Chairperson Weitzel called the Public Hearing to order at 7 : 39 P . M .
Affidavit of Mailing was submitted and the following Notice of
Publication was read :
" NOTICE IS HEREBY GIVEN t. h ,::at:. a Public Hearing will be held by the
Planning Board of the Town of Danby on Monday , August 30 , 1993 at
7 : 30 P . M . , 1830 Danby Road , Ithaca , New York . Purpose of hearing
is to consider granting a Special Perrrni. t. to Danby Community Council
for the proposed use of the building and premises at 467 Troy Road,
Ithaca , New York for Danby Motor Development , Danby After School ,
and Danby Summer Recreation Programs . Property is Town of Danby

J udy Tagli. avent. o addressed the Planning Board d and said that Ithaca
City School District did not obtain a Certificate of Occupancy from
the State of New York for the Danby School . Community Council is
in need of a space for the Danby Motor Development , Danby After
S chool and Sunrrrrer Recreation Programs ,.
Charles and Doreen Dvorak • have agreed to rent their building and
property located • at 467 Troy Road to Danby Community Council_ . The
property must pass Health Department approval for septic and water
and safety inspections for insurance purposes . She said that.
Community Council may rent the facility that the rental of the
facility may be for two ( 2 ) years .
K en Horst asked if there were three ( 3 ) separate programs and how
many children were enrolled in the programs .
S usan asked how pick - up and drop - off was handled .
Donna Collins said that most of the children in the Danby Motor
1 Development:. Program were dropped off and picked up by two or three
d rivers . The after school children were delivered by tlie school
buss and picked up by parents .
D iscussion followed on the driveway , parking available and the
tight turn -- around .

Community Council
K en Horst asked about the security of the children dropped off by
the bus on t. i _ e: walk up t. kie long drive ~
Bill. Farrell asked if the Community Counc: il had asked the fire
d epartment to Look at the drive to see if it were adequate for
emergency vehicles .
Ken Horst said he was concerned about the forty ( 40 ) kids in the
building and their safety in the event of a fire emergency . He
said it is more difficult to secure the safety of children in an
emergency because children panic: differently than adults .
J udy assured the Board that all of the programs practice fire
safety and practice fire drills regularly . The kitchen area will
be removed ( there will be no stove ) due to the lack of a fire wall. .
Ray Mayo asked how much the rental of this facility would cost and
who was going to pay for it . Ray said that there are serious water
problems in the area and two ( 2 ) neighbors are hauling water for
their residences .
Judy Ta. gliavento said the programs pay for themselves . Ninety
( 90 % ) is paid by tuition , there will be no change in how the
programs are funded , and all the children enrolled in the programs
at this time are Town of Danby residents .

will be parking along the road .
Donna Collins said that the driveway will be widened and t: lie turn -
around wi1. l be enlarged .
Nancy Weitzel asked if there was adequate parking for the employees
and room for the parents to turn around when dropping off and
picking up children .

Chairperson Weitzel called the Special Meeting of the Planning
B oard to order at 8 : 22 P . M . and asked the Planning Board for
comments and questions regarding the Community Council Application
for a Special Permit .
COMMUNITY COUNCIL - SPECIAL PERMIT - Discussion
Community Council President , Julia Tagliavento submitted an
application on behalf of the Danby Community Council for a Special
P ermit for the use of a building and premises at 467 Troy road ,
Ithaca , New York for the Danby Motor Development , Danby After
School , and Danby Summer Recreation programs . The property is
owned by Charles F . and Doreen E . Dvorak .
J oel Gagnon asked if there the Planning Board going to have a rule
t hat the parents coning to pick up the children must use the
parking lot .
D onna Collins said that it was fine with her as she does not think
most parents would be parking in the road . Parents must come in to
pick up their children .
K en Horst asked if there was any reason , under the present rules in
the ordinance , that this project could not move ahead other than a
special permit .
Susan Beeners said that for a Special Permit there are several
criteria that the Planning Board must view as far as how it fits
into the neighborhood . She listed the criteria as : 1 )
percolation on the site and is it adequate for public use ; 2 )
noise ; 3 ) pick - ups and drop - offs . She is concerned that the
driveway is too narrow and the turn - around is tight . Susan said
that Tompkins County Health Department has their own set of codes
pertaining to septic , sewage , and water testing .

P rograms . Property is Town of Danby Tax Parcel # 4 . - 1 - 32 . 11 and is

WHEREAS , this is an. Unlisted action for which the Planning board is
acting as Lead Agency in environmental review and for which no
coordinated review is required , and
WHEREAS , the Planning Board , at and following Public Hearing on

August 30 , 1993 , has reviewed the Environmental Assessment Form and
d raft environmental review prepared by the Code Enforcement
O fficer , now be it
RESOLVED , that the Town of Danby Planning Board , acting as Lead
Agency in environmental review of this Unlisted action , makes a
negative determination of environmental significance for this
action .
A roll call vote on the resolution resulted as follows :

WHEREAS , this action is the consideration of granting a Special

building and premises at 467 Troy Road , Ithaca , New York for Danby
Motor Development , Danby After School , and Danby Summer Recreation
P rograms . Property is Town of Danby Tax Parcel # 4 . - 1 - 32 . 11 and is
owned by Charles F . & Doreen E . Dvorak . Applicant is Julia
Tagliavento , President , Danby Community Council , and
WHEREAS , this is an Unlisted action for which the Planning Board on
August 30 , 1993 , acting as Lead Agency in environmental review , has
made a negative determination of environmental significance , and
WHEREAS , the Planning Board , at and following Public Hearing on
August 30 , 1993 , has reviewed a map entitled " Proposed Facility for
D anby Motor Development , Danby After School , & Danby Summer
Recreation Programs " , dated August 25 , 1993 , and other application
materials , now be it
RESOLVED , that the Town of Danby Planning Board grants a Special
Permit to Danby Community Council for the use of the building and
premises at 467 Troy road as proposed , and be it further
RESOLVED , that approval of this Special Permit is subject to the
completion of the proposed improvements to the driveway and turn -
around and staff parking before the drive is extensively used and
that the turn - around space not be used for staff parking .
