T:7is solution could involve scr,e City expense, though my reading of State F.aiiroad Law, Section 9y, indicates that si7nals on state hic;hwag crossings are paid for by state and railroad; thus, if State, Seneca and Buffalo were to be -signaled, there might be no recalre.mcnt for a city share. Nr. Connor did not propose such: a project, nor was there furt.'ier dis- cussion on it. Actually, the law seers to put the burden of initiating re- guests on the local government. If such a nethod is desired either as an interim measure or to elir,.inate the need for grade separation for Rt.96, it should be further reviewed for suitability. 1:r. Connor raised the issue of city limitation of train speed as a contri- buting factor in both concerns. He as);ed i f we i,,oul d consider Tai sina the 5 MPH limit to 10 IIPH, chick would shorten the time delay for regular traffic as well as avoid some potential delays of train or emergency traffic in emergency situations. He was under the impression that there is so^?e city legislation imposing the 5 MPli limit, but I have uncovered none in the City Code 13oo,k or .in- c-onsultation with Supt. Dingman or Dep. Police Chief Pagliaro, or in State Railroad, Highway or General Punicipal Law. If CO;JRAIL names such a request, and further search reveals no such limit enacted at local or State level , perhaps a simple resolution by Common Council would be all that is necessary. Your willingness to meet and work toward a solution of local problems involving the railroad would have been appreciated even had the outcome not been so promising. The solution to the traffic conuestion problem which you have volunteered to implement shortly, to schedule morning and evening train ,move:rents an hour earlier, seems to offer good potential for nirtimiziny- evening rusty-hour tie-ups. Ewen if it doesn't completely eliminate the problem, it will certainly be recognized as a sten in the right direction, to your credit and Conrail 's also. I should think that the earlier evenina schedule should benefit safety and worY.- ina conditions in the.Ithaca yard. Further contact on this matter should only I be necessary if monitoring by City and Conrail reveals problems. i As to the question of eneroenoy access across the track:, your suggestion of e-nergency signals seerns to offer the simplest and most direct means. We will hold this under advisement for the time being, but may wish to tal=e it up again after further local discussion. Since you seemed to indicate that the City would be resDonsible for installation of such si_anals, could you give us sose indication of the installed cost for an appropriate unit? State Railroad Law, Section 99, seems to indicate that the City would be only partly liable for such costs. With respect to the issue of City speed lim=it on trains, which you raised, I am sure we would consider raising it to 10 mph. I would thin). that a request to the City for such consideration, when branch operations and track- age are ready for increas"d speed, would be quickly acted on. However, brief search of official City records does not turn up any documentation of such sneed limit. If you have any such documentation, would you please send us a copy or a reference? Clinton Street Ithaca, New York 14850 Dear Chief Herson: Thanks for your letter following up my conversation with Deputy Chief Pagliaro. I understand your reservation about the effectiveness of the train schedule changes, particularly when the high .tate-afternoon peak of park-bound traffic hits those crossings. That potential situation should be kept in mind for observation when the leagues _get underway, but for now--say the next 3 to 4 weeks, since Conrail said the change would be implemented within two weeks after the meeting--would you please ask your personnel to keep an eye on the crossings to see if it has agy effect? Your concerns about increased train speed mirror mine, and I have told the Conrail Superintendent that the city would need assurance it would not increase the chance of derailments, before we'd consider it. I have not been table to find any record of city speed limits for trains either; It must have been a Conrail internal decision, due perhaps to similar safety considerations. It appears that at one point Conrail at least verbally agreed to modify their schedules somewhat and go through the City an hour earlier. They apparently never agreed to do so in writing . I would suggest that the staff of the City or my office if you desire should recommence negotiations with Conrail to see 'if something can be done to alleviate the late afternoon trips . Connor Superintendent Susquehanna Division 1 CONRAIL Hornell , N.Y. 14853 Dear Mr. Connor: In Mr. Hurd ' s letter of 3 January to me, copy to you, there »ere a couple of statements on which we would appreciate further information. This will help us evaluate alternative plans for improvements to NYS Route 96 which are currently being developed. Mr. Hurd states that* the Ludiowville-Ithaca local return trip must con- tinue to operate over grade crossings in the City during evening rush hours. Could you please explain the reasons for this? He says he understands there are alternate routes to get from one side of the tracks to the other during rush hours. While there is , in fact, one grade-separated crossing in the Ithaca area , its use requires a 41,-mile detour partly over the same congested City streets. Even at ambulance sr)eed this adds ten or more minutes to a hospital trill. This could be avoided either by construction of an expensive and perhaps not cost- justifiable overpass as part of the Route 96 project , or by changes in trie operation of trains (includinq scheduling) to permit passage of emergency traffic over existing grade crossings. Mr. Hurd suggests that time advantage could be gained by changing the City ordinance governing train speed. However, we understand there are physical factors operating here which are solely within the jurisdiction of Conrail , limiting train speed. These are condition of roadbed and train length. It Would seem likely that the City' s CDmmor Council would consider increasinc the speed limit to, say, fen mi�'ies per hour if Conrt:il would give assurance that the time delay due to train crossings would be halved. Another question, was raised in earlier correspondence which has not been addressed: Would it not be possible, using modern communications equip- ment, to establish a system and procedures by which local authoritites could notify trains to accelerate or decelerate in order to maintain an open for amergency vehicles? Such a system:, it it were called into action,, could help save lives at a fraction of the cost of an over- pass. Your early response to these questions would be most helpful . Liguori PE Commissioner of Planning June 8, 1982 Mayor William Shaw City of Ithaca 108 East Green Street Ithaca, NY 14850 Dear Bill: At a recent meeting of the Planning Committee of Council there was some discussion on the so-called 5 minute rule relating to 'trains blocking the flow of traffic on a road or street. Subsequently, I mentioned to you that the 5 minute rule does not apply to a moving train. I told you that I would try to confirm this with the New York State Department of Transportation. Steve Vetter, Engineer, NYSDOT, Syracuse Regional Office, has con- firmed that there is no specified time limitation in the State Traffic Laws in connection with the number of minutes that a moving train may block traffic. In other words, as long as the train is moving there is no designated time limitation. The 5 minute limita- tion applies to a train which is either stopped at a crossing (blocking traffic), or is stopped or switching in the immediate vicinity so that the traffic control signal is activated. Under these conditions, the train cannot block traffic for more than 5 minutes. If you wish further clarification you may call Steve Vetter at 315-428-8159. Also attached is a Bulletin Order from Conrail listing on page 2 the Ithaca line. The miles per hour (train) restriction rate is listed as 10 mph. Also note that the track between M.P. 306.7 and Milliken, is currently out of service on weekdays from 7: 00 a.m. to 3: 30 p.m. for maintenance. Berson Chief of Police SUBJECT CLIFF / PARK ROAD INTERSECTION SPENCER ROAD TRAFFIC On the issue of the Traffic Control Signal at the intersection of Route 96 (Cliff Street ) and Park Road , there does not appear to be any reasonable , workable method available under the present arrangement . As I indicated to you in an earlier meeting , one considerai:ion would have been to install vehicle detectors , which in essence would create a demand type of flow to the traffic during peak periods either direction . I would not however recommend this 4s being the answer , as this could seriously back traffic up on Cliff Street , and /or the bridge when traffic is peaked on Park Road due tc events takin , place at Cass Park , Treman Marina or Taughannocl- Park , etc . In that case we would seriously hinder access tc the hospital , or to Fire or Emergency equipment going to the gest Hill area . It is our feeling, that monitoring by the Patrol and Traffic Division personnel , and the continued manual working of the traffic control device is the best solution when man-power is available . Obviously , an alternate route appears to be the only real solution to this problem we have been living with for many years now. In relation to the Spencer Street problems , the Deputy Chief has discussed same with the Traffic Officers , Dockstader and Grover , and it is their total feelings that setting up Radar on a periodic basis will help alleviate most of the problems . Again , mar-power situations do—not always allow us this privilege . It is not our recommendation that the Spee ` be reduced , and _ believe that the installation of "Speed Dumps " are __iect;a= or, public streets . Please note attachments as they pertain to the "Stop Signs" at the intersection of Spencer Road and Albany Street . These diagrams show the locations of the Stop Signs that you have questioned , and also show on each separate sheet the distinctive use for each particular sign . Subsequently, I mentioned to you that the 5 minute rule does not apply to a moving train. I told you that I would try to confirm this with the New York State Department of Transportation. Steve Vetter, Engineer, NYSDOT, Syracuse Regional Office, has con- firmed that there is no specified time limitation in the State Traffic Laws in connection with the number of minutes that a moving train may block traffic. In other words, as long as the train is moving there is no designated time limitation. The 5 minute limita- tion applies to a train which is either stopped at a crossing (blocking traffic), or is stopped or switching in the immediate vicinity so that the traffic control signal is activated. Under these conditions, the train cannot block traffic for more than 5 minutes. If you wish. further clarification you may call Steve Vetter at 315-428-8159. Also attached is a Bulletin Order from Conrail listing on page 2 the Ithaca line. The miles per hour (train) restriction rate is listed as 10 mph. Also note that the track between M.P. 306.7 and Milliken is currently out of service on weekdays from 7:00 a.m. to 3:30 p.m. for maintenance. I appreciate your instructions to your transportation supervisor to run the north bound train one hour later. Can you be more specific as to when this north bound train will be going through the West End of the City of Ithaca. I am also informed that south bound trains have gone through the City at the most inopportune times . In fact I enclose a copy of a police report dated August 5, 1982 concerning massive traffic jame in the City of Ithaca between 4:00 and 5:00 p.m, on August 3 and 4, 1982 . The problem is getting insurmountable and I would like to further discuss with you as soon as possible the scheduling of trains through the City of Ithaca. It has even been suggested that Section 53C of the Railroad Law, a copy of which is enclosed, also applies in that that section does not require a train to be stopped before a highway crossing is obstructed for more than five minutes . Riddle did say that he hadjust spoken to Mr. Reed and the later would be responding to your latest correspondence dated 9/3/82 . Mr . Riddle indicated that they understood that the local employees and supervisors had shifted the boarding time of their northbound train from 4 : 00 P .M. to 5 : 00 P .M. In our conversations, you informed me that there is no ordinance restricting train speed and, indeed, Section 53(2 ) of New York railroad law would prohibit the imposition of a municipal speed limitation of less than 40 m.p.h. at four of the five grade crossings affected. As I informed you in our telephone conversation of October 28, 1982, Conrail ' s Regional General Manager has informed me that the operating speed of trains through Ithaca will be raised to 10 m.p.h. He was hopeful that could be accomplished by November 1. I was also informed that the normal scheduling of train movements in Ithaca is such as to avoid the rush hours . Recently, because of track work, some movements were made during the rush hours but that problem has now been corrected. Currently Conrail's local train operates north bound through Ithaca Monday through Friday about 6:30 P.M. and returns about 11:00 P.M. Beginning March 17, 1983, the crew will go north about 6:30 A.M. and return before the afternoon rush hour (about 2:00 P.M. ) . We took a traffic study on March 4, . 1983, of the. States Street Crossing and find that the hour between 6:00 A.ti - and 7:00 A.M. has less traffic of 'any hour checked during the day up to 9:00 P.M. Richard Stumbar, Corporate Counsel DATE: October 12, 1984 RE: CONRAIL SCHEDULES At the October 3 Common Council meeting I was asked to obtain the documents relating to last year's request to Conrail to curtail train traffic during rush hours. I have enclosed herein the relevent correspondence as well as Council's resolution of February 2, 1983. In the letter of March 15, 1983 Conrail's Asst. General Manager C. H. -Allen agreed to run the trains at "about 6:30 A.M." and 2:00 P.M. This was satisfactory to Paul Tavelli who by letter dated March 18, 1983 withdrew the City's complaint to NYDOT. However Ray Schlather wrote a memo dated March 28, 1983 indicating that in fact the schedule was not satisfactory because the 6:30 A.M. train, if even a little late, would run into rush hour traffic. There is no indication that Paul did any follow-up. What is your pleasure? Enc. Conrail had verbally agreed (Mr. J. W. Conner, Supt. Susquehanna Division, Hornell ) to modify their schedule for train movements "from Ithaca to Milliken and back will be begun an hour earlier". This effort by Conrail worked well for some time, but recent events have indicated a change in the policy. More and more the trains are passing through the City at the peak traffic time with the most recent being on Tuesday, November 27, 1984 at 4:55 p.m. Conrail has shown over the past several years that passage of trains through Ithaca at peak traffic periods can be avoided. I am not sure that Conrail's operational changes, recently enacted, do indeed resolve the matter. Specifically, the 6:30 a.m. train, if even 15 minutes late, will seriously interfere with the early morning traffic in the City's West End. In this respect, on at least two occasions during this past week, the Conrail train passed through at 7:00 a.m. or later. Is there any way that Conrail could schedule its trains to head north at approximately 11:00 p.m. , and return south between 5:00 and 6:00 a.m. ? Currently Conrail's local train operates north bound through Ithaca Monday through Friday about 6:30 P.M. and return; about 11:00 P.M. Beginning March 17, 1983, the crew will go north about 6:30 A.M. and rete before the afternoon rush hour (about 2:00 P.M. ) . Ie took a traffic stud on March 4, 1983, of the. Herson - Chief of Police RE CONRAIL TRAINS Please refer to attached copy of a report 86-1648 filed by Officer Charles House on his experience with traffic on March 3, 1986 due to the Conrail Train blocking intersections during peak traffic hours. There have been attempted agreements in the past between the City of Ithaca and CONRAIL, that their train movements would not take place during peak traffic hours, either in the morning, or afternoon hours. It now appears that they are now operating schedules that seriously hamper the direction of traffic and more importantly endangering the movement of emergency vehicles at critical times in the West end of the community. It is my understanding that the City Attorney has in the past communicated with Officials of CONRAIL over these problems, and it now appears that on the basis of the situations as explained by Officer Charles House, this agreement should be re-affirmed at this time. Green Street Ithaca, New York 14805 Dear Sir : Reference to your letter of March 13 , 1986 , concerning the incident on March 3rd , when Conrail train went through Ithaca during the morning rush hour . We have investigated this incident and found that we had an apparent communication failure with our conductor at Ithaca. Our intent is not to operate through Ithaca between the hours of 7 : 00 A.M. to 9 : 00 A.M. and 4: 00 P .M. to 7 : 00 P .M. Since we made that commitment , we have also been contacted by Edward M. Olmstead , Jr . , Fire Chief , requesting that we notify the Tompkins County Emergency Control before operating a train through Ithaca to allow fire and emergency medical apparatus and personnel to be moved to the west side of the train tracks . On the morning of March 3rd, the trains was delayed at Ithaca Yard until after 7 : 00 A.M. The conductor contacted the Tompkins County Emergency Control, and mistakenly thought that that satisfied our commitment , and proceeded north through Ithaca . We have reviewed our guidelines with this conductor on March 20th, and he now understands our commitment to the city. Except in an emergency, we will not operate through town during rush hours with a long train. We will, of course , continue to notify the Tompkins County Emergency Control of all train movements . As agreed to in Paragraph 1 of Mr. Olmstead' s letter, no crossing was blocked for more than 60 seconds and thus notification was not given. Our crew also reports that they did give a full 15 minutes notification time for the movement of the full coal train at approximately 9 :20 A.M. We have reviewed with the conductor the necessity of the 15 minutes notification, and I believe that in this case, that notification was given. The fire department has been keeping track of the trains (no pun intended ) since 10/3/85 and has been stationing fire and emergency medical apparatus and personnel across the tracks during train passages. As a practical matter , no notifications are made to the fire department when the length of the delay is less than one minute. There have been a few glitches, but for the most part , the system is providing a tempoEary solution to train obstructions. We have not recorded any fires, EMS calls or emergency traffic needs during these standbys. A copy of a letter to Chuck Allen of Conrail is also enclosed . I have asked Allen to meet with me (us) in the next few weeks to discuss the notification and train movement procedure. SUBJEC r ency Medical Service During n=�Mo�/ements As the attac ed letter indicates, we appear to have an agreement witnp-n'raillto notify us when they breeze through the West End . . Starting Monday, September 30, 1985, the Fire Department will be placing 1 engine (read hose and water ) , 1 ladder truck and one officer west of the crossing whenever the train takes longer than 1 minute to pass a crossing ( that is about 15-20 cars) . We are saying , in effect , that we accept the risk of a 1 minute response delay. Included in the equipment/personnel component will be at least 1 EMT and basic life support equipment . At least 3 firefighters will be with the apparatus ( total ) . In all cases, the placement of apparatus will be subject to the availability of personnel and equipment . That means sometimes we can' t do it . We will be keeping accurate records of times and events so we can review and improve the procedure. I don' t plan to make a media blitz about this as I am somewhat embarrassed by our historical lack of concern and action. That should not deter you folks from spreading the word , however . Rest assured that once we have the bugs out of the procedure and we are on the west side of the tracks when a event occurs while the train is passing , we will not be bashful about taking credit . Allen: This letter will summarize my understanding of our telephone discussion of 9/18/85 regarding notification of train movements that block: off the western portion of the City Of Ithaca, 1 ) The Ithaca Fire Department will be notified by Conrail of any movement through the City of Ithaca, in any direction, that blocks 1 or more crossings for a period Of time that exceeds 1 minute. 2) The train conductor will notify the Ithaca Fire Department by telephone 15-30 minutes prior to each movement described in Item 1 . 3) The telephone call will be made to Tompkins County Emergency Control (607-273--8000) . The conductor- will tell the Fire Dispatcher the time that the train is expected to pass through the "West End" of the City of Ithaca. This includes the rail crossings at West State Street , West Seneca Street , and West Buffalo Street 4) During the time that the rail crossings are Obstructed , the Fire Department will place fire and emergency medical. apparatus and personnel on the west side of the train tracks. 5) The Fire Department will record the actual times involved in the movements. Conrail and the Ithaca Fire Department will review the procedure 30 days after it begins and on , regular basis thereafter to determine if revisions need to be considered.
