The project consists of a new 3-story apartment building, to be constructed by a single prime Contractor selected by Owner. The scope of work includes the demolition of an existing house on the property. 1.2 DRAWINGS AND SPECIFICATIONS A. Construction Documents include drawings, specifications and technical information (catalog cuts, etc.) prepared by the Architect and its consultants. 1. Abbreviations on construction documents: Materials and products are identified by abbreviations published as part of the U.S. National CAD Standard. An edited version is available on the Architect’s website at www.streamcolab.com/standards. 2. Industry Organizations: Where abbreviations and acronyms are used in construction documents (such as NFPA, ANSI, ASTM, …), they shall mean the recognized name of the entities indicated in Gale's "Encyclopedia of Associations: National Organizations of the U.S." or in Columbia Books' "National Trade & Professional Associations of the United States." B. The intent of the Construction Documents is to include all items necessary for the proper execution and completion of the work by the Contractor. The Construction Documents are complementary, and what is required by one shall be as binding as if required by all. Anything called for in the drawings and not in the specifications, or vice versa, shall be executed as though called for or reasonably implied in both. 1. Items, assemblies, products, or labor not specifically noted, but reasonably required for the completion of the project and its intended use, and for the satisfaction of relevant codes, are assumed to be part of the project. C. Because the Construction Documents are complementary, the Contractor shall, before starting each portion of the work, carefully study and compare them, as well as any information furnished by the Owner. Contractor shall take field measurements of any existing condition related to that portion of the work, and shall observe and report to the Owner and the Architect any such existing conditions affecting the work. 1. Notes on one drawing, section or detail apply to all similar drawings, sections or details. D. Before ordering any materials or doing any Work, the Contractor and each Subcontractor shall verify measurements at the Project site and shall be responsible for the correctness of such measurements. No extra charge or compensation will be allowed on account of differences between actual dimensions and the dimensions indicated on the Drawings. Any difference which may be found shall be submitted to the Architect for resolution before proceeding with the Work. E. Drawings and specifications as instruments of service remain the property of the Architect, and are protected under common law copyright provisions. They are not to be reused, except by written agreement and with the agreed compensation to the Architect. If reused without permission, the Architect shall be indemnified and held harmless from all liability, legal exposure, claims, damages, losses and expenses. 1. Drawings shall not be used for issuance of a building permit unless signed and sealed by the Architect. 2. Drawings shall not be used for multiple or prototype development without written authorization from the Architect. F. Unauthorized alterations or additions to a drawing bearing a licensed architect’s seal is a violation of NYS Education Law, Article 147, and Commissioner’s Regulations Part 69. G. The Architect shall not be responsible where construction deviates from these drawings or from written recommendations. Changes to the plan by the Owner and/or Contractor shall be the responsibility of the persons making such changes. The Owner and Contractor shall hold the Architect harmless from and against all claims, damages, losses and expenses including, but not limited to, attorney's fees arising out of or resulting from the performance of the work by the Contractor. H. A complete set of construction documents shall be at the site, and available for inspection, at all times. I. The Contractor shall prepare and maintain a complete set of record construction drawings (“As Builts”) indicating all actual work, modifications and revisions to the work delineated on the constructions drawings, as well as any concealed construction work. Include any other information which would be helpful to the Owner. 1.3 DIMENSIONS A. Drawings are drawn to scale for the convenience of all parties, but do not scale drawings. On the drawings, given dimensions shall take precedence over scaled measurements and large scale drawings over small scale drawings. C. Contractor shall check, verify and maintain all dimensions, grades, levels and other conditions before proceeding with fabrication and construction. 1.4 DEFINITIONS A. Complete: A working system ready to serve the designated intent. B. Existing: Conditions previous to the award of a Contract for this project. C. Final Completion: The date on which the Contractor has finally completed satisfactorily all the work required of the Contractor under and in accordance with the Contract Documents, and the Certificate of Occupancy has been received by the Owner. D. Furnish: Supply and deliver to Project site, ready for unloading, unpacking, assembly, installation, and similar operations. E. Install: Operations at project site including unloading, temporarily storing, unpacking, assembling, erecting, placing, anchoring, applying, working to dimension, finishing, curing, protecting, cleaning, and similar operations. F. New: Work which has been or is to be installed under the terms and after the award of the Contract for this project. G. Provide: Furnish and install, complete and ready for the intended use. H. Substantial Completion: Stage in the progress of the Work when the Work or a designated portion thereof is sufficiently complete in accordance with the Contract Documents so that the Owner can occupy or utilize the Work for its intended use. Substantial Completion shall not be deemed to be achieved until after the Contractor has submitted the Operations and Maintenance Manuals, as-built drawings, and warranties for its Contract and these items have been deemed by the Architect as complete. 1.5 CODES AND REGULATIONS A. All work, materials, and equipment of the project shall comply with the current editions of all Federal, State, County and Local codes, laws, ordinances and regulations that apply to the work, including, but not limited to, the following: 1. New York State Building Code (IBC 2015, with NY amendments) 2. New York State Fire Code (IFC 2015, with NY amendments) 3. New York State Plumbing Code (IPC 2015, with NY amendments) 4. New York State Mechanical Code (IMC 2015, with NY amendments) 5. New York State Fuel Gas Code (IFCG 2015, with NY amendments) 6. New York State Property Maintenance Code (IBC 2015, with NY amendments) 7. New York State Energy Conservation Code (IECC 2015, with NY amendments) 8. New York State Uniform Code Supplement (2016) 9. National Electric Code (NEC) (NFPA 70, 2017) 10. Americans with Disabilities Act (ADA) (2010 ADA Standards and 2009 ANSI A117.1). B. All Work of this project shall be subjected to the provisions of all applicable requirements of local utility company regulations. C. If compliance with two (2) or more standards is specified and standards establish different or conflicting requirements for minimum quantities or quality levels, comply with most stringent requirement. Refer conflicting requirements that are different, but apparently equal, to Architect for decision before proceeding. D. The Contractor shall be responsible for obtaining and paying for all the required permits, inspections, etc. 1. The Contractor shall pay all sales, consumer, and use and other similar taxes required by law. 1.6 SAFETY A. The Architect shall not have control or charge of, and shall not be responsible for, construction means, methods, techniques, sequences, or procedures, for safety precautions and programs in connection with the work, for the acts or omissions of the Contractor, Subcontractors, or any other persons performing any of the work, or for the failure of any of them to carry out the work in accordance with the contract documents. B. The Owner assumes no responsibility or liability for the physical condition or safety of the project site or any improvements located on the project site. The Contractor shall be solely responsible for all job safety during construction including, but not limited to, sheeting, shoring and guying structures, barriers and signage. C. The Contractor shall take reasonable precautions for the safety of, and shall provide reasonable protection to prevent damage, injury or loss to: GENERAL CONSIDERATIONS STREAM Collaborative Page 3 of 4 U:\2018015 - 327 W. SENECA ST - VISUM\07.0 SPECIFICATIONS\2018015-327-01-0000-GENERAL CONSIDERATIONS.DOCX (PRINTED 6.13.2019) 1. Employees on the job site and other persons who may be affected thereby; 2. The work and materials and equipment to be incorporated therein, whether in storage on or off the site, under care, custody or control of the Contractor or the Contractor’s Subcontractors or Sub- subcontractors; and 3. Other property at the site or adjacent thereto, such as trees, shrubs, lawns, walks, pavements, roadways, structures and utilities, not designated for removal, relocation or replacement in the course of construction. D. A minimum of two readily available fire extinguishers shall be at the site at all times. 1.7 EXISTING CONDITIONS A. Contractors must inform themselves fully of conditions relating to construction project and material required for complete construction of project. Failure to do so shall not relieve a Contractor of their obligation to furnish all material and labor necessary to carry out the provisions set forth in the Construction Documents. B. The existence and location of underground and other utilities and construction indicated as existing are not guaranteed. Before beginning site work, investigate and verify existence and location of underground utilities, mechanical and electrical systems, and other construction affecting the Work. C. Before ordering any materials or doing any Work, the Contractor and each Subcontractor shall verify measurements at the Project site and shall be responsible for the correctness of such measurements. No extra charge or compensation will be allowed on account of differences between actual dimensions and the dimensions indicated on the Drawings. D. Prior to performing any work, or ordering materials, the Contractor and each Subcontractor shall examine the applicable conditions and substrates and correct any unsatisfactory conditions before proceeding with the work. Verify that substrate and base plies/coats are compatible with new work. Notify the Architect promptly of any modifications required. 1. Work performed over any surface constitutes acceptance of that surface for the specified quality of the work being performed thereon. E. Should unforeseen conditions be encountered that affect design or function of the project, Contractor shall investigate fully and submit an accurate, detailed report to the Architect without delay. While awaiting a response, Contractor shall reschedule operations as required to avoid delay of overall project. 1.8 SHUT DOWNS A. Such Work as connections to existing sewers, plumbing, heating and electric systems, shall be done at a time agreeable to the Owner, and shall be determined and agreed to well in advance of actually doing such Work so as to interfere as little as possible with the operation and use of existing utilities and services. Shut downs must be coordinated through the designated representative of the Owner. The continued uninterrupted operation of all utilities and services of the building is essential. If any existing utilities or services must be interrupted, the Contractor shall provide all necessary temporary utilities, services and connections necessary for maintaining these existing utilities and services at no increase in Contract price except as otherwise specified. No mechanical, heating, plumbing, sprinkler or electric services shall be interrupted at any time, except as approved in advance by the Owner, with a minimum of 72 hours’ notice from the Contractor. All communication systems must be maintained without interruption. As much related Work as possible shall be performed prior to shut downs, so as to minimize the period of shut down. All material and manpower to do the Work involved shall be at the job prior to interruption of services. B. If any of the Work is required to be inspected or approved by any public authority, the Contractor shall cause such inspection or approval to be performed. 1.9 HAZARDOUS MATERIALS A. The Contractor is responsible for compliance with any requirements regarding hazardous materials. If the Contractor encounters a hazardous material or substance not addressed in the construction documents, and if reasonable precautions will be inadequate to prevent foreseeable bodily injury or death to persons resulting from a material or substance, including but not limited to asbestos, lead, mercury, or PCB (polychlorinated biphenyl) encountered on the site by the Contractor, the Contractor shall, upon recognizing the condition, immediately stop work in the affected area and report the condition to the Owner and Architect in writing. B. Contractor shall not install any materials containing asbestos, lead, mercury or PCB. 1.10 MEANS AND METHODS A. Insofar as possible, the Contractor carrying on its work must employ such methods and means as to not cause any interruptions of or interference with the work of any other Contractor. Deliver, store, and handle products using means and methods that will prevent damage, deterioration, and loss, including theft and vandalism. Comply with manufacturer's written instructions. 1.11 WORKMANSHIP A. Install all products in accordance with the manufacturer's written instructions and recommendations, and the standards of recognized agencies and associations. 1. Provide all anchors, fasteners, and accessories required for a complete installation. 2. Allow for thermal expansion/ contraction and building movement. 3. Separate incompatible materials with suitable materials or spacing. 4. Prevent cathodic corrosion. 5. Protect aluminum surfaces from contact with masonry or other metals. 6. Provide control joints at materials and isolation joints between materials/structure as indicated and as required by manufacturer or recognized industry standards. B. Install products under appropriate environmental conditions (air temperature, surface temperature, relative humidity, etc.) To insure quality and durability, maintain proper protection during drying/curing. C. The Contractor’s duties shall also be applicable to all Sub- and Sub-subcontractors. The Contractor shall make appropriate provisions for this in all agreements with the Contractor’s Subcontractors D. The Contractor is expected to proceed in a neat, orderly and timely fashion according to the terms of his contract with the Owner. During construction the site must be kept neat and free from unnecessary debris. E. All electrical work shall be carried out by a licensed electrician. F. All plumbing work shall be carried out by a licensed plumber. G. If a portion of the Work is covered contrary to the Architect’s request or to requirements specifically expressed in the Contract Documents, it must, if requested in writing by the Architect, be uncovered for the Architect’s examination and be replaced at the Contractor’s expense. 1.12 INSURANCE A. All Contractors and all Subcontractors shall take out and maintain Workman's Compensation Insurance, and public liability and property damage insurance, acceptable to the Owner and the authorities having jurisdiction, B. The Owner, Architect, and its consultants shall be named as additional insureds on Contractor's policy of General Liability Insurance, with Owner, Architect, and consultants issued a full copy of said Insurance Policy from Prime Contractor(s). ***END OF SECTION 01 0000*** ALLOWANCES, UNIT PRICES & ALTERNATES STREAM Collaborative Page 1 of 1 U:\2018015 - 327 W. The Contractor shall include in the Contract Sum all allowances stated in the Contract Documents. Allowances shall cover the cost to the Contractor of materials and equipment delivered at the site and all required taxes. B. The costs for unloading and handling at the site, labor, installation costs, overhead, profit and other expenses shall be in the Contract Sum and not part of the Allowance. C. Whenever costs are more than or less than allowances, the Contract Sum shall be adjusted accordingly by Change Order. D. Allowances for this project include: 1. Ceramic tile (see Section 09 3000) 2. Resilient tile flooring (see Section 09 6519) 3. Tile carpeting (see Section 09 6813) 4. Toilet, bath and laundry accessories (see Section 10 2800) 5. Residential appliances (see Section 11 3100) 6. Casework (see Section 12 3200) 1.2 UNIT PRICES A. A Unit Price is a price per unit of measurement for materials, equipment or services or portion of Work, added to or deducted from Contract Sum by appropriate modification, if scope of Work or estimated quantities of Work required by Contract Documents are increased or decreased. Unit Prices include all necessary material, plus cost for delivery, installation, insurance, applicable taxes, overhead, and profit. B. Unit Prices for this project include: 1. Moisture control system and hydraulic cement underlayment over concrete slabs, per SF of area. 1.3 ALTERNATES A. An Alternate is amount proposed by Contractor to Owner for certain work defined in construction documents that may be added to or deducted from their contract amount if Owner decides to accept a corresponding change either in the amount of construction to be completed or in products, materials, equipment, systems or installation methods described in construction documents. All materials in this contract shall be new, without defects, and designed to function properly in the condition for which it is intended. 1. Salvaged or recycled materials may be used only if specifically called for in the construction documents, or if approved in writing by the Architect. B. Any covered product or material used shall comply with combustion/toxicity tests as found in the New York State Building Code and shall be listed by the Department of State Building Materials and Finishes Data File. 1. Products covered by such testing requirements include electrical conduit, electric wire insulation, any pipe, duct or thermal insulation and any interior finish or floor finish. C. Throughout these drawings and specifications particular products and assemblies have been called for (“Basis of Design”). It is the intent of these documents to describe a particular level of performance or quality of material, not necessarily (unless noted) a particular brand. In many cases Contractors may have experience and familiarity with different, but equivalent products, assemblies, or methods, the use of which would only benefit the project. The Owner strongly encourages proposals for substitution if it can be shown that such a substitution is equal in performance, quality and no more costly. It is the Owner’s intent to work as a team with the Contractor to identify and approve the most cost-effective, highest quality construction. The Contractor should feel free to propose substitutions that are equal in quality, dimension and performance (durability, fire resistance, moisture resistance, etc.), if such substitutions are more readily available, less expensive, easier to install, etc. If less expensive, Contractor shall offer credit to Owner for approval by Owner in consultation with Architect. 1. In general, the use of products containing volatile organic compounds (VOCs) or other chemicals known to cause harm to human health, either during manufacturing or use, and especially in the event of a fire, shall be avoided. Such products include, but are not limited to, vinyl, PVC, PCB, BPA, formaldehyde, etc. a. Refer to https://living-future.org/declare/declare-about/red-list/ for additional information. D. It is the Contractor's responsibility to select products which comply with the contract documents and which are compatible with one another, with existing work, and the products selected by other Contractors or Subcontractors. E. Submission of a substitution request by the Contractor, where permitted on the contract documents, shall constitute a representation by the Contractor that it: 1. has personally investigated the proposed substitute product and determined that it is equal or superior in all respects to that specified; 2. will provide the same warranty for the substitution that the Contractor would for that specified; 3. certifies that the cost data presented is complete and includes all related costs under this Contract except the Architect's redesign costs, and waives all claims for additional costs related to the substitution which subsequently become apparent; 4. will coordinate the installation of the accepted substitute, making such changes as may be required for the Work to be complete in all respects. 5. will reimburse the Owner for additional costs from claims by other Contractors resulting from incorporation of any requested substitution. 6. will reimburse Owner for additional costs billed by the Architect or its consultants for the review of the substitution request(s), any redesign of the Work of this Contractor or associated Contractors, additional site visits related to the substitution request and for the Work to prepare Change Directives or Change Orders. F.
