PLANNING BOARD MINUTES
Regular Meeting 7 : 30 P .M. June 21 , 1995

Chairperson Horst called the meeting to order at 7 : 36 P .M .
Privilege of the Floor :
Mary Lou Hardesty reported that she attended two (2) meetings at Tompkins County
Cooperative Extension entitled "Promoting Economic Vitality : What Local Government Can
Do. The meetings were about community networking and what other communities are doing to
promote economic growth. She suggested that the Planning Board might obtain copies of the
videos that were viewed at the meetings from Cooperative Extension to view.
Nancy Weitzel suggested Planning Board schedule a special meeting to view the networking
videos and that members of the Town Board, Board of Zoning Appeals and Community Council
be invited to attend.
A Special Meeting of the Planning Board was set for July 26 , 1995 at 7 : 30 P .M. at the Danby
Fire Station to view a video tape entitled 'Networks Build Economic Vitality. " The Town
Board, Board of Zoning Appeals, Community Council and members of the fire district will be
invited.

Approval of May 17 , 1995 Planning Board Minutes :
A motion was made by Joel Gagnon and seconded by William Farrell to approve the May 17 ,
1995 Planning Board Minutes as corrected.

" Camelot " Subdivision
Consideration of Final Subdivision Approval
Susan Beeners reported to the Board that the project has essentially not changed since the April
1995 preliminary review. The road plans and specifications submitted are sufficient to meet the
Town Highway and County Highway approval . The County Health Department has approved
of the plans. After final subdivision approval is granted, Mr. Harrington may come to the Town
Board , show a Letter of Credit, a proposed schedule for the construction of the houses , and
completion of other items for their decision of how to proceed.
Susan reported to the Board that if final subdivision approval is granted by the Planning Board,
Mr. Harrington will have 180 days to complete the two (2) conditions stated in the resolution
and to file the map at the County Assessment Office. He could come to the Planning Board and
request two (2) 90 day extensions if necessary.
RESOLUTION NO . 5 OF 1995
" CAMELOT " SUBDIVISION - FINAL SUBDIVISION APPROVAL

WHEREAS , this action is the Consideration of Final Subdivision Approval for the proposed
seven (7) lot "Camelot Subdivision" , proposed to be located northeast of the intersection of New
York State Route 34/96 (Spencer Road) and Hillview Road on Town of Danby Tax Parcel No .
26 . - 1 -9 . 3 , James and Catherine Benjamin, owners ; Glen Harrington, applicant, and
WHEREAS , on May 17 , 1995 , the Planning Board, acting as Lead Agency in Type I
environmental review of the proposed subdivision, made a negative determination of
environmental significance, and
WHEREAS, onMay 17, 1995 , the Planning Board, following a public hearing on the proposal , •
granted Preliminary Subdivision Approval for the project, and
WHEREAS , the Final Plans for the project are substantially in agreement with the Preliminary
Plans , and
WHEREAS , the Town Board on June 12 , 1995 accepted the proposed dedication of King
Arthur's Court and of the new water main for the subdivision, subject to various conditions set
forth in the Town Resolutions 34 and 36 of 1995 , now therefore it is
RESOLVED , that the Town of Danby Planning Board hereby reaffirms the negative
determination of environmental significance made by this Board on May 17 , 1995 , and it is
further

RESOLVED, that the Town of Danby Planning Board waives the requirement for a public
hearing on the final plat, since the Final Plans for the project are substantially in agreement with
the Preliminary Plans, and it is further
RESOLVED, that the Town of Danby Planning Board grants Final Subdivision Approval to
the proposed seven (7) lot "Camelot Subdivision" , proposed to be located northeast of the
intersection of New York State Route 34/96 (Spencer Road) and Hillview Road on Town of
• Danby Tax Parcel No . 26. 4 -9. 3 , subject to the following conditions which shall be met prior
to the signing of the Final Plat by the Planning Board Chairperson :
1 . Final approval of the final plans by the Tompkins County Health Department.
2 . Provision of an "Owner' s certificate", signed by the owner of the land to the
effect that he owns the land, has caused the land to be surveyed and divided, and
makes the dedications indicated on the plat.

Proposed - Bed and Breakfast - Griffin
The Planning Board reviewed a Sketch Plan for a proposed "Bed and Breakfast" to be located
at 208 Nelson Road. The proposal was submitted by Liz Griffin.
Susan explained the proposal for the "Bed and Breakfast" is to house a maximum of four (4)
lodgers .
Motion to set Public Hearing - Griffin
A motion was made by Joel Gagnon and seconded by Nancy Weitzel that the Planning Board
set a public hearing for the Griffin Bed and Breakfast Proposal for Wednesday, July 19 , 1995
at 7 : 15 P . M . , Town Hall , 1830 Danby Road, Ithaca, New York.

® Review of Proposed Zoning Ordinance Amendments
Draft Showing Proposed Zoning Ordinance Revisions Related to Mobile Homes - dated
6/21 /95
Susan reported that the Town Board asked her to draft revisions related to the existing
singlewide mobile homes for the Board to review. Page 2 - is proposed new material to allow
the existing singlewide mobile homes to be a lawfully permitted use. There are at least thirty-
five (35) singlewide mobile homes in various locations throughout the Town . The Town cannot
establish consistent documentation and consistent enforcement. Item (d) was added to the
proposed revision because there has been a lapse in enforcement and a lapse of records and
documentation.
Edward Inman, Chairman of the Board of Zoning Appeals, explained to the Board that the BZA
has had several requests related to singlewide mobile homes (specific situations) that called for

a blanket coverage of some sort . A request to the Town Board to allow replacements was to
create a possible incentive for owners to upgrade their mobile home with a newer model ,
doublewide, modular or a stick built home.
The Board reviewed the proposed zoning ordinance revisions related to mobile homes.
The following revisions were suggested :
(ii) (second sentence) -- It may be replaced with a new or newer manufactured home only
upon the granting of a Special Permit by the Planning Board.
Joel Gagnon suggested that. the Town allow mobile homes to be replaced with another one by
special permit only.
Approval of the Proposed Zoning Ordinance Revisions Related to Mobile Homes
(6/21 /95) - Section (d) (i)
Amotion was made by Nancy Weitzel and seconded by William Farrell that the Planning Board
approves the Proposed Zoning Ordinance Revisions Related to Mobile Homes (6/21 /95 ) with
the
following language:
Section (d)
(i) If such a singlewide mobile home is the single residential structure on the lot, it
may continue to be occupied as a lawfully permitted use. It may be replaced with
a new or newer manufactured, modular, or prefabricated, or stick built home
subject to the issuance of a building permit.

A motion was made by Nancy Weitzel and seconded by William Farrell that the Planning Board
approves the Proposed Zoning Ordinance Revisions Related to Mobile Homes (6/21 /95 with
the following language :

only upon the granting of a Special Permit by the Planning Board.

Susan asked the Board to approve the addition of appropriate language for the manufactured
housing to the definition section of the Zoning Ordinance to reflect the definition in the building
code.
Motion to add Definition of Manufactured Housing to Zoning Ordinance
A motion was made by Joel Gagnon and seconded by Nancy Weitzel to add appropriate
language for the definition of "Manufactured Housing" to the Definition Section of the Zoning
Ordinance and that the definition be the same as in the New York State Building Code.
