ELECTION OF CHAIRMAN The Chairman suggested that the first order of business sould Ue"The election of a chairman, and stated that due to- personal reasons he preferred to be relieved of the Chairmanship. . Commissioner Osborn expressed the opinion that the present chairman should be continued and it was moved by Corfycissioner Osborn; seconded by Commissioner Metzger Resolved, that bar. kontillon be nominated for the position. Thare being; no further nomination a vote was taken and Mr, Montillon was declared duly elocted chairman for the ansuing year, ZONING ORDINANCE The Chairman reported that the conference on t'te 15roposea Few 2oning Ordinance has not been held and it was moves. By Commissioner Geherin; seconded by Comr,.issioner Osborn Resolved, that the chairman be directed to write the Iiayor and re- quest that the City Attorney be urged to review the ordinanc,, with Mr. Thorne and be prepared to make dofinite recommendations to t'-0 : Commission at a Meeting to be held at 4 P,M. TOPICS- FOR DISCUSSION Chairman Montillon called attention to a num- ber or wor w e pro ects which might Well be studied by the Com- mission such as traffic routes around and through the- city, play- grounds, swimming pools and various other improvement;, and he ap- pointed Commissioners Metzger and Ward a committee to organize a pro- gram of discussion and study. WEST HILL DEVELOPMENT Attention was called to the program of the eve oF501 o p West Hill Section as prepared by Mr. N.H .Schick- ol and it was agreed that ho should be given an onporttnity to pre- sent the program to the Commission. ZONING ORDINANCE Attorney Powers presented a revised draft of the proposed zoning Ordinance and explained that it was a combination of the Ordinance that he had drafted in 1939 and the one prepared by Bldg. Commissioner Thorne more recently* After thoroughly discussing the revised Ordinance, it was agreed that copies should be prepared and further study made at the naxt meeting. Treman expresled the opinion that Municipal proportyp school:., churches, and similar property should be given a separate classifi- cation and it was moved By Comm.- Treman; seconded by Comm, Metzger Resolved, that the Attorney and Bldg. Comm* requested to study the ' idea of giving such properties a special category under the proposed ordinance and maps, Carried. PROPOSED AMENDMENX TO ZONING MAP Attorney Powers reported that the . s Fas pure ase e PaIrgrounds and that the grounds will pro- bably be used for oxperimental and semi-commercial purposes and that it hap been suggested that the section east of Meadow Ste opposite the Fairgrounds be made a commercial district also. ADOPTION OF ORDINANCE Mr. Powers stated that due to the sudden ending or the war at- the need for the new ordinance has increased and he rocommendel that, Articles II,III,X,XI,XII,XIII and XIV of the ordinance be referred to the Charter and Ordinance Committee of the Common Council at once, in ordor. that the completed ordinance and map may be submitted to the Council at the earliest possible date B y Comms Parryl seconded by Comm* Metzger Resolved, that the recommendation of the Attorney be approvod, and the above numbered articles referred to the Charter and Ordinance Committee$ Carried. ZONING MAP The proposed Zoning Map was also presented and reviewed., and on�Officer Thorne explained the proposed changes made to bring the map in agreement with the ordinance. ADJOURNW6NT It was agreed that in order to get the ordinance in shape for approval at the next regular meeting to be hold on Sept. 21st, that this meeting should be adjourned to 4 P.M. REPORT OF C TER & ORDINANCE COMMITTM Commissioner Perry reported at the Charter & Urdinence Gomm, nye with Attorney Pow6rs and review- ed the 'articles of the proposed Zoning, Ordinance which were referred to that Committee, and that with a fere minor changes the articles were approved and will be recommended to the Common Council for its approta7 when presented to that Board By Commissioner Osborn; seconded by Comm• Goherin Resolved, that the report be accepted and approved. C%rried. Commissioner Treman entered at this time. ZONE MAP Mr. Thorne presented the new Zoning Map for discussion, and he suggested that areas occupied by churches, educational institutions parks and other municipal property carry the same classification as that of adjoining property. Commissioner Troman again expressed the opinion that a separate class; ' cation alou d be established for educational insitutions and municipal property, and after discussion it was suggested that a special committee be appointed who with the City Attorney would make a study of the mattez and make recommendations. The an appointed Commissioners Osborn, Metzger and Troman to the C om mi 6• DEFINITTIONS Commissioner Troman called attention to the need of specia_ care n: thc preparation and approval of definitions in connection with tho now Ordinance and he cited recent cases where exceptions from the present ordinance haVe been requested, and since the old ordinance is no+ specific as to definitions of business and professions it is diff icult for the Board of Zoning Appeals to make decisions on such rdquest#, Since - only a part of the definitions have been prepared it was agreed that the Attorney and Zoning Officer be requested to complete the list for presentation at the next meeting. 'R!OF COMMERCE PARTICIPATION IN PLANNING Chairman Montillon cal1c.r attention o Erie Focont action of the CEFREFF of Commerce in regard to local planning and stated that if thare was no objection he would invit, representatives of the Chamber to attend future meetings and participate in the Boards deliberations. FUTURE MEETINGS Attentionvas called to the considerable amount of work neeess a oro the new Zoning Ordinance can be -submitted to the Coun•- cil and 'it *as agreed to hold meetings at 4 P.M. on Sept. 13th and 28t1t 1945, and eliminate the regularly scheduled meeting on .the third Friday of Septo,mber.. Comro Commissioner Treman argued for no zoning, or perimeter zoning only, for the Cornell Campus and for City properties. Chuscr and minor educational properties were omitted from the discus cion. Following Mr, Powers' entrance there was general discussion o-f these and related problems, Mr, Powers said that the Airport s should be left unclassified and sub je et to control by the Board of Public Works. It was suggested,, and there was gene al agreement that the Tabor Street "Island" be included in tho Industrial District, making the Inlet the west boundary of same as far south as the City Lino., Com+r, Treman, sketched a map embodying his conception of the Committee's recommendations for these special Zoning cases,, and filed same as part. of this Report, City Attorney Powers drafted the following proposed addition to the pending Ordinance,, andaiso filed same as a part of this Report: 'R L (Number to be assignod). Insure better cooperation between the Planning Commission and the Boar. of Zoning Appeals by appointing to the Board persons familiar with City Administration and he specifically recommended the appointment of- two mombors from the Planning Commission, one from the Common Council., ono from the Board of Public Works and two from the City at largo.
