M- January 30, 1941 PRESENT Tharman Montillon Commissioners - Perry, Treman, Dillon City Engr.--Acting Supt. .of Public Works - Marble Clerk - Springer Bldg. Commissioner - Thorne MINUTES Minutes of the preceding meeting were duly approved. CHAIRMAN - 1.941 Chairman Montillon called attention to the fact hat -it Isthp custom at the first meeting of the year to elect a Qhairman for the ensuing year. By Commissioner Treman, seconded by Commissioner Perry: Resolved, that the Secretary be directed to cast one ballot for Commissioner Montillon for Chairman. Carried. The ballot being cast, Mr. Montillon was declared duly elected. CAYUGAMBER CO. E LOPMENT - WE§T HILL Engineer .Sarble reported at the request of the Cayuga Lumber Co. for permission to increase the width of lots in the development on West Hill was referred to the Board of Public Works who approved the request provided the Cayuga Lumber Co. will install street monuments and furnish a plan showing the location of such monuments. f By Commissioner Perry, seconded by Commissioner Treman: Resolved, that the report of the City Engineer be accepted and the plans approved as agreed on by the Board of Public Works. Carried. COMMITTEE ON ZONING Chairman Montillcn reported that Mr. Treman haa previously expressed willingness to serve as Chairman of the committee to study the revision of the zoning ordinance and zoning map and as no record was shown in the minutes he formally appointed a committee •of three as follows: Chairman A. H. Treman, Commissioners William A. Dillon and J. F. Geherin. ANNUAL REPORT The Chairman submitted copies of the annual report of the activities of the Planning Commission for the year 1940 whish is to be submitted to the Common Council and he requested the Commissioners to make further suggestions in regard to the re- port, By Commissioner Perry, seconded by Commissioner Dillon: Resolved, that the report as submitted be accepted and that the Chairman together with other members of the Commission present the report in person at the next meeting of the Council. Carried. STUDY OF ZONING ORDINANCE AND MAP It was agreed that if the ommon Council desires the Planming Commission to study and make -recommendations on the proposed new zoning ordinance that the Council should make such a request. ZONING Y.# Enlarged copies of the present zoning map were pre- sented an Commissioner Treman suggested that the City be divided in sections and each section studied by committees and that a certain section be studied and reported on at each meeting. City Engineer ]garble agreed to make a division of the City and advise the approximate time which will be required to make the entire survey. By Commissioner Treman, seconded by Commissioner Dillon: Resolved, that the Chairman lay out a program for study over the next few months, for all sections -of the City. Carried It was agreed that a section of the proposed zoning ordinance Should be studied at each meeting of the Commission rather than to undertake the study of the whole ordinance at one time. February 25, 1941 PRESENT Chairman - Montillon Commissioners - Bishop, Mitchell, Treman, Geherin City Engr.-Acting Supt. of Public Works - Marble Forester - Baker { Clerk - Springer MINUTES Minutes of the preceding meeting were 'duly approved. Chairman Montillon announced that the annual report of the Planning Commission was presented to the Common Council as directed, and that the Council accepted the report and ordered it filed. He also reported that the Council requested the Planning Commission to study the proposed new zoning ordinance and be pre- pared to make recommendations at the June meeting of the Council. ZONING ORDINANCE Engineer Marble presented a plan for dividing The City into districts to facilitate the study 'of zoning and suggested that the City be divided into five sections as shown be- low, and he estimated that each district would require from two to three hours time to cover: Area, west of Fulton Street. Area, Fulton Street to Cayuga Street. Area, Cayuga Street to Linn Street. Area, East Hill Area, Cornell Heights By Commissioner Treman, seconded by Commissioner Geherin: Resolved, that the recommendations of the City Engineer be adopted. Carried. REPORT ON BRIDGES For the information of the Commissioners, Engineer Marble presented a map of the City on which all bridges have been located showing the posted capacity of each bridge. Chairman Montillon recommended that as soon as weather permits, the committee should start the study of each section as agreed upon. Articles 1, 2, 3 and 4 of the new zoning ordinance were studied and various suggested changes were noted. On motion the meeting was adjourned to rec nvene at the call of the Chairman. 5 F. April 19, 1941 PRESENT Mayor - Campbell Chairman - Montillon, presiding Commissioners - Bishop, Treman, Dillon, Geherin City Engr.-Acting Supt. of Public Works - Marble Clerk - Springer MINUTES Minutes of the preceding meeting were duly approved. RELATIONS WITH LOCAL DEFENSE COMMITTEE Chairman Montillon pre- sented a letter received from the Division of State Planning call- ing attention to the fact that local Planning Oommissiorshave an opportunity to cooperate with local Defense Councils. He stated that Ralph Smith, Secretary of the local Defense Council, has suggested that a member of the Planning Commission be designated to attend Defense Committee meetings. E By Commissioner Treman, seconded by Commissioner Bishop: Resolved, that Chairman Montillon be authorized to attend Defense Committee meetings as a representative of the Planning Commission, and if unable to attend to appoint another member from the Commission. Carried. RESTRICTIONS ON GAS STATIONS The Chairman called attention to the fact that there is nothing in the proposed new ordinance relative to the restrictions on gars stationsi MEETING AND INSPECTION DATES The following dates for meetings and inspection trips were agreed upon: Meetings - 4: 30 P.M. Inspection Trips - 4: 30 P.L . May 2, 16, 29 April 25, May 9, 23, June 6 ZONING ORDINANCE Article V of the Zoning Ordinance was studied and changes were noted. Commissioner - Thorne Deputy Clerk - Blean MINUTES Minutes of the preceding meeting were duly approved. INSPECTION TRIP Chairman Montillon reported on an 'inspection trip made with Engineer Marble with respect to nonconforming uses. By Commissioner Dillon, seconded by Commissioner Bishop: Resolved, that future inspection trips for the study of non-, conforming uses be left to Chairman 1.4ontillon and Engineer Marble. Carried. ZONE CHANGE Zoning Officer Thorne reported that the Board of Zoning Appeals had received a request for a zone change in the blocks bounded by S. Meadow, South, S. Plain Street and the City line, and had referred it to the Planning Commission .for recommendation. The request was to divide this area by a line from South Street southerly to the City line and .Hake the westerly section a commercial zone. By Commissioner Dillon, seconded by Commissioner Geherin: ' Resolved, that the request be referred to Chairman Montillon and Engineer Marble as a committee to investigate and report at the next meeting. Carried. ZONING ORDINANCE Article VI of the Zoning Ordinance studied and changes noted. On motion the meeting was adjourned to reconvene at 4:30 P-11- may .D4.May 16, 1941. Geo. A. INSPECTION TRIP Chairman Montillon reported that the Chairman and Engineer Marble have made inspection trips and a report will be made at a later date. ZONE CHANGE Chairman Montillon reported that the request for a zone change in the block bounded by S. Meadow, South, and S. Plain Streets and the City line was investigated by the Chairman and Engineer Marble and they recommend that no change in zoning be made inthis section. By Commissioner Perry, seconded by' Commissioner Bishop: Resolved, that the report be accepted and 'approved and that the request for change in zoning be denied. Carried. ZONING ORDINANCE Study of Article VI and VII of the new zoning ordinance was continued and changes noted. On motion the meeting was adjourned to 4: 30 P.M. CAYUGA LAND CO. MAP The revised map of the Cayuga Land Co. de- velopment on west Hill was presented and it was explained that all required monuments have been installed and are shown on the map. By Commissioner Dillon, seconded by Commissioner Geherin: Resolved, that the map as presented be approved and a copy placed on file in the City Clerk's office. Carried. REPORT ON STUDY OF NL7 ZONING ORDINANCE The following report as prepared by Chairman Montillon on the progress of the study of the ner: zoning ordinance was presented: "May 29, 1941 °Ta the Mayor and Common Council Gentlemen: On February 5th last, the Co:mr�on Council approved the then I current study of the Planning Commission of the tentative draft of the revised zoning ordinance and requested the Planing Commis- sion to continue the study and to report to the Council_ concerning the same at their June meeting. 'i The Planning Commission now reports as requested. During the past four months the Planning Commission has held fequent meetings, has given detailed study to the ordinance and f rias compared the tentative draft with the existing ordinance and *v:-th certain reference work on zoning. This study has resulted in a critical memorandum of some _ ,ngth. At the request of the Commission, the City Engineer and the 1hairman have been searching the City for non-confori.ing uses, �i�ecking and bringing up to date a, list of these exceptions, �zd observing certain existing zone boundaries. It has not been possible to date to complete either of these undertakings. The Commission, therefore, at this time, submits to the Council a report of substantial progress in this study of the zoning ordinance and zone map and aaks that the Council, later, presumably in. the aiitumn, receive from the Commission a report on the completed study. MEETING DATES It was agreed to hold meetings on the 13th and 27''1 of June at : 30 P.M. to continue the study of the zoning ordinance ZONING ORDIWANCE Article VI covering the commercial districts ab revised by Building Commissioner Thorne was presented and approved and Mr. Thorne agreed to revise Article VII covering industrial zones for the consideration of the Board. Article IX of the pro- posed ordinance was studied and changes noted. On motion the meeting was adjourned to 4: 30 P.H. Friday, . The Corand sion, during the past year, has studied, carefully wxd in detail, the tena.tive revision of this ordinance prepared F bz: the former City Attorney, Mr. Truman K. Powers. This study has ineluded a oomparison with the present Zoning Ordinance. The attitude of the Oommission is that changes from the present law should be made only for very good and sufficient reasons. Oertain literature has been consulted as an aid to the study. The BuIldi.ng Comni ssi oner, Mr. Thorne, has been constantly a parti eipant in the st sdy. The Common Council, .on February 5th. last, authorised and instructed the Planning Commission to continue its than current study of the revision of the Zoning Ordinance and Zone lisp and to repert its findings to the Council.
