and the plans call for interrupting Sisson Place and placing a building where the roadway was,

WHEREAS, in order to reduce confusion about a non -continuous Sisson Place (east and west
portions with a building in the middle), Cornell University has requested to rename a portion of
Sisson Place within the City, as shown on the attached map, to Northcross Road, which would
be continuous with Northcross Road, now, therefore be it
RESOLVED, That this segment of Northcross Road (the eastern portion that was Sisson
Place) shall be considered the 100 block of Northcross Road.

It was good speaking with you when I came by the office on Friday to discuss this matter with you and ask about the

snow removal penalty levied on 2/12/19. The invoice number in connection with this is 25877. 1 mentioned that the
payment is due today so I am sending you this appeal now.
To the Board of Public Works
As I will show the members of the board of public works in person whenever you suggest I attend, the photo furnished by
Streets and Facilities indicates the presence of two -three inches of snow on the sidewalk in front of our house at 309 N.
Albany street on February 13. At the time (and still now) I was under strict instructions from my doctor and physical
therapist to do NO shoveling, as I had torn the meniscus in my left knee. I will furnish a copy of the medical letter in
connection with that. I had therefore established a standing arrangement to pay a neighbor (Francisco Valioy) to remove
all snow during each "plowable event." Since only a small amount of snow fell on the 12th, Francisco quite reasonably
concluded that this did not constitute a "plowable event." Let me add that the amount of snow in front of our house did not
create any risk or hardship to people using the sidewalk. We are among the only people on our block who regularly salt
the area in front of our house each time it is slippery. In addition to the fact that the amount of snow on the ground was
negligible, the surface was not the least bit slippery. On top of THAT, the code, as furnished to me by Ray Benjamin
states clearly "
The "no snow" standard set out in the City's statute is unreasonable and should be changed. The language of the statue
creates a context in which enforcement of the rule is arbitrary and capricious. It is as if, the Ithaca Police Department were
authorized to set a speed limit for cars everywhere in the City of Ithaca of 5 mph and then said "when we stopped and
ticketed you, you were clearly driving more than 5 mph. Do you dent that?" It would be true but not compelling. Any
reasonable person might say "yes, "that law is on the books but we all understand that it would be enforced only when
someone is clearly and/or repeatedly exceeding that limit."
Only one resident of N. Albany Street had shoveled that day but having checked with all the residents of the street I have
learned that the City only chose to plow the sidewalk in front of our house and ticket only us and one property owner on
Geneva street. 16 other tickets were issued elsewhere in the City that day. An eyewitness to the plowing undertaken by
the City (Sequioa Graf Valloy) observed that "it seemed weird that the City drove up onto the; sidewalk by your house --
actually dug up your garden space -- drove the plow along the sidewalk for a small stretch and then drove back onto the
road." This is highly problematic. Are we to assume that we got ticketed because of a yard sign we had up expressing a
certain political view? Was it due to the color scheme on the outside of our house? One would certainly hope it had
nothing to do with a mezzuzah on our house indicating it was a house owned by a Jewish family? A cross indicating a
Christian family? It is bad enough that with the tax burden that befalls us that the City does not plow the sidewalks. Until
such time as that changes, however, there has to be more of a "reasonable person" standard applied. Whatever standard
is applied it must be applied more consistently (at least on a given block). We would like you to write us and send us a
copy of the articulation of objective criteria used by Streets and Facilities to determine which property owners to ticket.
That might be difficult to do because we now understand that there is no such written policy; it is left to the discretion of
the crews. Moreover it appears that no training is provided to the crews at all in connection with this, so it is
understandable that the consistency or lack of consistency of enforcement might be of legal concern.
Had there been a foot of snow unshoveled that would be a different matter. For that matter, had their been six inches of
snow and it not been shoveled for days that too might be reasonable. Had their been three inches of ice that made it
impassable that might have been reasonable. To be ticketed, however, with no warning and when there was less than
three inches of snow on the ground, as evidenced in the photo supplied by the City itself, when it was not slippery at all, is
completely unreasonable. For a homeowner, especially a homeowner who might be infirm, aging, working two jobs, it
would essentially mean that we could not leave our house for a period of time longer than it might snow two inches. This,
too, is unreasonable.

Please write me back to confirm my understanding is that with receipt of this note you will delay and further action (or
escalating penalty) and remind me of the time and location I should come to present my appeal. I assume that is the third
floor meeting room in City Hall and I think you said April 16.

12A. Declaration of Review of the IAWWTP
Resolution
WHEREAS, the State Environmental Quality Review Act (SEQR) and the City of Ithaca
Environmental Quality Review Ordinance (CEQR), Section 176 of the City Code, require that a
lead agency be established for conducting environmental review of projects in accordance with
local and state environmental law, and

lead agency shall be that local agency which has primary responsibility for approving and
funding or carrying out the action, and I

agency for the environmental review of the IAWWTP Emergency Outfalls for Ice Jam
Response.
12B. Environmental Review for the IAWWTP
: 'Resowtion
'IMEREAS, the Board of Public Works has declared itself to be the lead agency for the
environmental review for a project ("the Project") entitled "IAWWTP Emergency Outfalls for Ice.
Jam Response" in accordance with Section 176 of the Ithaca City Code (CEQR) and in
accordance with Article 8 of the New York State Environmental Conservation Law (SEQR),
and
WHEREAS, the Project will include the construction of permanent piping to three emergency
outfalls located on Cascadilla Creek and three emergency outfalls located on Fall Creek forth(. -
sole purpose of releasing treated wastewater effluent from the IAWWTP at various locations
along the two creeks during ice jam conditions to melt the ice in the creeks and prevent
localized flooding, and
'ITMEREAS, the Project is an Unlisted action according to CEQR and an Unlisted Action
according to SEQR, and
WHEREAS, a Short Environmental Assessment Form was prepared by staff for CE--QR and for
SEQR, and
WHEREAS, on April 16, 2019, the Board of Public Works declared itself lead agency for ar
uncoordinated environmental review for CEQR/SEQR, and
WHEREAS, the Board of Public Works, acting as lead agency, has, on April 16, 2019,
reviewed and accepted as complete the Short Environmental Assessment Forms Part I and
Part 11 prepared by staff, now therefore be it
RESOLVED, That the Board of Public Works determines that the project to construct six
emergency outfalls from the IAWWTP for the purpose of melting ice jams in Cascadilla and
Fall Creeks will result in no significant negative environmental impact and that a Negative

Install six emergency outfalls for fully -treated effluent for use during ice jam conditions on Fall Creek and Cascadilla Creek within the City of Ithaca

City of Ithaca, three locations each on Cascadilla and Fall Creeks, map attached
Brief Description of Proposed Action:
The downstream segments of Cascadilla Creek and Fall Creek occasionally freeze during periods of extreme and/or prolonged cold. Ice jams tend to
form under bridges, and the resulting flow restrictions lead to localized flooding of residential,
commercial, and institutional properties (including the
Ithaca High School). The City's Department of Public Works has successfully mitigated the ice jams and flooding by spraying fully -treated and
dechlorinated effluent from the Ithaca Area Wastewater Treatment Plant (IAWWTP) onto the surface of the streams. This action has been
accomplished by obtaining emergency NYSDEC approval, renting pumps, and running fire hoses to direct flow to the streams. The City is applying for a
modification to the IAWWTP State Pollution Discharge Elimination System (SPDES) permit to install permanent infrastructure improvements- piping
and hydrants. The proposed improvements will allow the City to reduce the risk of ice jam emergencies in
a proactive manner when extreme winter
conditions develop. All required construction will be completed under the City of Ithaca's standing permit to maintain water and wastewater
infrastructure.

Know for 2019 the rates are : water-$7.88/unit, sewer- $5.80/unit and your storm water charge will be $14.25.
Historically, for our water/sewer billing, for consumptions less than 12, residents are charged the yearly minimum bill.
This pays for necessary maintenance, water and sewer services and the convenience of having water at the tap when
you want to wash laundry, dishes or shower. For consumptions over 12, the formula is consumption x rate + storm
water fee.
City processes are determined by governing boards. For utility processes the Board of Public Works has the authority
to make change, then Common Council gives final approval. If you desire to see change in our billing process, I
recommend you have that discussion with a BPW member or your Common Council rep(s).
In the meantime, let me know if you have further questions about your bills.
