Re: Outing Program—Request for a partial leave of absence and related roster
changes
Date: October 5, 1999
Monica Bosworth,a member of our Outing Program staff,has requested permission to
reduce her hours and work part time,for personal reasons.
By temporarily increasing the hours of another member of our Outing Program staff and
by using temporary/seasonal staff we feel that we can honor her request without
significantly impacting our services.
We are recommending that Monica's request for a reduction of hours be approved and
that the Youth Bureau roster be amended as follows:
Reduction of hours— 1 Youth Development Program Leader(Outing Program—Monica
Bosworth)from 35 hours per week to 28 hours per week from 11/8/99 until 4/29/2000.
Increase of hours— 1 Youth Development Program Leader(Outing Program—Jim
D'Alterio)from 35 hours per week to 40 hours per week from 11/8/99 until 4/29/2000.

Re: Fire Prevention Coe Items

Attached please find two draft resolutions which deal with proposed amendments to the City Code
and/or required authorizations from Common Council to enable us to act. These were presented
to the Board last night, and are presented to you at this time only for the purpose of raising your
awareness on the issues and for initiating discussion on the eventual actions required by
Council. As noted at last night's budget review meeting, the Board of Fire Commissioners must
hold hearings on each as the next step. Once they have done this, a final resolution will be
completed and, I trust, forwarded to Council for action.
The first resolution addresses the actions required to establish a permit requirement for places
of assembly (C5) occupancies. The second resolution does the same for permits required for
installation, modification, or repair of fire detection, alarm, or suppression systems.
In accordance with past direction from Council, the associated fee schedules which will be
forwarded for your approval will be based upon recovering the costs to actually perform the
work. That is, reimbursement for the hourly rate paid for the work hours invested in the
delivering the service dictated by the permit.
All of this is not necessarily required to be discussed at the next Budget and Administration
Committee meeting. However, if you would prefer to be briefed on it at that time we will be
happy to attend for that purpose.

Place of Assembly Occupancy Permit Resolution
WHEREAS, the City of Ithaca has directed the Fire Department to generate additional revenues
for services performed; and,
WHEREAS, the mandated requirement (19 NYCRR 444.3(d)(3)) by New York State that places
of assembly (C5) occupancies be inspected at least annually; and,
WHEREAS, and as the result of the presence of special duty fire fighters, the Fire Prevention
Bureau has been engaged in performing these inspections since approximately 01 SEP 99; and,
WHEREAS, section 181-10 of the Code of the City of Ithaca empowers the Board of Fire
Commissioners to determine and specify, after giving affected persons an opportunity to be
heard, any new materials, processes or occupancies which shall require permits in addition to
those now enumerated in the code; and,
WHEREAS, pursuant to the interest of Common Council in recovering costs associated with
various City services, the Fire Chief has recommended that a requirement that an annual
operating permit be required for each place of assembly (C5) occupancy for which a fee shall be
assessed pursuant to section 181-9.F of the Ithaca Code; and.
WHEREAS, two public hearings were held where the public was given the opportunity to be
heard on this issue, and the Board has properly considered the comments received at such
hearings; now therefore, be it
RESOLVED, the Board of Fire Commissioners adopts the following specification for permits for
Places of Assembly (C5) occupancies in the City of Ithaca:
Places of Assembly (C5) Occupancies.
(a) Permit Required. No person shall operate an occupancy designated as a
place of assembly, which for purposes of this section are those with a
C5.1 to C5.5 occupancy designation as defined in the New York State
Uniform Fire Prevention and Building Code, without a valid annual
operating permit.
( b) An application for an annual operating permit shall be filed with the Fire
Prevention Bureau of the Ithaca Fire Department on forms provided by
that office.
(c) The application shall be accompanied by a floor plan of the assembly
space(s) and exits therefrom showing in appropriate detail the layout of
the space, the nature of the use, and the actual size of the exiting serving
the assembly space. If multiple uses occur with in the net floor area
space comprising the assembly space they shall be suitably identified.
Applications for renewal may be made without such floor plan provided
there has been no change in the use or arrangement of the net floor

area(s) in the assembly space from the original filing.
(c) Prior to the issuance of an annual operating permit, the Fire Prevention
Bureau shall review said application and cause an inspection of the
premises to be made to insure compliance with applicable codes, rules,
and regulations.
(d) In the event an on-premise inspection organization exists which may
provide third party inspection and certification of compliance with the
code, such fees as required for this section shall be adjusted to reflect the
actual time spent by the fire department required to assure compliance
with the intent of this part.
(e) Fees. As authorized in section 181-9.F(1), a fee shall be charged for
each annual operating permit application received.

RESOLVED, the Board of Fire Commissioners shall forward this resolution to the Common
Council for adoption of the permit requirement in City Code, along with the permit fee structure
as recommended by the Fire Chief for approval according to the provisions of section 181-
9.F.(2).

WHEREAS, the mandated requirement by New York State that requires fire detection, alarm ,
and suppression systems to be installed according to appropriate code; and,
WHEREAS, the importance of this testing to the proper operation of such systems, including the
reduction of false alarms, has been established time and again by the fire department; and,
WHEREAS, and at the significance expense of other duties, the Fire Alarm Superintendent has
been engaged in performing these inspections; and,
WHEREAS, the plan review, inspection and associated revenue generated by the Ithaca Building
Department for the building permits required for such work is separate and apart from the
work performed by the fire department as the result of these systems; and,
WHEREAS, section 181-21. Fire alarm and detection systems, specifies in part the work
required of the fire department and of installers with regard to these systems; and,
WHEREAS, section 181-10 of the Code of the City of Ithaca empowers the Board of Fire
Commissioners to determine and specify, after giving affected persons an opportunity to be
heard, any new materials, processes or occupancies which shall require permits in addition to
those now enumerated in the code; and,
WHEREAS, pursuant to the interest of Common Council in recovering costs associated with
various City services, the Fire Chief has recommended that a requirement that an installation
permit be required for each new or modified fire detection, alarm, or suppression system
installed subject to the requirements of the New York State Uniform Fire Prevention and
Building Code; and.
WHEREAS, a public hearing was held where the public was given the opportunity to be heard on
this issue, and the Board has properly considered the comments received at such hearing; now
therefore, be it
RESOLVED, the Board of Fire Commissioners adopts the following specification for permits for
installation or repair of fire detection, alarm, or fire suppression systems in the City of Ithaca:

WHEREAS, the Board of Public Works has been notified by the New
York State Department of Environmental Conservation that the
City will be receiving a $7, 500 Grant for the Citizen Pruner
Video Project; now, therefore, be it

On March 24, 1999 the Board of Public Works passed a resolution authorizing
you to file an application for a$7,500 grant from the New York State Department of
Environmental Conservation.
This grant for the Citizen Pruner Video Project has been approved_ In order for
the city to collect the funds,the D.E.C. requires that an Aid to Localities Resolution be
passed by City of Ithaca.Common Council. A sample resolution has been provided by:the
state and is attached.
The D.E.C, also requires a certified copy of the resolution as well as five copies of
the contract signed by you and notarized. A sample Certificate of Recording Officer is
attached.

Resolution Authorizing the signing of a State Contract for ari Aid
to Localities Project,- Under the Appropriate Laws of New ;York

WHEREAS,

herein called the "Municipality, " after thorough consideration of
the various aspects of the problem and study of available data, has
hereby determined that certain work, as described in the State
Contract, herein called the "Project" is desirable, in the public
interest, and is required in order to study and/or implement, the
local project or program; and
WHEREAS, under Chapter 53, Section 1 and 2, of the Laws of 1998
relating to the Local Assistance Budget, the Legislatures has
authorized financial assistance to localities for services, and
expenses related to local projects, programs and studies by means
of a written agreement; and
WHEREAS, the Municipality has examined and duly considered Chapter
53 , Section 1 and 2, of the Laws of 1998 relating to the Focal
Assistance Budget and deems it to be in the public interest. and
benefit under this law to enter into a .contract therewith:

WHEREAS, the Department of Public Works and the Fire Department
have examined their Year 2000 activity and have determined that
the following items are needed to make critical items Year 2000
compliant and/or prepare for the year 2000:
