In addition to the powers conferred by the lit section the Common Council has power to adopt ordinances for the following PurPoass within the city: 1. to regulate, a provide for the licensing of,expresemen, oartmen, porters, hack, cab, truck, omnibus and stage owner* or drivers, and the use of vehicles plying for hire in the trensporta,- tion .of personi or of articles of any kind, 'mete require his era of such vehicles to mark the same in such manner as the Council may designate, and to fix and regulate the amounts and rates of their compensation; also to regulate 'aand provide for the licensing ofd auctions and auctioneers, temporary sales and those conducting them, intelligence offices and those conducting them, junk-dealers and dealers in second-hand articles, pawnbroking and pawnbrokers, peddling and pear• diere, huckstering and hucksters, and the selling of hay, straw and -tor* r ^ streets or public places; also to regulate, and provide for the licensing of sky-signs,m electrical and kits aAvartising. the distribution and distributor' of airc'4ars, handbills, or advertising cards of any description or of samples ples of merchandise in or upon any street or public place of vohi.- ale; bill posting and bill posters, and the ereetien or maintenehie of any billboard ; 1> along the line el any street or public place in the city; also to regulate the -storing, sale or transportation of gun- powder, epowder, gasolene, fireworks or other explosive or inflammable a.rti— oleo or things within the city, or the use of lights in barns, star blee and other places, and to regulate or prevent the making of bon- fires, the discharge of cannon and firearms, fireworks„ or other omp plosives, the ringing of bells, the blowing of whistles and the (try- ing ing of good or meroMndiso within the city; also to regulate or to provide for the licensing of billiard saloons and billiard tables, bowling allays, shooting galleries, mat nt for toner or vide for the licensing, restraint or prohibitiae of circuses, thea• tress or Other exhibitions or performances, il„ or the giving of any exhibitions, performances or entertainments in any place whore liquor maybe sold or drunk under a state tax certificate; also to reful�,uaQte the inspection and dealing of weithts> and-meas- of Getta ure s, the operation ssdtd speed of all vehi cle s,upon the public street, highways and places, the practice of crmalting or the playing of bell or other games in public streets or places or in such proximity thereto that they shall have a tendency to frighten horses or to sus- danger or annoy persons passing in the said streets or places; also ii1AmiRe .man p__a_.-� -sr IJ hi -in open water, expo"'4 11 "'t+-; r......,' within the city; also to provide for the licensing of dogs, the seisure of u licensed dogs, the care and protection of lost , strayed And homeless dogs for securing the rights of the owners thereof and for the pro- teetion of the public against dogs, and the destruction of dangerous or vicious dogs, whether licensed or not; and to authorise the mayor to enter into a contract with any incorporated society for the pre- rention of cruelty to animals hawing jurisdiction in the city for the , ,: y .. p Y iande ge;_,.©f all unlicensed dogs, and for the mainte- nance of a shelter for lost, strayed or homeless dogs; provided, however, that the amount paid said society therefor shall not exceed in any one year the amount o alleoted by the city from the payment of fees for dog licensee during the same year; also to establish and regulate a public pound, and to regulate and restrain the running at large in the city of cattle, horses, sheep, swine, and other ani- sale or fowls and to authorise the diet raining, impounding and sale of the some, for satisfaction of the penalty incurred and for the keepingander the proceedings. 2. To prohibit the obstruction of the streets of the city by the gathering and assembling of persons (eta. , as charter p. 16, paragraph 7 to: ) disorderly persons; to prevent any enoroao ment, in- oumbranos or obstruction in, upon, or over any street, sidewalk, highway or public place in the city, and in case of neglect or re- fusal of any person who shall have caused any such encroachment, s cumbrance or obstruction or of the owner or occupant of any premises gri--+►hl be any building a.e, ruc urs or thing onoroaohing upon, encumbering or obstructing -any street, side- walk, highway or public ground in the city, to remove the same after being notified by so to do, the Board of Public, 'Works shall have power to cause such removal at the cost and expense of such person or of such owner or occupant so neglecting or refusing, and to collect such cost and expense as hereinafter provided. • 4. To authorise the Board of Public Works to grant a license or permieeien for an encroachment or projection over or on a public street, him or plat, or for the construction of areaways and sears beneath sidewalks of the public streets, highways or places; but no ordinance so authorising the board of public works shall bare reference to more than ono ouch enoroaohment, projection or none%rte tion, nor shall such ordinance be adop tsd except after a public hear- 1 t o no . tete must be publi shad, at the sole cost and eapen oe of the person applying for such license, for at least three days dur- , ing the week preceding the said hearing, in some daily newspaper pub. To require all persona owning or occupying property in the city and the owners of unoccupied property therein to rem ' alb. snow, ice and dirt from the sidewalks adjacent to the premises so owned or ocoupied by them and to keep the same clean and free there- from, and in case of neglect or refusal on the part of such owner or occupant so to do, the board of public works shell have power to remove the same at his wens', and to impose and aollaeot such pen- a +ded by amr } § e.`. : ; y size. ne- glect or refusal. The council may direct the manner of issuing and registering licenses, and prescribe the sum of money to be paid therefore into the treasury of the city; but no licensee authorized pursuant to (seotions 1, paragraphs 1-4 of Further powers) ahall be granted or valid for more than one year, and the person or corporation receiv Ing any licence shall, before the issuing thereof, exeoute a bond to the city, in each *sum as the common council may proscribe, with t sureties, .c ons r' vanee of the oherter and ordinance of the city. The mayor shall on- quire into the sufficiency of the securities in such bond, and the same, when approved by him, shall be filed in the office of the clerk of the city. Any board, bureau or officer authorized by ordinance of the common council to grant any license has discretionary power to get or refuse the same, and, except as otherwise determined in thio qct, the common council may provide that any license, right or permission 'granted under* or by virtue of an ordinance thereof, nay be re yoked by the board, bureau or officer issuing the same, either a mmaril; isaiii0204,11011e1011r4M4110/sientenv, or atter a rear# w; "` the laws of the state or the ordinances of the common council by the person or corporation to whom the same was granted, or Who is acting under or using the same, or by his or its agents, esrvants or employees. In any case where the city of Ithaca is, under the provisions of any law of the *tato, authorised to grant consentsi commonly call- ed franchises, to any person or persons, corporation or corporations, to construct, maintain or operate tracks, poles, wires, pipes, con- duits, or other constructions in, over, under or along the streets, alleys, highways, or public places of the city, no such con tent ar franchise shall be valid unless authorized or consented to by ordi. No franchise hereafter gpanted, and no addition to or sen- ', franshiso rights already existing, in the city, shall be granted or operative for a longer period than fifty (?) years. All +misting ordi- nances. by-laws, resolutions or regulations of the former village of Ithaca or of the city of Ithaca, not inconsistent with the provisions of law or of this act, are hereby declared to continue in full f orc e and effect within the limits of the city until repealed or modified, as provided in this act. No appropriation of money may be made by the common council for any purpose except by ordinance specs Ong amount thereof, and the department, board, bureau, court, office or specific fund for which the appropriation is made. The mayor and aldermen of the city shall con- stitute on- stit to the common council thereof. Section 2. The common council shall meet on the first day of. January after the election at the regular place of meeting of t ,? co.rrirn council for the previous year, and thereafter it shall meet- a* the places and times hereinafter .provided: Section 3. At all meetings of the common council, the mayor when present, shall preside, but in his absence one of the aldermen shall be called to the chair. In the proceedings of the common council, each meaber present shall have avote, except the mayor, who shall have only a casting vote when the votes of the other members are tied, and except as hereinafter provided. The sittings of the common council shall be public except when the public interest shall require secrecy. The minutes of the proceedings shall be kept by the city clerk _be open at a4.41 time ; A majority of th.e common council shall be a quorum for the trans action of business , but no tax or assessment shall he ordered except by a concurr1ng vote of a majority of all the members of the common council innoffice, including the mayor who shall be entitled to vote thereon as a member of the council , and no tax levied, assessment-bill ordered , resolution or ordinance shall take effect until the same shall receive the approval of the mayor, as hereinafter provided. Regular and Special Meetings . Sec . 4. To suppress, repress and restrain disorderly houses, houses of ill fame, billiard tables, bowling allays, pistol galleries, and houses and place whre intoxicating liquors are sold to be drank and to restrain and punish the keepers thereof. 5. To restrain and punish vagrant mondicats, street beggars and persons soliciting alms, common prostitutes, lewd TM? "All matter intended to be incorporated in the revised Charter, involving any material change in existing law, shall be first tentative- ly adopted by a majority vote of the members present at any meeting of the Committee, subject to reconsideration on motion of any member of the Committee at any time before final passage. The Secretary shall furnish copy of all resolutions adopted at any meeting (except in executive session) to all newspapers published in the City who desire to publish the same as a matter of news. Before any provision thus tentatively adopted shall be presented for final passage , at least one weekts notice of such presenta- tion, stating briefly the nature of the change involved, shall be given, either orally at a previous meeting , or by the Chairman through the daily papers ; but in case of emergency a majority of the aggregate membership of both committees may waive such notice. The Sub Committee on the "Board of Public Works , its organiza- tion, general powers and duties" , submitted with recommendations XXII a preliminary report, which, on Motion was received and ordered placed on file . On motion, by Mr. Treman, RESOLVED, that the Chairman of the several Sub Committees be requested to submit preliminary reports in writing . The sub committeeon the "Powers of the Board of Public Works in respect to water service" filed copies of the Law and of the rules and regulations governing the Water Board and recommended its substantial adoptit applied to the water service under the Board of Public Works. Mr. Lynch, relative to the sewer service, recommended the substantial adoption of the law and of the rules and regulations govern- ing the present Sewer Board. Mr. St.John, relative to Creeks and Creek Improvements, recommended the substantial adoption of the present law governing the Creek, Drainage & Park Commission. Mr. Rowlee relative to Cemetery & Parks, recommended the subatantial adoption of the provisions in the Creek, Drainage & Park Act applicable to Cemetery & Parks . The Committee, relative to the Fire Department , suggested the substantial adoption of the Law governing the Acts of the Fire Commission reserving to the Common Council all legislation. Relative to Schools, the Committee suggested the advisability of providing that all taxes and assessments , including school taxes, ' be in the hands of one City Collector Relative to Elective and Appointive officers, the Committee submitted verbal report suggesting the selection of one Engineer to have charge of all municipal engineering work, and the appointment of a Chamberlin to have charge of the Collection of all city revenues and the disbursement of all funds. Mr. Jacob Rothschild addressed the Committee urging that all branches of the city service should come under the direction of one Board . A joi petition was filed by the Woman's Club, the Political Stud Club and the Woman's Christian Temperance Union urging that provisi be made whereby the State Law may Iteevail in the matter of extending the privilege to vote for school officers and appropria- tions for school purposes. On motion the foregoing petition was referred to the Committee on Schools. The Mayor filed certain suggestions in the matter of establish- ing a uniform method in condemnation proceedings by the City and of levying assessments for improvements . The Mayor submitted further suggestions relative to certain phraseologies , terms, forms of expression and definitions for consi- deration in final draft to be inserted in the Charter. On motion by Mr. Stewart the foregoing suggestions were referred to the Committee on Constitutionality. On- motion by Mr. Stewart ; seconded by Mr. Rowlee, the Secretary was authorized to prepare copies of all reports submitted and furnish each member of both committees with copy thereof. Depriving~ the mayor of a vote helps to ensure permanence and to keep politics out of the Board. 5. There will he no occasion for a city tuperintenderit, appointed by the mayor. The Board of Public Works should ap- point one well paid general superintendent , (not necessarily an engineer, and never an engineer unless he is a business man as well as an engineer) , and two assistant superintendents, - one in charge of water and one doing the work now performed b m '. The Common Council should retain the power of commis stoners of highways for the purpose of laying put, altering or discontinuing highways; but the power to fix grades should rest with the -3oard of Public Works. 8. The Council should not only receive periodic state- ments of receipts and expenses from the Board of Public Worka: but should have the right to demand statement and full info ation at any time; and it should be the duty of the Council t keep fully informed and to inform the public in regard to the operations of the Board of Public Works. It is the only sa e guard against the otherwise unlimited power within its appr,,- priation of the Board of Public Works , and should be fearles:- ly exercised. '; t. t 6 } t a y y1 . 1 `^I 4 (610q— As it was requested by the chairman of your last meeting that I submit my statements in writing, I proceed in the moat concise form, for your consideration, to give the thoughts of an individual, and if therein there is any suggestion that can be consistently adopted for the betterment of our city's government, I will consider it time well spent. drat -of all, as it appears to the citizens who are favor of a public service commission, and wish to place the most responsible affairs of our municipal government in the hands of appointive officers instead of elective, as a means of prolonging the commissioners term of years for a longer period than an elective board of aldermen, the benefits are very apparent. Second, we could obtain better men to serve on the public works commission by eliminating the disagreeable ordeal of nominations and elections. These features are uppermost in the minds of the people, and justly so. It is a step in the right direction ; yet, the very essential question of placing our municipal government on a sound business basis is lost sight of, and when you complete your labors by asking a commission of four or six commissioners to serve you, to meet twice a month for an hour or two, to liston to the reports and recommendations of their subor- dinates, merely advising a policy of actions,- granting your first commission to be composed of excellent men, and who for a time will give up more time than the following boards, we must not lose sight of the business to be transacted in the future, by adding the water works and its problems, __and as the city1s expenditures are inoreasing and there are more details to be carried out, and the only incentive that prompts these men top serve the city is their public duty. You will pay dearly, as we do now, for the many wastes and indifferences 1 that arise -,,unity bath , "That I am one of the many", and "I am not expected to shoulder the blame and responsibility." It is either a patched up charter for the time being, or should we strive to start right "a business administration," pure ftizawso and simple, from start to finish,- "Pay for what you get , and get what you pay for . " ' These are the suggestions, as they appear to a layman, which, no doubt , will have to be revised to conform to the laws and statutes of our ,State. There are many defects, which, no doubt , will be pointed out ,- yet, after careful study, I am not willing to concede but what the principles can be adopted with best results. Elect a mayor every year. Pay him a slary to attend to the city's business, and no other. Aone year term is long enough for a poor mayor, and a good one with a good salary can easily be elected for a number of years. A City Clerk to be appointed by the mayor, to do all the • city's business not provided by the later commission, and pay him more than you do now, for the work is worth it. * City Engineer to attend to all the city's business, for all occasions. The Public Works Commission should consist of the following six commissioners, in their respective departments, with their titles which can best be named later ; each one with a respective salary. For your consideration let us call them, as follows : No.l. Commissioner to have charge of streets, bridges, parks and cemeteries. No. 2. Commission to have charge of water, sewers, etc. No. 3. Commissioner to have charge of the finances, tax assessor , tax collector and city treasurer . No. 4. Commissioner to have charge of health office, hospital, garbage, and poor master. No. 5. Commissioner of Public Safety Department, police department, and fire department . No. 6. Commissioner of Law Department, City Magistrate, - civil, criminal and city attorney. You can readily see there will be enough to keep each -3- commissioner busy, to do his duty, and pay him for keeping busy. Thus it will give you an appointment of the following differ- commissioner ent classes of men : No. 1, working man/; No. 2 , a business man; No. 3, a real estate man ; No . 4, a doctor ; No. 5, a fireman ; No. 6, a lawyer. The main objections I have heard while attending the meetings were that our school commissioners wanted a better tax�aollector than the city has had ; and the recommendation of our mayor to keep the fire department separate. The third objection is bound to come.- It will cost more to administrate our offices than now. Now, lot 's take objection No. 1.- We all realize the efficiency of our school board, and their perpetual policies have served than well, in spite of the innumerable criticisms, for which the publiois pardonable, as they do not always know facts; yet, we hope some day they will consider the welfare of the city and citizens at large. As individuals they are honored men ; why not collectively work on a broad city policy for what is best for the entire city ? I do not anticipate any diffibulty there. Objection No. 2. - To eliminating our Fire Department,- I have to offer for your consideration the following : In merging th® fire department with the police department it would not only bring a better service, but a more effective service ; not that we haven't a good Volunteer Fire Department ; not that we forget the services and risk of life of our firemen. This we hope to avoid, and place our- selves in a position in case of emergency that instead of taking these risks , there should be less risk. For instance have fifteen or twenty paid policemen doing police duty, as they do now, but let them acquaint themselves with all the dangerous cellars, alleys and dangerous fire places. Let them keep the fire apparatus in good condition. Give them something more to do for more pay. Have disciplined firemen and efficient policemen when the fire bell rings. Let them all be on fire duty, and half a dozen men can be appointed to act as police while they act as firemen. • • -4- Thereby you will in time have trained firemen, if you wish to keep your volunteer department , to aid in assisting. I am sure they would be welcome to stay, and get all the assistance they deserve for past services, as well as future. . I have in mind one company (not criticising) , but telling the truth, who are gentlemen of the highest type- so much so that they furnish a handy list for pall bearers to choose from. They are an honor to our city, to see them tie duty parade day (in front) , but I have not haard that one of their sons has recently applied for membership in their company. I da not find fault with our Fire Departmekt . We needed them, and for their past services I am willing to respect them and honor them, but we want a more efficient fire department. We want to pay for it . We also want to economize, merging the two together , to be called "Public Safety Department"'. The citizen would save more than the cost of maintenance, for less insurance rates in time to come. Besides it is well to presume that two or three lives might have been saved the past year, had we had a disciplined Fire Department. Extra Cost . There is no way of telling how much we can save, admitting that you will pay a few higher salaries, and in one or two instances, extra men. On the whole, deducting the amount now paid, the differ- ence you will save in having everything done in a business-like manner, will, I predict, not be very much more. In summing up the situation, I realize even our press calls practical ideas radical. I take no exception to being criticised, as I may have done too much of it in my own time, and even now, but it is done in the best of spirits. I have not picked up our humble organization for comparison. I really called your attention to the very men I eg(pect to reason with, and enlist their influence for better municipal government.. Let us forgetfor a little while our own form of opinions and reason what is best for our city. We do not worship ideals any more. The time 'pay tribute to military heroes, to place them in public office, is fast vanishing. Our party ties are fast breaking and independent voters are being • ..-- -5- more respected daily, so by not limiting their franchises, let them elect their common council and mayor on those principles, and let these commissioners be subject to the various committees that the common council will arrange in conformity with the various com- missioners. The mere partisan additions, by dividing everything equally, does not appeal nearly as much as to have four or six good men in their right places, be they- Republicans or Democrats. Hire your commissioners as you hire your own help ; as long as they do their duty, so long they have their jobs. We no longer cling to the ideas of the men who play to the galleries. We must be honest in our convictions, to have others re- spect our ideas. For instance, Governor Hughes could have received 410bt more applause and fraise by signing the 2g fare rate bill, but his opinion is respected more and more daily because he wanted even the railroad companies to have a square deal, and when the 20 rate is inaugurated, it will stay for good. I, therefore, ask your consideration to get a Charter on the lines that we can feel at least that we are honest with ourselves, not because we have no traditions to follow and business methods to adopt. It if is practical, why not consider it ? Think it over. Talk it over. There is no "nigger in this fence." It is either a business municipal government Charter or a makeshift pleasing delusion. Mr. Rothschild submitted a brief verbal report relative to P . the question of the control and management of the City Hospital, citing the methods pursued in Binghamton and Cortland. Also submitting a suggestion by the present management of the Hospital that the expenses of the Contagious Ward of the Hospital be a City Charge. Mr. Speed supplemented'Lreport in urging that the City assume, in some manner, a measure of the expenses of the Hospital as a public institution. Mayor Newman submitted, for the consideration of the Committee on Taxes and Assessments , the suggestion as to the advisability of extending the period for the collection of taxes from the date of filing the roll to the end of the fiscal year, with interest at the rate of One half of one per cent after the first thirty days and the usual penaltyfive per cent after the close of the year. Mr . Lynch offered the further suggestion for the consideration of the�Committee that all taxes, including city, school and county taxes , in the same tax roll, with two or more fixed periods for payment . ' There being no objections, the Chairman so referred the foregoing suggestions. The Chairman announced that the suggestion had been filed with him that the Charter-be 'amended so that the election of the _awor and the Recorder shall occur in years not conincident with the election of the Governor. The foregoing suggestion was referred to the Sub- committee on elective and appointive officers for consideration. Mr . Z`he _S ecial Committee heretofore appointed, to cone3:der-. ke question of having the City assume control of the City Hospital filed a report recommending extension of the powers of the Overseer of the Poorin providing for necessary Hospital care of the Poor and Indigent of the City and providing for the payment by the Common Council to the City Hospital at least $1,000 per year and providing further that the Common Council may co-operate with the City Hospital corpora- tion in providing adequate buildings and equipment for the care and treatment of the Poor of the City. A petition was filed urging favorable consideration on the question of amending the Charter providing for Women's- S xffr-aga- in' all matters pertaining to the Public Schools and of holding school office. On motion the foregoing petition was referred to the Committee on Schools. The Committee on Fire Department filed a final report in the matter of organization and operations of the Fire Department . The Committee on Elective & Appointive Officers submitted its report which was taken up and considered Section by Section. On Motion by Mr. Newman s seconded by Mr. Major RESOLVED, that the Chapter on Elective and Appointive officers be referred back to the Committee for complete and full draft to be submitted at the next ; tng Carried. Yr. Treman submitted the complete report en the Board of Public Works-Organization, Powers and duties which, on motion, was referred to the Committee on final draft . A delegation representing Fire Department Companies Nos . 1,3, 4,5,6,7 , and 9 appeared before the Committee in behalf of the several companies representing protests and arguments in opposition to the proposed change in the management of the Fire Department providing that the same shall be under the control of the Board of Public Works . Also in opposition to the appointment of the Chief Engineer. Communications sere received from Fire Companies No . 2 and No. 8 in support of the proposed transfer of the Fire Department to the control of the Board of Public Works . By Mr. Newman t seconded by Mr. Treman RESOLVER, that action of the Committee relating to the control of the Fire Department be reconsidered . Carried. After prolonged discussion and argument the meter of final action relating to the Fire Department was, on motion by Yr. Treman and a vote of four to three , laid on the table. Chairman wing announced that the provision as drafted continu- ing the control of the Fire Department in the hands of a separate Commission would be forwarded to Albany. By ) r. Recommending also that the provision be modified requiring that two of the Commissioners shall be active firemen. The consideration of the foregoing petition was deferred to be taken up in the regular order . Bristol : RESOLITPD, that, the original clause , providing that the City Chamberlain shall be appointed by the '`ayor subject to confirmation by the Common Council , be restored irmtead of providing that he shall be elected by the people . By a rising vote there were 6 ayes and 5 nays Referring to the Rule requiring two-thirds vote of the full Committee for final adoption, the Chairman ruled the above motion lost . ,`r. Stewart appealed from the decision of the Chair and with the rising vote there were five ayes and 5 nays . The Chair ruled the Chair sustained. r'r. We are compelled to believe that there is a safer, more economic and business-like method of administering our city affairs than the one proposed and we wouldrecommend that - accre of the proposed charter be def erre , ;: subject be left to the further and continued deliberation of the charter commission; that a complete examination be made into the Galveston plan of city government. And we believe that with a full and fair understanding of the commission form of government as the same is administered in many cities of the West/that the charter commission will be lead to incorporate many of its business-like features in a charter for Ithaca,if' it is not deemed expedient andwise to adopt the general plan as a whole.
