Minutes of the preceding meeting were duly approved. REPORTS The usual monthly reports were received, read and ordered filed. INSANITARY DWELLING - Dr. Broad reported that a dwelling at 207 Fifth Street has been found to be in very bad condition and recom- mended that it be proclaimed unfit for human habitation and the tenants ordered to vacate or otherwise conform with Chapter. 11 Section l,of the Sanitary Code. By Commissioner Parker, seconded by Commissioner Patterson Whereas, it appears to the Board that a building krown as 207 Fifth Street has become insanitary and continues in an in- sanitary condition and Whereas, a p_cposed order has been presented to this Board which order conforms with the provisions of Chapter. 11 Section 1 of the Sanitary Code of the City of Ithaca. Now Therefore Be It Resolved that said order be and hereby is approved as presented and the Aealth Officer be and hereby is authorized and directed to execute the same on behalf of this Board and cause copies thereof to be served as provided- in said Sanitary Code. Carried. AUDIT By Commissioner Patterson, seconded by Comm. McCormick: Resolved, that the bills approved and audited by the Fin- ance Committee be and the same hereby are approved for payment. Carried. SANITARY SEWER CONNELTIONS Dr. Broad again asked that the Board of Public Works be requested to furnish a list of properties in the City not connected with the sanitary sewers. Mayor Myers agreed to take the matter up with the City Engineer to secure a list of such properties. At this point the Mayor declared the meeting would adjourn to executive session. HEALTH OFFICER - SCHOO& PHYSICIAN Commissioner McCormick stated that he felt a committee shoulbe appointed to confer with the Board of Education in regard to the continuance of arrangement of duties of the Health Officer, since the present arrangement ex- `pires in June 1939. State Health Officer - Fear Laboratory Director - Ferris --� Inspectors - Kolar, Stubblefield Clerk - Springer �- MINUTES Minutes of the preceding meeting were duly approved. i COLLECTIONS Collections of $8. 00 for scavenger and $12.00 for storekeepers milk license fees were reported. WEQRM The usual monthly reports were received, read and ordered filed. COMPLAINTS - Chinese Laundry Commissioner Parker reported that complaints have reached her in regard to the condition of the house at 321 E. State Street now occupied by the Chinese laundry. Dr. Broad stated that he, together with the Building Commissioner, had inspected the house, and while it is not in first class condition, he did not feel it was a public health hazard. Mayor Myers stated that he understood the owner is now nego- tiating sale of the house, and is seeking a new location for the laundry. PUBLIC LIBRARY Commissioner Parker reported complaints in regard o the lack of toilet facilities in the Public Library. Mayor 11yers reported that a movement was now on foot to make alterations in the Library building at which time necessary installa- tions could be made. It was suggested that the Health Officer contact the trustees of the Library and endeavor to work out a solution. DIRTY &SILK BOTTLES Commissioner Parker reported receipt of a com- plaint in regard to dirty cream bottles delivered to a residence on Cayuga, Heights. Dr. Broad stated that he had also received the complaint, and while Cayuga Heights is not under the jurisdiction of this Board, he had tried to work and: remedy the situation, but the complaintant would not cooperate. SANITARY REGULATIONS Dr. Broad stated that the sanitary inspeo- tions have disclosed the need of inspection of premises prior to opening new establishments or removal to a new address, of all food and drilk establishments, barber shops, and beauty parlors, since it has been necessary to order alterations after the business has been establishedo Ey Commissioner Patterson, seconded by Commissioner Parker: Resolved, that the matter be referred to the City Attorney, with the request that he draft suitable amendments to the Sanitary Code, which will require persons to secure approval of the Health Department before establishing or removing to a new location of such business. Carried. ANNUAL REPORTS The annual report of the Health Officer, Inspectors, Kolary Biker and Stubblefield were received, read, and ordered L placed on file. CO:e.1PLAUT - REIDY PROPERTY Dr. Broad reported on investigation N of conditions at the ReMy property in Dryden Road, , and stated that the owners have been notified to connect the house with the ,sanita ry sewer or install a septic tank, but to date neither have been done. By Commissioner Carey, seconded by Commissioner EcOormick: ' Whereas, it appears to the Board that a building known an 603 Dryden Road has become insanitary and continues in an insani- tary condition, and Whereas, a proposed order has been presented to this Board' which order conforms with the vrovisions of Chapter II Section I of the Sanitary Code of the City of Ithaca. Now Therefore Be It Resolved, that said order be and hereby is approved as presented and the Health Officer be and hereby' is authorized and directed to execute the same on behalf of this Board and cause copies thereof to be served as provided in said Sanita- ry Code. Carried. PUBLIC LIBRARY The Health Officer stated that he had dimmeed with Mr. Bradford, the matter of installing a toilet in the' Library, but that Mr. Bradford stated the Library had no funds for the pur- pose. No further action was taken. Carri�;d, GARBAGE CONTAIFERS Commissioner Patterson stated that many. per- sons er sons are not complying with provisions in the Sanitary .Code by placing garbage in covered containers, and that dogs scatter the contents of the cans on lawns and parking. It was agreed that some publicity be given the matter, 4nd if the nuisance continues that offenders should be summoned into City Court. On motion the meeting adjourned. ...�, F. The Sanitary Inspector reported that it was found a number of barber shops are careless about sterilizing combs and brushes, and he felt that the State Sanitary Code should be enforced in this regard. Dr. Broad stated that some restaurants are not complying with the sanitary, regulations and asked if it would not be well to con- sider the idea of issuing permits, which could be revoked upon violation of the Code. It was regularly moved, seconded and carried that the matter be referred to the City Attorney and Health Officer for study and report. TRAILER CLAMPS Dr. Broad reported that a group of five trailers are now camped on land at the north end of Tioga Street -' and since complaints have been made he believes the citizens of tie City do not want trailer camps in the City. N. Attorney Powers stated that he expects to receive frog the Mayors Conference, model ordinances in regard to the regulation of trailers, and suggested that no action be taken until receipt and study of these ordinances. INSANI DWELLING Dr. Broad reported receipt of oomplairits of the com .ion` a of houses in Cliff Street in which welfare clients are housed, and found upon investigation that it was possible to make their habitable. He expressed the opinion that the 'Welfare Department should confer with the Health Department before placing clients in.houses which may be insanitary or otherwise unfit for habitation. By Commissioner Livermore, seconded by Commissioner Patterson: Resolved, that the Health Officer be requested to discuss the matter with tba Welfare Department with the view of selecting suit- able houses for welfare clients. Carried. AUDIT By Commissioner Livermore seconded by Comm. Patterson: Resolved, that the bills to list of which is herewith appended)' approved and audited by the Finance Committee be and the same hereby are approved for payment. Carried. SANJUEY REGULATIONS Attorney Powers, reporting on the resolu- tion passed Feb. 8, 1939, requesting him to draft suitable amend- ments to the sanitary code which would require persons to .secure approval of the Health Department before establishing or removing - food and drink establishments, barber shops and beauty parlors, stated that he felt it unwise to issue permits or approval of these establishments. .._ He stated that he had requested the Building Commissioner to notify the owner when a building permit is applied for, to submit plans for the construction or alterations for such establishments, to the Health Department for approval. HFADQtIARTERB - 80ARD OF HEALTH Dr. Broad called attention to the fact thate lease for t e present quarters -expires within the year, and if removal is anticipated it might be well to look fora new location. Mayor Myers agreed to ascertain if quarters will be available in the old library building. ISSU,INNG_ SUBPENAS Dr. Broad requested the Board to designate one of the commissioners to issue subpenas. By Commissioner Livermore, seconded by Commissioner Peabody: Resolved, that Commissioner Patterson be designated to issue subpenas, citing persons to appear before the Board. Carried. State Health Officer - Fear Inspectors - Baker, Kolar, Stubblefield Clerk - Springer MINUTES Minutes of the preceding meeting were duly approved. �..; CODE VIOLATION James Papathates, who oonducts a fruit store at 103 N. Aurora Street, appeared in answer to a summons due to san- itary conditions at his store. Inspector Stubblefield reported that Mr. Papathates is a chronic violator of the sanitary code, and submitted the following report of inspections: july 26, 1939 Y There was no toilet paper in the toilet. Paper towels should be installed at the sink. Garbage was exposed in the rear room. August 19, 1939, There was still no toilet paper in the toilet. Mr. Pan�hates said he used orange wrappers. Paper towels were still needed at the sink. The toilet needed sweeping out. The garbage situation was no better. Rotten vegetables should be picked out and discarded. October 4 139 There were no paper towels at the sink. Mr. Papathates agreed to install them. Garbage was fairly well covered. '41� December -9, 1938 There were nopaper towels. The toilet and toilet bowl were dirty. An inspection was made later the same day. Paper towels had been installed and the toilet and bowl cleaned. February 17, 1 This ore comp ed with the regulations. April .f Toilet s d be swept out. w June 19, 1939 Toilet needed sweeping and cleaning. Lavatory needed cleaning. There were nopiper towels. At the suggestion of Dr. Broad, it was moved, By Commissioner Livermore, seconded by Commissioner. Patterson: ; Resolved, that Mr. Papathates be put on parole and given an opportunity to correct conditions; Be It Further Resolved, that upon next violation, he be brought into City Court. Carried. Dr. Broad reported receipt of a request from the above named company for a permit to sell Grade B milk at their store in N. Aurora Street which was refused pending action by the B oar d. PAROCHIAL SCHOOLS Dr. Broad called attention to a new provision in the law in regard to medical care of pupils in schools in other than public schools. He explained that it is not entirely clear and is to be discussed at the next meeting of the Board of Edauoa- t i on. DR. BROAD LEAVE OF ABSENCE Health Officer Broad informed the Bid that e would like a` leave of absence for study and that the Health Committee of the Board of Education would like to meet with a com- mittee from the Board of Health to discuss the matter._ By Commissioner McCormick, seconded by Commissioner Parker: Resolved, that the Mayor be requested to appoint a committee to meet with the Health Committee from the Board of Education of which Dr. Helen Bull is chairman. Kulp reported that the committee from the Board of Education and the Board of Health unanimously recommended the appointment of Dr. R. Stewart Wallace of Dryden to substitute for Dr. Broad during his leave of absence, subject to approval of his credentials by the State Board of Health and the approval by the Civil Service Com- mi sei on. By Commissioner Carey, seconded by Commissioner Livermore: 'Resolved, that the recommendation of the committee be approved, and Dr. Wallace appointed to position of Health Officer at the annual ealary of §2, 600. 00 during the leave of absence of Dr. Broad, subjectt, however, to the approval of the State Department of Health and the local Civil Service Commission. REPORTS The usual monthly reports were read and ordered filed. COLLECTIONS Collections of $5. 00 for vaccine were reported. M6M Dr. Broad submitted a list showing counts in milk collected at various eating establishments in the city. These counts were shown to be very high and he suggested vari- ous ways to correct the trouble, but stated that the use of bottled milk only, was the best. He asked for an expression of opinion from the Board. By Commissioner Livermore , seconded by Commissioner Parker: Resolved, that the matter be referred to the committee on "dairy products" for study and report. Carried. BROAD LEAVE OF ABSENCE Dr. Broad requested a leave of absence for study from Sept. 15, 1939 to June 1, 1940. By Commissioner Livermore, seconded by Commissioner Parker: Resolved, that Dr. R. H. Broad be granted leave of absence from Sept. 1, 1939 to June 1, 1940. Carried. ACTING HEALTH .OF.FICER The Clerk reported receipt of a letter from the State fepartment of Health, approving the appointment of Dr. C. Stewart Wallace as Acting Health Officer during the absence of Dr. Broad. He also reported that the local Civil Service Commission has approved the appointment. By Commissioner Livermore, seconded by Commissioner Patterson: Resolved, that Dr. C. Stewart Wallace be and he hereby -is j appointed "Acting Health Officer" of the City of Ithaca, N. Y. for `Y a period of three (3) months beginning Sept. 15, 1939 at an- annual ; salary of 42600. 00. A few extremely high counts were found, and it was felt that by warning the propriet6rs, a great improvement would be made. CIVIL SERVICE CLASSIFICATION The Clerk reported that State Exam- iner, F. By Commissioner Carey, seconded by Commissioner Parker: Resolved, that the City Clerk be authorized and directed to re- quest the Civil Service Commission to approve temporary appointment of all employees of the Board of Health who have not qualified under Civil Service Rules. DISPENSING OF MILK IN RESTAURANTS The following amendments to the Sanitary Code governing the dispensing of milk in restaurants, as prepared by the City Attorney were read and discussed: Pr2posed Amendment to the Sanitary Code with Reference to the Dispenaing of ME In es auran s. All milk shall be served to the consumer in bottles and no form of dispenser shall be used. Bull,: milk shall be delivered and used only for cooking purposes. All establishments serving milk for consumption on the premises shall have conspicuously posted therein a sign or signs stating: "Only bottled milk served. " (Alternate section suggested by certain restaurant proprietors) No milk dispenser shall be used which require the transfer of the contents of the original receptacle furnished by the dealer, : and all such milk shall be dispensed directly from such original a container. All dispensing devices shall be approved by the Health , Officer and no device not so approved shall be used. All such de- vices shall be thoroughly emptied and sterilized whenever the milk receptacles are changed and at least once in every twenty-four hours. Upon questioning, Inspectors Baker and Stubblefield expressed the opinion that the amendment, which will prohibit dispensing milk except in bottles will be the most satisfactory. ` Mr. Joseph Morrison requested permission to address the Board, and stated that the restaurant owners of the City certainly do not want to handle milk in a way which will be injurious to the public, but felt that owners of the newer type of pumps should be given an ►- opportunity to demonstrate that pumps can be properly used, before being required to install equipment necessary to handle bottled milk. DWELLINGSDr. Wallace reported and furnished pictures of two dwellings at 704 and 706 Oascadilla Street whiah are now occupied but have no sewer or water connections. He stated that inspection had been made and they were found to be in a very in- sanitary condition. Dr. Wallace was instructed to notify the owner Mr. Abe Shultaan that the dwellings must be connected with the sanitary sewer or they will "be condemned. COMPLAINT BE PROPERTY 315 TUAGHANNOCK BLVD. Dr. Wallace reported that several months ago Dr. Broad had notified Mr. H. L. Cobb, owner of the property at 315 Taughannock Blvd. that either a septic tank must be installed or the house must be connected with the 10' sanitary sewer, and stated that in response to a recent complaint, the owner was again notified of the necessity of installing a sewer connection but that nothing has yet been done, and that he expected it would be necessary to summon the owner before the Board. RATS , CITY DUMP Dr. Wallace reported that due to many complaints of rate in the vicinity, the city dump will again be baited. BUD4ET Dr. Wallace presented the tentative budget for 1940 in the to amount of $19,940.00.
