Whispell, former Board Members; Myrtle Spencer and Shirley McGowan, Northside tenants; Martha Nelson, Nancy Hall, Marla Osterweel, Walter Brock CALL TO ORDER The Chairman called the meeting to order with a quorum present. APPROVAL OF MINUTES Motion made by Mr. Baldwin, seconded by Mr. Slattery that minutes of the regular Board meeting of January 6, 1977 be accepted. Motion made by Mr. Slattery and seconded by Mr. Crowley that the minutes of the Special Board meeting of January 11, 1977 be accepted. Ayes 5 Nayes 0 REP O R T S TIT_U_S TOWE_RS_T_E_N_A_NT _CO_UNCIL - Nancy Hall spoke In behalf of the Titus Towers Tenant Council In the absence of the Chairman. Tenants are very pleased with the installation of the new outdoor lock. Discussion of the flag not being in use for a few days. The Executive Director will look into the matter in the event there is a technical problem. Ms. Hall said that there had been no complaints re- ceived from the tenants. NORTHSIDE TENANT COUNCIL - Ms. McGowan advised the Board that election did not take place Tuesday because Viola was ill and attendance was not good, possibly due to the weather and not knowing other tenants personally. Flyers were distributed to tenants in an effort to get them interested in what the Council was doing. -2- There were complaints in the project of uncleaned sidewalks. Question raised about a tenant representative on the Board. The Board expects to act upon the resolution tonight to adopt the by-laws entitled Election of Tenant Representatives and Election of Tenant Representative Procedures. Once the by-laws are passed the election will probably be held on the third Thursday in April. A certain time frame has to be maintained. PERSONNEL COMMITTEE Question raised by Mr. Cusack regarding personnel. Executive Director advised Mr. Cusack that the personnel policy is fashioned after the Civil Service Commission Rules and Regulations. Problem in Parking Lots - Executive Director informed Board that Camp McCormick made available to the IHA six boys who worked four afternoons a week, three hours per day. She was not aware of a snow removal problem in the projects and assumed that the Camp McCormick boys had their work planned for them. She will check into snow removal immediately. Further, when a call is received from a tenant it is im- mediately transferred to a work order which she checks a few times each day, and was not aware maintenance was not doing the work. The project supervisor at Camp McCormick said that the boys could work in other projects beside Titus Towers, but a work program was never set up by the Maintenance Foreman. They are also allowed to work in cleaning recreation rooms, laundromats, painting, and can be utilized in many areas. Chairman commented on the financial savings in using Camp McCormick and that it was equivalent to two additional maintenance men. Executive Director will check into a work program for the boys. Chairman raised question about the snow removal equipment and the plow on the truck. If they were in good condition there should be no reason for the un- cleaned sidewalks. TENANT RELATIONS SELECTOR'S REPORT Approved by the Board. Report attached and made a part of the minutes. FINANCIAL REPORT Chairman explained the Glover Escrow Account which was due to claims by the tenant that certain work had not been done in his apartment. Executive Director commented that report is deceiving, had discussed this with the Principal Account Clerk, but has failed in receiving a proper financial report. She assured the Board that proper reports would be given in the future. Principal Account Clerk's total in the escrow account is not accurate, actually approximately $200 is in escrow on arrearage. Ms. Battisti would discuss the financial reports with the Principal Account Clerk again. -3- Ms. Battisti further explained the payment plan outlined by her regarding six active accounts that were in arrears. The Board does not want to reach the point as existed in March, 1976 when Accounts Receivable were over $8,000. It then becomes too difficult for tenants to repay. Tenants should not be evicted immediately when they have not been instructed to pay their rent on time. It was agreed at the last Board meeting the Executive Director would have the prerogative to decide which tenants would live up to their agreement in paying arrears. Those who have not have been sent notice for 48 hour conference. How- ever, if the Board feels that eviction should take place for non-payment after the 5th of the month, that is a policy that should be set by the Board. Mr. Baldwin questioned if a fund should be set up for tenants in financial trouble. Director thought not, but the Tenant's Council has monies if they want to do this. Management should not be involved in the lending business. It is not the intent of the IHA to evict, but we cannot allow tenants to get behind three or four months in payments as in the past. Director will set up system to pay arrearages. Mr. Baldwin also noted that the Board is short one member. Nancy Hall reported that there was a mix-up in the mail. It was pointed out that possibly there were no names listed inside the mail boxes. Postmaster to be notified. ATTORNEY'S COMMENTS ON SOUTHVIEW PROJECT DEFICIENCIES Mr. Stolp said that it is difficult in getting the contracts together to determine who is exactly responsible, and until he has all of the contracts he cannot go after anyone in particular until he has this information. As soon as he has the contracts and the correspondence between the various parties he will be able to do something for the Authority. Question raised if there is an extension in the contract, and Mr. Stolp said not unless it is limited by the contract, or the warranty is limited by the con- tract, and he will not know that until he sees them. Mr. Cunningham asked about the development of the Hector Street six units that were being deprogrammed. A meeting is to be set up on February 24, 1977 with HUD, the architect and IHA to arrive at some sort of agreement. Ms. Battisti has had about four inquiries from contractors, realtors, etc. , whether the Authority was going to put it on the market. Permission from HUD is necessary. If the Board should decide by resolution that they entertain the idea of getting rid of the property, they should put it in writing and submit it to HUD giving a financial analysis of expenditures and income. HUD then would study the Board's report to see if it is feasible to maintain it. EXECUTIVE DIRECTOR'S REPORT The rear sections of the boiler at Titus Towers have been completely installed and are operating very well. -4- All of the documentation was submitted to HUD for Section 8 Housing, and we are awaiting their reply. There is a great deal of problems regarding cars in the tenants' parking lots. Ms. Battisti said that some tenants have not had their cars inspected, get another car, thereby using more parking space. She reminded the Board that they had passed an ordinance regarding this problem, and she was going to enforce it and have cars towed away. Ms. Battisti introduced Sandy Butler, a student with the Department of Community Service Education at Cornell University, who will be working with the IHA two days a week. Sandy's position will be in giving service to the tenants but will not be involved in counselling. Economic Opportunity Corp (EOC) has assigned a girl to IHA. When Executive Director was doing the Section 8 budget it was discovered that IHA did not have enough monies in the budget for a full-time secretary. Director had placed a request with EOC for a person to fill this position, and yesterday was advised that our request had been approved. The secretary is presently working with the Director and will be at the Site Office when it opens. A new maintenance man, Richard Olander, started work Monday. Mr. Olander will be working two weeks days and will then go on the 2-10 P.M. shift. Mr. Cunningham had invited Mr. Waselchak and Ms. Whispell to the meeting this evening. Mr. Slattery thought it would be a nice gesture that each time a board member's term expired or resigned the Board present them with a plaque for their service to the Board. The two members were presented with a plaque, and Mae Kelly will receive hers through the mail. OLD B U S INE S S RESOLUTIONS La Resolution #77-4 RESOLVED that Resolution #77-4 - Personnel Policy attached hereto and made a part hereof, be adopted and implemented in a manner compatible with the objectives of the United States Housing Act of 1917, amended by the Housing Community Development Act of 1974.. Donald Slattery moved that the resolution be adopted as introduced and read; motion seconded by Mr. Baldwin. Ayes 5 Nayes 0 Chairman declared motion carried and resolution adopted. -5- La Resolution #77-5 RESOLVED that Resolution #77-5 be implemented in a manner compatible with objectives of Title VI of the Civil Rights Act of 1964 and the United States Hous- ing Act of 1937, as amended by the Housing Community Development Act of 1974. Thomas Cusack moved that the resolution be adopted as introduced and read; motion seconded by Mr. Crowley. Ayes 5 Nayes 0 _ Chairman declared motion carried and resolution adopted. La Resolution #77-6 RESOLVED that Resolution #77-6 - Lease Agreement attached hereto and made a part hereof, be adopted and implemented in a manner compatible with the objectives of the United States Housing Act of 1937, amended by the Housing Community Development Act of 1974. John Crowley moved that the resolution be adopted as introduced and read; motion seconded by Donald Slattery. Ayes 5 Nayes 0 Chairman declared motion carried and resolution adopted. Question raised. Was it in the lease agreement that there is a penalty for late payment. Ms. Battisti advised the Board that the penalty clause was sub- ject to the approval of HUD. According to HUD many Authorities do implement this clause but do not like the idea of it being on a percentage basis and prefer a flat rate of between $3.00-$5.00. La Resolution #77-7 RESOLVED that Resolution #77-7 - Grievance Procedure attached hereto and made a part hereof, be adopted and implemented In a manner compatible with the ob- jectives of the United States Housing Act of 1937, amended by the Housing Community Development Act of 1974. Ayes 5 Nayes 0 Chairman declared motion carried and resolution adopted. -6- La Resolution #77-8 RESOLVED that Resolution #77-8 - Admission Policy attached hereto and made a part hereof, be adopted and implemented in a manner compatible with the ob- jectives of the United States Housing Act of 1937, amended by the Housing Community Development Act of 1974. Donald Slattery moved that the resolution be adopted as introduced and read; motion seconded by Thomas Cusack. Ayes 5 Nayes 0 Chairman declared motion carried and resolution adopted. La Resolution #77-9 RESOLVED that the Commissioners of the Ithaca Housing Authority of the City of Ithaca, New York, in compliance with the Public Housing Law of the State of New York, Section 30, as amended by the Laws of 1974, effective 1 January 1975, do hereby adopt the by-laws entitled Election of Tenant Representatives and Election of Tenant Representative Procedures as attached hereto and made a part hereof. There was discussion relating to the vacancy on the Board of the Family Tenant Representative. Mr. Cusack moved that the Board appoint someone to fill the position until time of the election. Mr. Baldwin seconded the motion. After lengthy dis- cussion the vote was: Baldwin Yes Slattery No Cusack Yes Crowley No Cunningham No Hart Absent La Resolution #77-10 WHEREAS, the Board of Commissioners, the Executive Director, all Tenant Council members, and Staff of the Ithaca Housing Authority wish to extend their appreciation to Myron Wasilchak for his effort, time, interest, sincerity and devotion to duty in assisting the Authority since 1971, NOW THEREFORE BE IT KNOWN, that all of the above mentioned acknowledge with thanks his services as a member and officer to the Ithaca Housing Authority. -7- Donald Slattery moved that the resolution be adopted as introduced and read; John Crowley seconded the motion. Ayes 5 Nayes 0 Chairman declared motion carried and resolution adopted. La Resolution 477-10A WHEREAS, the Board of Commissioners, the Executive Director, all Tenant Council members, and Staff of the Ithaca Housing Authority wish to extend their appreciation to Barbara B. Whispell for her effort, time, interest, sincerity and devotion to duty in assisting the Authority, NOW THEREFORE BE IT KNOWN, that all of the above mentioned acknowledge with thanks her services as a member and officer to the Ithaca Housing Authority. Thomas Cusack moved that the resolution be adopted as introduced and read; Ted Baldwin seconded the motion. Ayes 5 Nayes 0 Chairman declared motion carried and resolution adopted. La Resolution #77-11 BE IT HEREBY RESOLVED the Executive Director is hereby authorized to establish an account with Tompkins County Trust Company for Section 8 monies. Mr. Cusack moved that the resolution be adopted as introduced and read; Mr. Crowley seconded the motion. Ayes 5 Nayes 0 Chairman declared motion carried and resolution adopted. La Resolution #77-12 BE IT HEREBY RESOLVED the Executive Director is hereby authorized to establish a Savings Account with Tompkins County Trust Company for reserve monies. Mr. Cusack moved that the resolution be adopted as introduced and read; Mr. Crowley seconded the motion. Ayes 5 Nayes 0 Donald Slattery Secretary pro tem ITHACA HOUSING AUTHORITY BOARD OF COMMISSIONERS REGULAR MONTHLY MEETING MARCH 3, 1977 PRESENT: Elester Cunningham, Chairman; Donald Slattery, Frank Baldwin, Mary Hart, John Crowley, Thomas Cusack Mary Louise Battisti, Executive Director Robert Stolp, IHA Counsel CALL TO ORDER The Chairman called the meeting to order and a quorum was present. APPROVAL OF MINUTES The minutes of the previous Board meeting were not mailed to the Board members before the meeting and will not be dispensed with. This portion of the meeting will be taken up at the next meeting. OPEN DISCUSSION FROM THE FLOOR A taxpayer approached the Board. She must take the detour imposed upon her by the City of Ithaca and has noted in her trips up and down Hector Street a build- ing that is boarded up and she understands it is part of the low-income housing. She went on to state that the building was built by Giordano Construction Company, built under UDC funds, and still has a mortgage on it. It is condemned by the City and is closed to all tenants. She would like an answer as to why and what is going to be done about it. Is Giordano going to be made to fix it, is it going to be replaced, what is going to happen to it. Chairman explained that portion was boarded up and the tenants were removed from there because the building is unsafe, and plans are under study by the IHA architect and HUD engineers. Chairman told taxpayer that IHA is under HUD, and we are working on it, and will not attempt to get into legalization on it. Taxpayer said the $42,000 that was allocated has come into the IHA, and she has it on pretty good authority that it is here. It was to be sent into this area to fix and maintain the Hector Street housing, in conjunction with the other units in need of repair. Ms. Battisti advised the Board and taxpayer that the prevalidated money has not been received, and if the taxpayer has documentation to verify this statement she would like to see them because IHA is not in receipt of $42,000. Further, IHA -2- has been allocated some $80,000 for the rehabilitation of these properties but has not received any monies, just an allocation. The taxpayer commented that there is a discrepancy in what the Director says because Albany informed her that a check had been sent at least two weeks ago. Director explained that Albany does not sent the money, that monies are received through sale of notes. If Albany had informed taxpayer of monies received, she would like to know who the spokesman was. Taxpayer reiterated that she was told the money was with IHA; Director said we did not receive money as such. IHA receives an alloca- tion which is a little different. Taxpayer brought up $100,000 for the Farmer's Home Housing under Title 8. Director asked taxpayer if she was possibly remotely or alluding to the Section 8 Housing. IHA has an allocation of $160,000 which we do not get in one lump sum, which is requisitioned as needed, and which as yet has not been received. We do not handle Farmer's. Home Administration monies in IHA. Taxpayer assured Board that she wanted only to get the information directly from them and not hear it from anyone else. Ms. Battisti did agree that there was quite a bit of misinterpretation and hoped that she had made clarification where the funding goes. Ms. Battisti assured taxpayer that FHA funds do not come through IHA. Mr. James Glover approached the Board to question the 5% late charge on late payments. Mr. Slattery advised Mr. Glover the Board is concerned about the wel- fare of the entire project and not just a single family. We must be sound financially so that everyone has a chance to live in these projects. A 5% late charge is not unreasonable because there is a large backlog on late payments. He reiterated that he would stand behind his vote. Mr. Glover did not think it fair that if someone did not pay by the 10th of the month they were sent a letter and told they were in danger of being evicted, and were charged a 5% late charge after the five-day period. Mr. Cunningham said that some people make no effort to pay their rent and have built up thousands of dollars in back rent. REPORTS TITUS TOWERS TENANT COUNCIL No report. Everything going fine at Titus Towers. NORTHSIDE TENANT COUNCIL Shirley McGowan reported that she cannot get the Tenant Council going, nor can she get the tenants out together. She has sent out communications, but until the office is returned in the community building where business can be conducted, tenants will not have the interest. Maintenance has equipment there, and the office has been turned into a workshop. It needs to be brought back to ,the tenants. Mr. Cusack asked why the Maintenance Department is storing their equipment in the community room. It was brought out that evidently the Maintenance Department \./ -3- took over this room when they started with the plexiglas. Ms. Battisti informed the Board that she had had a complaint from the County Youth Bureau because the Maintenance crew were cutting plexiglas on the pool and ping pong tables donated by them. Mr. Cusack made a motion to move the Maintenance Department out of the room and give it back to the community as an office. Mr. Cunningham suggested that it be tabled for discussion in executive session. The motion was withdrawn. SOUTH VIEW TENANT COUNCIL A question was raised why Hector Street, Center Street, and Northside were not together as it once was. Chairman suggested that tenants meet to get some- thing going. PERSONNEL COMMITTEE Chairman requested the Committee go into executive session. FINANCIAL COMMITTEE No report; however, there was a list of cash disbursements. TENANT RELATIONS COMMITTEE Mr. Baldwin of this Committee said that it is everyone's responsibility for good tenant relations. One Committee person cannot do it, but must be the attitude of a group of individuals. TENANT RELATIONS SPECIALIST'S REPORT Mr. David and Ms. Battisti are making tenant inspections. He felt his first step was in getting to know the tenants better. Ms. Battisti interjected that Mr. David does not give a full report, but only shows his tenant selections which is only part of his duties. He has been meeting with all types of social agencies, e.g. , Fire Department for safety precaution and setting up meetings for discussion; the Chief of Police speaking on security. Mr. David is not only working as a tenant selector but is fulfilling his position in tenant relations. EXECUTIVE DIRECTOR'S REPORT The biggest problem ensued by Management is the garbage problem. IHA does have a responsibility to the tenants and has been remiss insofar as not keeping the garbage bins cleaned out for the insertion of garbage. However, the tenants also have a responsibility in inserting the garbage in the proper bins. She would like to see a policy set up whereby tenants use only plastic bags. If the problem continues the City will stop collection. This means that IHA will have to pur- chase dumpsters and employ a private hauler. Our budget does not permit or allow -4- this, and IHA would have to assess each and every tenant for what the cost would be to haul the garbage. All of the tenants should live up to the provisions of their lease. Inspections have been made and there has been a great deal of controversy about these inspections. "Inspections have been made and will be made, and I have the right and I will use it." Board advised that it is Director's respon- sibility to inspect premises. Ms. Battisti explained that most of the defi- ciencies discovered on these inspections were not the fault of the tenants but the fault of the IHA. We are out to correct our own errors. HUD has advised Director to make one of two choices (1) make entry with key to inspect premises or (2) evict tenant that refuses entry. Based upon our tests of transactions and examination of records, we believe that the Ithaca Housing Authroity has substantially complied with the financial regulations and procedures perscribed by management and those of its governing board. 2. As part of our examination, we reviewed and tested the Authority's system of internal accounting control to the extent we considered necessary to evaluate the system as required by generally accepted auditing standards. Under these standards the purpose of such evaluation is to establish a basis for reliance thereon in determining the nature, timing, and extent of other auditing procedures that are necessary for expressing an opinion on the financial statements. Additionally,our examination included procedures necessary in our judgement to determine compliance with contractual terms and conditions and regulations, policies, and procedures prescribed by HUD and by management and the governing board of the Authority, insofar as such compliance review was necessary under the provisions listed as "A" through "Q" under "Requirements" in the HUD Audit Guide for the Low-Rent Housing Program. Our study and evaluation of the Authority's system of internal accounting control and our review of its compliance with contractual terms, regulations, policies and procedures which was made for the purpose set forth in the paragraph above, disclosed the following material weaknesses or evidence of noncompliance in addition to the inherent limitations resulting from a small number of employees. FINDINGS, RECOMMENDATIONS AND REPLIES The following audit findings were discussed with Mary Louise Battisti, Executive Director, at a conference held December 15, 1976. 1. Cooperation Agreement With respect to payments in lieu of taxes, the Ithaca Housing Authority failed to comply with the terms of the cooperation agreement with the City of Ithaca. In October of 1971 payments of property taxes were made to individual taxing authorities amounting to $8 267 which should not have been made. These payments represented school and city taxes based upon the assessment of the Hancock Street project for 1971. Similar 'payments were made in 1970 on the Hector Street project amounting to $7 249. The payment in lieu of taxes per the cooperation agreement should have been approximately $1 300 and $ 650 for the years ended September 30, 1971 and 1970. respectively. In addition, tax payments and payments in lieu of taxes for the five year period October 1, 1969 through September 30, 1974 amounted to $-31 772 while these payments under the terms of the cooperation agreement should have totaled $29 856, a difference of $1 916. This discrepancy is the result of inadequate and inaccurate financial records. Recommendation We recommend that the Authority strictly comply with the terms of the cooperation agreement with the City of Ithaca. Procurement Practices x The Ithaca Housing Authority does not have a policy regar.ing the use of the HUD Consolidated Supply Contracts for procurement of available items. Recommendation We recommend that the Authority formulate a policy as to the use of HUD Consolidated Supply Contracts to avail itself of any savings in pro- curement of available items that may exist. Reply The Authority will formulate a policy relative to the use of HUD Consolidated Supply Contracts. 3. General Fund Investment of Idle Funds In reviewing the cash activity for the 1973-74 fiscal year we noted funds in the Authority checking account from $20,000 to 50,000 which could have been invested from 90-120 days. This situation continued into the 1974-74 fiscal yeac. At a rate of 5%, interest amounting to approximately $1500 could have been earned in the 1973-74 fiscal year alone had the monies been deposited in interest earning accounts or certificates. Recommendation We recommend that only funds necessary to meet reasonable needs of the Authority be maintained in a'checking account and the excess invested in accordance with HUD regulations to maximize earnings on idle funds. The forecasting of cash requirements will be necessary in order to estimate the amount of funds which can be invested and for what period. Reply The Authority will immediately institute a plan for investing idle funds in accordance with HUD regulations. (3) 1NOt - MAXFIELD. Fixed Asset Inventories No records are maintained with respect to fixed asset (land, structures and equipment) inventories to provide control, accountability and a sound basis for insurance coverage. Periodic inventories of fixed assets have not been attempted in the past for this reason. Recommendation We recommend that fixed asset records be set up, maintained and reconciled by means of a periodic inventory on a minimum of a yearly basis, as required by HUD. Reply The authority will initiate steps to set up-and maintain fixed asset records as required by HUD. 5. Materials and Supplies Inventory There are currently no procedures, with respect to physical control or accountability for operating supplies. Recommendation We recommend procedures be implemented to correct this deficiency. Reply Procedures will be formulated and initiated with respect to controlling and accounting for operating supplies. 6. Tenants Accounts Receivable Our review of tenants accounts receivable subsidiary records indicated that these records were not maintained properly nor were tenants accounts receivable recorded on the books of account. Recommendation We recommend that tenant accounts receivable detail records be maintained properly and reconciled periodically to amounts recorded on the books of account. The cash balance recorded on the books of account amounted to $7,154 whereas the actual balance in the bank amounted to $2 717, a difference of $4,437. Likewise the liability for security deposits was overstated by approxi- mately $5,700. The reason for this variance could not be determined, but we surmise that the amounts at variance were utilized as operating funds. Accounts Payable Accounts payable as recorded in the books of account were understated by approximately $31,000 at September 30, 1974 representing claims paid subsequent to that date for which the liability existed at that date. NORTHSIDE TENANT COUNCIL - Mrs. Viola Scott, the new Chairperson for the North- side Tenant Council, reported to the Board that their Council is attempting to establish programs for its young people from the Tompkins County Youth Bureau. Mrs. Scott gave the Board copies of the Northside Newsletter. A survey is being conducted at Northside to give IHA some idea what the tenants feel they need and what has to be done in the individual apartments. -2- SOUTHVIEW TENANT COUNCIL No representation - No report. PERSONNEL COMMITTEE Mr. Slattery reported on personnel changes, primarily the hiring of Henry Kirchgraber, new Maintenance Foreman, replacing Richard Hayes, on April 4, 1977. Since the hiring of Mr. Kirchgraber there has been two vacancies in the Maintenance Department, but these vacancies have been filled. FINANCE COMMITTEE Mr. Crowley had no report for the Board. TENANT RELATIONS COMMITTEE Mr. Baldwin reported that a meeting was held at Titus Towers informing tenants of the FISH Program (Friends in Service to Humanity) . FISH is a volunteer program providing medical and miscellaneous transportation for shut- ins, and help in the home. Mr. Baldwin brought up the fire which partially destroyed Camp McCormick. The Authority has benefitted,in the work performance of the boys from that school. It was suggested by the Board that the Executive Director submit a letter to Camp McCormick expressing their regrets. Mr. Baldwin mentioned that he and Mrs. Battisti had attended a meeting at Northside and noted comments and suggestions at that meeting. TENANT SELECTOR'S REPORT Attached and made a Part of the minutes, EXECUTIVE DIRECTOR'S REPORT Section 8 Coordinator will start to accept applications Monday, April 11, 1977. This office is located at 311 Fourth Street. Mrs. Battisti had also submitted a second application for Section 8 for 50 additional units in com- pliance with the City's Housing Assistance Plan and the Community Development Act. The application is presently being reviewed in HUD and, if acceptable, will bring units under Section 8 to 125. Mrs. Battisti submitted an application to CETA under the Emergency Employ- ment Program requesting five staff people: two security guards, two youth workers, and one outreach worker. The use of guards will ease some of the problems which exist in Titus Towers and the family units. Executive Director submitted an application to Economic Opportunity Corp. (EOC) requesting five boys for lawn and other summer work, especially in the family units. • \d -3- Mrs. Battisti will be submitting a preliminary application for the funding under the Modernization Program 1977. She is requesting the following for the family sites: New windows including screens for both Northside and Southview Projects; new storm doors including screens for both projects; removal of existing bathtubs and installation of new ones, tiles and accessories; insula- tion for all family units where needed; all new lock sets and security locks for family units; new type of exterior lighting in both projects for better illumination for safety, security, and energy conservation. A study of the four units on Hector Street to site problems (if any) and recommend remedies to correct same. If problems do exist on above, monies to correct them; rehabilitation and modernization of both laundromats. For Titus Towers Executive Director has requested: Fans, electric eyes and an emergency unit in both elevators; expansion of parking lot; new lock sets and security locks for all units smoke detectors in each unit; removal of existing and installation of lighting fixtures in all hallways, installa- tion of a timing mechanism of air in hallways; installation of water condi- tioners to soften water; a study to be done on the heating and plumbing systems; resurfacing of roof at Titus Towers. HUD will give highest priority to work items relating to energy conserva- tion, compliance with Federal, State, and Local laws relating to health, safety, preservation of the basic integrity of the structure and systems and immediate and demonstrable cost savings to the IHA. Executive Director requested input from Tenant Associations and Board if they know of any other needs to be sub- mitted in the preliminary application: On April 28, 1977 Chief Herson of the Ithaca Police Department will speak to the residents at Titus Towers on security. In May, Chief Weaver of the Fire Department will speak at Titus Towers on fire prevention and shall make arrange- ments to set up a fire drill for the tenants. IHA had its first sale of project notes, Series one, for 1977, in the amount of $1,139,000. The successful bidder was Bankers Trust Company, interest rate at 2.59%. Mr. Crowley asked Mrs. Battisti if the security guards through the CETA program will be trained. Mrs. Battisti explained that IHA submits the applica- tion, the job description is from the,County. We request the position, CETA processes and screens. The Sheriff and Police Departments will train them for three weeks. IHA COUNSEL'S REPORT No report. Mrs. Viola Scott of Northside approached the Board again to advise that some tenants' furnaces had never been cleaned. Mrs. Battisti explained to the Board that she had planned to present a service contract, but the Maintenance Foreman has background in this type of work. -4- CHAIRMAN'S REPORT Chairman commented his report would be an analysis of what had been pre- viously stated. Mr. Cunningham wanted it fully understood by the tenants, press and all, that the Board is 100% behind the Executive Director who has done a wonderful job and will continue to do so. There had been calls to him regarding a petition to remove the Executive Director. The IHA Board of Commissioners hires the Executive Director, and it will be the Board who will dismiss for any given cause; not a petition, not the press, or the Mayor. Chairman advised the Board and guests that inspections are a part of a tenant's lease for their safety and health. It is HUD's mandate that in- spections must and will be done. Tenants must do their part as the IHA is doing theirs. Mrs. Nelson interjected that the Board should exonorate Titus Towers of any involvement in a petition because the tenants there all love Mrs. Battisti, and she has never heard one person ever say anything derogatory about her. Mr. Glover approached the Board to inform them that he had considered running for Tenant Representative selected by the tenants. Mr. Glover alleged that he had decided not to run because tenants who had signed his petition or seen speaking to him had been harassed by the Executive Director. He further alleged that one of the tenants had received a telephone call, a very terrifying- call, from what he had heard. Mr. Glover continued that "If the Board could sit there and say they were fully 100%behind Mrs. Battisti, then you are a despicable group of human beings. In no way can I jeopardize those people's lives, they have to live here, I don't. I have called these people and told them I won't run, rather than subject them to that kind of thing". Mrs. Spencer stated that she had heard this particular petition was dis- cussed at the Northside meeting. This is not true, at least it was not said at that meeting. Mr. Glover further went on to say that "It effectively prevented me from my right to run for that position, and I am not happy with it, and I think you =gentlemen_should know that I am not happy with it, and I don't think you should condone that kind of behavior" Chairman pointed out that whoever is elected by their peers to sit on the Board will be welcomed by the Board. MAINTENANCE REPORT No report. OLD BUSINESS Chairman reported to the Board that Mr. Wolf of HUD had reviewed and approved our Statement of Policy Governing Admission, Rent Range, Schedule, Grievance Pro- cedure and Lease, but wanted insertions on the grievance procedure, principally changing "reasonable time" to specific time. -5- Mrs. Battisti read the original and amended changes to the Board, 1. Mrs. Battisti advised that our highest number is between $51-$75, the number of units in that range is 122, and the mid-point of that range is $58. HUD instructed IHA to remain solvent and above water, we must have a mid- point of 88 units, with a mid-point of $105. IHA has a deficit each month of $3,864, if all rents are collected. Changed to: Penalty based upon a flat fee of $5.00 shall be imposed by the IHA upon a tenant whose rent is not received in the IHA office prior to the close of business on the 5th day of the month for which payment is due. Sciarabba Walker Company will accept the $1500.00 figure. Therefore, the Board will have to amend the contract. -8- Changed to: "Not to exceed $1,500.00", due to outstanding reports that have been completed by Accountant and additional reports still to be completed. Mrs. Battisti informed the Board that the window, laundromats, etc. , are all in the modernization budget. The hearing officer should be an impartial, disinterested person selected jointly by the IHA and the complainant, or if the IHA and the complainant cannot agree on a hearing officer they shall each appoint a member of a hearing panel and the member so appointed shall select a third member. It shall now be three members on the grievance hearing. Executive Director added that IHA has two grievances at the present time. The sooner we can have a panel, the sooner we can get it set up. Mr. Crowley volunteered to be the representative for the Board on this committee. Chairman brought up the NYSARHO Conference to be held in Niagara Falls, New York on June 6-9, 1977. Mr. Cusack asked how many individuals were able to attend the conference, and Chairman answered seven Board members and one staff per- son. Deadline is prior to 5/26/77, so it was suggested that members let Chairman know at the next Board meeting in May. Chairman reported that the May Board meeting will be held at Northside Community Room. At one time if a tenant reached a certain income while a resident in low-income housing, they were immediately out of occupancy and would be asked to move. There was a ceiling at that time set on the rent, and tenant could not go above it. Presently, if a tenant goes over the income limits they can remain but must pay 1/4 of their income, even if it would be $300 a month. However, tenant can remain in public housing now, as before they could not. In reiteration, Mrs. Battisti said an individual must be within these incomes to be admitted to public housing, but if they go over these incomes now they can remain where at one time they could not; however, tenant must pay 1/4 of their income. Mr. Baldwin questioned how long a resident can remain under these circumstances, and Mrs. Battisti said as long as they wish. Mr. Cusack raised question if IBA publishes minutes of the meetings. Al- though this is not done, Mrs. Battisti suggested that she could send minutes to the Chairman of each tenant council and they can read them at their meetings. April 13, Met with David Abbott to explain Section 8 and worked out some basic understandings. April 14, Met with Philip White, a landlord, and explained Section 8 and he wishes to participate. April 19, Inspected several units owned by Philip White - nice, standard units. April 28, Met with John Barney, a landlord, and explained Section 8 and he wishes to participate. April 29, I had an interview for an article in the Ithaca Journal regard- ing the Section 8 Program. Through the month of April several contacts were made with staff at the Office for the Aging, Tompkins County Social Services, Tompkins County Board and Ithaca Neighborhood Housing Services, these contacts included distribution of brochures and basic information. In addition, during the month of April the planning, editing and printing of a brochure and a public notice was accomplished. An office was set up at 311 Fourth Street and before the months end the new furnishings arrived. The Section 8 staff began to accept applications and five tenants were signed to the program. -1- `./ -2- \-1 The planning for the coming month of May includes: The Journal Article, several Demension Programs on WHCU, an informational meeting with the Ithaca Landlords Association on May 10th and the continuing program of reaching the public to make application as participants. Utility meter readings will be taken each month, either ind pendently or in conjunction with the utility company meter reader. _ The energy consumed will' be recorded in GAL., KW. , KVA., or appropriate energy ubits. 2. AU utility bills will be calculated independently and compared with the utility company bill. 3. Tenants will be educated and asked to participate in the program. 8. Energy saving devices will be investigated and cost analyzed for incorporation into the various systems. • 9. Recognition, praise and )ther methods will be used to honor those individuals who make recognL.able contributions to the program. 10. Posters, notices, etc. will be used to increase awareness of the conservation program and contribute to the reduction of energy waste. • ENERGY CONSERVATION PROGRAM OF THE ITHACA HOUSING AUTHORITY COMMITMENT We, the management of the ITHACA Housing Authority, with the approval of the Board of Directors, commit ourselves to the direction of, and participation in the Energy Conservation Program outlined below. PURPOSE & GOALS • The purpose of this program is to comply with the National Energy Conservation by reducing our utility energy consumption by 5% per year. In addition, we will endeavor to increase the awareness of the staff and tenants to energy saving techniques and invite their participation in the program. MANAGEMENT & RECORDING Management of the energy savings program will be the responsibility of the Director or Manager of each project and the Superintendent of Maintenance. It will also be the responsibility of management to initiate and maintain sufficient records, graphs, etc. to adequately measure the effectiveness of the program. TENANT. PARTICIPATION Tenant participation will be solicited on a voluntary basis for both individual tenants and Tenant Associati )n Groups. Ayes 4 Nayes ' 0 REPORTS TITUS TOWERS TENANT COUNCIL No report NORTHSIDE TENANT COUNCIL Mrs. Viola Scott, Chairperson of the Northside Tenant Council, notified the Board that Northside tenants are holding meetings every Tuesday. At the last meeting, with the Youth Bureau in attendance, Council decided to hire the young people to clean up in the project, with minimum pay from the Council. During the summer and winter months the youth group will be allowed to use the community building, and it will be their responsibility to clean up. The Youth Bureau representative advised the Council they will sponsor and fund a free nutrition luncheon program during the summer months with 75-90 lunches to be served. A notice will be going out to the parents for their approval to have their children participate in the free lunch program. Mr Crowley asked about the mother-child program. Mrs. Scott said that the center would be open three days a week,€or mother and child to work together and get to know other parents. The Hector Street and Southview tenants will also be notified, as well as neighbors outside the projects. Northside has planned a "Welcome Wagon" for new tenants moving into the project; also a summer cookout on an annual basis. Mr. Baldwin commended Mrs. Scott for her efforts in making the Council's projects a success and volunteered more books for their library. Mrs. Scott said they also could use play pens when the mother-child program gets under way. Mr. Baldwin asked if the window had been replaced in the laundry room, and it was brought out that this item is included in the modernization funding. SOUTHVIEW TENANT'.COUNCIL No report. The Chairman introduced Mr. Chester Rawa, Titus Towers Tenant Representa- tive who replaced former Board member Mary Hart. PERSONNEL COMMITTEE Mr. Slattery, Chairman of the Personnel Committee, introduced Jon Austin, Section 8 Coordinator, and Henry Kirchgraber, Maintenance Foreman, to the Board and guests. Mr. Slattery asked Mr. Kirchgraber about the window in the laundry room; Main- tenance Foreman noted that ventilation was needed badly, and that the window could be installed by the Maintenance Department. Mr. Slattery offered his assistance in helping to install the window. 2 FINANCE COMMITTEE Mr. Crowley had no report. TENANT RELATIONS COMMITTEE Mr. Baldwin noticed during a recent visit to Titus Towers that the drive going to the Plaza needed to be leveled. He reported that the Titus Towers Tenant Council has $1,000 in their treasury and will be purchasing two screen houses to be utilized by the tenants during the summer months. ATTORNEY'S REPORT Mr. Stolp had no report. TENANT SELECTOR'S REPORT Attached and made a part of the minutes. Mr. Baldwin asked if an individual had to be a resident of Ithaca to make application for tenancy. Executive Director said that the family in question had applied to Section 8 Program. Chairman asked Mr. David if he would elaborate on the inspections being con- ducted in the projects. Mr. David said most of the inspections performed in the project showed apartments in satisfactory condition, but a few needed better housekeeping. Most of the inspections at Northside are completed, then he will go to Center Street and Titus Towers. . In answer to Mr. Slattery's inquiry, Mr. David said it takes about twenty minutes per inspection, and about five are scheduled per day. There is some neglect on the part of tenants in calling in work order repairs. Inspections at this time of year brings Maintenance up to date. Chairman asked Mr. Kirchgraber if he thought the IHA had been lax in maintaining the apartments. Mr. Kirchgraber said that overall the apartments were in good condition, if there was a problem it was brought to the Executive Director's attention; however, he was satisfied in what he saw. Mr. Slattery brought up the conditions of the screens and storm doors. Maintenance Foreman informed the Board they were in very bad condition. Plexiglas is very diffi- cult to keep clean, and he hopes to replace this material with thermo glass. Plexiglas is good only for storm doors. Mr. Crowley asked if annual inspections to the apartments were often enough. Ms. Battisti informed Board that HUD mandates inspections are to be once a year; however, if there is a problem unit with a problem tenant IHA can inspect once a week if necessary. Mrs. Scott asked what will be done where there are no screens in the apartments. Sliding screens will be used this summer. Ms. Battisti mentioned again that screens and storm doors are being requested in the modernization program, but it would be a year before they can be purchased. Mr. Cunningham complimented the Maintenance Foreman in his monthly report. It expressed more in what the Board really wanted to know and was clear in its context. 3 Mrs. Scott expressed her gratitude to Ms. Battisti and Mr. Kirchgraber in having the community room cleaned. Chairman thanked Ms. Jane Marcham of the Ithaca Journal for the excellent article which recently appeared in the newspaper on the Section 8 Program. WHCU had invited Mr. Austin to speak on the Section 8 Program also. Mr. Baldwin suggested IHA place a copy of the news article on the bulletin boards. In addressing the Board Mr. Austin said that Section 8 was getting good cover- age, and had run a public notice in the paper. The program presently has forty (40) applications. He has been getting landlords agreeable to our rent structure and units which would pass inspections. Mr. Austin and Executive Director met with Building Commissioner Hoard regarding inspections. Section 8 will be using the first of the month as a start date, and West Village will qualify under the Section 8 Program. • The 75 unit original application will be filled within the first year of the program. Mr. Austin passed the Section 8 brochure to the Board members. He is working with the landlord-tenant on an individual basis rather than in group sessions which gives a better flavor in dealing with them. Mr. Crowley raised question about zoning�,in`relation to the Section 8 Program. Mr. Slattery, who is a member of Common Council, said that Council had settled on a three year inspection in the new apartment Ordinance and Certificate of Compliance, hopefully in the future it will be every year. Zoning has not been finalized, each zone has its own qualifications, multiple housing will have to be brought up to standards, and the Building Commissioner will have housing inspectors do the inspections. ' In answer if zoning would affect exist- ing housing, Mr. Crowley said that a landlord would have one year to convert back. Ms. Battisti added that the new Ordinance was restricted to new con- versions. Mr. Slattery assured Board that the final zoning Ordinance will be quite clear. FINANCIAL REPORT Board commented on the precise financial report which is a part of the minutes. Ms. Battisti advised Board new books are being set up. This report • was only reflecting the assets so that the Board would be aware of what our holdings are. We have four (4) Certificates of Deposit in the amount of $153,500. The in- terest earned from these certificates are being deposited into our vintage savings account in order to build up a reserve. When Executive Director arrived at IHA there was a substantial amount of money in our checking account that was not earning interest. She invested $25,000 in a Certificate of Deposit, and $2,500 that was Mod monies was invested into a Certificate of Deposit and ear- marked as such. No development accounts or budgets had been closed out and she felt that these CD's were monies due HUD from development accounts. HUD has stated emphatically that if the accounts are not closed out we will not receive any modernization funding, and she has the fee accountant attempting to resolve the problem. 4 She pointed out that Accounts Receivable have come down considerably. In answer to question raised by Mr.Baldwin, sale of project notes are twice a year. Ms. Battisti brought to the Board's attention that some tenants pay rent in installments, i.e. , twice a month, which is easier for them to pay. Mr. Slattery made motion to impose penalty at this point. Executive Director went on to say that some pay the 4th of the month, paying balance on the 17th without fail. A clause in the new lease policy is based on a 5% penalty for tenants paying after the 5th of the month; therefore any change must be a Board decision. Mr. Stolp suggested a resolution which would state that en- forcement of the provision in the lease providing collecting late fees be enforced at the discretion of the Executive Director. Motion made by Mr. Slattery, seconded by Mr. Baldwin, to adopt resolution. Ms. Battisti explained this would create a problem. Mr. Slattery recommended that the matter be referred to the Personnel Committee and withdrew his motion to impose a penalty. Messrs. Crowley, Slattery, and Stolp will present their recommendations to the Board at its next meeting. EXECUTIVE DIRECTOR'S REPORT Ms. Battisti opened her report saying that staff present this evening had reported their areas of work to the Board well. A policy from the Board is requested by Executive Director regarding CB antennas. attached to tenants' roofs. HUD has mandated this cannot be allowed. One tenant in the project has maintained that his CB is a necessity, and he does not actually have it bolted to the building. Other tenants in the project have complied. Ms. Battisti said that if we can permit one CB to remain, we must have a policy that CB's not bolted to the buildings are allowed. The tenant in question belongs to the Civil Air Patroland states he must have the CB in the event of an emergency. Ms. Battisti feels that policy regarding CB's must be the Board's decision, not hers. HUD` mandates no attachments or major altera- tions to units can be made. Chairman and:Mr. Kirchgraber will discuss the matter after the Board meeting. Mr. Baldwin notified Board members that IHA drew money from the Special Account to purchase tickets to the circus and a play which will be distributed to the children in the projects. CHAIRMAN'S REPORT Mr. Cunningham informed Board members that he will give his annual report at the annual meeting on June 2, 1977. OLD BUSINESS NYSARHO Conference - Resolution be adopted that Board members who wish to attend the Conference are allowed to do so, and Executive Director will make reservations. 5 Motion made by Mr. Crowley, seconded by Mr. Slattery to accept the resolution. Resolution 77-13 RESOLUTION APPROVING AN ENERGY CONSERVATION PROGRAM TO COMPLY WITH THE UNITED STATES DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT ADOPTED PROGRAM OF 1975. Resolved that Resolution #77-13 Energy Conservation Program attached hereto and made a part hereof, be adopted and implemented in a manner compatible with the objectives of the 1975 'Energy Conservation Pro- gram adopted by the United States Department of Housing and Urban Development. Executive Director informed Board that IHA has been in conformance with the program. A report is made on a quarterly basis on utility costs, and presently is monitored. In response to a question regarding water meters in the units, Mr. Kirch- graber said master meters are installed at Northside, Titus Towers, and Center Street. There are no individual meters. Chairman commented on the high utility bills. A discussion ensued on rates, and "demand rate", as it relates to occupied and vacant apartments. Motion made by Mr. Slattery, seconded by Mr. Crowley, that Resolution 77-13 be adopted. EXISTING HOUSING ACC PART I NUMBER AND DATE' CONTRACT NUMBER 2.1 NONDISCRIMINATION IN HOUSING. (a) Neither the Owner nor the PHA shall,in the selection or approval of Families,in the provision of services,or in any other manner, discriminate against any person on the ground of race,color,creed,religion,sex,or national origin.No person shall be automatically excluded from participation in,or be denied the benefits of,the Housing Assistance Payments Program because of membership in a class such as unmarried mothers,recipients of public assistance,etc. (b) The Owner shall comply with all requirements imposed by Title VIII of the Civil Rights Act of 1968,and any rules and regulations pursuant thereto. (c) The Owner shall comply with all requirements imposed by Title VI of the Civil Rights Act of 1964,Public Law 88-352,78 Stat.241; the regulations of the Department of Housing and Urban Development issued thereunder,24 CFR,Subtitle A,Part 1,Section 1.1,et seq.;the requirements of said Department pursuant to said regulations;and Executive Order 11063 to the end that,in accordance with that Act, the regulations and requirements of said Department thereunder,and said Executive Order, no person in the United States shall, on the ground of race, color, creed, religion, or national origin,be excluded from participation in,or be denied the benefits of, the Housing Assistance Payments Program, or be otherwise subjected to discrimination. This provision is included pursuant to the regulations of the Department of Housing and Urban Development,24 CFR,Subtitle A,Part 1,Section 1.1,et seq., issued under Title VI of the said Civil Rights Act of 1964,and the requirements of said Department pursuant to said regulations;and the obligation of the Owner to comply therewith inures to the benefit of the Government,the said Department,and the PHA,any of which shall be entitled to invoke any remedies available by law to redress any breach thereof or to compel compliance therewith by the Owner. 2.2 COOPERATION IN EQUAL OPPORTUNITY COMPLIANCE REVIEWS.The PHA and the Owner shall cooperate with the Government in the conducting of compliance reviews and complaint investigations pursuant to all applicable civil rights statutes,Executive Orders,and rules and regulations pursuant thereto. 2.3 ANNUAL CONTRIBUTIONS CONTRACT. (a) The PHA has entered into an Annual Contributions Contract,identified in the introductory paragraph of this Contract,under which the Government will provide financial assistance to the PHA pursuant to section 8 of the Act,for the purpose of making housing assistance payments with respect to the PHA's Existing Housing Program. A copy of this ACC shall be provided by the PHA to the Owner upon request. (b) The PHA hereby pledges such annual contributions as are payable under the ACC for housing assistance payments to the making of such payments pursuant to this and other Housing Assistance Payments Contracts entered into as a part of the PHA's Existing Housing Program. 2.4 MONTHLY PAYMENT TO OWNER. (a) The Owner shall be paid monthly the amount due under this Contract. The Owner agrees that the endorsement on the check(1)shall be conclusive evidence that the Owner has received full payment, and(2)shall ponstitute certification by the Owner that(i)the Con- tract unit for which the payment is made is in Decent, Safe, and Sanitary condition and is leased to an Eligible Family,(ii)the amount of the payment is the correct amount due him under this Contract, and(iii)the payment meets all other requirements under this Contract. (b) The Owner agrees further. (1) Should the PHA or the Government determine that the Owner is not entitled to the payment, or any pert thereof, the PHA or the Government, in addition to other remedies, may deduct the amount of the overpayment from any other amounts due the Owner. (2) That he will notify the PHA promptly of any change of circumstances which would affect the amount of the monthly payment and that he will return any payment which does not conform to the changed circumstances. Failure by the Owner to comply with the requirements of this paragraph(b)(2)may be considered by the PHA or the Government as grounds for termination of this Con- tract. 2.5 MAINTENANCE,OPERATION AND INSPECTION. (a) Maintenance and Operation. The Owner agrees(1) to maintain and operate the Contract Unit and related facilities so as to provide Decent, Safe,and Sanitary housing,and (2) to provide all the services,maintenance and utilities set forth in the Lease.If the PHA determines that the Owner is not meeting one or more of these obligations,the PHA shall have the right, in addition to its other rights and remedies under this Contract;to abate housing assistance payments in whole or in part. (b) Inspection. • (1) Prior to occupancy of the unit by the Family, the Owner and the Family shall inspect the unit and shall furnish a report and certification of the condition of the unit,on the form prescribed by the PHA.By executing this Contract,the Owner certifies that to the best of his knowledge and belief and in accordance with the criteria provided in the PHA-prescribed form,the unit • is in Decent,Safe,and Sanitary condition on the date of execution. (2) The PHA shall inspect or cause to be inspected the Contract Unit and related facilities at least annually and at such other times (including prior to initial occupancy of the unit)as may be necessary to assure that the Owner is meeting his obligation to maintain the unit in Decent,Safe,and Sanitary condition and to provide the agreed upon utilities and other services.The PHA shall take into account complaints by occupants and any other information coming to its attention in scheduling inspections, and shall notify the Owner and the Family of its determinations. HUD 52535B Page I of 3 pages (6.76) (c) Units Not Decent, Safe,and Sanitary.If the PHA notifies the Owner that he has failed to maintain the dwelling unit in Decent,Safe, and Sanitary condition and the Owner fails to take corrective action within the time prescribed in the notice,the PHA may exercise any of its rights or remedies under the Contract,including abatement of housing assistance payments(even if the Family continues in occupancy)and termination of the Contract. If the Family wishes to be rehoused in another dwelling unit with section 8 assistance and the PHA determines to terminate the Contract,the PHA shall issue to the Family another Certificate of Family Participation. (d) Notification of Abatement. Any abatement of housing assistance payments shall be effective as provided in written notification to the Owner.The PHA shall promptly notify the Family of any such abatement. (e) Overcrowded Unit.If the PHA determines that a Contract Unit is not Decent,Safe,and Sanitary by reason of increase in Family size, the Family and the PHA shall try to find an acceptable unit as soon as possible. If an acceptable unit is found that is available for occupancy by the Family,and the Lease with the first Owner can be terminated in accordance with its terms,the Contract with the first. Owner shall be terminated and housing assistance payments shall be made available to the Family for occupancy in the acceptable unit. Housing assistance payments will not be terminated unless the Family rejects without good reason the offer of a unit which the PHA judges to be acceptable. 2.6 EVICTION.The Owner shall not evict the Family unless the Owner complies with the requirements of local law,if any,and of this Section. The Owner shall give the Family a written notice of the proposed eviction,stating the grounds and advising the Family that it has 10 days (or such greater number,if any,that may be required by local law)within which to respond to the Owner.The Owner must obtain the PHA's authorization for an eviction;accordingly,a copy of the notice shall be furnished simultaneously to the PHA,and the notice shall also state that the Family may, within the same time period, present its objections to the PHA in writing or in person.The PHA shall forthwith examine the grounds for eviction and shall authorize the eviction unless it finds the grounds to be insufficient under the Lease. The PHA shall notify the Owner and the Family of its determination within 20 days of the date of notice to the Family,whether or not the Family has presented objections to the PHA.If the Owner has not received a response from the P1-IA within 20 days,he shall telephone the PHA and shall be informed by the PHA whether a notice of determination has been mailed.If the PHA informs the Owner that no notice has been mailed within the 20 day period,the PHA shall be deemed to have authorized the eviction. 2.7 RENT ADJUSTMENTS. (a) Contract Rents shall be adjusted as provided in paragraphs(a)(1)and(2)of this Section upon request to the PHA by the Owner, provided that the unit is in Decent,Safe,and Sanitary condition and that the Owner is otherwise in compliance with the terms of the Lease. Subject to the foregoing, adjustments of Contract Rents shall be as follows: (1) An adjustment as of any anniversary date of the Lease not to exceed the percentage of change in the applicable published Existing Housing Fair Market Rent (with appropriate reduction in the adjustment where utilities are paid directly by the Family),provided that the Owner has the legal ri3ht to terminate the tenancy as of such anniversary date. (2) A special adjustment, subject to Government approval,to reflect increases in the actual and necessary expenses of owning and maintaining the unit which have resulted from substantial general increases in real property taxes, utility rates or similar costs (i.e.,assessments,and utilities not covered by regulated rates),but only if and to the extent that the Owner clearly demonstrates that such general increases have caused increases in the Owner's operating costs which are not adequately compensated for by the annual adjustments provided for in paragraph(a)(1). The Owner shall submit financial statements which clearly support the increase. Such adjustment shall be effective as of the date when the Owner has the legal right to terminate the tenancy, which need not be the anniversary date of this Contract. (b) Notwithstanding any other provisions of this Contract, adjustments as provided in paragraph (a) shall not result in material differences between the rents charged for assisted and comparable unassisted units,as determined by the PHA(and approved by the Government in case of adjustments under paragraph (a)(2)),nor shall any adjusted rent be in excess of the amount that could be approved by the PHA as an initial Contract Rent as of the date of the rent adjustment. 2.8 RENT REDETERMINATION AFTER ADJUSTMENT IN ALLOWANCE FOR UTILITIES AND OTHER SERVICES.In the event that the Owner is notified of a PHA determination making an adjustment in the Allowance for Utilities and Other Services applicable to the Contract Unit, the Owner shall promptly make a corresponding adjustment in the amount of rent to be paid by the Family and the amount of housing assistance payment. 2.9 PHA AND GOVERNMENT ACCESS TO PREMISES AND OWNER'S RECORDS. (a) The Owner shall furnish such information and reports pertinent to the Contract as reasonably may be required from time to time by the PHA or the Government. (b) The Owner shall permit the PHA or the Government or any of their duly authorized representatives to have access to the premises and,for the purpose of audit and examination,to have access to any books,documents„papers and records of the Owner that are pertinent to compliance with this Contract,including the verification of information pertinent to the housing assistance payments. 2.10 RIGHTS OF PHA IF OWNER DEFAULTS. (a) A Default by the Owner under this Contract shall result if: (1) The Owner has violated or failed to comply with any provision of,or obligation under,this Contract or of any Lease;or (2) The Owner has asserted or demonstrated an intention not to perform some or all of his obligations under this Contract or under any Lease. (b) Upon a determination by the PHA that a default has occurred,the PHA shall notify the Owner,with a copy to the Government,of (1)the nature of the default,(2)the actions required to be taken and the remedies to be applied on account of the default(including actions by the Owner to cure the default,and,where appropriate,abatement of housing assistance payments in whole or in part and recovery of overpayments),and (3) the time within which the Owner shall respond with a showing that he has taken all the actions required of him. If the Owner fails to respond or take action to the satisfaction of the PHA and the Government,the PHA shall have the right to terminate this Contract in whole or in part or to take other corrective action to achieve compliance,in its discretion or as directed by the Government. 2.11 REMEDIES NOT EXCLUSIVE AND NON-WAIVER OF REMEDIES.The availability of any remedy under this Contract or the ACC shall not preclude the exercise of any other remedy under this Contract or under any provisions of law,nor shall any action taken in the exercise of any remedy be deemed a waiver of any other rights or remedies.Failure to exercise any right or remedy shall not constitute a waiver of the right to exercise that or any other right or remedy at any time. (a) Except as otherwise provided herein,any dispute concerning a question of fact arising under this Contract which is not disposed of by agreement of the PHA and Owner may be submitted by either party to the Department of Housing and Urban Development field office director who shall make a decision and shall mail or otherwise furnish a written copy thereof to the Owner and the PHA. (b) The decision of the field office director shall be final and conclusive unless,within 30 days from the date of receipt of such copy, either party mails or otherwise furnishes to the field office director a written appeal addressed to the Secretary of Housing and Urban Development.The decision of the Secretary or duly authorized representative for the determination of such appeals shall be final and conclusive unless determined by a court of competent jurisdiction to have been fraudulent,or capricious,or arbitrary,or so grossly erroneous as necessarily to imply bad faith, or not supported by substantial evidence.In connection with any appeal proceeding under this Section,the appellant shall be afforded an opportunity to be heard and to offer evidence in support of his appeal.Pending final decision of a dispute hereunder,both parties shall proceed diligently with the performance of the Contract and in accordance with the decision of the field office director. (c) This Section does not preclude consideration of questions of law in connection with decisions rendered under paragraphs(a)and(b) of this Section;Provided,however,that nothing herein shall be construed as making final the decision of any administrative official, representative,or board on a question of law. 2.13 INTEREST OF MEMBERS,OFFICERS,OR EMPLOYEES OF PHA,MEMBERS OF LOCAL GOVERNING BODY,OR OTHER PUBLIC OFFICIALS.No member,officer,or employee of the PHA,no member of the governing body of the locality(city and county)in which the Project is situated,no member of the governing body of the locality in which the PHA was activated,and no other official of such locality or localities who exercises any functions or responsibilities with respect to the Project,during his tenure or for one year thereafter,shall have any interest,direct or indirect,in this Contract or in any proceeds or benefits arising therefrom. 2.14 INTEREST OF MEMBER OF OR DELEGATE TO CONGRESS.No member of or delegate to the Congress of the United States of America or resident commissioner shall be admitted to any share or part of this Contract or to any benefits which may arise therefrom. 2.15 ASSIGNMENT OF THE CONTRACT OR INTEREST THEREIN, (a) The Owner agrees that he has not made and will not make any sale,assignment, or smear in any other to®.*Ledo Contract,or any of his interest therein,except with the prior consent of the PHA. (b) The Owner agrees to notify the PHA promptly of any proposed action covered by paragraph(a)of this Section.The Owner further agrees to request written consent of the PHA in regard thereto. (c) (1) A transfer by the Owner,in whole or in part,or a transfer by a party having a substantial interest in said Owner,or transfers by more than one party of interests aggregating a substantial interest in said Owner,or any other similarly significant change in the ownership of interests in the Owner,or in the relative distribution thereof,or with respect to the parties in control of the Owner or the degree thereof,by any other method or means(e.g.,increased capitalization,merger with another corporation or other entity, corporate or other amendments,issuance of new or additional ownership interests or classification of ownership j interests or otherwise) shall be deemed an assignment or transfer for purposes of this Section 2.15. An assignment by the Owner to a limited partnership,in which no limited partner has a 25 percent or more interest and of which the Owner is the sole general partner,shall not be considered an assignment or transfer. (2) The term "substantial interest"means the interest of any general partner,any limited partner having a 25 percent or more interest in the organization,any corporate officer or director,and any stockholder having a 10 percent or more interest in the organization. TOPIC: 1976-1977 Budget The total IHA income operating receipts are estimated to be $243,170 and expenditures estimated to be $315,620, and IHA is requesting $73,000 from HUD to subsidize the difference. HUD 52599 - Statement of Operating Receipts and Expenditures Executive Director read the Statement of Operating Receipts and Expenditures for the six months ending March 31, 1977 which was the actual amount expended. The figures in the report are based upon 263 dwelling units. HUD 52564 - Op rating Budget Executive Director informed the Board that this is the actual budget under which IHA will be operating until September 30, 1977. We have pro- jected a total operating receipts of $243,170, total Administration Expenses $69,700, Tenant Services $810, total Utility Expenses $99,800, Total Ordinary Maintenance and Operation Expenses $85,090, Insurance Expense $17,000, Payments in Lieu of Taxes $13,600, Terminal Leave Payments $4,400, Employee Benefit Con- tributions $17,660, for a Total Routine Expenses $308,060. Nonroutine Ex- penditures $7,560, Total Operating Expenditures $315,620, which has a residual deficit of $72,450. HUD contributions Operating Subsidy is $73,345, which at the end of the year should be $895 in the black. Chairman expressed concern regarding utility costs. Mr. Levy of Sciarabba-Walker explained that they took six months of actual utility figures that IHA had already used for those months, then they took the re- maining months from the prior year and increased the cost by 10-15% to project estimated current figures. In questions raised by Mr. Cusack, Executive Director explained that IHA does not request allotments. The Performance Funding statement in- cluded in the budget material is used to come up with the subsidy rate. HUD has an inflationary factor that is set up by staticians in Washington. If IHA has additional costs we must cut back in another area; this is the most we can receive. We must project the rents with the subsidies to have a balanced budget. Questions raised if there are excesses in any area. Ms. Battisti said there was in sundry. We may run into problems with maintenance costs which have been higher than they have ever been due to attempts in getting the projects in order. We can, however, live within each line item if careful. In answer to a question raised regarding tenant services, until recently there were two separate accounts, a special account and regular operating monies. Tenant services are shown at $810, $3 per unit maximum, which HUD has mandated. Actually, we have given more than this amount to the tenants. Collections from laundromat machines should have been placed in our operating expenses, but the monies IHA was giving to the tenants out of the special account should have been under tenant services. However, next year it will show $810, plus what we actually do give. Monies are given to the tenant associations which do not show. To question raised, HUD does not give IHA any operational guidelines in making up the budget. Executive Director further explained that the insurance is high because IHA is under the Fair Plan on Hector Street, and we are expending more on that project than on the other insurances. Next year this should decrease and should be able to use the money in another line item. Executive Director went on to the following page to support line 120, Administration Expenses other than Salaries, to justify that figure; and supporting document for line 790, Schedule of Nonroutine Expenditures. Chair- man noted only two stoves listed for replacement, and Ms. Battisti agreed it was not sufficient to replace only two. She would like to replace this item with two-door refrigerators in all the family units, but it will take time to accomplish this. Ms. Scott inquired about the playground item. Executive Director ex- plained that the playground located at Center and Plain Street is charged to this budget. Actually, that development account was never closed out. If we have our books reconstructed and have monies left over from Center and Plain Street, this $1000 would be charged to the development account rather than our operating budget. It has been paid for and we must charge it to the operating budget. -2- s Schedule for Positions and Salaries: Under Management $43,440 corresponds with line item 110; $45,590 corresponds with line item 410. Executive Director explained to question raised that some of the salaries are being paid partially out of the Section 8 budget; therefore it is pro-rated. Mr. Crowley noted that it was about 15% on the first salary and asked if that is what Section 8 said they would pay. Ms. Battisti said that is the. way IHA set up the Section 8 budget. When that budget was being prepared and the program was in the preliminary stage, she was spending about 25% of her time in that program, and it was being paid from their budget. Once we got into operation, 15% of her salary was paid from that budget. Other positions varied, as noted. We must work with the Section 8 budget also. Mr. Crowley questioned Maintainers item in the amount of $13,790. Mr. Levy explained to the Board the turnover during the year and over- lapses in maintenance personnel, and it is not a representative figure. In discussing utility costs (line item 390) Ms. Battisti explained that Titus Towers is very low, and family units high. Titus Towers is controlled by an outside thermostat, whereas family units have their own. Windows are not good in the family projects and consequently it will cost more in utilities. HUD form Operating Receipts and Expenditures, which ended September 30, 1976 is one of the delinquent reports. You can compare the actual amount budgeted with the actual amount spent. Mr. Cunningham requested clarification on line item 130, account 3690, Other Income, in the amount of $647, and also Administration, line item 220, account 4170. He said that it is a known fact that checks were written to that account at that time, double the budgeted amount, and $1,593 was actually spent. Executive Director explained that entries were posted to the wrong accounts, some posted to Sundry rather than the proper line items. Mr. Cunningham questioned Nonroutine Maintenance, line item 530, account 4610, in the amount of $42,006, and asked if this amount included the smoke detectors. Ms. Battisti said that the supporting document included the smoke detectors and storm doors which are considered nonroutine ex- penditures; the others posted to this account are not. Most of the items should have been charged to the 1975 Modernization Program. Mr. Crowley asked if the $41,000 in the General Fund on the Balance Sheet (period ending 9/30/76) is an interest bearing account. Executive Director said it is not. Ms. Scott questioned the amount $4579 under Accounts Receivable. Executive Director advised this amount was unpaid rents. A discussion followed regarding line item 79, Account 2810, Surplus. Mr. Levy explained that a projected budget is made up at the beginning of the current fiscal year. At the end of the year the monies not spent from the budget is called surplus. Surplus is split up into what is termed pro- vision for operating reserve, which is basically surpluses set aside over -3- the years to cover future years when your budget may come up with a deficit. The other section is what is called residual receipts. Other than the fact the general ledger balanced, he does not know what else to tell the Board because that number just contains a multitude of errors that have been occurring and building up over the years. Mr. Cunningham thought that to get an actual picture we would have to reconstruct the books. Mr. Levy agreed that he, Ms. Battisti, and HUD concurred. Mr. Levy said that he had taken the figures directly out of the general ledger to make certain they balanced, and they did. He checked the accounts again which were obviously incorrect and adjusted them, but not all of them. Mr. Crowley asked if the surplus figures were a combination of all the monies that were left over in all of the categories. Mr. Levy said it is the surplus from the beginning. As you have a surplus in your income and ex- pense items, it will also reflect in various asset and liability items. If you have a surplus during the year on the books and records, the income will be higher than the expenses and the assets will be higher than the liabilities by the same amount. When you close out the books, you close out zero on the income expense accounts into the surplus account. If you had a surplus or income for the year, then the surplus will go up, and in- come and expense account will start with zero. The balance just carries forward year after year. The problem with the surplus account is that there had been errors in the posting and bookkeeping, and these figures have reflected in the balance sheet accounts year after year. Mr. Levy cannot say if the surplus amount listed is what the actual figure is. Ms. Battisti informed the Board, that HUD has given IHA approval to go back to 1970,and to send out to get proposals from fee accountants to come in to_reconstruct the books from 1970 up to the present and close out all of our development accounts. When this is done we will start out with good figures with the development accounts closed out. HUD has been down to look at the books, and there is no way that we can go on the way we are, so we will have to have a full reconstruction. In effect, your surplus is your own worth. Performance Funding: Mr. Levy explained that what they basically are is HUD's formula in what the operating subsidy should be beginning with the number of units IHA has, size of the units and buildings, etc. HUI) gives various factors to work with. Mr. Crowley noted on the number of dwelling units IHA has, it is ob- vious that all of the units are not filled all of the time. He wondered about this. We always show 263 units and then multiply that by twelve to get the months, but actually it is somewhat lower than that. He questioned if there was any formula that adjusts for apartments being repaired or un- occupied. Ms. Battisti informed Board that IHA figures a 98% occupancy rate rather than 100%. The operating receipts in our budget is not reflecting 100% occupancy, but 98% -4- t IHA has monthly reports that must go to HUD regarding occupancy, going over a year's reports it was showing 98%; this is how income is projected. The figure 263 units is not reflecting the six deprogrammed buildings. Actually we have 271 units, two that are being used for offices, and six deprogrammed. The Summary of Data and Justifications estimates occupancy at 987 derived at by the monthly reports. 98% is on the 263 units. Mr. Crowley questioned then why we cannot figure on the office or the six deprogrammed units as part of the formula. Ms. Battisti said IHA had thought of doing this which we can do next year. The six had been deprogrammed all year, and yester- day we advertised for construction proposals. They will not be occupied by the end of this fiscal year; therefore, we could not figure them in the budget. Mr. Cusack asked if we have expenses against our operating budget. Ms. Battisti said the insurance is the biggest item, also lawn work and winter plowing of sidewalks, and heat level in the buildings. However, IHA was instructed to deprogram them. Ms. Cusack pondered if we have expenses against those units and we are deprogrammed insofar as budget is concerned, what does it make our budget look like. We take resources from the operating budget and are not getting any subsidy from HUD. It seems that we could make a case in going to HUD for whatever it is costing the deprogrammed units. They should at least go 50-50. Mr. Cunningham suggested this could be discussed when HUD visits. There were no further questions from the Board pertaining to the budget. RESOLUTION 77-15 WHEREAS, an Operating Budget for the Ithaca Housing Authority has been prepared for the Fiscal Year October 1, 1976, through and including September 30, 1977, and, WHEREAS, said budget has been prepared for submission to HUD, Albany, New York Office, for approval , BE IT THEREFORE RESOLVED, that said Budget is hereby approved as per the following HUD requirements: 1. • That proposed expenditures are necessary in the efficient and economical operation of the housing for the purpose of serving low-income families. 2. That the financial plan is reasonable in that: (a) It indicates a source of funding adequate to cover all proposed expenditures. (b) It does not provide for Federal funding in excess of that payable under Circular HM 7475.12. 3. That all proposed charges and expenditures will be consistent with provisions of law and the Annual Contributions Contract. Mr. Cusack questioned if additional allocation were to be requested for the abandoned six units, how do we go about it relative to this resolution. He noted the resolution does not take into consideration that we may like to -5- r ` ' 4 request from HUD monies in sharing the costs of these units. Mr. Cunningham said that any resolution can be amended and adoption thereof. Mr. Cusack wonders if we can make a legitimate argument with HUD for renumeration. Chairman suggested that we get the resolution going and discuss with HUD later when IHA is under the Mod Program. He would like to get the resolution passed and forwarded to HUD, so that we can continue to operate. Chairman expressed concern regarding the reserve fund. We are not sure whether we actually have it, is a figure that shows onthe books but is not actually what we have. Mr. Cusack asked if we have another package to submit to HUD before the end of this year. Ms. Battisti said IHA is starting to work on that now. The 1976-77 budget is seven months late going in. Mr. Cusack requested the chair. to direct the administration to give the Board an indication of costs relative to those deprogrammed projects so that an adjustment, if deemed to be substantial enough for our consideration, might be included in our final budget costs. He inquired how we perform relative to HUD in amendments to subsidies. Ms. Battisti said that anytime we foresee we are going to run over a line item we are supposed to amend the budget. She has never run into a case of this nature and will have to investigate as to what direction to take. Mr. Crowley thought that Mr. Cusack's proposal was reasonable and should get this amount so that we can keep operating. However, he is not in favor of holding up this budget. Ms. Battisti mentioned that HUD has been sending our monthly subsidy checks, and stressed that if the Board does not submit the budget they could stop our checks immediately as we would be in violation of the ACC on our part. She recommended that IHA send it in, and go on from there insofar as getting other monies, if possible. She added that ,she does not know what HUD's actual definition of deprogramming is. Chairman asked if he could have a motion on this resolution. • Mr. Rawa made a motion that Resolution #77-15 be accepted and passed; Mr. Crowley seconded the motion. Ayes 4 Nayes 1 (Cusack) Chairman said that he was in agreement with Mr. Cusack's comments on de- programming, which does open up a case where we have the right to ask questions. However, he suggested the Board get the resolution and budget to HUD. Found 2" sag inthe pipe. This was the problem with the sewer plugging on .the 600 block of Hancock Street.
