I. Call to Order
Vice‐Chairperson Schlather called the meeting to order at 8:37 A.M.
II. Agenda Additions/Deletions
Cummings suggested adding brief updates to the agenda regarding: the 402 S. Cayuga Street
project; the IURA enrolling in the Greater Tompkins County Municipal Health Insurance
Consortium; and the $1M in approved bond funding for the IURA that she has mentioned at prior
meetings. No objections were raised.
III. Public Comments (3‐minute maximum per person) ― None.
IV. Review of Meeting Minutes: December 15, 2017
Cummings moved, seconded by Whitmore, to approve the December 15, 2017 meeting minutes,
with one minor modification. Carried Unanimously 4‐0
V. Old Business
A. Assessment of Fair Housing (AFH) Update
Bohn reported the AFH was approved by HUD; however, HUD has now delayed implementation of
the entire AFH initiative for five years. Nonetheless, since the IURA’s AFH was approved, it is
mandated to work towards the goals it established.
VI. New Business
A. Authorized Signers on IURA Bank Accounts
Bohn noted the former City Deputy Director for Economic Development retired, so the authorized
signers list needs to be updated with the City’s Deputy Director for Planning and Development.

B. Procurement of Independent Contractors
Schlather asked if there is any particular rationale for the increases in attorneys’ fees. Bohn
replied, attorneys typically increase their fees in increments of five dollars an hour; but there is no
other particular benchmark or rationale he is aware of. He added this is the last year an extension
to the original RFP can be made, so next year the IURA will need to issue a new RFP. The reason
the IURA contracts with three attorneys is that there can be occasional conflicts of interest. Some
attorneys also have expertise in certain areas, which others lack. Having three attorneys also
helps ensure the IURA has the capacity to process multiple contracts at one time, on a timely
basis.
Cummings remarked she would strongly encourage the IURA to look for new attorneys, who
charge less. Also, she does not support approving the Mariette Geldenhuys resolution, due to a
problem she remembers encountering that adversely affected the IURA.

2018 Procurement of Independent Legal Services: Geldenhuys
WHEREAS, the contract for independent legal services with Mariette Geldenhuys, Attorney‐at‐
Law (Geldenhuys) expires on February 28, 2018, and
WHEREAS, in accordance with IURA procurement policy and regulations contained in 24 CFR
§85.36, the IURA selected Geldenhuys through a Request for Proposals (RFP) selection process
in 2015, and
WHEREAS, whereas per applicable procurement regulations, a contractor selected through an
initial competitive selection process may be renewed for up to three additional one‐year terms
without undertaking a new competitive selection process, and
WHEREAS, a proposed 2018 contract would constitute the third one‐year extension of the
base independent consultant contract, and
WHEREAS, Geldenhuys submitted a proposal on January 31, 2018 to continue providing
legal services to the IURA at a maximum billing rate of $215 per hour, a 2.3% increase from
the current contract rate, and
WHEREAS, the IURA staff is highly satisfied with the quality of legal services provided by
Geldenhuys, and
WHEREAS, the 2018 IURA budget recommended a total authorized contract amount of
$12,000 for legal services; now, therefore, be it

RESOLVED, that IURA Chair is hereby authorized, upon review of IURA legal counsel, to execute
a contract extension for independent contractor legal services with Mariette Geldenhuys,
Attorney and Mediator, at a maximum hourly rate of $215 per hour with the total amount not
to exceed $12,000, and be it further
RESOLVED, that the source of such funds for legal services shall be derived from a variety of
funding sources, including, but not limited to, CDBG and HOME funds, and expenses shall be
billed to the appropriate source of funds for which the services were performed.

Law, at Levene Gouldin & Thompson, LLP (Ruswick) expires on February 28, 2018, and
WHEREAS, in accordance with IURA procurement policy and regulations contained in 24 CFR
§85.36, the IURA selected Ruswick through a Request for Proposals (RFP) selection process in
2015, and
WHEREAS, whereas per applicable procurement regulations, a contractor selected through an
initial competitive selection process may be renewed for up to three additional one‐year terms
without undertaking a new competitive selection process, and
WHEREAS, a proposed 2018 contract would constitute the third one‐year extension of the
base independent consultant contract, and
WHEREAS, Ruswick submitted a proposal on February 5, 2018 to continue providing legal
services to the IURA at a maximum billing rate of $195 per hour, a 2.6% increase from the
current contract rate, and
WHEREAS, the IURA staff is highly satisfied with the quality of legal services provided by
Ruswick, and
WHEREAS, the 2018 IURA budget recommended a total authorized contract amount of
$4,000 for legal services; now, therefore, be it

in 2015, and
WHEREAS, whereas per applicable procurement regulations, a contractor selected through an
initial competitive selection process may be renewed for up to three additional one‐year terms
without undertaking a new competitive selection process, and
WHEREAS, a proposed 2018 contract would constitute the third one‐year extension of the
base independent consultant contract, and
WHEREAS, Sulimowicz submitted a proposal on January 24, 2018 to continue providing
legal services to the IURA at a maximum billing rate of $175 per hour, a 0% increase from

Sulimowicz, Attorney‐at‐Law, at a maximum hourly rate of $175 per hour with the total

2. Community Development Services

2018 Procurement of Independent Consultant Services: H. Sicherman & Co., Inc.
WHEREAS, the contract for independent professional consulting services with H. Sicherman &
Co., Inc. (“Sicherman”) expired on February 28, 2018, and
WHEREAS, in accordance with IURA procurement policy and regulations contained in 24 CFR
§85.36, the IURA selected Sicherman through a Request for Proposals (RFP) selection process in
2015 to provide technical assistance for development, administration and implementation of
the IURA community development program, including loan underwriting, and
WHEREAS, whereas per applicable procurement regulations, a contractor selected through an
initial competitive selection process may be renewed for up to three additional one‐year terms
without undertaking a new competitive selection process, and
WHEREAS, a proposed 2018 contract would constitute the third one‐year extension of the base
independent consultant contract, and
WHEREAS, Sicherman submitted a proposal on January 25, 2018 to continue providing
community development consulting services to the IURA at a maximum billing rate of $181 per
hour, a 3.4 % increase from the current contract rate, and
WHEREAS, loan underwriting services of Ms. Elizabeth Kraus of Sicherman are offered at a rate
of $145 per hour, a 4.1% change from the 2016 rate of $139 per hour that remained unchanged
in 2017, and
WHEREAS, the IURA staff is highly satisfied with the quality of services provided by Sicherman,
and
WHEREAS, the 2018 IURA budget recommended a total authorized contract amount of $10,000
for community development consulting services; now, therefore, be it
RESOLVED, that IURA Chair is hereby authorized, upon review of IURA legal counsel, to execute
a contract extension for independent contractor community development services with H.
Sicherman & Co., Inc. at a maximum hourly rate of $181 per hour with the total amount not to
exceed $10,000, and be it further

C. 2016 HUD Consolidated Annual Performance Evaluation Report (CAPER) Review
Bohn explained the CAPER is an annual report that is submitted to HUD in a format HUD requires;
and it is primarily based on the data contained HUD’s online Integrated Disbursement and
Information System (IDIS). Bohn stressed the CAPER only reports on past outcomes, and not
outcomes for projects that may be in development, or are under construction. It measures
outcomes within the context of the IURA’s five‐year Consolidated Plan goals. Needless to say, the
IURA has been operating on significantly less HUD funding than it anticipated receiving five year
ago, which explains a handful of areas in which the IURA falls short. In addition, the outcome for
creating rental housing units has fallen short: the IURA originally assumed it was going to fund 14
units for the Magnolia House project, but the project sponsor subsequently declined the funding.
D. HUD 2016 Annual Community Assessment (ACA) Review
Bohn explained that the ACA is essentially a HUD desk‐monitoring report, which identified no
substantive concerns in 2016. HUD did note, once again, that the IURA needs to report Program
Income in a timely manner. Last year, IURA staff had been reporting Program Income on a
quarterly basis; but in response to HUD comments, has been doing that monthly. (Bohn is not
sure why HUD mentioned the issue again, since he believes the IURA already met that standard.)
VII. Other Business
A. Review of IURA Financials Report: January 2018
Bohn explained that all projects listed in the Grants Summary are generally progressing well. The
two City of Ithaca projects (Wading Pool Renovation Project and Spencer Road Sidewalks Project)
represent large amounts of unexpended money, but they should both be completed by July 1st,
2018. There are also two projects for which the project sponsors declined IURA funding: Ithaca
ReUse Expansion and 402 S. Cayuga Street. Habitat for Humanity withdrew from the 402 S.
Cayuga Street project, after analyzing the site and determining it would not be able to make it
financially and operationally viable. Ithaca Neighborhood Housing Services (INHS) subsequently
expressed interest in the site and believes it has identified a workable model for affordable
housing on the site.
B. CDBG Timely Expenditure Analysis Report
Bohn reported that he created the following spreadsheet to roughly illustrate IURA funds that
need to be spent by a certain time, to conform to HUD requirements:

Bohn reported that the IURA’s 2017 annual financial audit was recently completed and it appears
no significant issues were raised.

Bohn reported that Greater Tompkins County Municipal Health Insurance Consortium Executive
Director Don Barber expressed support for the IURA enrolling in the consortium, but special
legislation would need to be passed by the State legislature before that could take place. The
IURA is still waiting for draft legislation from the County in order to proceed.
