Mayor Campbell announced the meeting was called to elect a
ohairiban, and asked for nominations for the office.
The names of Commissioners Montillon and Geherin were suggested,
and there being no further nominations they were declared closed and
it was moved:
By Commissioner Treman, , seconded by Commissioner Bishop:
Resolved, that the Beer, be directed to cast one ballot for
Commissioner Montillon. Carried.
The ballot being cast, Commissioner Montillon was declared duly
elected Chairman of the Commission.
There being no further business, the meeting was adjourned to
reconvene at the call of the Chairman.

MINUTE Minutes of the preceding meeting were duly approved.
Chairman Montillc4i announced that the meeting was called to
discuss a request for a special permit filed with the Bldg. Commis-
sioner on which Mr. Thorne has requested the Planning Commission
to express an opinion.
Bldg. Commissioner Thorne explained that Mr. Floyd Poyer has
requested that an exception be made to the Zoning Ordinance to
permit him to remodel a one family residence at 102 First Street
into a four family apartment house. As the house is located in
the "A" Residential district, the request is to be considered by
the Board of Zoning Appeals at a meeting on May 6, 1940, Mr. Thorne
felt that an expression from the Planning Commission would be helpful
to the Board in their deliberations.
By Commissioner Dillon, seconded by Commissioner Perry:
Resolved, that it is the sentiment of this Commission that 1
the Board of Zoning Appeals should make an exception to the Zoning j
Ordinance and permit Mr. Poyer to make the alterations to the
building as requested. Carried.
Mr. Thorne reported receipt of an inquiry from a local real
estate agency in regard to the purchase of the Moore property in
W. State Street for the purpose of building a gas station, and
since it is within 200 ft. of the property of the State Street
Uethodist Church he feels that a permit should not be given, and
suggested that a committee from the Planning Commission be appointed
to investigate the matter.
Chairman Yiontillon appointed Commissioners Perry and Mitchell
to cooperate with the Building Commissioner in the investigation.
Bldg. Commissioner Thorne reported other requests for excep-
tions to the Zoning Ordinance and suggested that the Commission
might study the idea of consolidating the "A" and "B" Residence
zone when the new Zoning Ordinance. is adopted.
Chairman Montillon reported that Mayor Owiipbell will be pleated
to have the Commission carry on the work of preparing a new zone
map and study of the new Zoning Ordinance.

Resolved, that the Chairman appoint a committee to further
study the Zoning Ordinance and prepare a new zone map.
Carried.
It was agreed that the work on the "City Improvement Base Maps"
should be continued as time and funds permit.

REQUEST FOR ZONE ORANGE-t• JAY STREET ChairmarMontillon announced
the meeting was called to consider a petition to change a portion of
the 200 Mock in E. Jay Street, north side, from "A residential to
commercial-11
Bldg. Commissioner Thorne explained that the east half of the
block is now "commercial" and as Mr. Carlos A. Furman wishes to
erect a milk station on his property at the corner of Utica and Jay
Streets, he has presented a petition signed by the majority of the
property owners in the vicinity requesting that the change be made.
After discussion it was moved,
By Commissioner Bishop, seconded by Commissioner Geherin:
Resolved, that the Chairman be authorized to appoint a committee
to investigate the request and report back to this Board.
Unanimously Carried.
The Chairman appointed Commissioners Bishop and Geherin to a
committee to act with the Bldg. Commissioner 1n the investigation.
ZONING ORDINANCE AND UP Chairman Montillon reported that Commis-
sioner Treman is willing to assume the chairmanship of a committee
to continue study �of the zoning ordinance and map, and he expressed
hope that work on the base map will go forward as funds and time
will permit.
GAS -STATION-W. STATE STREET In accordance with the action of the
Commission taken at the May 3rd meeting in connection with an in-
quiry from a local Real Estate Agency asking if permission would be
given to erect a gas station in W. State Street within 200 ft. of
the State Street M. E. Church, the following report was submitted
by the committee:
"August 6, 191+0
CITY PLANNING 0011 ISSION
ITHACA, N. Y.
"We the undersigned committee appointed to investigate the de-
sirability of permitting a gas station to be erected on the Moore
Property, corner of Geneva and State Streets, report as follows:
"1. This property is on an increasingly important block which
should see steady growth in regular commercial property, as the
population trend is definitely westward.
112. A fair portion of the property lies nearer than 200 ft.
from the State Street E. E. Church.

E t3. State Street at this point and Albany Street at the next
corner, handle some of the heaviest traffic flow in the city.
"For these reasons we do not approve of any variation in the
11200 ft. rule" as now in force in the Zoning ordinance and recommend
that a gas station or similar use at this point be not permitted.

MINUTES minutes of the preceding meeting were duly approved.
ZONE CHANGE - E. JAY STREET Chairman Montillon announced that the
meeting was called to consider the report of the committee appointed
to investigate the petition to change a portion of the 200 block in
E. Jay Street from "A" residential to commercial classification.
The following is the report as submitted by the committee:
11We, the undersigned having been appointed to investigate the
request of Furman Bros. to change the zoning ordinance to permit
the erection of a building for commercial purposes on the corner of
Jay Street and Utica Street repoxt as 'follows.
"Your committee visited the site of the proposed building and
talked with Mr. Furman. Mr. Furman is anxious and willing to co--
operate in every way and informed us that in addition to the milk
house mentioned in his petition he intends to include a milk bar.
These milk bars are ordinarily very attractive and certainly tend
to enhance the architecbure of the neighborhood. Therefore in
accordance with the above state of facts your committee feels that
Mr. Furman's request should be granted provided, however, that the
contemplated building shall comply with all the requirements of the
building code and Fire Department.

Resolved, that the report of the committee be accepted and
approved.
Be It Further Resolved, that this Commission recommend to the
Oo-.nmon Council that that part of the south end of the block bounded
on the west by Utica Street, on the south by Jay Street, on the
east by the existing commercial district, and on the north by a line
F parallel to and 96' from the north line of Jay Street be changed
from "A" residential to commercial classification. Carried.

EXCEPTIONS TO ZONING ORDINANCE Bldg. Commissioner Thorne reported
that the Purity Ice Cream Co. located at 218 First Street has filed
a request to be considered by the Board of Zoning Appeals for an
exemption to the zoning rules, and Mr. Thorne suggested that a study
should be made by the Planning Commission of a possible change in
zoning in the district. '

MINUTES Attention was called to the resolution adopted at the
meeting held August 27, 1940, and it was felt that it did not cover
the entire area which should be considered in the study of rezoning,
and it was moved
By Commissioner Treman, seconded by Commissioner Geherin:
Resolved, that the resolution adopted August 27, 1940 be amended
to read as follows: That the Committee study the advisability of
changing the balance of the residential area to commercial classi-
fication, all that area situated between Cascadilla Creek on the
north, Oascadilla Street on the south, and the Auburn branch of the
Lehigh Valley Railroad on the west. Carried.
There being no further corrections, the minutes were duly
approved.
REZONING Commissioner Treman reported that the matter of rezoning
in the above outlined area was studied by the Committee and due to
the many violations or exceptions he felt that a change in zoning
should be made, but questioned the advisability of chaAng this
district before the entire zoning map is revised.
After further discussion it was agreed that a study of zoning
in the entire City should be made, and it was moved

Resolved, that the Chairman be authorized to delegate certain
members of the Committee to study the various sections of the City
and make recommendations in regard to zoning. Carried. .
ZONING ORDINANCE Attention was called to the fact that the pro-
posed zoning ordinance has been distributed to members of the Plann-
ing Commission and to members of the Common Council and Board of
Public Works, and it was suggested that Commissioner Perry bring
the matter to the attention of the Council with the idea that they
should request the Planning Commission to study the ordinance and
make recommendations, if that is the wish of the Council. It was
agreed that regular meetings should be held in order to study the
zoning ordinance and it was moved

Resolved, that it is the sense of this Board that regular meet-
ings be held on the 4th Tuesday of each month at 4: 30 P.Lr. . . . .

CAYUGA LUMBER CO. DEVELOPMENT NEST HILL The :following letter was

The Cayuga Lumber Co. has arranged to take over a portion
of the property owned by George H. Hook on Hook Place. This prop-
erty was developed by Mr. Hook and a map was made by K. P. Crandall
in 1906 and later in 1912• On this map the hots had a frontage of '
F 501. A new plan has been made by Carl Crandall under date of
E November 2, 1940, titled "Cayuga Lumber Co. Development on Rest Hill"
which increases the width of each lot as well as the depth and in
addition provides for widening of Warren Place to 501-
