PLANNING BOARD LIT: RATURF Chairman Montillon reported that he has requestea Me State PlaiMing Commission to forward to each member of this Board a copy of the pamphlet on local planning and zoning procedure written by Harold M. Lewis, Consultant, Ywt BZR4hIP - N.Y.S. F.,�r;D.ERATION PLANA;ING BOARDS A letter from the Viae-President of the M.S. Federation o Official Planning Boards was presented inviting the local Planning Co�ar-ission to renew its membership in the Federation for the year 1942. `1'he Commissioners expressed the opinion that the publication E issued by the Federation provides considerable material of use to this Board and it was moved By Cori:missioner hopper, seconded by Commissioner Geherin: Resolved, that the Common Council be requested to approYe the bill for ,14,10.00 for the membership. Carried. UTITIT.ION FOR ZONA; CHANGE - W. SAN CA STR;"T The Clerk reported that a petition signed by R persons representing.more than 50/o of the property owners within a 300 foot radius of premises known as 402 r4. Seneca Street and 202 N. Plain Street, requesting a chane of zoning from B Residential -to Commercial, was presented to the gommon Council who referred the petition to the Planning Commissioner for study and recommendation, The Commissionersconsidered the petition and agreed that since the south side of Vv. Seneca Street is-now in the commercial zone, that the entire section from Leadow Street to the present Commercial zone near Cayu a Street should be made Ccmmercial. By Commissioner Treman, seconded by Commissioner Perry: Resolved, that this Planning Commission recommend to the Comion Council that the area on the north side of W. Seneca Street running from :I.eadow Street or, the west to the existing Commercial zone on the east near Cayuga Street, be changed to Commercial zone, such area beim; bounded on the north between 11eadow and Geneva Streets by a line c half way between beneca and Buffalo otreets� and east of Geneva street by the existing north property lines,,,of the premises fronting on the north side of 16. Seneca Street. Carried. ZO2dJ; I-;AP Chairman Kontillon stated t:zat while the Zone K-ap was the ite of immediate consideration, he felt that long range planninE should be considered with the zone study. Wayor Comfort expressed the opinion that there is a need for a Planning Co-trAssion in the City and he pledged his full cooperatio. Among sug; ested activities for the Commission he mentioned the need of the enlargement of the airport and the possible revision, of the rules governing the acceptance by the City of subdivisions. April 24, 1942 PRESENT Mayor - Comfort Chairman Montillon Commissioners - Geherin, Perry, Treman Acting Engineer-Supt, of Public Works - Cass Deputy City Clerk - Blean MINUTES Minutes of the preceding meeting were duly approved. AIRPORT Discussion centered around the possibility of enlarging and n improving the airport. Mayor Comfort commented on his efforts to obtain federal aid in this respect while Mr. Cass visioned the extension of the airport to the north for about 1000v into the lake if funds could be secured for dredging as a flood control project. By Commissioner Treman, seconded by Commissioner Perry: Resolved, that the Chairman be authorizedtoconfer with the Mayor and Chairman of the Buildings & Grounds Oommittee of the Board of Public Works to ascertain by what means the Planning Commission can serve best in the future developement of the airport. Carried. ZONE CHANGES X ' Commissioner Treman, seconded by Commissioner Geherin; Resolved, that the Planning Commission recommend to the Common Council that the east side of the block bounded by Marshall, Farm, Cayuga and Utica Streets extending to a line running along the rear of the Cayuga Street lots be changed from a "B" to an "A" residence district; and further that the block bounded by Utica Marshall, Tioga and Farm Streets be changed from a "B" to an "A residence district, Carried. By Commissioner Treman, seconded by Commissioner Perry: Resolved, that the Planning Commission recommend to the Common Council that the present "B" district on the east side of Linn Street between University Avenue and Marshall Street and that the present "B" district on the west side of Linn Street between King and Yates Streets be changed to "A" residence districts;and further that the area bounded by Lincoln, Linn and Queen Streets and a line about 1131 east of Aurora Street which is a commercial district at present$ be changed to an residence district. Carried, By Commissioner Treman, seconded by* Commissioner Geherin: Resolved, that the Planning Commission recommend to the Common Council that the south side of E. State Street from Schuyler Place extended on the west to Quarry Street on the east and Six Mile Creek on the south be changed from an "A" to a "B" residence district. Carried. October 29, 1942 PRESENT Chairman - Montillon Commissioners - Geherin, Perry, Hopper, Mitchell Zoning Officer - Thorne Clerk - Springer MINUTES Minutes of the meeting held April 24, 1942 were duly approved. ZONE CHANGE - W. SENECA STREET The Clerk reported that the Common Councll held a gub is eating on May 6, 1942 on the proposed change ' in zoning from 'B" residential to commercial of the north side of W. Seneca Street from Meadow Street on the west to the existing commercial zone on the east near Cayuga Street. He further reported that a petition signed by 12 residents of the district was presented requesting the Council to refrain from making the change and after hearing persons who were present, the Council referred the matter back to the Planning Commission for further study and recommendation. After discussion, Chairman 11ontillon appointed Commissioners Perry and Hopper, and Acting City Engineer Cass a committee to study the section and report at the next meeting. PIeANNING POST-WAR WORK The Chairman reported receipt of a communica- tion from the ommiss over of the State Division of Planning calling attention to the importance of planning at this time for post-War work. The letter stated that the State Planning Commission has recommended a program whereby the State will participate with municipalities on a 50-50 basis in the work. The Chairman was authorized to inform the State Commission that this Board favorscooperation with the State Department and is cooper- ating with the Board of Public Works on plans for post-Viar work and that a report of actual progress will be submitted at a later date. SPECIAL ORDER OF BUSINESS NEXT MEETIATG By Commissioner Perry, seconded by Commissioner TAitchell: resolved, that the special order of -business at the next meeting be the resumption of work on the zoning map and a, review of work already accomplished. Carried. MEETING DATES The Commissioners agreed that in order to expedite the woorr on the zoning map, meetings should be held twice each month, and it was agreed that meetings should be of not to exceed one hour duration beginning at 2:00 P.M. , and the following dates were agreed upon for meetings during November and Decembers November 5 - 19, December 3 - 17. November 5, 1942 PRESENT Mayor - Comfort Chairman - Montillon Commissioners « Hopper, Mitchell, Geherin Zoning Officer - Thorne Acting City Engr.-Supt. of Public Works - Cass Clerk - Springer MINUTES Minutes of the preceding meeting were duly approved. F - 'RAL HOME - 125 W. GREEN STREET A petition signed by John F. Bangs was presented request ng the Council and/or the Planning Commission to clarify the zoning laws in regard to the establish- ment of a funeral home, or grant permission to establish such a business in the address shown above. Attorney Adams appeared for Mr. Bangs and stated that the zoning ordinance is not clelar in regard to such regulations, and that the block in question is divided into "A" and "B" residential and commercial districts. The Clerk reported that the petition was presented to the Common Council at a meeting held November 4th and that the Council referred the matter to the Planning Commission for study and recommendation. After discussion the Commissioners agreed that nothing in the zoning ordinance prohibits the establishment of a funeral home in that district and it was moved, By Commissioner Geherin, seconded by Commissioner Mitchell: Whereas, this Board finds no prohibition against the establish- ment of a funeral home in a "B" residential district. Now Therefore Be It Resolved, that this Board recommend to the Common Council that permission be granted Mr. Bangs to establish a funeral home as requested. Unanimously Carried. ZONE CHANGE - W. SENECA STREET Acting City Engineer Cass reporting r for the Gonimittee appointed at the meeting held October 29, 1942, stated that the section on the north side of W. Seneca Street be- tween Meadow Street and the existing commercial zone near Cayuga. Street consists mainly of residences and apartments and that only F three non-conforming uses exist in the section and that the present _ PSB" classification seems proper. Commissioner Hopper expressed the opinion, to which the Commissioners present and Commissioner Perry who was contacted by phone, that . the two blocks from Meadow Street on the west to Plain . Street on the east should be changed from "B" residential to commercial, and it was moved, By Commissioner Mitchell, seconded by Commissioner. Geherin: Resolved, that the report of the Committee be accepted, and Be It Further Resolved, that this Board recommend to the Common Council that the area on the north side of tib. Seneca Street running from Meadow Street on the west to Plain Street on the east, be changed from "B" residential to commercial zone, such area being bounded .on the north by a line one-half way between Seneca and Buffalo Streets. Carried, ZONE STUDY The Commissioners reviewed the changes already agreed upon in-zoning and Zoning Officer Thorne agreed to present an idea for zoning at the next meeting of the Board. November 19, 1942 PRESENT Chairman - Montillon Commissioners - Dillon, Geherin, Hopper, Mitchell Zoning Officer Thorne Acting- City Engr.-Supt. of Public Works - Cass City Clerk- Springer MINUTES Minutes of the preceding meeting were duly approved. ZONE MAP Zoning Officer Thorne presented a new idea of zoning which- w771d which- w77provide for "A", `cB't and. "GA resido.ntial districts and the Zone Map which has been partially completed, indicated his idea of the proper boundaries of these zones as well as the revision of the present business and industrial zones. Mr. Thorne explained that due to the limited time since the last meeting, the map was not completes but after extensive question- ing, the Commissioners were convinced that the idea was good and presented an opportunity to modernize and simplify the administration of the zoning ordinance, and it was moved By Commissioner Mitchell, seconded by Commissioner Hopper: Resolved, that Mr. Thorne be thanked for his efforts in prepar- ing the map and requested to complete the study and present the completed map with recommendations at the next meeting of the Commission. Commissioner Thorne presented copies of a drafE o a proposed ordinance and a zoning map indicat- ing his ideas for zone classification. He explained that his ideas are not new and have been worked out over a considerable period of time . After questioning Mr. Thorne on many points in the ordinance, the Commissioners were agreed that with minor additions it pre- sented an up to date zoning ordinance, and it was moved By Commissioner Treman, seconded by Commissioner Mitchell, Resolved, that the Bldg. Commissioner be requested to confer with City Attorney Powers on the ordinance and map and report at the next meeting of the Board, and Be It Further Resolved, that the Commissioners study the draft of the ordinance and be prepared to offer suggestions at the next meeting.
