PRESENT : Supervisor Dietrich Councilpersons : Eckstrom , Marisa , Oltz , Schwartz OTHERS PRESENT : Town Clerk - Carol Sczepanski Members of the Public : Paul Viscuso , Roy Casterline ; Tom Johnson , Celona Williamson Motion to Open Public Hearing to Consider Emergency Towing of Vehicles Parked or Abandoned on Town of Danby Roads On a motion the Public Hearing to consider a local law providing for the emergency towing of vehicles parked or abandoned on Town of Danby roads was called to order by Supervisor Dietrich at 7 : 30 P . M . , on January 8 , 1990 . Supervisor Dietrich read the following Public Notice published in the Ithaca Journal , December 29 , 1989 . PLEASE TAKE NOTICE that a Public Hearing regarding the adoption of a local law to provide for the removal and storage of vehicles parked or abandoned on highways during snowstorms , floods , fires , or other public emergencies , or found unattended where they constitute an obstruction to traffic will be held on Monday , January 8 , 1990 , at 7 : 30 P . M . at the Danby Town Hall , 1830 Danby Road , Ithaca , New York . By order of the Danby Town Board . The following resolution was passed to the public for their review . Adopted from New York State vehicle and Traffic Law - Subsection 8 of Section 1660 , providing for the removal and storage of vehicles parked or abandoned on highways during snowstorms , floods , fires or other public emergencies , or found unattended where they constitute an obstruction to traffic . WHEREAS , vehicles parked or abandoned on gighways , during s'howstorms , floods , fires or other public emergencies , or found unattended where they constitute an obstruction to traffic may be removed by order of the Town Superintendent of Highways and , WHEREAS , the payment of a towing charge not to exceed $ 75 . 00 and a storage charge not to exceed $ 15 . 00 per day shall be payable by the owner or operator of the vehicle , and WHEREAS , the Town Highway Superintendent shall notify without delay any vehicles so removed to the Town Clerk , and WHEREAS , it shall be the duty of the Town Clerk to ascertain to the extent possible the name of the owner of the vehicle and to notify them of the removal and disposition of such vehicle , and of the amount which will be required to redeem the same . THEREFORE , BE IT RESOLVED , That the rule and regulation shall apply hereinabove - described until a public announcement is made by the Town that the emergency has been terminated . Discussion followed : Paul Viscuso of 122 Heisey Road addressed the Board and asked what happens to abandoned cars that have been left along the highway and towed away by the Town if it is not claimed by the owner . Can the Town levy fines against owners ? Councilperson Schwartz stated that generally the Sheriff ' s Department is called and an attempt to find the owner is made . If the owner of the vehicle is not found it is sold by the County at a Sheriff ' s sale . -~b - ? - Public Hearing ( Towing ) g January 8 , 1990 Councilperson Eckstrom stated that there is a procedure for disposal of property in the event an abandoned car action causes cost to the Town . New York State can encumber the owners drivers license . Supervisor Dietrich reported that both Benjamin ' s and Paul Hardesty will remove cars for residents of Danby at no charge . Discussion followed on the floor in regard to the procedure for towing and storage of vehicles not claimed by the owner . Supervisor Dietrich explained that this local law is basically proposed for the towing of vehicles in a snow emergency . He further explained that in the event of a snowstorm , cars parked along the side of a road create a hazardous situation . M . Roberts PLEDGE OF ALEGIANCE : Supervisor Dietrich led all present in the Pledge of Allegiance to the American flag . APPROVAL OF MINUTES : The approval of the minutes of the December 29 , 1989 Danby Town Board Meeting were postponed until the February 12 , 1990 Board Meeting . COMMUNICATIONS : Letter of Resignation From Bonita Franklin Supervisor Dietrich reported that he received a letter of resignation from Bonita Franklin thanking the Town Board for the opportunity of working for the Town of Danby . Bonita resigned as of December 21 , 1989 and would like the opportunity to resume her employment in the future . Health Department Report on the West Danby Water District Supervisor Dietrich reported that he has received a copy of the 1989 inspection report from the Tompkins County Health Department on the West Danby Water District . This year a detailed system evaluation ( DSE ) was conducted and the completed inspection sheets were included for the Town to review . The Health Department is pleased with the o peration of the water system by Mr . Roy Casterline . Supervisor Dietrich also reported that any inspections , whether they be State or local , o f our water district have always come back with a Class A rating and stated that Mr . Casterline and his board deserves a vote of confidence and credit as they are doing a real good job . NEW BOARD MEMBERS : Supervisor Dietrich welcomed Richard Marisa and Joseph Schwartz to the Town Board . TOMPKINS COUNTY BOARD OF REPRESENTATIVES REPORT : Frank Proto , Town of Danby representative to the Tompkins County Board of Representatives , reported on the following : U . S . Air Contract The Tompkins County Board of Representatives approved the new contract with U . S . Air . Committee Assignments The members of the Tompkins County Board of Representatives have not formally received their committee assignments for 1990 . Danby Recycling Center The Town of Danby Recycling Center Grand Opening will be held on January 13 , 1990 . at 1 : 00 P . M . DU . nilluces 5a3 - 2 - 1 / 8 / 90 State Forest Vegetation Management Representative Proto reported that he is trying to set up a public information Meeting with the DEC in regard to the control of vegetation management of State Forest kthrough burning . 4 .l ,tentative date is set for Thursday , February 15 , 1990 at 7 : 30 P . M . Ai the Danby Town Hall . There will also be an alternate meeting at the Town Hall in Coroline on February 20 , 1990 at 7 : 30 P . M . . Representative Proto reported that residents should write to Senator James Seward , Assemblyman Martin Luster or directly to Governor Coumo with their concerns in regard to the burning of State Forests to control vegetation . Solid Waste The Board of Representatives have approved the findings statement for the Central Processing Facility for Tompkins County . Appointment to Tompkins County Transportation Commission Frank Darrow is confirmed as the Town of Danby Representative to the Tompkins County Transportation Commission . Tompkins County Landfill Tdfitpkitth County is now working on the permit application for the Tompkins County Landfill . Representative Proto also reported that when the Landstrom Landfill is closed on August 30 , 1990 that it will be necessary for Tompkins County to ship their garbage for at least six ( 6 ) months . Harris Family Tragedy Representative Proto reported that due to the recent homicides of the Harris family in Ellis Hollow , the Tompkins County Mental Health Department is counseling friends , neighbors and others concerned and troubled by this tragedy . The Tompkins County Board of Representatives passed a resolution to contribute $ 1 , 000 . 00 to the reward fund that has been set up for the arrest and conviction of persons responsible for the Harris family tragedy . COMMITTEE REPORTES : Community Council Councilperson Marisa reported that Community Council is helping with the Grand Opening of the Danby Recycling Center and the Danby Cub Scout Pack had Made a recycled paper parchment which will be used as part of the preeentation . Councilperson Marisa has been working with Barbara Hotchkiss to get announcements out through South Hill School in an effort to get the children involved . HIGHWAY REPORT : Highway Superintendent Coddington reported that the Town Highway Department has a fire truck from West Danby and that the pump from the truck has been sold . Superintendent Coddington also asked for clarification on how the Highway Warrants are charged in the 1990 budget . Supervisor Dietrich suggested that Superintendent Coddington meet with the bookkeeper to review the 1990 Highway Budget as there have been a few changed in line items . CODE ENFORCEMENT OFFICERS REPORT : The December 1989 Code Enforcement Officers report was postponed until the tebruary 12 , 1990 Town Board Meeting . 1989 Year End Code Enforcement Officers Report Supervisor Dietrich reported that in December 1989 the Town issued permits for $ 145 , 000 . 00 worth of construction and received fees in the amount of $ 329 . 50 , issued two ( 2 ) renewal permits and two ( 2 ) Certificated of Occupancy . This brings a total for the year 1989 to $ 10 , 360 . 00 for fees collected and construction value of $ 4 , 669 . 705 . 00 . Supervisor Dietrich reported that these figures are very close to the 1988 figures . DOG WARDEN REPORT Lorraine Bard reported that in December 1989 she received four ( 4 ) complaiit8 , three ( 3 ) doge reported lost , four ( 4 ) dogs found , four ( 4 ) doge impounded and two ( 2 ) impounded dogs adopted out . Lorraine also reported that there were no doge redeemed by owner and there are ( 2 ) dogs from the Town of Danby that need homes . :tit •. ; . . 4 Bd . Minutes 1 / 8 / 90 as-3 - 3 - Lorraine Bard submitted $ 20 . 00 to the Town Clerk for fees collected for two ( 2 ) adoptions of dogs . The Dog Warden expense for December 1989 was $ 55 . 55 and there were no tickets issued . PLANNING BOARD REPORT : Planning Board Chair Weitzel reported that the Planning Board is in need of one member . Supervisor Dietrich asked Planning Board Chair , Nancy Weitzel to attend the Town Board Agenda Meeting on February 7 , 1990 . Super Group Meeting Postponed Supervisor Dietrich reported that the Super Group Meeting scheduled for January 18 , 1990 will be postponed until January 25 , 1990 . Tompkins County Planning Board Liaison Report Supervisor Dietrich congratulated Tompkins County Planning Board Member Frank Darrow on his appointment to the Tompkins County Transportation Committee of the Tompkins County Planning Board . County Youth Board Supervisor Dietrich reported that there will be a meeting on January 18 , 1990 in regard to matching funds from the Ithaca City Schools . He reported that he and Judy Tagliavento will be meeting with John Caren to pursue the issue of the Youth Commission . Supervisor Dietrich also reported that the Tompkins County Three Year Comprehensive Plan has been completed . Copies of this plan will be on file for interested persons to review . The information from the Youth Forum that was held in Danby this summer is included in the county ' s three -year plan . OLD BUSINESS : Old Town Road Supervisor Dietrich reported that the Town Board will have a formal vote tonight in regard to the issue of Old Town Road and asked members of the public present to comment . Marge Hovanek of Olde Towne Road asked the Town Board to explore the possibility of an emergency exit across thirty- five ( 35 ) feet of Old Town Road ( for emergency only ) . Discussion followed in regard to a recent fire in Olde Towne Village . Supervisor Dietrich reported that the Town Board has received two ( 2 ) letters in regard to a recent fire in Olde Town Village . He reported that he attended the fire and stated that the Danby Fire Department did not have difficulty in getting to that location . He further stated that if there was a problem with other fire departments responding to the fire that it was lack of communication with the fire police . ' Lorene Jump aof 308 Meadow Wood Terrace addressed the Town Board and reported that she thinks there needs to be a "No Through Traffic " sign installed immediately on Olde Towne Road , a "No Access " sign on Old Town Road and a turn-around . Ms . Jump also stated that she would like to see the Old Town Road condemned for emergency exit only . Pat Woodworth of 305 Gunderman Road addressed the Board and stated that she is very much against condemning private property unless there is no other alternative . Supervisor Dietrich explained that there is a real concern that some of our Town roads have different names on the County maps . Currently the Town is addressing the re -numbering of some of our roads and that Old Town Road and Olde Towne Road are only one of the problems that needs to be addressed . Highway Superintendent Coddington stated that the Town Highway Department 'i cannot put a t :Utn-around on private property . Paul Decker of 102 Olde Towne Road addressed the Board and stated that he feels that the Old Town Road should be designated a Fire Lane that could be used by only snow plows and emergency vehicles . ' / Board Minutes 03 5-` 1 / 8 / 90 -4 - / Frank Darrow of 400 Gunderman .Road stated that at , the qend of his comments at the Public Hearing for O1`de $owns ; Village Subdivision :aie oncluded that in his opinion it was not reasonable for the Town to proceed with condemnation for a variety of reasons . Ken Horst of 318 Meadow Wood Terrace addressed the Board and asked the Town to formally alert fire officials of the need to direct emergency and fire vehicles accurately . Marge Hovanek stated that in her opinion since Old Town Road was a road for at least 150 years it should be made an emergency exit and she . sees no real+ on why it cannot be . • Supervisor Dietrich stated that approval of Olde Towne Village Subdivision was contingent upon the Court decision of the legal status of Old Town Road or an alternative road built to specifications . This fact is clearly stated in all the Town . minutes and is extremely clear that the Town Board was not in favor of pursuing Old Town Road until the court decision was clear : He further stated that there were no Certificates of Occupancy issued and it was written into the agreement that no Certificates of Occupancy were to be issued until the court decision . Supervisor Dietrich Stated for the record that the approval for . Olde Tawne . Village ' . Subdivision , WAS contingent upon the court allowing the Old ? own Road as a Town Road and it was stated very clearly in the contract agreement and performance bond . Councilperson Eckstrom stated that he is in favor of a resolution to discontinue research on the condemnation of Old Town Road and asked the Board if they also wanted to formally abandon the remaining section of . Old Town Road . Supervisor Dietrich stated that the Board needs to find out the proceddrs '' . for abandonment of roads . Councilperson Oltz stated that she thinks that the issue of Old Town Road is a property owners problem and the town should not get involved . Councilperson Marisa stated that he thinks the Town should : certainly • not . go ahead with condemnation and that if the Town board does not go ahead with some • abandonment procedures nowt .j a should clearly mark Old Town and Olde Towne Roads . • Councilperson Schwartz stated that he agrees with Councilperson Marisa that the Town should not go ' ahead with condemnation and that street or traffic signs should be installed to clearly mark ' the roads . Discussion followed in regard to the issue of abandonment of Town roads . Resolution No . 1 of 1990 . Old Town Road By Councilperson Oltz : Seconded by Councilperson Eckstrom RESOLVED , That the Town of Danby not enter into condemnation procedures • on • Old Town Road for egress , access or for emergency use . • A roll call vote on the resolution resulted as follows : Eckstrom - Aye • Marisa - Aye Oltz - Aye Schwartz = Aye Dietrich - Abstained Carried Councilperson Marisa requested that a report be included in the Agenda for the February 12 , 1990 Town Board Meeting in regard to changing signs and procedures for abandonments fin BUSINESS ! Retycling Coordinator • Councilperson Eckstrom reported that it is necessary to hire a person as Recycling Coordinator for the Town of Danby Recycling Center . Board Minutes ,25:3- 1 / 8 / 90 - 5 - Supervisor Dietrich requested an Executive Session of the Town Board after tonights meeting to discuss applicants for the Recycling Coordinator position . Discussion followed in regard to the possibility of extended hours of operation and unattended hours at the Danby Recycling Center . Supervisor ' s Statement to Board Roberts Rules of Order will be followed at all Town Board Meetings except when special roll call vote is necessary . Roll call will be alphabetical with the Supervisor voting last . All meetings will begin at 8 : 00 P . M . and terminate no later than 10 : 00 P . M . Method of claims for payment of all bills will be by voucher . '• Vouchers must be submitted no later than Thursday preceding Town Board Meeting . Vouchers may be submitted to the Supervisor or Town Clerk . The Town Board in accordance with Town Law AT103 will audit all bills . All personnel matters will be discussed in executive session . These will be introduced as a resolution with all information and all restrictions carefully stated . Resolutions are to be drawn up by the Attorney for the Town and the Town Clerk will note votes of Town Board on the resolution and attest to same . Owner will be asked to give a signed statement to the Town Clerk that he accepts this Resolution Agreement and will abide by its rules . Section 1 . TITLE . This local law shall be entitled " Providing for the removal and storage of vehicles parked or abandoned on highways during snowstorms , floods , fires or other public emergencies or found unattended where they constitute an obstruction to traffic . " Section 2 . PURPOSE . The purpose of this local law is to authorize , as provided in Subsection 8 of Section 1660 , of the New York State Vehicle and Traffic Law the removal of vehicles parked or abandoned on highways during snowstorms , floods , fires or other public emergencies , or found unattended where they constitute an obstruction to traffic may be removed by order of the Town Superintendent of Highways . • , Section 3 . PEES . The payment of towing charge not to exceed $ 75 . 00 and a storage charge not to exceed $ 15 . 00 per day shall be payable by the owner or operator of the vehicle . Section 4 . DUTIES : The Town Highway Superintendent shall notify without delay any vehicles so removed to the Town Clerk , and it shall be the duty of the Town Clerk to ascertain to the extent possible the name o f the owner of the vehicle and to notify them of the removal and disposition o f such vehicle , and of the amount which will be required to redeem the same . Section 5 . EFFECTIVE DATE .
