A Resolution to Deny Request for a Loading Zone on Linden Avenue WHEREAS, the owners of 210 Linden Avenue have requested that a loading zone be created along their street frontage as mitigation for a state fire code variance request related to the height of the proposed building and aerial fire apparatus access, and WHEREAS, staff agrees that there is not a need for a loading zone at this location for any delivery or commercial reason, and WHEREAS, staff has determined that this scenario could occur at numerous locations around the City, likely the majority of tax parcels in the City, and WHEREAS, staff and the Board of Public Works are concerned about the precedent that would be set by granting the request, and WHEREAS, if the BPW was to grant this request, the City would effectively restrict parking on this portion of Linden Avenue forever because if the BPW allowed parking on the street in the future or somehow otherwise modified the roadway as to lessen the clear width (exclusive of parking) between the curbs, the building would likely not be allowed to be occupied in accordance with the NYS Fire Code, now, therefore be it RESOLVED, That the Board of Public Works hereby denies the request for a loading zone in front of 210 Linden Avenue. Approval for the Distribution of One Hour Free Parking Passes to Downtown Retailers — Resolution WHEREAS, the Downtown Ithaca Alliance proposed the distribution of one hour free parking passes for the 2017 Holiday Season, and WHEREAS, the parking passes would be intended for customers of downtown businesses to thank them for shopping locally, and WHEREAS, the costs of the parking passes will be paid for jointly by the City and Downtown Ithaca Alliance, now therefore be it RESOLVED, That the Board of Public Works hereby authorizes the distribution of one hour free parking passes to downtown businesses beginning December 12, 2017, for the 2017 holiday season. This has been determined to be is a Type I Action under the City of Ithaca Environmental Quality Review Ordinance ("CEQRO") §176-4 B.(1)(h)[2]and (5) and the State Environmental Quality Review Act ("SEQRA") § 617.4 (b)(10) and is subject to environmental review. In an effort to coordinate review under SEQRA and CEQRO, your Board or Agency has been identified as having "approval" authority over some aspects of this project. It is the Planning and Development Board's intention to act as Lead Agency in site plan review. The CEQRO Full Environmental Assessment Form ("FEAF") Part 1 and supplemental information provided by the applicant are enclosed. The playgro d is being designed by three local and award-winning playground des' ui f is with the Friends of Stewart Park (FSP) providing desis coot ation and leadership and TG Millers providing site engine g. Our goal is to design and build an inclusive playground for children of all ages and abilities to enjoy and sh, - with their f. • ilies and friends. FSP is proposing this new playground in Stewart Park for these reasons: • The park's existing play equipment and splash pad are out of date and do not meet cu at rnin safety or • • ssibility rawents. • FSP believes the play!, 'und will invigorate the park and be a catalyst for further park revitalization efforts being pl: led for the 2021 centennial celebration of Stewart Park's opening as a City -owned park on Ca e. • The c ent Stewart Park Playground was not desi ed with accessibility in d. This makes it difficult, sometimes impossible, for children with disabilities or mobility p ents to navigate and use the equipment and fully enjoy their playground experience. This location was selected and recommended by the Parks Co 'ssion four y s ago and has been presented to the Board of Public Works on y occasions. FSP envisions the area to the north of the overhead ele -cal lines, in the vie. Recommendations for Existing Play S etures 'd Equipment The Carousel will re in place and be ced and protected by a clear -roofed, o -sided pavilion stru that will cover the colorful a ing and new fence. The c • • spray padwill be demolished and replaced. The 5-12 y . old play structure near the Carousel will be removed and reused, if possible, in another location outside of Stewart Park. Most of the existing play equipment north of the overhead ele •cal lines is old and outdated, not meeting c ent safety standards. While some features have a rustic and nostalgic ch oth are sightly and have . play value. The old play equipment is not accessible and has many safety issues, not alit, with the goals we believe arc bodied in the new playground desiaa. FSP recommends removing all of this equipment with the exception of the large s g to near the Wharton Studio building (DPW Mainte ce Building) and the beloved' ly Bug.' However, the scope and efi-. $$ e for removal of existing equipment will be dete 'ned in consultation •th park s ; , the Parks Co ssion, and the Board of Public Works. We believe that any initial resistance to remo g old equipment will quickly wane when the new playgro d is completed. Design Description The Pinnacle Path The playground is organized d a gently -sloped be riscs to an elevation of 5'3" at "The Pi $ cle." This overlook is reached by an accessible path .y that does not exceed a 5% gradient. The pathway cu •tes at the P ; cle with a lovely view of the park and Cayu.ga Lake. This Pinnacle Path is s ced in concrete with a handrail on one edge and a curb on the other. The rail and curb are now required by code, due to the gentle slope; they are po -3 el ents to safely and comfortably. o • odating those with mobility c enges. The path has four circular, level, and shaded gathe Ig places bounded by •c limestone seating walls. In our design work with physical and occupation therapists and accessibility advocates and experts, we le. d that the experience of height is exciting and • usual for those in wheelch . • Elevation also creates many oppo i'ties for cl• bing and sliding for all children. Both the pre- school and school age play struct tie into the i along its climb providing access directly onto these accessible play stru es. The Pi acle Play Zone is located between the final two path circles at an elevation of approximately 5' 3". It supports two beautiful stainless steel slides, and boulder sc ble and a hillside climbing net. FSP and our accessibility advisors believe that this pathway will be a very popular destination for people of all ages with and . ge of mobility issues. However, the concrete pad is curbed (therefore inaccessible), is all day, is very uall, and does not ent an intere ig ety of play exp ences common in modern splash pads.
