P . M .
