TOWN BOARD MINUTES
Regular Meeting 8 : 00 P . M . April 10 , 1995

S upervisor Oltz called the meeting to order at 8 : 00 P . M . and led
all present to the Pledge of Allegiance to the American flag .
Approval of March 13 , 1995 Town Board Minutes
A motion was made by Councilperson Schwartz and seconded by
Councilperson Steiner to approve the March 13 , 1995 Town Board
Minutes .
[ Minor correction - pg . 5 - Under Privilege of the Floor
( last sentence - Councilperson Schwartz ) to read if a
sense of fairness has prevailed . ]
A roll call vote on the motion resulted as follows :

ADDITIONS OR DELETIONS TO AGENDA
1 ) Supervisor Oltz requested that under New Business - Possible
Resolution No . 28 - Authorization for Highway Superintendent
t o seek bids for a used telescopic hydraulic excavator be
d eleted from the agenda .
2 ) Councilperson Schwartz requested an item be added under New
B usiness - Appointment of Linda Kelley to Danby Youth
Commission .
N o Board member objected .
PRIVILEGE OF THE FLOOR :
Richard Lazarus - Howland Road - addressed the Board regarding the
restoration of the Town Hall building . He reported that if the
Town Hall was put on the National Register of Historic Places it
d oes not mean that it cannot be modified or that changes cannot be
made in the future . If the building is put on the register there
are funds available for repairs and restoring .
D onald Barnes - Michigan Hollow Road - Submitted a letter to the
D anby Town Board dated April 10 , 1995 regarding his proposal for a
P lanned Development Zone on 8 acres of Town of Danby Tax Parcel
# 14 . - 1 - 4 . 2 and asked the Town Board to disregard the
recommendation from the Planning Board related to his proposal .
County Representative Report
Representative Frank Proto reported on the following :
1 ) Finger Lakes Land Trust - Unpaid taxes are nearly $ 8 , 000 . 00 on
a thirty - six ( 36 ) acre property in West Danby that was
purchased by the County . The Fingerlakes Land Trust is
proposing to purchase this land for A Biodiversity Preserve

for Chemical Ecology . He said he would like the Finger Lakes
L and Trust to purchase the property outright for the unpaid
t ax amount .
Councilperson Schwartz suggested that the Finger Lakes Land Trust
consider selling two ( 2 ) building lots along the roadway to help
o ffset the loss of property tax to the Town and County from the tax
e xempt status of the organization .
• 2 ) Rural Affairs Committee - Supervisor Oltz hosted a meeting of
t he Tompkins County Municipal Officers Association here at the
D anby Town Hall in February 1995 . Members of the Rural Affairs
Committee were guest speakers at the meeting . Items of
concern expressed at the meeting were libraries , youth
services , and roads and bridges . The Rural Affairs Committee
is looking at ways to improve communication and outreach into
t he rural communities and working as more of an advocacy
group .
3 ) Biggs Complex - the County has voted not to put any more money
into the Biggs Complex and are looking at alternate sites for
County services .
4 ) Labor Management . - The Total Quality Management Plan for
County employees is now in the review process .
5 ) Cat Licensing - The S . P . C . A . is going to withdraw their
request for cat licensing .
6 ) Waste Water Treatment Plant - there is concern that the City
Waste Water Treatment Plant usage is not calibrated .
7 ) School Tax Rate - is asking the Ithaca City School District
for a table to show the actual percentage of increase in the
school tax for each township before the budget is passed .
Councilperson Steiner reported to Representative Proto that he has
n ever received a copy of the County quarterly publication that is
inserted in the Ithaca Journal and other publications .
Representative Proto said that the publication " The County News " ,
is published each quarter and inserted in newspapers . The last
quarter published was inserted in the " Ithaca Times " , and the
✓ andom harvest publications .
COMMUNICATIONS :
1 ) Letter - from Joel Gagnon - re : Resignation from Solid Waste
Advisory Committee . SWAC
The Town Board accepted the Resignation of Joel Gagnon from the
Solid Waste Committee .
2 ) Referral from Planning Board - Donald Barnes Proposal for a
Planned Development Zone .
S upervisor Oltz reported that the Town Board will review the Barnes
P roposal at the May 3 , 1995 Agenda Meeting of the Town Board .

S upervisor Oltz reported that there is a vacancy on the Danby Youth
Commission and made the following motion :

S chwartz to appoint Linda Kelley of 893 Steam Mill Road , Ithaca ,
N ew York to the Danby Youth Commission .
A roll call vote on the motion resulted as follows :

Town Hall Project
Supervisor Oltz reported that the Town is still working on Town
H all Project and funding for grants may not be available .
Letter of Support for the Creation of a Biodiversity Preserve for
Chemical Ecology
S upervisor Oltz asked the Town Board to endorse a letter to the
Tompkins County Board of Representatives to support the concept of
the Creation of a Biodiversity Preserve for Chemical Ecology .
N o Board member objected .
APPROVAL OF WARRANTS
General Fund Warrant No . 4 of 1995 - Approved
A motion was made by Councilperson Steiner and seconded by
Councilperson Schwartz to approve the General Fund Warrant No . 4 of
1995 vouchers numbered 89 - 124 in the amount of $ 9 , 391 . 16 .
A roll call vote on the motion resulted as follows :

Highway Fund Warrant No . 4 of 1995 - Approved
A motion was made by Councilperson Steiner and seconded by
Councilperson Schwartz to approve the Highway Fund Warrant No . 4 of
1995 vouchers numbered from 37 - 50 in the amount of $ 16 , 390 . 33 .
A roll call vote on the motion resulted as follows :

West Danby Water District Fund Warrant No . 3 of 1995 - Approved
A motion was made by Councilperson Steiner and seconded by
Councilperson Schwartz to approve the West Danby Water District
Fund Warrant No . 3 of 1995 vouchers numbered 12 - 14 in the amount
of $ 869 . 39 .
A roll call vote on the motion resulted as follows :

Town Clerk ' s March 1995 Report - Approved
A motion was made by Councilperson Steiner and seconded by
Councilperson Schwartz to approve the Town Clerk ' s March 1995
Report as submitted .
