Members of the Planning Board , Susan Beeners , Carol Sczepanski and
H arriet Moore met at 6 : 30 P . M . for a Field Tour . Harriet Moore
d irected the tour of " West Jersey Hill Acres " , a proposed
subdivision of a portion of Town of Danby Tax Parcel # 1 . - 1 - 19 . 2
near West Jersey Hill and King Road West . The property is owned
by Charles and Eloise Phinney .

Approval of July 6 , 1992 Minutes
A motion was made by Ken Horst and seconded by Bill Farrell to
approve the July 6 , 1992 Planning Board Minutes as corrected .

Approval of July 15 , 1992 Minutes
A motion was made by Joel Gagnon and seconded by Bill Farrell to
approve the July 15 , 1992 minutes as published .

OLD BUSINESS :
P roposed " West Jersey Hill Acres " - Phinney
Harriet Moore presented the Phinney Proposed " West Jersey Hill
Acres " subdivision update . Harriet said she would like the
P lanning Board to approve the proposal with the following changes
and to schedule a public hearing for the next meeting .
1 ) Moving the turn - around back ;
2 ) Squaring up of the two pie shaped lot lines ;
3 ) Preparation of a permanent map of the subdivision ;
D iscussion followed regarding the two lots near the Cayuga Trail
and the creek area .

Building envelopes for the lots near the trail was suggested .
Susan suggested minimum yard set backs for rear and / or side yards
as well as placement of septic and wells should be included in the
site plan .
Motion to adjourn for Public Hearings
A motion was made by Paul Viscuso and seconded by Ken Horst to
adjourn at 8 : 43 P . M . to hold Public Hearings .
Carried Unanimously
The Planning Board adjourned for scheduled public hearings at 8 : 43
P . M . and reconvened at 9 : 10 P . M .
Discussion of Proposed Koval - Smith Subdivision :
Code Enforcement Officer requested the following changes in the
Short SEQR Form :
C - 1 Add the following sentence : There is 150 ' distance from
the rear property corner to the main stream in this area .
C - 3 Add the following : No significant species or habitats
are known on the site of the proposed new lots .
C - 5 Add the following : The proposed new lot would not have
sufficient frontage or acreage to permit subdivision .
RESOLUTION NO . 10 - August 19 , 1992
RESOLUTION TO APPROVE - SEQR - KOVAL SUBDIVISION

WHEREAS , This action is the Consideration of Subdivision Approval
for the proposed subdivision of a 1 . 96 acre lot from the Town of
Danby Tax Parcel # 29 . - 1 - 8 . 8 , 124 acres total , on the east side of
South Danby Road opposite LaRue Road . John C . and Jo Anne Koval ,
owners ; Barbara Blanchard , agent , and
WHEREAS , This is an Unlisted action for which the Planning Board
is acting as Lead Agency in environmental review and for which no
coordinated review is required , and
WHEREAS , The Planning Board , at Public Hearing on August 19 , 1992 ,
has reviewed the Environmental Assessment Form and draft
environmental review prepared by the Code Enforcement Officer , now
be it
RESOLVED , That the Town of Danby Planning Board , acting as Lead
Agency in environmental review of this Unlisted action , makes a
negative determination of environmental significance for this
action .

WHEREAS , This is an Unlisted action for which the Planning Board

significance , and
WHEREAS , The Planning Board , at Public Hearing on August 19 , 1992 ,
has reviewed the proposed subdivision map , now ; be it

acres total into a 2 . 92 acre and a 7 . 98 acre parcel , and
WHEREAS , This is an Unlisted action for which the Planning Board
o n August 19 , 1992 , acting as Lead Agency in the environmental

significance , and

submission of a final survey plat suitable for filing for approval
by the Planning Board Chairperson .

D iscussion on Phinney Proposal for " West Jersey Hill Acres " .
The Planning Board reviewed the Phinney Proposal for " West Jersey
H ill Acres " .
Code Enforcement Officer Susan Beeners will meet with Harriet Moore
t o discuss the preparation of a preliminary plat , drainage for the
road , preliminary perk tests for septic , etc .
The Planning Board agreed that the change in design is a good one .
Miscellaneous :
P aul Viscuso said he is concerned about members of Planning Board
who do not regularly attend meetings . Members of the Planning Board
expressed concern that there is ; not a liaison from the Town Board
at Planning Board meetings .

NOTICE IS HEREBY GIVEN that a Public Hearing will be held by the
P lanning Board of the Town of Danby on Wednesday , August 19 , 1992
at 8 : 30 P . M . , 1830 Danby Road , Ithaca , New York 14850 . Purpose of
h earing is to consider approval of the proposed subdivision of a
1 . 96 acre lot from Town of Danby Tax Parcel # 29 . - 1 - 8 . 8 , 124 acre
total , located on the east side of South Danby Road opposite LaRue
Road . John C . and Jo Anne Koval , owners ; Barbara Blanchard ,
agent .
At such time and place all persons interested in the subject matter
thereof will be heard concerning the same .
A regular meeting of the Planning Board will follow the public
h earing .

Members of the Public :
Rhonda Engman - 571 South Danby Road addressed the Board and said
she has asked the DEC to reclassify the creek running through the
adjacent property as a Class B creek because it is possibly a trout
stream and there is a stand of Yellow Birch trees in the area . She
thinks the Town should consider protecting these areas and one way
is to prohibit building . She said she is concerned about new
h ousing in the area when there are many existing homes on the
market .
J oanne Koval - 815 South Danby Road - addressed the Board and said
t hat she has never seen the trees Ms . Engman referred to and to her
knowledge they are not on her property . She believes that they are
on a neighboring parcel .
G eorge 0 . Smith , Jr . - addressed the Board and public and explained
the proposed placement of a home on the property and said that
there are no plans to remove the existing trees on the property .
Code Enforcement Officer Susan Beeners described the area and the

Motion to Close Public Hearing
A motion was made by Paul Viscuso and seconded by Joel Gagnon to
close the public hearing at 9 : 05 P . M .
