The Public Hearing was called to order by Chairperson Weitzel and
the following Notice of Publication was read .
NOTICE IS HEREBY GIVEN that the Planning Board of the Town of
Danby will hold a public hearing on Wednesday , September 16 ,
1992 at 8 : 15 P . M . , 1830 Danby Road , Ithaca , New York 14850 .
Purpose of hearing is to consider approval of a 1 . 3 + / - acre
lot from Town of Danby Tax Parcel # 11 . - 1 - 4 . 2 , 26 + / - acres
total located on the east side of Durfee Hill Road near Steam
Mill Road . Dean H . and Cheryl L . L ' Amoreaux ,
owners / applicants .
At such time and place all persons interested in the subject
matter thereof will be heard concerning the same .
A regular meeting of the Planning Board will follow the public
hearing .

P ublished : September 11 , 1992
J oseph Schwartz of Durfee Hill Road addressed the Board and said
that he has no problem with the proposed subdivision of a 1 . 3 + 1
lot . He said that he personally would prefer , if and when the
L ' Amoreaux ' s want to build a road for another house that the
Planning Board consider a road at that time .
Dean L ' Amoreaux explained that the sketch plat was only to show
that in the future he may want to build or subdivide the remaining
property .
Joel Gagnon explained that there is no road proposed and the
Planning Board was only going to consider the subdivision of a 1 . 3
+ / - lot at this time .
Susan Beeners explained that the map was a sketch plan even though
it shows preliminary plat details . it might be possible for Mr .
L ' Amoreaux to show just the Parcel A on the final plat .
Discussion followed regarding the property lines .

John Rantanen of 100 Durfee Hill Road asked if the sketch showing
a road was because there would be future subdivision of the
property .
Motion to Adjourn :
A motion was made by Paul Viscuso and seconded by Bill Farrell to
adjourn the Public Hearing ( L ' Amoreaux ) at 8 : 25 . P . M .

No . 2 . - 1 - 43 . 5 , located on the north side of Muzzy Road , east of
Ridgecrest Road . John C . Shepardson , Jr . , owner / applicant .
At such time and place all persons interested in the subject matter
• thereof will be heard concerning the same .
A regular meeting of the Planning Board will follow the public
hearing .

COMMENTS FROM THE PUBLIC :
John C . Shepardson , Sr . - 318 Ridgecrest Road said he owned the
property on each side of the building lot and had no objections to
a doublewide mobile home whatsoever . He said he has talked with the
adjacent property owner ( Mrs . Klein - Tax Map Parcel # 4 . - 1 - 39 and
# 4 . - 1 - 43 . 1 ) and she has no objection .
Raymond Mayo - 335 Ridgecrest Road said he owned a neighboring
parcel in the area and hopes the doublewide mobile home is approved
so that it can be installed on the lot before winter sets in .
Richard Moore - 125 Muzzy Road said he lives across the road and
had no objections to the placement of a doublewide on the property .
Mary Hovanec - Agent for John Shepardson , Jr . presented the
Planning Board with samples of a the R - Cotes Skirting Panels and
explained the process of installation and described in detail how
panels are joined .

Mary said the home was a small home that would be placed on piers
and has a roof pitch of 5 . 09 inches per foot as described in the
d rawing presented .
Susan Beeners asked Mary Hovanec to clarify which anchoring detail
would be used .
Mary Hovanec said it was her understanding that the Town of Danby
d id not have a specific requirement for tie downs . She said MVE
H omes procedure is that they only use tie downs when it is a town
regulation . New York State does not require tie downs in this
area . When the concrete for piers is poured , rebar loops are
placed in the concrete so that a customer may use them if desired .
J oel Gagnon asked Mr . Shepardson if he was going to anchor the
doublewide mobile home to the piers .
Mr . Shepardson said he would not anchor the doublewide unless it
was a building code requirement of the Town and was required of
all doublewides .

County Planning Board Report :
P aul Viscuso reported the Tompkins County Planning Board met on
S eptember 9 , 1992 ,
1 ) Joan Jerkowitz from Tompkins County Planning and Michael
Duttweiler from the Department of Human Services at Cornell
University talked about visions and visioning procedures .
2 ) Mary Beth Holob reported that the Right to Farm Law has been
passed and signed by Governor Cuomo .
, 3 ) The Town of Ithaca is working on a steep slope overlay
district .
4 ) Lynn Erwin recommended that the Towns write to NYS
Representatives regarding the lack of CHIPS funding .
Code Enforcement Officer Report :
Susan Beepers submitted the Code Enforcement Office August 1992
Report and reported that she has drafted two proposed zoning
amendments . 1 ) Standardizing the notification features , and
2 ) A public notice sign for posting on properties where public
hearings have been scheduled for development review or
appeals .
H illview Mobile Home Park Expansion Proposal
S usan Beeners reported that according to the General Plan
Requirements of Section 800 for Rezoning , the Hillview Mobile Home
Park Expansion Proposal meets all the plan requirements as far as
d ocumentation needed for a rezoning in the general site plan with
the exception of proposed locations of buildings within the upper
areas . She said that she has advised Mr . Albern that the Planning
B oard can waive the requirement that the locations be shown in the
rezoning action of the General Plan , but he must provide good
reason for that waiver .
D iscussion followed regarding the density of the project , water
supply , and the impact to neighbors wells .
Motion to Adjourn Meeting :
A motion was made by Joel Gagnon and seconded by Arch Dotson to
temporarily adjourn the Planning Board Meeting at 8 : 15 P . M . to
hold a Public Hearings scheduled for 8 : 15 P . M . and a Public Hearing

HILLVIEW MOBILE HOME PARK
Mary Lou Hardesty submitted to the Planning Board the following
communication - dated September 15 , 1992 .
" Hillview Mobile Home Park
D anby Planning Board , 9 / 15 / 92
Sections of the Zoning Ordinance indicate , in certain
circumstances , that size and locations of existing and
proposed structures be shown on the final site plan . We are
requesting a waiver of that requirement for the areas to be
d eveloped in the future . Future site plans which much be
submitted to this Board will provide that information in
detail . At this time , the exact use and arrangement of the
land has not been determined ; except that , a portion is being
shown as rental property and a portion being privately owned .
We are providing , in the spirit of the ordinance , the detailed
site plan information for the area presently proposed for
development and suggesting uses for the remainder which future
site plans will detail . "
Attorney Rich John of Thaler and Thaler addressed the Planning
Board and referred to the July 1992 presentation to the Planning
Board and their decision to seek advice from Town Council regarding
pre - existing rights for the Hillview Mobile Home Park Expansion .
He said he thought from the information he presented that the
Planning Board thought it was pretty clear what the Board ' s actions
were in 1970 and the question was how to proceed . He said the
Hardesty ' s need a determination from the Planning Board regarding
the issue of pre - existing rights so that they can proceed with
their application .
Discussion followed regarding pre - existing rights .
Attorney John asked the Planning Board for a determination so that
the Hardesty ' s can make an appeal .
Discussion followed regarding the maps presented to the Planning
Board on July 15 , 1992 , modifications within the original P plan after
1970 , the intent of the owners ( developers ) of the mobile home park
to develop in phases , and whether there are pre - existing rights for
a mobile home park .

Attorney John asked the Board to state their position and asked the
Board to vote on their decision .
Chairperson Weitzel said that the decision is that the Hardesty ' s
need to apply for a new Planned Development District because the
original plan that was presented is no longer going to take place .
Susan Beeners reported to the Board that the opinion of counsel is
as follows :
1 ) there was no concrete information to connect the resolution
e stablishing the PDD with an available site plan ;
2 ) the applicant has been advised to either go before the Board
o f Zoning Appeals for interpretation of whether indeed there
is a valid non - conforming use ; or
3 ) to proceed with this Board and complete the proposal as a new
application .
Motion to Accept Opinion of Town Counsel Concerning the Proposed
Hillview Terrace Mobile Home Park Expansion Pre - existing Rights .
A motion was made by Arch Dotson and seconded by Joel Gagnon that
the Town of Danby Planning Board accept the opinion of Town Counsel
concerning pre - existing rights associated with this Application of
the Proposed Hillview Terrace Mobile Home Park Expansion as
reported by Code Enforcement Officer Susan Beeners .
A vote on the motion resulted as follows :

Attorney John said that his client would make a decision on how to
proceed later and that Mr . Albern had a New Site Plan to submit to
the Board .
New Site Plan - Hillview Terrace Mobile Home Park Expansion
Mr . Albern said that at the request of the Planning Board , he has
prepared a site plan for the south acreage located in the Hillview
Terrace Mobile Park PDD .
The new site plan Mr . Albern presented was dated September 7 , 1992
and included the following :
1 ) The proposed expansion of thirty - one ( 31 ) units ;
2 ) The existing park ;
3 ) A transitional area of modular , doublewides , or
apartments ;
4 ) Private home area of one - acre homes ;
5 ) Private home area and the transitional home area roads
would not connect ;
6 ) Proposed sites with the approximate density of 2 . 5 units
per acre ;
Discussion followed regarding impacts on the neighboring community
as follows :
1 ) density of 2 . 5 units per acre in a low density zone ;
2 ) density of proposed apartments ;
3 ) impact on neighbors water supply ;

density area ;
5 ) enclosed containers for trash storage and / or common area
for waste disposal ;
6 ) storage space for individual lots as required on Pg . 5

Susan said that the Planning Board needs to make a determination
on the following :
1 ) the technical completeness of the application related to
having a hearing ;
2 ) are there enough circumstances where you can comfortably
waive the requirement for a site plan showing the
proposed location of buildings and structures
requirements .
Susan referred the Board to Sections 800 , 803 and the section
d ealing with mobile home park zones of the Town of Danby Zoning
O rdinance .
D iscussion followed regarding the density of the project within a
low density zone .
Susan Beeners said that assuming that this project is proceeding
as a rezoning application , that before public hearing the Planing
B oard must determine officially that there are some reasons why
they should waive the requirement for size and locations of
proposed structures . After public hearing the Planning Board must
send a SEQR recommendation as part of a full recommendation to the
Town Board .
J oel Gagnon , Paul Viscuso , Arch Dotson and Nancy Weitzel all
expressed the opinion that they would like to see fewer homes in
the southern part of the proposed development .
Attorney John addressed Board and said that it appears that nothing
is going to be resolved and the Hardesty ' s need to have a
d etermination as to whether there are pre - existing rights before
they can proceed further .

A motion was made by Joel Gagnon and seconded by Paul Viscuso that
the Planning Board Meeting adjourn at 11 : 10 P . M .
