01. Call to Order by DePaolo 5:07. The meeting was recorded.
02. Agenda Additions and/or Deletions: none.
03. Public Comments. Metro: A long-time producer, he wants the studio open at full
capacity. Stefanelli mailed him the Covid-19 Health Questionnaire. For a short time last
year I was able to work in the small studio without a mask. I should be able to do so
again. Everything else in Ithaca is open at full capacity, PEG should be too.
04. Comments by AOC members: none.
05. Approval of Minutes of the August 3, 2021 Meeting: moved by Gearhart, seconded
by van Leuken, passed 3-0-1 (DePaolo was absent from the August 3 meeting and
therefore abstained).
06. Access Studio Coordinator Report. Submitted in writing today by Michael
Montesano (Sr. Manager, Programming, Charter Communications) and attached below.
Montesano’s report included (a) his response to AOC questions raised at the August 3
meeting and mailed to him August 8 (“Access Oversight Committee September
Report”), (b) Charter’s slightly revised Covid-19 Guidelines, and (c) documents the AOC
had asked for (“Ithaca Forms”): (1) Studio Application, (2) Editing Application, (3)
Portable Field Production Equipment Application, as well as (4) Ithaca Access Facility
Sign In/Out Sheet. Charter’s Covid-19 Health Questionnaire, also attached, was
forwarded last month.
Van Leuken: surprised that Stefanelli was not copied on the report. DePaolo asks
Kelly; was this a conscious decision? Kelly: I think it was an oversight. DePaolo to
Stefanelli: are you still involved with writing the report? Stefanelli: I provide information.
a. PEGASYS’ operations during the COVID-19 pandemic – report. DePaolo: I see
that Montesano provided answers to some of AOC's questions in his e-mail. Are other
AOC members satisfied with his answers?
Van Leuken: AOC felt that only vaccinated persons should use the studio, which was not
addressed in the response. Also we noted that producers were asked to fill out forms that
were new to us. These forms are included in Montesano's Email of today (see Coordinator
Report). None are part of our Manual (the “PEGASYS Policies and Procedures Manual”),
and none are connected with COVID. Charters’ forms also introduced new limitations such
as a "7 days in advance" condition and that "only two non-consecutive sessions" could be
applied for.

DePaolo asks Kelly: Are these new requirements? Kelly: Let me know in an e-mail
what your issues are. We don't want to keep people away, but the Delta variant of
COVID is here and we have company-wide policy about that... DePaolo: But not in the
Spectrum stores! Kelly: In stores, customers come in for short times. DePaolo: But you
have hundreds in a store, just half a dozen at PEG. I see procedures here limiting
access to PEG which don't relate to public health, to keeping everybody safe. We're not
pushing back as hard on COVID protocol as on changes in day-to-day operations. Are
these new documents now required, or are they presented to AOC for review? Van
Leuken: The AOC first saw the documents today. Stefanelli was required to use them
from August 2 on.
DePaolo: these documents are the same ones that AOC rejected previously? How
did they get implemented? Van Leuken: They were rejected at our June 1 meeting and
implemented August 2 without our knowledge.
DePaolo: screen-shares the three "Ithaca Forms" on Zoom. "Studio Application": I see
no public health or COVID connection. "Editing Application": I see time limitations "7
days prior". Again not health-related. The “Portable Field Production Equipment
Application” I see the same issues. DePaolo will put these objections into an e-mail to
Kelly.
DePaolo: we see Stefanelli as caught in the middle between corporate overlords and
municipalities.
Gearhart: How are reservations made now? Van Leuken: Series producers make
reservations once a year for all their production needs. Single reservations are made by phone
or Email with Stefanelli for the first available timeslot, with a screen shot of the reservation from
Facil e-mailed back as confirmation.
Gearhart: Did we in our previous vote identify the elements in the forms which we
rejected, or should we vote again? Van Leuken: the AOC rejected the whole of
Charter’s proposed manual with its suggested changes at the June 2021 meeting (see
minutes). We didn't pass a resolution. However, our objections are in the resolution
passed on Aug. 3 (minutes, p. 3). DePaolo cites the Aug. resolution: we stick to the
current Manual. Charter is free to submit proposals for changes. The new forms have
not been approved by AOC. Kelly: can't speak for the company.
DePaolo: On COVID rules, what is our major objection? Will Metro asked for no
requirement for masks when alone in room, but, as Gearhart points out, Ithaca College
requires masks in all studios when on the air. DePaolo flags "Names must be included
on studio or edit applications”. "Designated area": presumably includes restroom?
Stefanelli: That would be studios, edit room, restroom, but not the common area (people
will be escorted through it). DePaolo gathers: no wandering around.
DePaolo: the COVID-19 Health Questionnaire and Ithaca Access Facility Sign In/Out
Sheet seem OK. The AOC concurs.
DePaolo: let’s go over Charter’s COVID-19 Guidelines. Re the reference to
applications: there isn't an application according to AOC's procedures. Is there an
attempt to standardize procedures throughout Charter? Kelly: correct.
DePaolo: Other PEGs might not have the same authority that Ithaca's AOC has. We
have to balance AOC's rules with Charter's health protection. We will stay as close to
Charter's proposals as we can. Gearhart: van Leuken's suggestions were: require
vaccinations, require masks (rather than "acceptable face coverings").
DePaolo: Some entities do require proof of vaccination (or: either vaccination or a
negative COVID test). The Town of Ithaca doesn't have mandatory vaccination for
employees, but is discussing it.
Gearhart: The City has not required vaccination for staff or visitors to City Hall.

Van Leuken: Montesano quoted "access on a first-come-first-served, non-
discriminatory basis" in his Email to us.
DePaolo: It seems that AOC itself doesn't have the authority to impose a vaccination
requirement. We should ask the City's legal staff, since it's ultimately a City Franchise.
DePaolo calls on producers attending the meeting. Metro: Is opposed to a
vaccination requirement, but not to a temperature check when entering PEGASYS.
Stern: It might be good to put a time frame on COVID guidelines, e.g. review them after
6 months. The AOC agreed to keep “COVID guidelines” as an item on future agendas.
DePaolo: We do have authority over reservations and program scheduling; for
COVID guidelines, it's less clear. Charter has an interest in protecting its employees.
Van Leuken: sees no distancing requirement in the document. DePaolo: will make a
note of that.
DePaolo asks for 10 minutes to review Charter’s COVID Guidelines; asked van
Leuken to temporarily chair the meeting. She covered items 7 b and c, see below,
before DePaolo returns and offers an edited version of the Guidelines with Track
Changes. The Committee reviewed the document line by line, removing language
unrelated to public health, such as "Forms" and adding "social distancing". A resolution
to adopt and add the Guidelines as item 3 to the Manual’s Section IX “Additional
Policies & Procedures During the Covid-19 Pandemic” was moved by van Leuken,
seconded by Browne:
Resolution to amend Section IX of the current Policies and Procedures Manual
WHEREAS, the current Policies and Procedures Manual (“Manual) for the PEGASYS
Community Media Center (“PEGASYS”) was approved by the Access Oversight
Committee (“AOC”) on January 5, 2021 and amended on May 4, 2021; and
WHEREAS, the AOC wishes to amend the Manual because operating PEGASYS
during the COVID-19 pandemic requires certain changes;
NOW THEREFORE BE IT RESOLVED, that the AOC approves the addition of the
attached item 3 to Section IX of the current Policies and Procedures Manual.
IX 3. Covid-19 Guidelines for users of the PEGASYS facilities
a. Hours of operations will be by appointment only.
b. Only essential individuals for PEG production will be allowed to enter production facility.
Any non-essential individuals including visitors (e.g., friends, family, guests) are
prohibited from entering the production facility.
c. All crew and cast/talent MUST wear acceptable face coverings and maintain social
distancing, where practicable, at all times within the production facility.
d. All Access Users, crew and cast/talent must be signed in via the Sign In Sheet.
e. All Access Users, crew and cast/talent will ONLY be permitted in applicable designated
areas (i.e. edit, control room, studio, etc.).
f. A Covid-19 Health Questionnaire will need to be completed and submitted on the day of
the scheduled session by all cast and crew/talent. The producer will be responsible for
making everyone anticipated to be in attendance aware of the questionnaire that MUST
be completed and submitted to the Access Coordinator.
All are required to comply. This policy is subject to change with the introduction of
additional public health guidelines from local, state and federal authorities.

Approved Unanimously, 4-0. For the record: this resolution implies AOC's determination
that use of "Forms" not connected with COVID must be discontinued pursuant to
Resolution #65 of August 3, 2021. Charter’s Sign-In sheet and Covid-19 Health
Questionnaire will be included in the Manual with this amendment
b. Release of Producer’s Contact Information – report. No report submitted by
Charter. See 07e for further discussion.
c. Charter's disclaimer bookending public access programs - report. No report
submitted by Charter. See 07f for further discussion.
d. Charter's Maintenance and Repair Report. See attached report. No repairs
were required.
07. Member Reports.
a. PEGASYS’ operations during the COVID-19 pandemic. See 06a.
b. AOC Vacancy. Van Leuken notified producers of the vacancy and referred them
to the application form at the City’s web site. Gearhart: hasn't heard about any
applications. Stern: I have applied.
c. Communications with City Attorney’s office. Gearhart: Again hasn't been able to
converse in detail with City Attorney. We should be specific in saying what we want from
him. See 09 for additional discussion. Van Leuken now e-mails the Agenda to the
Attorney; she will add the Assistant City Attorney and staff to the e-mail list.
d. Amendments for the PEGASYS Manual. See 06a and 07e.
e. Release of Producer’s Contact Information – review of Charter’s report. Van
Leuken: we have been waiting for Charter’s report for a while now, but we have since
learned that both NYS law and the Franchise Agreement state that names and
addresses of program providers must be available for public inspection. I propose an
addition to Sections I and VIII of the Manual to clarify this issue for producers.
Reviewing the text, DePaolo suggests adding a reference to the New York State law
and omitting language about providing just an e-mail address of a producer. A
resolution to amend the Manual was moved by DePaolo, seconded by Gearhart:
Resolution to amend Sections I and VIII of the PEGASYS Policies and Procedures
Manual
WHEREAS, the current Policies and Procedures Manual (“Manual") for the PEGASYS
Community Media Center (“PEGASYS”) was approved by the Access Oversight
Committee (“AOC”) on January 5, 2021 and amended on May 4, 2021; and
WHEREAS, the AOC wishes to add language on contact information in the Manual’s
Section I and revise the PEGASYS Public Access Cablecast Agreement (“Agreement”)
in Section VIII; and
WHEREAS, New York State law at 16 CRR-NY 895.4 (c)(10) states that “The entity
responsible for the administration of a public access channel shall maintain a record of
the use of such channel which shall include the names and addresses of all persons

using or requesting the use of any such channel and which record shall be available
for public inspection for a minimum of two years” and
WHEREAS, the City of Ithaca’s current Franchise Agreement at Section 15.6-1 states
that “Franchisee shall direct access staff to, and access staff shall, maintain records of
the use of the designated access channels, including the names and addresses of
persons and organizations providing programming for such channels; such records shall
be available locally for public inspection and retained for a minimum of two years”; now
therefore be it
RESOLVED, that the AOC approves amending the Manual by adding Section I.5 and
amending the language of the PEGASYS Public Access Cablecast Agreement at Section
VIII, as described further in the attached documents.
Section I.5 Records maintained
Use of the PEGASYS facilities and equipment and PEG Channels is tracked by Staff
with the use of Facil, a data management system designed for PEG access TV. In
accordance with the requirements of New York State regulations at 16 CRR-NY 895.4
(c)(10), PEGASYS staff is required to maintain records of the use of the access
channels, including the names and addresses of persons and organizations providing
programming for these channels. These records must be available locally for public
inspection upon request, and retained for a minimum of two years.

Series on the public access channel. I assume sole legal responsibility for all Program contents. I have

obtained all necessary approvals, clearances and licenses for all material included in the
Program(s). I attest that the Program(s) contain no material which is commercial, obscene or otherwise
illegal, as described in the PEGASYS Policies and Procedures Manual (“the Manual”) and by law. I
understand that I may be held criminally or civilly liable for such content appearing in the Program(s).
I understand that Charter must make available my contact information to members of the public who
request it.
I have read and understood the Manual regarding cablecast rights and obligations, and agree to abide
by them. I understand that failure to follow the Manual may result in Charter’s refusal to cablecast
the Programs and/or restriction of my right to submit additional programming. I understand that in
the case of programming produced through the facilities of the PEGASYS Community Media
Center, failure to follow the Manual in the creation of these programs may result in suspension of
my access privileges. I also understand that submitting commercial programming for cablecast on
public access channels will result in the suspension of my access privileges for up to six months.
My signature hereupon shall indicate my acceptance of these responsibilities. I have read all the
forgoing, and understand its provisions as they apply to me and the Program(s).

f. Charter’s disclaimer – review of Charter’s report. DePaolo reports he called the
New York State Department of Public Services on a couple of issues. The term
"capacity" in the federal statute governing Public Access is not under the jurisdiction of
the DPS, so DePaolo will contact the Federal Communications Commission (FCC).
g. Bulletin Board, TBA and Archive Programs. Tabled for next month.
h. Publicity and Outreach - Communications with Producers. Gearhart: it does
seem viable to involve Ithaca College students. Let's have a brief description of what
could be a student project. DePaolo: Important to raise PEG's public visibility. We have
legitimate concerns about lack of visibility. We should give students some latitude on
how to do it. Stern: offers to be a go-between, a producer who students can speak to.
i. Equipment purchases. Van Leuken asks for a follow-up on Jim Blizzard buying
equipment. Pinney: Jim bought the device, and is waiting for Stefanelli to reimburse him
from the PEG Usage Funds [approved by AOC]. Stefanelli: will reach out to him.
08. Old Business
a. Franchise Agreement negotiations. Nothing new; waiting for City Attorney.
b. Franchise agreement non-compliance letter. Nothing new; waiting for City
Attorney.
c. Inclusion of PEG Channels on Spectrum App. DePaolo spoke with Department
of Public Services. There's some confusion re what's in basic service. Our Franchise
Agreement is clear about "any subscriber at no charge" but unclear on the relation
between TV subscription and internet portal. This is another issue I can bring up with
the state Public Service Commission and Office of Community Services. I will draft a
communication and circulate it.
d. I-Net “end equipment” maintenance cost shift. DePaolo: Also part of non-
compliance letter; will see City Attorney.
09. New Business.

a. Gearhart will make a list of items for the City Attorney and distribute it for review
and further additions; DePaolo will summarize his concerns from correspondence with
Charter.
b. Van Leuken: I understand that Stefanelli is no longer allowed to download
programs for local providers of PEG programs; I ask Charter to rescind this rule.
PEGASYS is equipped to very quickly download material that, for the average producer
takes much longer to complete. It takes some producers about 3 hours to upload a
one-hour program to the PEG server. Not all producers and providers have a computer.
Kelly: I don't know about this; will look into it.
Gearhart asks: could a volunteer download material at the studio, using the
equipment? Van Leuken: I do not know if that is currently possible. She recalls that the
municipalities are paying more than $30K/year for staffing. DePaolo: we have a
precedent for staff doing it, so I don't understand the change. Montesano isn't here but
could provide information about it. He will add it to his letter to Charter.

and submitted to us.

Hi AOC,
Please see attached for the September Coordinator Report. I am also providing the answers to
your questions you had last month, sorry for the delay. I will not be on the call this month but
feel free to reach out to me and Lauren Kelly with any questions you might have.
[The COVID19 HEALTH QUESTIONNAIRE appears to be a good tool, but we are asking for
one addition. The AOC feels strongly that only vaccinated persons should use the PEGASYS
facilities. This does not apply to producers checking out equipment, which should continue to
take place pursuant to the no-contact process described in Section IX of the PEGASYS Manual.
But for those using PEGASYS for editing and studio productions, we would like to see a line on
the form stating that staff has verified proof of vaccination. We do not ask that this information
is copied and kept on file - only that staff verifies it and checks off the appropriate box. ]
Revised COVID-19 operational guidelines are being put into place that align with CDC
guidance, promote the continued health and well-being of our employees and comply with local
and state health and safety guidelines. For the health and well-being of our employees, our
customers and our communities, Charter strongly encourages all employees to get vaccinated for
COVID-19 at their earliest opportunity to do so. We are obligated to provide Public Access on a
first-come, first-served, non-discriminatory basis.

Paragraph 1 states: “Forms must be filled out…” Which forms are you referring to? Please
provide them to us if they are not in the current PEGASYS manual. ]
COVID-19 operational guidelines are being put into place that align with CDC guidance,

we require an appointment be made to enter building and no longer allow walk-ins, see attached.
We would be happy to remove PEGASYS and replace with Charter logo if preferred.

us why they are being used.]

Envoy”. Are we still talking about the crew and persons being interviewed? Please clarify.
Please provide a copy of the sign-in sheet if it is different from the Covid Questionnaire. And
what does “Envoy” refer to?]
This applies to any person entering the building, crew or cast (cast is persons being interviewed).
“Envoy” is a Cloud-based registration and management tool to pre-register guests and send
invitations. This is not available at our Ithaca location so a sign-in sheet is required and is
different from the Covid Questionnaire, see attached.

application”. Please clarify the procedure and the application form, neither of which are required
in the current PEGASYS Manual.]
