Supervisor Dietrich called the meeting to order at 8 : 05 P . M .
PLEDGE OF ALLEGIANCE :
Supervisor Dietrich led all present to the Pledge of Allegiance to
t he American flag .
APPROVAL OF MINUTES :
Agenda Meeting of December 4 , 1991
A motion was made by Supervisor Dietrich and seconded by ; 11
Councilperson Marisa to approve the minutes of Agenda Minutes of
December 4 , 1991 , as submitted .

ADDITIONS TO THE AGENDA :
Councilperson Marisa asked that an Executive Session of the Town
Board be held immediately following the regular Board Meeting to
d iscuss the American Community Cablevision contracts .
Councilperson Marisa asked that an item entitled " Warrant No . 3 of
1991 for payment of Election Inspectors be added to the Agenda .
Supervisor Dietrich asked for the addition of a communication item
from Brian Caldwell be added to the agenda .
No Board member objected .
County Representative ' s Report [Hi
Representative Proto reported on the following : s !
1 ) Proposed Tompkins County Sales Tax Increase - Tompkins County
sales tax increase to eight percent ( 8 % ) was not approved ;
2 ) County Agricultural Districts - Agricultural Districts are
up for review in January , 1992 . Property owners who wish to
be added to or removed from ag districts must apply now .
3 ) New York State Land Acquisition Commission -- Draft report
completed . Danby State Forest Lands may be included in the
report .

4 ) Part 75A of the New York State Septic and Sewage Regulations -
Tompkins County Health Department has applied for waivers .
The County is in the process of revising the County Sanitary
Codes .
5 ) Tourism Advisory Board - Exceeded their goal for 1991 .
6 ) Rabies - Tompkins County has three ( 3 ) confirmed cases of
rabid raccoons and one ( 1 ) rabid ferret .
7 ) AIDS ( HIV ) - There are twenty - three ( 23 ) active cases of AIDS
( HIV ) in the County .
8 ) Tompkins County Landfill - Sterns and Wheler have projected
that it will take 4 , 000 additional man hours to produce the
reconfiguration for the DR - 7 site .
9 ) Tompkins County Airport - Are proceeding with the initial
design phase .
Representative Proto extended his appreciation to Ric Dietrich and
said it had been a privilege working with him for the past several
years .
Supervisor Dietrich reported that the Highway Superintendents
Association held a retirement dinner in, honor of Highway
Superintendent Coddington ' s retirement .
H ighway Report :
H ighway Superintendent Elect - Bill Hall addressed the Town Board
and asked why there has been a cut of $ 2 , 500 . 00 in the Highway
Superintendent ' s Salary for the Fiscal Year 1992 Budget . He said
he was not aware of the reduced salary at the time of election .
D iscussion followed .
Supervisor Dietrich said it was his understanding that salaries
were going to be kept in line and now it appears that the Town of
D anby now has one of the lowest ( if not the lowest ) salary for
H ighway Superintendent in Tompkins County .
Councilprson Eckstrom reminded the Board that the salary levels
were set long before the election . The salary level was not
reflective of the indivisual but of the budget situation .
Superintendent Coddington said that the Ithaca Journal published
an article that listed salaries for all the towns in Tompkins
County for elected officials . The article quoted 1991 salaries for
the Town of Danby .
Rick Dobson - said he did not feel that a cut in this salary was
justified as the Highway Superintendent Elect is well qualified and
h as several years of experience .
L iz Owens - Roe - said that she does not have a problem with
arbitrary rule for salary adjustments but all positions should be
adjusted as new people come in not just the Highway Superintendent .
E dward M . Roberts - said that he thinks that with the job
responsibilities the Highway Superintendent salary should not have
been cut .
Councilperson Marisa said that he is not sure what adjustments can
be made if any at this point and that it should be discussed in
executive session .
H ighway Superintendent Coddington said that his salary was cut the
first year and he was not aware of the cut at the time of election .

He said the Board should make candidates aware when budget items
such as salary have been cut .
Motion to Discuss in Executive Session
A motion was made by Councilperson Oltz and seconded by
Councilperson Eckstrom to discuss the Highway Superintendent Salary
in Executive Session .

Rick Dobson - Danby Road asked when the Board was going to vote on
the New Zoning Proposal . He said he is unhappy with the new zoning
map and the Commercial C Zone on the Proposed Map and the
requirements for special permits .
S upervisor Dietrich said that the changes in the zoning proposal ,
maps and subdivision regulations , would be addressed at the
D ecember 11 , 1991 Public Hearing .
COMMUNICATIONS :
1 ) Communication from Assemblyman Luster regarding request from
the City of cIthaca to introduce legislation that would permit
the use of the county equalization rate for the purpose of
levying school taxes in the County .
2 ) Automatic Data Processing Agreement for Town Payrolls .
3 ) Memo from West Danby Water Commissioners regarding quotes on
purchase and installation of a well pump .
4 ) Proposal from Gay Huddle regarding the Danby Reading Room .
D iscussion followed in regard to the Reading Room Proposal .
Councilperson Marisa said that he would like to encourage a
proposal for the next fiscal year .
Councilperson Eckstrom said that this was something the Town could
d iscuss with Community Council .
5 ) Letter from Rhonda Engman regarding $ 4500 allocated for
J ennings Pond in the 1992 Budget and suggested the money be
spent for dog control through the SPCA .
D iscussion followed regarding the services and costs for dog
control through the SPCA . The letter will be on file with the Town
Clerk .
6 ) Copy of a letter to Landfill Neighborhood Protection Committee
from Brian Caldwell and Charlotte Griggs requesting quarterly
water testing for pollutants which may come from the County
L andfill .
7 ) Letter to the Town Board from Gould Coleman regarding the curt
response he received from our Code Enforcement Officer when
h is building permit expired .
8 ) Community Council December 1991 Report .
Supervisor Dietrich reported the following items listed in the
Community Council December Report .
Community Council has been notified of the 10 % cut in the county
allocation for the ACE / AFTER - SCHOOL PROGRAMMING and will be
adjusting their budget accordingly .

D ivision for Youth ( DFY ) for 1992 will be $ 2160 and we will receive
$ 1951 for 1991 .
D ivision for Youth ( DFY ) money and part of the County Money for
1991 has been applied for . County monies for September - December
1991 will be applied for at the end of the quarter .
The budget process for United Way Funding is in progress .
As soon as confirmation for use of the church for Summer Recreation
programs is received we will start advertising for Summer
Recreation personnel .
Environmental Management Committee Report
EMC Representative Herb Engman reported on the following :
1 ) Open Space Land Acquisitions Hearings will be held soon . The
closest one in our area will be held in Binghamton or Elmira .
2 ) Rabies - may pass soon as it seems to travel in a cycle .
3 ) DR - 7 Site - The EMC met with representatives of the County
Solid Waste Division regarding the Natural Resource Guide and
the Wetlands Map .
Herb Engman thanked the Town Board for the privilege of
representing the Town of Danby on the Environmental Management
Council for the past eleven ( 11 ) years .
Community Council Report :
Supervisor Dietrich reported that Community Council has an interest
in the school and communications have been going well . He hopes
the Board will continue communications with Jim Rothberg as the
principal person for negotiations between the school and Community
Council for youth programs . Community Council would like to
encourage the Town Board to keep the Town Highway Barns in mind for
a youth center .
Community Council would like to have the Town Board appoint a
✓ epresentative to serve on the Council for 1992 .
Community Council qualifications for State Licencing under Day Care
w ill make a difference for funding for the After School Programs .
H ighway Report :
Supervisor Dietrich reported that it is possible for the Town to
✓ eceive funding for repairs to Michigan Hollow .
D iscussion followed .
Councilperson Eckstrom suggested that the Town go directly to the
County Budget and Administration Committee asking them to adopt
Michigan Hollow Road .
Senior Citizens

Code Enforcement Officer ' s November 1991 Report :
Permits were issued in November 1991 for the following :

Additions - four ( 4 )

P ermit Renewals - five ( 5 )
Total Building Permit fees collected - $ 1 , 824 . 00

Dog Control Officer ' s Reports
The October and November 1991 Dog Control Officer ' s Reports have
been received and on file with the Town Clerk .

P lanning Board Report :
Chairperson Weitzel reported that the Planning Board held a Public
Information Hearing on November 21 , 1991 and at a Special Planning
B oard Meeting following the Public Hearing passed the following
motion :
Motion to Approve the Proposed Subdivision Regulations and to Pass
the Completed Documents and Ordinance to the Town Board
" A motion was made by Joel Gagnon and Seconded by Arch Dotson
that the Town of Danby Planning Board adopt the Proposed
Subdivision Regulations with the chain of notification
provisions to be made in the same manor as the notification
for special permit proposals and to pass the completed
documents on to the Town Board .
A vote on the motion resulted as follows :
Carried Unanimously
The Planning Board is also working on a list of priorities for
their next year planning goals .
Supervisor Dietrich reported that the Town Board will hold a final
P ublic Hearing on the Revisions to the Proposed Zoning Ordinance ,
Revised Maps , Subdivision Regulations , Fee Schedules , Local Law # 1
and Local Law # 2 on Wednesday , December 11 , 1991 at 7 : 30 P . M .
County Youth Report :
Supervisor Dietrich reported that programs for County Youth are
now being reorganized due to budgets cuts in funding from Tompkins
County and New York State .
NEW BUSINESS :
H illview Terrace Mobile Home Planned Development District Proposal :
Councilperson Marisa reported that The Town Board has received a
P lanned Development District application for Hillview Terrace
Mobile Home Park from Mr . and Mrs . Paul Hardesty . The PDD is for
t he expansion of Hillview Terrace Mobile Home Park . Attorney for
the Town , Nelson Roth said the Town Board must clarify the intent
of the application . Councilperson Marisa said he would like to be
able to accept the application as it is and pass it on to the
Planning Board as quickly as possible and he appreciates the
H ardestys ' being able to put the last pieces together to present
to the Board .
Mary Lou Hardesty said that she had a difficult time getting this
proposal through our zoning office so that it could be placed on
the Agenda for tonight for the Board to look at .
Councilperson Marisa said that the Board needs to know exactly what
is being asked for - - whether it is a application for a revision
to the PDD that is on file ( whatever that may be ) or if it is
asking for an expansion under pre - existing authorization .
Councilperson Marisa said that personally he thinks we could accept
the application as a revision to the PDD , which is basically a
reconsideration of the entire site plan for the expansion and go
ahead on that basis right away . If what you would really like is
to have the Town entertain a revision under the pre - existing
arrangement then the position of our Town Attorney is that we will
have to spend some time to figure out exactly what that is to come
to an agreement on it .
William Albern asked Councilperson Marisa to state that again .
Councilperson Marisa stated that the Town could accept the
application for essentially a revision of a PDD which means that

we are going to take this as if it were in effect a new PDD to be
placed right on top of the current property regulations ( whatever
those were ) and in the process clearing up whatever ambiguities
were between what may have been in old Town Minutes and Maps and
proceed directly .
Mary Lou Hardesty said that if you were talking about the original
P DD that was presented for ninety - nine trailers - - we have
forgotten about all of that - - this PDD proposal is all new .
Councilperson Marisa said that from the Town ' s prospective we were
going to take the piece of property and PDD outline , create a new
P DD in that spot that it is going to be an expansion of the current
use , to include all of the new things that you have there .
Mr . Albern asked for clarification as to whether the PDD was there .
Councilperson Marisa said that there was something there but he
d id not want to argue about what used to be there but worry about
this new plan and the whole thing in total .
Mary Lou Hardesty said what she would like to clarify is that we
do agree that there is a PDD there now .
S upervisor Dietrich said no .
Councilperson Marisa asked if she could agree that there is a PDD
that was approved but we don ' t know exactly what the number of
units were and exactly what site plan and map were adopted . He said
there was a site plan and map adopted . He thinks we can agree that
there was a PDD there with some parameters on it . What the Town
B oard would like to do is entertain an application for this new
proposal that you would like to have . We would like to consider
this as a new application for the whole thing and start a process
as if we were going to rezone this parcel as a new PDD and in the
process remove all the ambiguities
Mary Lou Hardesty said she did not agree as that was a PDD before
this application .
Mr . Albern said this piece of property with this perimeter ( he
described the perimeter on a map property map ) is part of the PDD .
He said the minutes dated 1970 describes that area as a PDD and the
resolutions prove the development of the mobile home park with the
development of units as shown with twenty - six units . It shows a
development of twenty - six units within a PDD . He said he believes
the PDD is there and this proposal is for construction within the
PDD .
Councilperson Eckstrom said that there is consensus that twenty -
six units were probably approved . Then what we are quibbling about
is phase II and whether or not the application is of new or
existing zoning applies .
Mary Lou Hardesty said that in the Town of Danby Resolutions andin
Town minutes it is stated that each phase of construction must be
approved by the Town Board . That is what we are doing .
Supervisor Dietrich said that all of the specifics refer to a dated
map and none of the maps we could find corresponded with the dates .
He said we have a map with the same architect and surveyor but the
dates do not correspond . It is unclear whether the map we have is
a subsequent map . All of the specifics are on a map . Supervisor
D ietrich said that he took all the data to the Town Attorney in
August 1991 to see if we could get clarification on the map .

to the map .

Councilperson Marisa said that if we could agree that something was
agreed to before , and there was a PDD , what we have now is an
application for a new expanded use on the same site that we are
going to treat and process as it was a new PDD application . We can
start it as a new PDD application , process it , put it on the same
site , and consider the plan for what you want here .
Mary Lou Hardesty asked Councilperson Marisa to explain the steps .
She said that every time she has started this proposal something
comes up that is contradictory . She asked that the Board tell her
what steps that we need to do that would be different than what
they have presented .
Councilperson Marisa said that there is a list of things that the
Town Board have passed on to the Zoning Officer that they would
consider as a completed application for PDD ' s . He said he thinks
that most of the things are here or could be put here . We have to
decide what kind of SEQR action to take . We have to send the
application to the Planning Board for its review of your Part I of
the EAF and to make recommendations for the second part of the EAF
and we could start the process for Declaration of Lead Agency for
SEQR review . After the Planning Board considers the data they will
come back with their recommendation and the Town Board will decide
whether or not the SEQR Environmental Quality Review Act needs to
be taken or whether they can make a Negative Declaration of the
Environmental Assessment . In either case we can move on almost
directly to public hearing and a decision .
Mary Lou Hardesty said that it was her understanding they would
have to do all of those things no matter what . She said that she
just wanted to present the proposal to the Board now and she would
talk to her lawyer about the rest of the procedure .
Elizabeth Owens - Roe said that it was pretty obvious to her that if
the Town PR this as a new PDD there will be a tremendous amount of
resistance than if you accept responsibility for the fact that this
was an existing PDD . If at one time there was approval for an
expanded site and you now approach it as a new PDD . Basically you
are jeopardizing this person ' s livelihood . Here is a person who
had a plan for expansion that was approved . From everyone she has
talked to who know , it may be possible that there are some records
somewhere .
Nancy Weitzel said that she remembers that due to the previous
owners financial situation at the time , they were asked to come in
with a small unit that they could afford . It was suggested that
they do a small section and when they obtained the capitol to come
back .
Supervisor Dietrich said the many residents do remember this area
as being a commercial zone , but the documentation for it just isn ' t
there . The specific records refer to a map . The map we have
allows for only twenty - six ( 26 ) units on a particular piece of
land .
Discussion followed in regard to the actual boundaries of the PDD .
Joel Gagnon said that if it is all within the boundaries of the PDD
it can be regarded as an expansion and it can be treated the same
as H & E . It is a revision of a PDD ( an expanded use but not in
size ) .
Mr . Albern said that this is a revision within a PDD .
Mary Lou asked for the Town to let Bill Albern present the plan .
Mr . Albern said that there was previous approval for a section of
the PDD . It was expected that they would develope little phases
at a later time .

Mr . Albern presented a detailed drawing of the site showing details
o f the proposed site including the placement of mobile home lots
for seventeen ( 17 ) double wides units and fourteen ( 14 ) single
w ides , septic fields , driveways , entrance , recreation areas ,
lighting , etc . He explained the proposed developed area in detail .
The County Health Department has been out to the site several times
to look at the concept of the septic system . The water system will
be an extension of the present water system .
Councilperson Eckstrom asked about the downcast lighting
✓ equirement and the ten percent set aside requirement . He said
that we should uphold the same standards as for a subdivision .
Mr . Albern and Mary Lou Hardesty asked the Town Board to refer this
proposal to the Planning Board .
D iscussion followed in regard to whether this application was to
be considered as a revision within an existing PDD .
J oel Gagnon said that there is no provision under the current
zoning ordinance for a PDD revision . It is necessary to create a
new one every time a change or modification is requested .
Councilperson Marisa said that the following changes need to be
made on the EAF that was submitted :
1 ) The DOT needs to be listed .
2 ) The maximum potential development of the site is permitted by
the present zoning - - is questionable .
3 ) Lighting - - the town is wants down lighting incorporated in
all residential areas .
Motion to Pass Hillview Terrace Planned Development District
Application to the Planning Board for Review - Approved
A motion was made by Councilperson Marisa and seconded by
Councilperson Eckstrom to accept the new application which is
substantially complete for a revised PDD to establish thirty - one
( 31 ) new housing units at Hillview Terrace as submitted by Mary Lou
and Paul Hardesty . The Town Board passes the application to the
Planning Board for their review of the Draft Environmental
Assessment Form ( DEAF ) and their recommendations on the EAF , Site
Plan and all of the application . The Town Board classifies the
action as Type I under the SEQR Law and initiates the procedure to
become Lead Agency under the SEQR Law .
Discussion followed .
Mary Lou Hardesty asked the Board if this motion meant that this
property was not a PDD .
Councilperson Eckstrom said it was part of her original PDD but not
part of the original site plan .
Councilperson Marisa directed Mary Lou Hardesty to show in the
application the perimeter of the PDD which is consistent with the
old map and shows the whole area . ( An outline of the entire PDD
area . )

NEW BUSINESS :
RESOLUTION # 68 OF 1991
REAPPOINTMENT OF BOARD OF ZONING APPEALS MEMBERS
WHEREAS , the Town of Danby Board of Zoning Appeals Members are
appointed officials for the town , and
WHEREAS , all appointed officials are required to swear and
subscribe to the Oath of Office before they can enter upon the
discharge of any official duty within thirty ( 30 ) days of the
commencement of his / her term , and
WHEREAS , under Section 10 , of the Public Officers Law states the
oath of every municipal officer is to be filed with the clerk of
the municipality , e . g . town officer , town clerk , and
WHEREAS , the members of the Town of Board of Zoning Appeals do not
have an Oath of Office on file in the Office of the Town Clerk , now
therefore be it
RESOLVED , that the Town of Danby Town Board reappoint the Members
of the Board of Zoning Appeals as follows :
Edward L . Inman Term Expires June 30 , 1992
Ted Merritt Term Expires June 30 , 1993
Susan A . Hautala Term Expires June 30 , 1994
Elizabeth Owens - Roe Term Expires June 30 , 1995

RESOLUTION # 69 OF 1991
REDUCTION OF SPEED LIMITS :
By Supervisor Dietrich
WHEREAS , the Town Supervisor of the Town of Danby has received many
complaints regarding the speed limit
etc .
Discussion followed
Councilperson Eckstrom asked if it was necessary to adopt all
zones . He said he would like to move as an unfriendly amendment
that Item 3 and 4 be removed and that in Item 5 that the following
be appended on the end - - to the Brown Road Bridge .
Discussion followed regarding the new housing and density on Bald
Hill Road from Jennings Pond to Station Road . ( Item # 3 ) .
Councilperson Eckstrom said that there this area is primarily
vacant land .
Supervisor Dietrich said that he thinks the fifty - five ( 55 ) mile
per hr . speed limit is dangerous in an area where there are
children .

Councilperson Eckstrom said he does not think that there needs to
be a speed limit imposed through the State land on Station Road .
Supervisor Dietrich said this resolution would be sent to Tompkins
County requesting them to come out and look at the roads with us .
Dean proposed Brown Road to the bridge , ( # 5 ) ( Station Road )
and to State Land on Station Road .
E liminate extending the 35 mile per hr up Bald Hill Road .
( Eliminate # 3 entirely'
Motion to Refer Sheriff Patrol for the Town Request to the Planning
B oard
A motion was made by Supervisor Dietrich and seconded by
Councilperson Eckstrom to refer a proposal to the Planning Board
for the Town of Danby to purchase law enforcement services .

RESOLUTION # 70 OF 1991
SET YEAR END MEETING DATE
B y Councilperson Marisa and seconded by Councilperson Eckstrom
RESOLVED , that the Town of Danby Town Board hold a special year end
1 meeting on Monday , December 30 , 1991 at 5 : 00 P . M .

Councilperson Eckstrom said that we will need a resolution on
D ecember 11 , 1991 to pass on to the Planning Board so that they
will know what zoning law we are talking about in regard to the
H illview Terrace Proposal .
Motion to Purchase a Computer and Accounting and Payroll Software -
Approved
A motion was made by Councilperson Eckstrom and seconded by
Councilperson and seconded by Councilperson Marisa that the Town
B oard requests Councilperson Oltz to research with Carl Kimberly
the Williamson Law Book Accounting and Payroll Software Packages ,
and to enter into agreements with him , if it is desirable . The
Town Board authorizes Councilpersons Eckstrom and Marisa to
research the costs of computers and to purchase same for delivery
as soon as possible . The cost of computer purchase shall not
exceed the budgeted amount .

Motion to Discontinue Payroll Services with Automatic Data
P rocessing ( ADP ) - Approved
A motion was made by Councilperson Eckstrom and seconded
Councilperson Marisa by that the Town of Danby Town Board
d iscontinue Payroll Services with Automatic Data Processing ( ADP )
effective the last payroll of 1991 and that we contract with them
to provide us year - end reports through 1991 and to provide W - 2 ' s
for all our Town employees and request that they straighten out
accounts appropriately .
