The public hearing was called to order by Chairperson Weitzel at
7 : 20 P . M . and the following public notice was read :

N OTICE OF PUBLIC HEARING
NOTICE IS HEREBY GIVEN that a Public Hearing will be held by the
P lanning Board of the Town of Danby on Wednesday , December 16 , 1992
at 7 : 15 P . M . , 1830 Danby Road , Ithaca , New York 14850 . Purpose of
h earing is to consider approval of the proposed subdivision of a
one ( 1 ) acre lot from the Town of Danby Tax Parcel No . 3 . - 1 - 27 . 1 ,
4 . 9 acres total , located on Nelson Road west of Ridgecrest Road .
E lmer and Gerda Medgyaszay , owners ; Gail Fish , applicant .
At such time and place all persons interested in the subject matter
t hereof will be heard concerning the same .
A regular meeting of the Planning Board will follow the public
h earing .

The Regular Meeting of the Planning Board was called to order at

RESOLUTION NO . 1 OF DECEMBER 16 , 1992
S EQR - NEGATIVE DETERMINATION OF ENVIRONMENTAL SIGNIFICANCE -
PROPOSED MEDGYASZAY TO FISH SUBDIVISION
B y Paul Viscuso : Seconded by Joel Gagnon
WHEREAS , this action is the consideration of Subdivision Approval
for the proposed subdivision of a one ( 1 ) acre lot from Town of
D anby Tax Parcel No . 3 . - 1 - 27 . 1 , 4 . 9 acres total , located on Nelson
Road west of Ridgecrest Road ; Elmer and Gerda Medgyaszay , owners ;
G ail Fish applicant , and
WHEREAS , this is an Unlisted action for which the Planning Board is
acting as Lead Agency in environmental review and for which no
coordinated review is required , and
WHEREAS , the Planning Board , at Public Hearing on December 16 ,
1992 , has reviewed the Environmental Assessment Form and draft
environmental review prepared by the Code Enforcement Officer , now
be it
RESOLVED , that the Town of I) anby Planning Board , acting as Lead
Agency in environmental review of this Unlisted action , makes a
negative determination of environmental significance for this
action .

APPROVAL OF MEDGYASZAY TO FISH SUBDIVISION

WHEREAS , this action is the consideration of Subdivision Approval
for the proposed subdivision of a one ( 1 ) acre lot from Town of
D anby Tax Parcel No . 3 . - 1 - 27 . 1 , 4 . 9 acres total , located on Nelson
Road west of Ridgecrest Road ; Elmer and Gerda Medgyaszay , owners ;
G ail Fish , applicant , and
WHEREAS , this is an Unlisted action for which the Planning board on
D ecember 16 , 1992 , acting as Lead Agency in environmental review ,
h as made a negative determination of environmental significance ,
and
WHEREAS , the Planning Board , at Public Hearing on I) ecembe .r 16 ,
1992 , has reviewed a sketch plan showing the proposed new lot ,

Gail M . Fish , dated November 6 , 1992 , now be it
RESOLVED , that the Town of Danby Planning Board grants Preliminary
and Final Subdivision approval to the proposed subdivision as
presented , subject to the submission of a final survey map for such
lot , suitable for filing , for approval by the Planning Board
Chairperson .

Corrections to November 18 , 1992 Planning Board Minutes :
1 ) Under Planning Board Report correct names - Bill Wendt and
John Gutenberger ;
2 ) Under No . 4 add " and twenty - five ( 25 ) feet around the
remaining periphery ;
3 ) Under No . 3 delete the word " sight " replace with " site " ;
4 ) Page 3 - under other items add " Finger Lakes Land Trust " .
Approval of November 18 , 1992 Planning Board Minutes :
A motion was made by Paul Viscuso and seconded by Bill Farrell to
approve the November 18 , 1992 Planning Board Minutes as corrected .
Carried Unanimously
COMMUNICATIONS :
1 ) Memo dated November 24 , 1992 from Jim Hanson , Commissioner of
Planning regarding SS : 239 1 and m .
TOMPKINS COUNTY PLANNING BOARD REPORT :
Paul Viscuso reported that the Tompkins County Planning Board Met
on December 9 , 1992 at the new transportation facility . Joan
Jerkowitz from Tompkins County Planning Department talked about the
Tompkins County Outlook on Planning our Future project ( the former
Tompkins County Comprehensive Plan ) . Joan said that they hope to
start with the mapping process next year and it will be divided
into five parts - - 1 ) roads ; 2 ) utilities and pipe lines , etc . ;
3 ) boundaries , ( municipal , school , etc . ) ; 4 ) general land use - -
residential , industrial , commercial , etc . ; 5 ) terrain features .
P aul reported that the County Planning Board Chair for 1993 will be
L ew Roscoe and the Vice - chair will be Mary Beth Holub .
REVIEW OF SKETCH PLAN - JACK BOYD
The Planning Board reviewed the sketch plan for a proposed
subdivision of a 7 . 5 + / - acre lot from Town of Danby Tax Parcel No .
15 . - 1 - 11 . 1 , 12 . 9 + / - acre total , located on the west side of
Comfort Road Extension , south of Lieb Road . Jack Boyd ,
owner / applicant .
The following Letter was presented to the Planning Board from. Jack
Boyd ( owner / applicant ) .

Dear Ladies and Gentlemen :

I am requesting the waiver of the 150 ft . minimum road
frontage requirement through clustered subdivision procedure ,
for my property located on the Comfort Rd . extension
( T . P . # 15 . - 1 - 11 . 1 ) . My proposed subdivision will allow for a
20 ft . wide road access to an approx . 7 1 / 2 acre parcel .
Furthermore , my proposed subdivision will have a built in
✓ estriction limiting the parcel to one dwelling . In proposing
the afore mentioned subdivision I wish to maintain a sense of
o pen spaciousness for the existing dwelling and a new
dwelling . Subdividing my property using the 150 ft . minimum
✓ oad frontage requirement obstructs the face of the existing
dwelling and creates an imbalance between the two parcels of
land . In addition , subdividing with a 20 ft . road access has
the least impact possible on all existing houses in the
immediate area .

Susan Beeners explained the two variations of the proposal for a
one ( 1 ) lot subdivision . She said that Mr . Boyd ' s preference is to
have a twenty ( 20 ) foot right - of - way to the back acreage .
D iscussion followed :
Joel said that this parcel is in the low density zone and the road
frontage is already more houses per mile than he would like to see
in that zone and he wants it fixed so there will not be any more
h ouses on this parcel .
B ill Farrell asked why he could not get a variance for the seventy
( 70 ) feet he needs to get to his back land and let him have square
ill
lots .
S usan said that her personal feeling is that anytime you can
maximize use of existing road frontage by figuring out a way to
legally permit less than 150 ft . and basically have some back lot
d evelopment you are better off .
S usan said that Mr . Boyd was willing to do a deed restriction on
t he back seven ( 7 ) acres . There is a question as to whether
another lot be could be allowed in the future .
P aul said that if there is to be a seventy ( 70 ) foot right - of - way
t o the back lots there should be deed restrictions to the property
for no more than three ( 3 ) dwellings including the lot with the
e xisting house .
J ersey Hill Acres :
S usan gave an update on the progress of Jersey Hill Acres
Subdivision Proposal . Harriet Moore has received letter from the
Tompkins County Health Department and she may lose one of the lots
o n the plan . If a sand filter was required in any one of four lots
t hat are sold within a three year period , a minimum lot of two ( 2 )
acres would be required on all the lots . II
Fieldstone Circle Subdivision :

Susan Reported that a Fieldstone Circle Subdivision approval will
✓ equire an extension or reaffirmation as signed agreements have not
been received within the one hundred eighty ( 180 ) day period . Susan
w ill write a letter to Mr . Hoffay regarding the Fieldstone Circle
Subdivision .
