Accept Purchase Offer for Carpenter Business Park
WHEREAS, the 10 .8 acre Carpenter Business Park located on Third Street
with frontage along N. Meadow Street was completed in 1990, and
WHEREAS, the City owns four parcels totaling 4 .94 acres of land and
the Ithaca Urban Renewal Agency (IURA) owns the remaining three
parcels totaling 5 .86 acres of land in the Carpenter Business Park,
and
WHEREAS, the IURA has been unsuccessful in securing satisfactory
tenants and Carpenter Business Park has remained vacant since its
completion in 1990 with the exception of the community gardens located
on the 2 .25-acre parcel#36-1-3 .4, and
WHEREAS, at the April 1, 1998 meeting the Common Council authorized
disposition of all City-owned parcels in Carpenter Business Park,
except those leased to Project Growing Hope, Inc. used for community
gardens, through the IURA for no less then fair market value, subject
to the following conditions :
A. property must not be used for an adult entertainment
establishment use,
B. property must not be used for a warehousing or storage as a
primary use for a period of 10 years from the date of conveyance
from the IURA, and
C. retention of access and utility easements to parcel #36-1-3 .4,
currently used for community gardens, and utility easements for
any other public utilities located on the property, and be it
further
WHEREAS, the Common Council further resolved that upon abandonment by
the Board of Public Works (BPW) , the Carpenter Circle cul-de-sac
street property shall also be considered surplus and authorized for
disposition, and
WHEREAS, Building Links, Inc. has submitted a purchase offer for
Carpenter Business Park that is binding if accepted by the Common
Council by 10/7/99, and
WHEREAS, following extensive negotiations, the IURA voted on 9/20/99
to approve the purchase offer with changes per verbal negotiations
conducted at the 9/20/99 meeting, and
WHEREAS, the IURA staff has reviewed the revised 9/22/99 purchase
offer and found that the results of the verbal negotiations have been

satisfactorily incorporates into the revised purchase offer,
therefore, be it,
RESOLVED, that the Budget and Administration Committee hereby
recommends that the Common Council accept the 9/22/99 purchase offer
from Building Links, Inc. , subject to Board of Public Works
abandonment of Carpenter Circle, and be it further
RESOLVED, that staff is directed to publish a legal notice 10 days
prior to the 10/6/99 Council meeting in compliance with general
municipal law governing disposition of property, and be it further
RESOLVED, that the Mayor, upon review by the Executive Director of the
IURA and the City Attorney, is hereby authorized to sign any and all
instruments necessary to accept the purchase offer and convey the
property.

18 . 8 Conveyance of Certain Parcels in the Carpenter Business Park
to the IURA for Disposition (Carpenter Circle included only if
abandoned by BPW) - Resolution

WHEREAS, the 10 . 8 acre Carpenter Business Park located on Third
Street with frontage along N. Meadow Street was completed in
1990, and
WHEREAS, the City owns four parcels totaling 4 . 94 acres of land
and the Ithaca Urban Renewal Agency (IURA) owns the remaining
three parcels totaling 5 . 86 acres of land in the Carpenter
Business Park, and
WHEREAS, the IURA has actively marketed the lots for lease and
sale for light manufacturing industrial uses with a job creation
goal of 17 jobs per acre since 1990, and
WHEREAS, the IURA has been unsuccessful in securing satisfactory
tenants and Carpenter Business Park has remained vacant since
its completion in 1990 with the exception of the community
gardens located on the 2 . 25-acre parcel #36-1-3 .4, and
WHEREAS, besides the community garden parcel, the City owns four
other land parcels totaling approximately 2 . 7 acres in size
(#36-1-2 , #36-1-3 . 3 , #36-1-3 . 5 and #36-1-3 . 6) , and
WHEREAS, a 1998 appraisal of Carpenter Business Park, excluding
the community gardens parcel, establishes the fair market value
at $1, 364, 000; now, therefore, be it
RESOLVED, That the Common Council does hereby declare all City-
owned parcels in Carpenter Business Park, except those leased to
Project Growing Hope, Inc. used for community gardens, as
surplus property, and be it further
RESOLVED, That the Common Council does hereby authorize
conveyance of these surplus parcels to the Ithaca Urban Renewal
Agency for disposition for no less than fair market value,
subject to the following conditions :
A. property must not be used for an adult entertainment
establishment use,
B. property must not be used for a warehousing or storage as a
primary use for a period of 10 years from the date of
conveyance from the IURA, and
C. retention of access and utility easements to parcel #36-1-
3 .4, currently used for community gardens, and utility
easements for any other public utilities located on the
property, and be it further
RESOLVED, That should the Board of Public Works (BPW) abandon
the Carpenter Circle cul-de-sac, the street property will be
conveyed separately at a later date, and if it is not abandoned
by BPW, Carpenter Circle shall not be considered surplus
property and will therefore not be conveyed, and be it further
RESOLVED, That the IURA consider various options for disposition
to optimize development potential and purchase price of
Carpenter Business Park including, but not limited to, selling
all parcels to a single developer or offering individual parcels
to a variety of purchasers, and be it further
RESOLVED, That any net proceeds from the sale of the parcels
after expenses incurred by the IURA shall be returned to the
City, and be it further
RESOLVED, That the Mayor, upon review by the City Attorney, is
hereby authorized to sign any and all instruments necessary for
the conveyance of this property to the Ithaca Urban Renewal
Agency.

Process for Sale of Fire Station No. 7
WHEREAS, the Fire Department has been assisted by the Planning
Department and Controller' s office regarding the sale of Fire
Station No. 7, and
WHEREAS, it is now being recommended that the Board of Fire
Commissioners place Fire Station No. 7 up for sale through a
sealed bid process; now, therefore, be it
RESOLVED, That Common Council hereby authorizes the Board of
Fire Commissioners to sell Fire Station No. 7 by advertising
for sealed bids, in consultation with the City Attorney,
Planning Department and Controller offices, and be it further
RESOLVED, That upon the commissioner' s opening of the bids,
the highest bidder shall be required to supply plans for any
exterior changes proposed for No. 7 to the Ithaca Landmarks
Preservation Commission, which shall review the plans'
appropriateness with regard to the structure' s historic
character and the surrounding neighborhood, and shall forward
the commission' s comments to Common Council, and be it further
RESOLVED, That the sale agreement shall be contingent upon the
granting of any permits needed for the high bidder' s reuse of
the structure, with all of the above city steps in the
procedure to be completed within a maximum of six months, and
be it further
RESOLVED, That the sale decision shall then be referred to
Common Council, which shall not withhold its approval without
cause, and be it further
RESOLVED, That the proceeds from the sale of Fire Station No.
7 shall be allocated through a mutually agreed-upon
arrangement between Common Council and the Fire Department.

THIS IS A REQUEST TO FUND CAPITAL PROJECTS FOR BOTH WATER AND SEWER TO SUSTAIN PROGRESS ON AN
EXEMPLARY RECORD OF ACHIEVEMENT IN CAPITAL IMPROVEMENTS OVER THE PAST FOUR YEARS. THIS
PROGRESS WILL SOON BE WITHOUT EITHER WATER OR SEWER CAPITAL FUNDS WITHOUT YOUR IMMEDIATE
ACTION. THE PROBLEM OF FOCUSING ON LONG TERM AND EXPANSIVE NEEDS FOR WATER AND SEWER
CAPITAL IMPROVEMENT WITHOUT REACHING A CONCLUSION IS THAT THE DEPARTMENT'S ANNUAL REQUESTS
FOR CAPITAL FUNDS SINCE 1995 HAVE LARGELY BEEN DEFERRED IN FAVOR OF DEALING WITH THE TOTAL
PICTURE. THIS IS NO LONGER POSSIBLE IF KEY PRODUCTIVITY, COST SAVING, PARALLEL O&M
EFFICIENCIES, PROJECT ENGINEERING—ADMINISTRATIVE—CONSTRUCTION, ETC. INITIATIVES ARE INTERRUPTED
OR BROUGHT TO A STOP.
On the water side, attached you will find the cover page of the final draft of the Comprehensive Water System
Evaluation first issued to policymakers in October 1997. Also, you will find the latest listing of the regionally favored
Alternative 2A that has substantial value added for City north end distribution and storage improvement needs. Under an
engineering schedule projecting $2.8 million of improvements for 2000, it is reasonable to ask you to establish a capital
project in the amount of 40% of 2.8 million = $1,120,000 as most of the early projects include improvements to the City
distribution and pumping facilities. In the worst case scenario, of the City building its own new water plant, these
distribution improvements are necessary to support the gravity and Mitchell-Coddington tank zones serving all City wards.
Your immediate action is needed to complete 1999 work and sensibly plan, stage, and purchase toward 2000'
improvements. These funds will be covered by reserves until BAN'S are issued.
On the sewer side, please know that the work accomplished since 1995 with the now exhausted $2 million has a street
value of $3.5 million. It includes over four miles of interceptor construction that will allow simple resolution of over $2
million of local sewer collapses, undulations, aging/leaking pipe problems identified to begin to be resolved. The first
major area already replaced is between Fulton Street and Meadow Street now contemplated for high-density
development. These improvements will allow the City to follow whatever economic vision it decides for this area without
infrastructure constraints. In order to move forward a program that will benefit all areas of the City and sustain great
return on investment at least $1.22 million should be approved at this time toward the collector sewer and interceptor
improvements. An easy digestion of a very expansive program is this is the amount of the grant already awarded for 1/1
work under the 1998 Bond Act Application. So, although we have already permanently financed $1.435 million @ 2.8%

through the revolving loan fund program, this current request for $1.2 million would not increase long term debt. This is
overly simplified for where the sewer capital program, with over$15 million of needs, might be improved over the next few
years. But, it will at least keep a highly successful in-house program moving forward for now.
I hope this succinctly summarizes a dire need for capital funds. The slice for water, a $1.2 million request, will sustain
improvements needed in any long-term or regional alternative. The slice for sewer, a $1.22 million request, will sustain
local City sewer interceptor and collector improvements separate from any regional sewer alternatives. Your positive and
prompt action on these requests are both needed and welcome.

1. Youth Development Program Leader. Unsure whether to fill for the Adult Program or Teen
Program. The Mayor will attend the next GIAC Board meeting to discuss the need to have
the position in the Teen Program. . Mike will return to the next Position Review Committee
meeting.
DPW (Water Plant)
1. Senior Operator. Passed. 3-0. Job description will include coverage for the Chief Operator
without out-of-title pay.

Amendment to Personnel Roster - DPW/Water and Sewer Division
WHEREAS, Paige Rumsey has requested a voluntary reduction in her
work hours from September 13, 1999 through June 17, 2000 and
WHEREAS, the Department of Public Works is able to accommodate
her request and wishes to do so, and
WHEREAS, the Personnel Roster of the Department of Public Works
also needs to be amended to clarify Ms. Rumsey' s correct job
title as authorized by the Civil Service Commission, NOW,
THEREFORE, BE IT
RESOLVED, that the Personnel Roster of the Department of Public
Works be amended for the period September 13, 1999 through June
17, 2000 as follows:
Add: One (1) Senior Account Clerk (35 hrs)
Delete: One (1) Senior Account Clerk-Typist (40 hrs)

A LOCAL LAW to amend Section 2 of Local Law No. 4-1999
electing a retirement incentive program as authorized by
Chapter 70, Laws of 1999 for the eligible employees of the
City of Ithaca.
BE IT ENACTED by the Common Council of the City of Ithaca, as
follows :
Section 1 . Section 2 of Local Law No. 4-1999 shall be hereby
amended to change the commencement date of the retirement
incentive program to October 3, 1999.
Section 2. This local law shall take effect upon filing with
the Secretary of State.
