S pecial Public Meeting 7 : 30 P . M . September 10 , 1990
The Town of Danby Town Board held a Special Public Information
Meeting at the West Danby Fire Hall at 10 Maple Avenue , West
D anby , NY . The purpose of the Special Meeting was to update the
Town of Danby Town Board and Danby residents on the Tompkins
County Landfill ( Landstrom Landfill ) which is located in West
Danby .

Supervisor Dietrich called the public meeting to order and
introduced our quest speakers I) a. n .i. el Winch from the Tompkins
County Board ofRepresentat .ives and William Mobbs from Tompkins
County Department. of Public Works .
Daniel Winch addressed the Town of Danby Town Board and public .
Mr . Winch is Chairman of the Public Works Construction
Management Committee .
Mr . Winch explained :
1 ) Landfill operations have been taken over by the Public Works
Construction Management Committee and that he was here to inform
the Danby Town Board and the residents of West Danby and Danby
about the landfill situation in Tompkins County . Currently the
County landfill is in the Town of Danby primarily West Danby and
Spencer which is in Tioga County . The Solid Waste Department/
Public Works staff as well as the Public Works Committee feel
this is in the best interest of all. of Tompkins County that the
landfill remain open until we are able to open the landfill. ,
hopefully in the DR - 7 site in the Town of Dryden . Unfortunately
the process of opening the new landfi_ 1l has taken much longer
that what we had expected .
2 ) The permitting process with the DEC to construct a new
landfill ;, site*is � taking ;! longer ; than ' . :they County . expected . The cost to
the County and the time spent producing information for the DEC
to review the future landfill for Tompkins County has been
greater than expected .

3 ) The County definitely needs to extend the life of the Landstrom
Landfill ( Tompkins County Landfill ) . ; `
Mr . Winch said he is very proud of our County ' s Solid Waste
staff , andit. is very aptly run by Barbara Eckstrom our Solid
Waste Manager .
4 ) Mr . Winch also said that he thinks the show of support
that the County has been able to give to the residents of Tompkins
County is that a Citizen ' s Advisory Committee has been developed
for the DR- 7 Landfill . ( The Citizen ' s Advisory Committee was
proposed and developed by Frank Proto . ) The County is looking
for input from the governmental agencies that represent the
d ifferent districts around DR- 7 Landfill . The County also
h as developed a Neighborhood Advisory Committee for the Central
P rocessing Facility that is proposed on Commercial Avenue in
t he City of Ithaca .
5 ) The current Tompkins County Board of Representatives is
very much concerned with the Solid Waste Program in Tompkins
County and are confident that a new landfill will be opened
in Tompkins County in the near future and that they can justify
keeping Landstrom ' s open until a new landfill is operational .
BILL MOBBS - TOMPKINS COUNTY COMMISSIONER OF PUBLIC WORKS
Mr . Mobbs addressed the Town of Danby Town Board and the public
with a summary and background of landfills in Tompkins County .
1 ) About 1969 the County made a decision to take the responsibility
for solid waste disposal through Board resolution . The resolution
was to open landfills and County staff obtained landfill disposal
sites .
2 ) July 1970 Tompkins County opened three ( 3 ) sites .
3 ) The County ? , Planning Commissioner entered into studies regarding
t he burning of garbage in the mid 1970 ' s . Several studies
later it was concluded that burning was not feasible at this
t ime .
4 ) In 1983 the baling of garbage was explored .
5 ) In October 1985 the County closed the Caswell site .
6 ) In 1986 the County picked up the operation of the Landstrom
site through . a• lease arrangement and continued to seek another
site .
7 ) In 1986 the County thought a new landfill site would be
opened in 1989 .
8 ) Several monitoring wells have been put in at Landstrom
site to monitor the ground water at various depths to test
t he surface water around the site . Compounds and biological
life are being analyzed . The County has started to close a
portion of the landfill by putting on a final cover material .
9 ) A leachate collection system has been installed and we
h ave a perimeter perforated pipe arrangement which collects
t he contaminated water before it leaves the site .
B ill Mobbs also reported that the County is using the Landstrom
site through the good graces of the DEC and that they could
force us to cease operations there at any time they saw fit .

The landfill is nearing the total volume that it is possible
to place at that location . The obvious thing that the County
can do to increase that life is to increase the side slopes
of the landfill .
( Bill Mobbs presented a scale showing the proposed slope of
the landfill . )
Public comment and questions followed for approximately two
( 2 ) hours . Some ofathe concerns : and :iquestions :lhare ;: been , sumarized
as follows , :
LEACHATE COLLECTION SYSTEM
1 ) Is the collection system successful ?
2 ) How much leachate is collected ?
3 ) What is found in the leachate ?
4 ) How far downstream will it go before the County stops it ?
5 ) Impact is more than one mile downstream and increases six
miles away near vicinity of trailer parks .
6 ) There are misunderstandings where the secondary rise is .
Response from County Representative - It was explained that
the leachate collection system was designed to collect as much
as possible under the present circumstances and details of the
environmental impact studies would have to be referred to some
of the solid waste staff who have actual data .
SLOPE OF LANDFILL
1 ) Has the DEC responded to the proposed height for the landfill ?
2 ) What is the slope at Landstrom verses Caswell site ?
Response from County Representative - - The grade as Caswell
varies 4 IThe proposed slope at Landstrom is less than the maximum
allowed by the DEC .
COST TO CLOSE LANDFILL
1 ) How much would it cost the County to close the landfill ?
2 ) How much are we saving by keeping Landstrom open ?
3 ) Has anyone figured out how much the County is saving by
keeping it open ?
4 ) Has anyone looked at making a deal with neighboring landfills ?
Discussion followed in regard to the cost of $ 40 per ton verses
$ 100 + for shipping out of the County .
RECYCLING EFFORTS
Representative Winch reported that the Tompkins County Recycling
program is successful and that we are in excess of 30 % of
materials that can be recycled .
Many residents responded that to them it means the landfill
is going to stay in their community for 30 % longer and are
concerned that the size of the landfill would be larger , is
not lined , and that garbage will be just dumped as it is now .
MAINTENANCE AT LANDFILL
Many Town of Danbyk ' residents ; expressed their concern in tegard
to the maintenance at the landfill and do not agree that it
is handled properly . Sludge .H ( and other materials ) are being
dumped there and the landfill is not a permitted landfill and
is unlined . One resident reported that he has been pictures
showing leachate that appears to be reaching the wetlands near
the landfill .
Also residents reported to the County Representatives that the
roads leading to the landfill ( including Route 34 / 96 ) are littered
with debris from trucks going to and from the landfill .

WELL WATER TESTING
Many questions from West Danby residents were asked in regard
to when their water would be tested for contamination - -
how long before well water testing would be available
and how / who could be contacted for informantion and concerns
about their well water .
Mr . Winch will report back to the Town with information
relating to how Danby residents can be included in a well
water testing program .
D iscussion followed in regard to testing for ground water pollution
at the landfill and how the Landfill Overseer Committee could
g et information to the County Board of Representatives in regard
to a well testing program and other concerns related to the
landfill . Requests for reports of test results , etc have not
been responded to in the past .
A Spencer resident stated that he is concerned that nothing
is being done for the Tioga County residents and the majority
of the Landstrom Landfill is in Tioga County .
County Representative responded that in regard to the ground
water pollution that the data shown on test results is inconsistent .
Discussion followed in regard to the need for more test wells
for more accurate test results .
LANDSTROM LANDFILL CLOSURE
There was lengthly discussion with residents expressing concern
that the DEC has allowed the Landstrom Landfill site to remain
open and operating without a permit . Some of the questions
raised were as follows :
1 ) Why is the site operating without a permit ?
2 ) How will the landfill be capped ?
3 ) Is it open due to lack of funds to ship garbage ?
4 ) At the present time the landfill is not properly covered - -
will it be capped properly ?
5 ) With steeper slopes will it be covered properly ?
County Representative responded that the DEC ' has allowed the
Landstrom site to remain open because Tompkins County is moving
forward in the process of siting a new landfill . He further
explained that the County must follow the DEC standards for
landfill closures .
S upervisor Dietrich requested that the County send a letter
t o the Town of Danby with some kind of methodology spelled
out as to how / who to contact for information relating to the
Landstrom Landfill . Who can the Town of Danby contact for
information relating to what is happening at the Landstrom
site ?
County Representative Winch suggested that a written request
for information be sent to William Mobbs with a copy to Representative
P roto .
S upervisor Dietrich also said he would like to see some kind
of a study ( figures ) relating to what kinds of damage might
be incurring - -what it is costing the County to keep the Landstrom
S ite open . He stated that we do not have any information .
The stream near the site and in West Danby is a major feeder
stream and a major aquifer that goes into Cayuga Lake . If
we pollute the aquifer or ruin the stream we could enter into
some kind of mamoth damage . Do we know if we are permanently
affecting this aquifer ?
Lengthly discussion followed :
Representative Winch reported that the commitment of the Tompkins
County Representatives , ' the Board of Public Works and Solid
Waste staff is to build the safest environmentally sound landfill
t hat we can to protect the residents of Tompkins County .

Representative Mobbs reported there is an interesting concept
at the Landstrom Landfill that - like : it or not - - it has been
there since 1970 and if we stopped putting garbage there today
there is bound to be some impact from twenty ( 20 ) years worth
of material . He further reported that he thinks the question
we have to evaluate . and address is whether the extra material
that we ' re putting in there now is going to make certain
environmental impacts .
A Tioga County resident expressed very strongly that as a
resident of Tioga County he had only heard here tonight that .
Tompkins County must protect the people of Tompkins County
and asked " what in the world about the people in Tioga County
that have been putting up with twenty ( 20 ) years of Tompkins
County garbage ?
County Representative Winch responded that Tompkins County
has an agreement to accept material from the Town of Spencer
into the County landfill .
Discussion followed from community residents expressing the
need to cap Landstrom Landfill now . Also discussed was the
damage to Town of Danby roads , litter along roads created from
traffic going and coming from the landfill , particularly Michigan
Hollow and Hillview Road . The residents perception is that
we are no closer now to closing Landstrom Landfill than we
were two years ago .
Discussion followed with the County representatives explaining
the process related to the building of the new site and Representative
Winch reported that the process is taking longer than expected
and County staff is working as rapidly as possible .
COMPENSATION FOR NEIGHBORS TO THE LANDSTROM LANDFILL
A Danby resident said that there has been discussion about
compensation for people near the proposed landfill ( DR- 7 ) and
asked why compensation was not extended to property owners
here in West Danby .
Discussion followed in regard to a compensation program for
West Danby and a water well protection program .
The County Representative explained the compensation program
for the Dryden residents and said he is confident that a program
will be extended in the West Danby area .
Al Becker stated for the record that 1 - 1 / 2 years ago the DEC
was taking samples of fish and water throught his property
and other properties near the Landstrom Landfill . He reported
he has a copy of the testing results and asked the County
Representatives if Tompkins County claims that there are no
problems with water in that particular area on the surface .
Mr . Mobbs responded that adjacent to the County Landfill tests
show some pollutants from the landfill .
Mr . ,Becker quoted some of the test results and stated that
there is a problem with ground water pollution in his neighborhood
and does not feel comfortable even watering his apples from
that stream .
Tompkins County Representative Beverly Livesay said she thinks
part of the problem with the landfill issue is that the whole
Board of Representatives is not as close as Frank Proto was .
She reported that she has heard some discussion here tonight
that have never come before the entire Board and she thinks
that they need to . A slide show has been prepared by Barbara
Eckstrom and her staff to present to • the Board of Representatives
and they will be brought up - to - date on where the test wells
are , the new leachate collection system , and what is proposed
for expanding the landfill , etc . She reported she thinks the
public should be invited to present their problems and concerns
so that we all heart the same information at the same time .

Supervisor Dietrich reported that two years ago a few of us
went - to Mr . Mason and discussed concerns about the Landstrom
Landfill and many of the same concerns are being raised here
tonight . The Town was unable to get satisfactory answers ,
in fact we were unable to get answers at all . Supervisor Dietrich
explained that Mr . Mason gave the Town a methodolgy of how
to get information and to report our concerns to the County .
Nothing seemed to get results and Supervisor Dietrich stated
that he has been personally frustrated in attempts to get response
through the process .
Supervisor Dietrich reported to the Town Board and Town of
D anby residents that in the future questions and concerns should
be in writing to Bill Mobbs with copies to Dan. Winch and
Representative Proto as the method of .' communication i weinow
d eem as acceptable .
Representative Livesay stggested: that questions to the County
B oard of Representatives from the Town should be posed in advance
of the public meeting . Her concept of what she wants at that
meeting is for everybody to hear all the information at one
t ime so that the Board can begin to make judgements .
Councilperson Schwartz stated that three ( 3 ) County Board of
Representatives have heard what is going on at Landstrom Landfill
tonight and maybe the Board should consider trading garbage
with another county .
Representative Livesay responded that she had never heard the
question of shipping garbage posed before tonight .
S upervisor Dietrich thanked the representatives for coming
tonight and sharing information with the Town of Danby Town
Board and residents .

PRIVILEGE OF THE FLOOR :
Park and Ride
Councilperson Schwartz reported that he has been in contact with
Dwight Mengel in regard to the Park and Ride bus service for the
Town of Danby . Tom - Tram is coming to parts of Danby . A route
is now scheduled to begin soon on Route 96B and may be possible
for Route 34 / 96 if Mr . Mengel can assess a need . A place for
residents to park their cars on 96B is being explored for a park
and ride service .
' Supervisor Dietrich reported that Mr . Mengel will be coming to
the October 1990 Town Board Meeting .
Senior Housing
Councilperson Schwartz reported that we are still looking into
the Senior Citizen Housing Project .
County Representative Report
Tompkins County Representative Proto reported on the following :
1 ) The Circut Rider in the County Planning Department has
been approved ;
2 ) County Board has passed a resolution to approve Tom-
Tram service for the Town of Danby ;
3 ) The Health Department proposses that the Board of
Representatives pass for 1991 the Environmental Health Fees
for septic tanks , well testing , etc .
4 ) The Health Committee is putting together a program on
rabies . control . Mr . Proto reported that a rabid bat has
been reported in Tompkins County .
5 ) The District Attorney ' s Office and the Tompkins County
Sheriff ' s Office have received a $ 15 , 000 . 00 grant for drug
enforcement .
6 ) The Town of Danby and the Town of Caroline will share a
representative on the Economic Advisory Board .
7 ) Tompkins County Planning Board will be assessing Mr .
Hanson ' s priority list for the County .
8 ) Adoption of Payment of Taxes in Installments Local Law .
9 ) Airport - The tests by the Army Corps of Engineers show
that the the preliminary site south of the CFR building
meets the criteria for wetlands .
Supervisor Dietrich reported that the Town of Ithaca Town Board
has an item on their agenda tonight in regard to a feasibility
study for a recreation center .

Discussion followed in regard to who to contact with concerns ,
complaints , questions , etc . about Landstrom Landfill to the
County Representatives . Rather than the residents writing
directly to Mr . Mobbs they should contact the Town of Danby and
the Town will write to the County .
Members of the Public
Joel Gagnon - asked the Board why the Town could not close
Michigan Hollow Road or impose ,: a five ( 5 ) ton weight limit .
Discussion followed in regard to where the swapping of Michigan
Hollow Road with the County stands .
Mr . Wright - - asked the Board to look into getting a slower speed
limit through West Danby . Mr . Wright reported that there are

many accidents as a result of speeding traffic especially near
the intersections .
Supervisor Dietrich reported that the Town has no authority to
reduce the speed limit on a New York State Highway but the Town
is looking into the issue .
Several residents reported that there is an ongoing problem with
speeding trucks .
Other Reports
The Code Enforcement Officer ' s Report and the Dog Control Report
were postponed until October 8 , 1990 .
OLD BUSINESS :
Payment of Taxes in Installments - Resolution
After discussion the Town of Danby Town Board postponed the
Payment of Taxes in Installment Resolution until
September 27 , 1990 Meeting .

By Councilperson Schwartz : Seconded by Councilperson Eckstrom
WHEREAS , A . Francis Wright was elected as Town Councilperson in
November, ' 1967 and served from January 1968 to July 1968 , and
WHEREAS , A . Francis Wright was appointed to fill a vacancy as
Town Justice from July 1968 to July 1972 , and •
WHEREAS , A . Francis Wright was appointed Town Supervisor to
complete the unexpired term of Donald Makie from July 1972 to
December 1972 , and
WHEREAS , A . Francis Wright was elected Town Supervisor in
November 1972 and served as Town Supervisor for four consecutive
two year terms from January 1 , 1972 to December 31 , 1979 , and
WHEREAS , A . Francis Wright was elected Town Justice in November
1985 and served a four year term , and
WHEREAS , A . Francis Wright was re -elected in November 1989 to a
second term of Town Justice ; now , therefore be it
RESOLVED , That the Town Board of the Town of Danby recognizes
the dedication of A . Francis Wright to the Town of Danby and
presents this resolution in his honor to his beloved wife , Onalee
Wright .

FOR THE APPLICATION TO THE TOWN OF DANBY ( THE " TOWN " ) FOR
APPROVAL OF THE RAPTOR HEIGHTS PLANNED DEVELOPMENT . DISTRICT
( " RAPTOR hEIGHTS II " ) SUBMITTED BY SCOTT HOFFAY ( " APPLICANT " )
WHEREAS , Applicant has submitted tothe Town a new and revised
application for a Planned Development District for a site

consisting of 29 lots on approximately 72 acres located in the
Town ( the " proposed action' or PRaptor Heights II " ) ; and
WHEREAS , A previous application
submitted to the Town for a ( consisting of 42 lots ) was
Development District ( the �� approval of a proposed Planned
for the same site as thatpincludedtinn ��ther ��proposedraction , such
prior action having been the subject of a full environmental
review by the Town of Danby Board ( the " Town Board " ) in
accordance with Article 8 [ State Environmental Quality Review Act
( " SEQR " ) ] of the New York State Environmental Conservation Law
and 6 NYCRR Part 617 , such ' prior environmental review having
included preparation of a Draft Environmental Impact Statement
and Final Environmental. Impact Statement , and which prior review
culminated in the filing of a Findings Statement and the
disapproval of the prior action by the Town Board ; and
WHEREAS , in accordance with the Town Zoning Ordinance the
proposed action must be referred to the Town Planning Board for
purposes of a preliminary review of Applicant ' s application and a
recommendation to the Town Board ; and
WHEREAS , Applicant has submitted to the Town Board a newly
completed Part I of an Environmental Assessment Form ( EAF ) , and
other information and materials with respect to the environmental
impact of the proposed action ; and
WHEREAS , the Town Board
having received Applicant ' s new
application for approval for the proposed project , , must take
certain preliminary steps in order to proceed with any additional
environmental review of the proposed action which may be
required ; and
WHEREAS , the Town Board wishes to re-designate itself as Lead
Agency for the purpose of completing any and all required
additional environmental review for the proposed action ;
WHEREAS , the Town Board has given written notification to all
involved agencies informing them that the Town Board proposes to
be lead agency , and the Town Board has received no written
notices objecting thereto ; now , therefore be it
RESOLVED , That the Town Board of the Town of Danby , Tompkins
County , New York hereby re-designates itself as the lead agency
for the purposes of conducting whatever additional environmental
review may be required of the proposed action ; and be it further
RESOLVED , That the Town Board hereby classifies the proposed
action under SEQR as Type I ; and be it further
RESOLVED , That the Town Board proceed with consideration of the
proposed action , including review of the EAF , Part I submitted by
the Applicant and completion of Parts I , II and III , that
The Town Board determine the significance or non - significance of
the proposed action and proceed with such further proceedings as
may be required .

Councilperson Schwartz to approve the West Danby Water District
Warrant #9 of 1990 in the amount of $ 118 . 08 .
