Such hearing shall be advertised at least 10 days prior to such hearing. The institution shall be given the opportunity at the hearing to present its report and to respond to comments and questions; and [3] Within 30 days following the public hearing, work jointly with the institution to amend the report to address all issues deemed appropriate by the Building Commissioner. (c) Within 45 days following the public hearing, the institution shall submit an amended report, together with such additional copies as may be reasonably required by the Building Commissioner. Within 30 days following receipt of such amended report, the Building Commissioner shall determine the extent to which the parking requirements of Subsection G(1) above shall be reduced as a result of participation in a TDMS. The Building Commissioner shall forward a copy of the amended report, a summary of the public comments received and a copy of his determination to the Mayor, and to each member of Common Council, the Board of Public Works, and the Planning Board. (d) The decision of the Building Commissioner shall be a ministerial act pursuant to Chapter 176 of this Code and may be appealed within 30 days pursuant to § 325-37B of this chapter. (e) The institution shall inform the Building Commissioner at least 60 days in advance of the elimination of more than 25 parking spaces. H. Parking in WEDZ-1 District. [Added 3-1-2000 by Ord. No. 2000-2] (1) Notwithstanding anything contained herein to the contrary, there will be no off-street parking requirements in the WEDZ-1a District., (2) Notwithstanding anything contained herein to the contrary, where off-street parking abuts the sidewalk in the WEDZ-1a or WEDZ-lb District, the two areas must be separated by a low wall, with or without plantings, or a planted hedge. The setback of the wall or hedge must meet the fifteen -foot minimum, twenty -foot maximum setback requirement for new buildings. The area of the setback shall include a minimum eight -foot -wide tree lawn, a minimum five -foot -wide sidewalk and an additional two - foot distance between the sidewalk and the wall or hedge. Where a fifteen -foot setback is not feasible, an application may be submitted to the Board of Zoning Appeals for a special permit to substitute aminimum eleven -foot -wide sidewalk between the curb and the building facade. If parking and sidewalk are separated by a low wall, the wall must be no less that three feet and no greater than four feet high. A hedge planting may be substituted if the planting area is at least four feet wide.
