Chairperson Weitzel called the meeting to order at 7 : 50 P . M .
Correction of January 20 , 1993 Public Hearing Minutes
P age 1 - add the word " acres " at the end of the page .
Approval of January 20 , 1993 Public Hearing Minutes
A motion was made by Joel Gagnon and seconded by Bill Farrell to
approve the January 20 , 1993 Public Hearing Minutes as corrected .
Carried Unanimously
Corrections to January 20 , 1993 Planning Board Minutes
1 ) Pg . 1 add " Nancy " after Chairperson
2 ) Pg . 3 - under CEO Report delete the word " has " replace with
the word " have " ;
3 ) Last Page - under Joel Gagnon reported - delete ( that there
was ) and delete the word ( and ) insert even though funding for
the overall project
Approval of January 20 , 1993 Planning Board Minutes
A motion was made by Ken Horst and seconded by Joel Gagnon to
approve the January 20 , 1993 Planning Board Minutes as corrected .

COMMUNICATIONS :
1 ) Code Enforcement Officer ' s January 1993 Report
Susan Beeners reported that the attachment to the monthly report is
a summary of day - to - day activities in the Zoning Office . The 1992
Annual report will be submitted next month .
2 ) Addendum to Closure Plan for Tompkins County Sanitary Landfill
No . 1 ( Hillview road Landfill ) - dated August 31 , 1992 .
3 ) Copy of SEQR form for Hillview Road Landfill Phase II
I/I Closure / Cover Material Mining
Susan Beeners reported that Kenneth P . Thompson , Assistant Solid
W aste Manager will attend the March 17 , 1993 Planning Board Meeting
and will speak to the Board at 8 : 30 P . M .
Fieldstone Circle Update
S usan reported that she has consulted our town attorney regarding
Fieldstone Circle . Before Final Subdivision approval can be
obtained an abbreviated SEQR will be necessary and a public hearing
must be held .
D iscussion followed in regard to the Environmental Assessment Form .

corner of Danby Road and Buttermilk Lane , James D . and Angela B .
D ellepiane Block , owners , with such tract to be consolidated with
Town of Danby Tax Parcel # 2 . - 1 - 22 . 42 , 1 acre total , located on the
south side of Buttermilk Lane , James G . and Margaret Hovanec
owners .
S usan Beeners requested the section of C - 4 be deleted and should be
referenced to C - 1 .
RESOLUTION NO . 3 OF 1993
S EQR DETERMINATION - PROPOSED BLOCK TO HOVANEC SUBDIVISION

WHEREAS , this action is the consideration of approval of the
proposed subdivision of a 6000 + / - square foot tract from Town of
D anby Tax Parcel # 2 . - 1 - 11 . 45 , 1 . 7 + / - acres total , located at the
southwest corner of Danby Road and Buttermilk Lane , James D . and
Angela B . Dellepiane Block , owners , with such tract to be
consolidated with Town of Danby Tax Parcel # 2 . - 1 - 22 . 42 , 1 acre
t otal , located on the south side of Buttermilk Lane , James G . and
Margaret Hovanec owners , and
WHEREAS , this is an Unlisted action for which the Planning Board
is acting as Lead Agency in environmental review and for which no
coordinated review is required , and
WHEREAS , the Planning board , at and following Public Hearing on
February 17 , 1993 , has reviewed the Environmental Assessment Form
and draft environmental review prepared by the Code Enforcement
O fficer , now be it
RESOLVED , that the Town of Danby Planning Board , acting as Lead
Agency in environmental review of this Unlisted action , makes a
negative determination of environmental significance for this
action .

Angela B . Dellepiane Block , owners , with such tract to be
consolidated with Town of Danby Tax Parcel # 2 . - 1 - 22 . 42 , 1 acre

WHEREAS , this is an Unlisted action for which the Planning Board on
February 17 , 1993 , acting as Lead Agency in environmental review ,
h as made a negative determination of environmental significance ,
and
WHEREAS , the Planning board , at and following Public Hearing on
February 17 , 1993 , has reviewed a map entitled " Survey for James D .
and A . B . Dellephiane Block " , by George C . Schlecht dated December
24 , 1992 , showing the proposed subdivision , now be it

and Final Subdivision approval to the proposed subdivision as

Proposed Revisions to Zoning Ordinance
Code Enforcement Officer Susan Beeners submitted the following
draft materials for the Planning Board to review :
1 ) Section 1101 - Permit to Build
2 ) Section 516 - Extraction or Deposit of Fill and Related
P roducts
3 ) Subdivision Regulations - Section 105 - Notification of Public
N otice Signs
Bill Farrell said he would like to see the regulation requiring a
✓ oof pitch of 4 / 12 pitch for doublewides eliminated from our
o rdinance as it is discriminating and creates additional expense .
A stick built home can have a flat roof or any kind of roof you
w ant to put on it .
D iscussion followed regarding roof pitch and types of shingles .

N OTICE IS HEREBY GIVEN That a Public Hearing will be held by
t he Planning Board of the Town of Danby on Wednesday , February
17 , 1993 at 7 : 15 P . M . , 1830 Danby Road , Ithaca , New York
14850 . Purpose of hearing is to consider approval of the
proposed subdivision of a 6000 + / - square foot tract from Town
of Danby Tax Parcel # 2 . - 1 - 22 . 45 , 1 . 7 + / - acres total , located
at the southwest corner of Danby Road and Buttermilk Lane ,
J ames D . and Angela B . Dellephiane Block , owners , with such
t ract to be consolidated with Town of Danby Tax Parcel # 2 . - 1 -
22 . 42 , 1 acre total , located on the south side of Buttermilk
Lane , James G . and Margaret Hovanec , owners .
At such time and place all persons interested in the subject
matter thereof will be heard concerning the same .
A regular meeting of the Planning Board will follow the public
h earing .

Affidavit of mailing to adjacent landowners has been submitted to
the Code Enforcement Officer .
N o public appeared before the Planning Board .
Marge Hovanec explained to ;. the Planning Board that this is a
request to • add approximately 1 / 10th of an acre to an existing lot
where the sign for Old Town Village is placed . The additional
piece will be added to the neighboring lot and made a part of Old
Town Village .
D iscussion followed regarding the placement , angle and size of the
sign , is it considered a structure subject to setback requirements ,
and are signs permitted in residential zones .

H orst to close the Public Hearing at 7 : 50 P . M .
