LA RESOLUTION #184
WHEREAS, the Ithaca Housing Authority recognizes that the major
emphasis in the City of Ithaca's COMMUNITY DEVELOPMENT applica-
tion is aimed toward meeting the needs of low and moderate income
families and individuals, and
WHEREAS, the Ithaca Housing Authority feels that SOCIAL SERVICES-
HUMAN RELATIONS component is vital and helps to meet these needs,
now
THEREFORE BE IT RESOLVED that the Ithaca Housing Authority
strongly suggests that the City consider funding such an activity
out of CDA grant monies; and the Ithaca Housing Authority
FURTHER RESOLVES to seek the support of other Social Service
agencies in this request, and that the HUMAN SERVICES COALITION
explore other methods of funding in the event that this position
is accepted so that the City of Ithaca will not have to assume
financial responsibility for the continuation of this SOCIAL
SERVICES-HUMAN RELATIONS component.

EXISTING HOUSING PROGRAM
The Section 8 Existing HOusing Program provides rent subsidies to
lower income families in existing housing units. How the program works
is outlined below:
Fair Market Rents
UUD establishes fair market rents for the Ithaca area by a survey. These
gross rents give the maximum amount of rent that can be charged for a given
size Unit for it to be eligible for the program. •
Certificate of Family Participation
Once the ACC has been executed and the program is operational, families
will apply to the IHA for a Certificate of Family Participation. After an
income check and a determination of eligibility, the IHA issues a Certificate
of Family Participation. The family then, on its own, shops for a suitable
housing unit which rents for under the established Fair Market Rent.
Request for Lease Approval
Once the family has found a unit, it returns to the IHA (the family has
60 days to find a unit) with a Request for Lease Approval. At this time the
City Building Department inspects the unit to assume its compliance with the
Housing Quality Standards. If the unit meets the guidelines of the program,
the IBA approves the signing of a lease and entering of a Housing Assistance •
Payments Contract as agent for the City of Ithaca.
Housing Assistance Payment Contract
The Housing Assistance Payment Contract is a three-way agreement between
the IHA, the Owner, and the tenant. It sets out special clauses to be included
in the lease, and the amount of family contribution and housing assistance
payment. Generally, the family contribution will be 25% of gross family income.

3) Undertake publication and dissemination of information concerning the
availability and nature of housing assistance under the Existing
Housing Program. The City will coordinate the Existing Housing
. Program with other housing programs established under the City's
Community Development Programs.
u) Develop a working relationship with local landlords, including dissemi-
nation of information and invitations to participate in the Program.
• 5) Provide, through its Building Department, housing inspection prior to
leasing and again at least annually to determine that the units are
maintained in Decent, Safe and Sanitary condition as defined in rules
and regulations published by HUD.
6) Make any subsequent Applications for Existing Housing and enter into
an ACC as may be required in future years.
II. The IHA agrees to:
1) Receive and review applications for Certificates of Family Participation
and maintain a waiting list.
2) Issue Certificates of Family Participation to Eligible Families in.
accordance with regulations set forth periodically by HUD.
3) Notify families determined to be ineligible.
k) Provide each applicant with basic information necessary to participate
in the program as required in regulations set forth periodically by HUD.
5) Determine amounts of Gross Family Contributions, Shopping Incezitive
Credit, and housing assistance payments.
• 6) Review and act on Request for Lease Approval. The IHA shall be a party,
as agent for the City, to the Housing Assistance Payments Contract.

7) Undertake periodic reexamination of Family Income as necessary to
redetermirw azrcirts of Gross Family Contribution and Housing Assistance
Payments.
8) Redetermine amount of rent payable by Family and Housing Assistance

Payment in accordance with HUD adjustments or locally determined
utility allowances. Forward to the City Chamberlain a monthly list
• of all funds to be disbursed and to whom they will be disbursed.
• 9) Authorize evictions according to regulations set forth periodically
by HUD.
10) Administer and enforce all contracts with Owners, and take appropriate
action in case of non-compliance or default.
il) Comply with equal opportunity requirements as set forth periodically
by HUD.
12) Maintain all files and records as may be required of the PHA by HUD.
The IHA shall file a monthly report with the City including information
as to the number and addresses of units assisted, family breakdown,
• racial breakdown.
In order to cover the administrative expenses `.of the,Existing Housing Program,
the administrative monies provided by HUD will be shared % to the City and
% to the IHA.

The terms of this agreement shall be reviewed before the filing of any
subsequent. Application for Existing Housing and entering into any Annual Contri-
butions Contract. This agreement shall be in effect for the duration of the
Annual Contributions Contract resulting from submission of the 1975-1976 Appli-
cation for Existing Housing.

In order to implement the Existing Housing Program in Ithaca, assist
lower income families ease the burden of high housing costs, improve housing
conditions, and further the goals of the City's Community Development Program,
we have set forth our hands this day of September, 1975.

• MEMORANDUM OF AGREMENT
AGREEMENT, this - day of September 1975' by and between the City of
Ithaca ("IHA"), for the purposes of implementing an Existing Housing Program
under Section 8 of the United 'States Housing Act of 1937, as amended.
WHEREAS, the Housing and Community Development Act of 1974 requires the
• coordination of all housing activities with the Community Development program,
and
tEREAS, Section 8 of the United States Housing Act of 1937, as amended,
providOs for the making of Housing Assistance Payments to families in Existing
Housing ("Existing Housing") through funds allocated by the federal government,
such funds to be in addition to the City of Ithaca's Community Development Funds,
and
WHEREAS, the City will contract directly with the Department of Housing
and Urban Development ("HUD") for an Annual Contributions Contract ("ACC") for
the purposes of making Housing Assistance Payments, and
WHEREAS, the Existing Housing Program is a vital component of the City's
Community Development Program, and
WHEREAS, the IHA has resolved to assist the City in appropriate areas of
its Community Development Program,
THEREFORE, the parties agree to the following:
I. The City agrees to:
1) Apply for authorization for 100 units of Section 8 Existing Housing'
and enter into an ACC with HUD.
2) Disburse all funds received under said ACC, based on information
received monthly from the IHA.

The amount of housing assistance payment is the difference between 25% of the
family's gross monthly income and the Fair Market Rent for the unit. The
lease is signed by the Owner and Tenant only. The IHA has no responsibility
for maintenance or conduct of the tenant. However, IHA must approve all
evictions initiated by the Owner.
Annual Contribution Contract
HUD will make quarterly payments on the ACC. The City Chamberlain will
make m�nthly disbursals of housing assistance payments. Included in the ACC

will be an amount to cover administrative costs of the program to be shared by
the City and IHA.
