I. Call to Order
Chairperson Rosario called the meeting to order at 8:40 A.M.
II. Agenda Additions/Deletions
Cummings asked Bohn for a staffing/personnel update and an update on the status of
Southside Community Center. There were no objections.
III. Public Comments (3‐minute maximum per person) ― None.
IV. Review of Meeting Minutes: January 20, 2017
Cummings moved, seconded by Schlather, to approve the January 20, 2017 meeting
minutes, with no modifications. Carried Unanimously 3‐0
V. New Business
A. Procurement of Independent Contractors
1. Legal Services
Bohn explained that Geldenhuys typically reviews CDBG, land transaction, and ethical
compliance contracts/issues. Sulimowicz typically reviews HOME contracts/issues.
Ruswick typically reviews HOME and tax‐credit contracts/issues.

Rosario observed Sulimowicz proposed a 25% increase in her fee. Bohn explained that
originally Sulimowicz offered the IURA an introductory rate, since she was not fully
versed in HOME regulations. If the Committee feels the fee increase is an issue, the
IURA could ask her if she would be willing to graduate the increase over time. He added
Sulimowicz performs work very similar to Ruswick’s, although she appears to be a little
faster, so that is one benefit of employing her.

2017 Procurement of Independent Legal Services, Geldenhuys
WHEREAS, the contract for independent legal services with Mariette Geldenhuys,
Attorney‐at‐Law (Geldenhuys) expires on February 28, 2017, and
WHEREAS, in accordance with IURA procurement policy and regulations contained
in 24 CFR §85.36, the IURA selected Geldenhuys through a Request for Proposals
(RFP) selection process in 2015, and
WHEREAS, whereas per applicable procurement regulations, a contractor selected
through an initial competitive selection process may be renewed for up to three
additional one‐year terms without undertaking a new competitive selection
process, and
WHEREAS, a proposed 2017 contract would constitute the second one‐year
extension of the base independent consultant contract, and
WHEREAS, Geldenhuys submitted a proposal on January 25, 2017 to continue
providing legal services to the IURA at a maximum billing rate of $210 per hour, a
2.4% increase from the current contract rate, and
WHEREAS, the IURA staff is highly satisfied with the quality of legal services
provided by Geldenhuys, and
WHEREAS, the 2017 IURA budget recommended a total authorized contract
amount of $10,000 for legal services; now, therefore, be it
RESOLVED, that IURA Chair is hereby authorized, upon review of IURA legal
counsel, to execute a contract extension for independent contractor legal services
with Mariette Geldenhuys, Attorney and Mediator, at a maximum hourly rate of
$210 per hour with the total amount not to exceed $12,000, and be it further

RESOLVED, that the source of such funds for legal services shall be derived from a
variety of funding sources, including, but not limited to, CDBG and HOME funds,
and expenses shall be billed to the appropriate source of funds for which the
services were performed.

Attorney at Law, at Levene Gouldin & Thompson, LLP (Ruswick) expires on February
28, 2017, and
WHEREAS, in accordance with IURA procurement policy and regulations contained
in 24 CFR §85.36, the IURA selected Ruswick through a Request for Proposals (RFP)
selection process in 2015, and
WHEREAS, whereas per applicable procurement regulations, a contractor selected
through an initial competitive selection process may be renewed for up to three
additional one‐year terms without undertaking a new competitive selection
process, and
WHEREAS, a proposed 2017 contract would constitute the second one‐year
extension of the base independent consultant contract, and
WHEREAS, Ruswick submitted a proposal on February 8, 2017 to continue providing
legal services to the IURA at a maximum billing rate of $190 per hour, a 2.7%
increase from the current contract rate, and
WHEREAS, the IURA staff is highly satisfied with the quality of legal services
provided by Ruswick, and
WHEREAS, the 2017 IURA budget recommended a total authorized contract
amount of $4,000 for legal services; now, therefore, be it
RESOLVED, that IURA Chair is hereby authorized, upon review of IURA legal

in 24 CFR §85.36, the IURA selected Sulimowicz through a Request for Proposals
(RFP) selection process in 2015, and
WHEREAS, whereas per applicable procurement regulations, a contractor selected
through an initial competitive selection process may be renewed for up to three
additional one‐year terms without undertaking a new competitive selection
process, and
WHEREAS, a proposed 2017 contract would constitute the second one‐year
extension of the base independent consultant contract, and

2. Community Development Services Resolution: H. Sicherman & Co., Inc.
Bohn indicated Sicherman acquired business partner as part of his retirement
succession plan: Charles Bell, who has worked on economic development in western
New York. Sicherman plans to continue providing services on a limited basis.
Cummings noted that since the IURA has been accustomed to working with the
company for a long time and found it reliable, it should just make sure it is comfortable
with Mr. Bell’s work.

WHEREAS, the contract for independent professional consulting services with H.
Sicherman & Co., Inc. (Sicherman) expired on February 28, 2015, and
WHEREAS, in accordance with IURA procurement policy and regulations contained
in 24 CFR §85.36, the IURA selected Sicherman through a Request for Proposals
(RFP) selection process in 2015 to provide technical assistance for development,
administration and implementation of the IURA community development program,
including loan underwriting, and
WHEREAS, whereas per applicable procurement regulations, a contractor selected
through an initial competitive selection process may be renewed for up to three
additional one‐year terms without undertaking a new competitive selection
process, and
WHEREAS, a proposed 2017 contract would constitute the second one‐year
extension of the base independent consultant contract, and
WHEREAS, Sicherman submitted a proposal on January 23, 2017 to continue
providing community development consulting services to the IURA at a maximum
billing rate of $175 per hour, a 3.4 % increase from the current contract rate, and

WHEREAS, loan underwriting services of Ms. Elizabeth Kraus of Sicherman are
offered at a rate of $139 per hour, no change from the current contract rate, and
WHEREAS, the IURA staff is highly satisfied with the quality of services provided by
Sicherman, and
WHEREAS, the 2017 IURA budget recommended a total authorized contract
amount of $10,000 for community development consulting services; now,
therefore, be it
RESOLVED, that IURA Chair is hereby authorized, upon review of IURA legal
counsel, to execute a contract extension for independent contractor community
development services with H. Sicherman & Co., Inc. at a maximum hourly rate of
$175 per hour with the total amount not to exceed $10,000, and be it further
RESOLVED, that the source of such funds for legal services shall be derived from a
variety of funding sources, including, but not limited to, CDBG and HOME funds,
and expenses shall be billed to the appropriate source of funds for which the
services were performed.

B. Review of Annual IURA Board Self‐Evaluation Survey
Bohn reported that IURA Board members completed the survey.
Rosario observed there only seems to be one outlier response, regarding the IURA’s
meeting its statutory authority. It was a good use of the newly added comments box.
Schlather remarked the survey still seems deficient in some ways. Many of the
questions are too general in terms of the response options that are included (e.g.,
totally agree, do not agree). She suggested there could be a comments box for each
question. Alternatively, an online survey could be created to provide further
opportunity for comment.
Rosario agreed an online survey would allow people to think about the questions a little
more and elaborate on, or clarify, their responses to certain questions.

C. FY2015 City Financial Audit Review
Rosario observed there appears to be nothing particularly new about the auditor’s
comments, compared to prior years. At the recent IURA Board meeting, the issue of
hiring additional permanent City staff in the Controller’s Office to work on the audit was
brought up. The common understanding was that Common Council approved the
action in the Mayor’s recommended budget, specifically so the City could make progress
with the timeliness of its audits. The Mayor confirmed that was the case, but that staff
changes in the Chamberlain’s Office necessitated a reallocation of staff that may
undercut efforts to dedicate more staff time to City audits.
Cummings wondered who in City government has oversight to ensure funds specifically
budgeted for a given purpose are actually employed for that purpose. Bohn replied that
the City budget is often not detailed enough regarding the purpose of a given set of
funds.
Cummings suggested asking the City’s Chief of Staff how best to ensure that what is in
the City budget is actually secured for the use it was intended for. Bohn responded that
the Mayor seemed optimistic the City could continue to reduce its audit delays. He
added that the issue was in fact brought up with the Chief of Staff, who appeared to
take it seriously. It was emphasized to him that delayed City audits could conceivably
pose a serious problem with the City’s grant applications (e.g., to NYS Empire State
Development).
Rosario suggested the Chief of Staff be invited to a future Committee meeting to discuss
the issue. Bohn agreed to do so.
VI. Other Business
A. Review of IURA Financials: January 2017
Bohn reported IURA projects are now starting to spend down more of their funds. INHS
is making rapid progress on 210 Hancock Street and the 202 Hancock Street projects.
Bohn noted the loan report shows three delinquencies; however, two of them are now
current. The State Theatre remains one month behind.
B. IURA Strategic Planning Update
Bohn reported the IURA and other organizations are still planning to reach out to U.S.
Representative Tom Reed about the current Federal CDBG and HOME budget situation
and invite him to personally see some IURA‐funded projects/programs. The current
discussion is focusing on how to structure the visit to be most productive. Cummings
asked if Tompkins Trust Company would be a part of the visit. Bohn replied, he is not
sure.

C. 2017 HUD Entitlement Funding Round Report
Bohn reported that the funding application deadline is February 28, 2017. He has
communicated with 25 people about potential applications.
D. Southside Community Center Update
Bohn reported there has been progress in terms of Southside Community Center. He
met with Nia Makepeace, chair of the organization’s board, and Nydia Blas, its Interim
Executive Director. They discussed both the Recycle Ithaca's Bicycles (RIBs) and Building
for the Future programs. Makepeace and Blas both believe they can produce
documentation of more beneficiaries for the Building for the Future program, which
they had not been able to do. They expect to produce approximately 25 beneficiaries.
They are also exploring how to proceed with the RIBS program. Two new volunteers
have recently reinvigorated it. They have committed to resolving the issue by 3/31/17.
E. Community Development Planner Hiring Update
Bohn reported that the first interviews were conducted for the vacant position.
F. IURA & Common Council Actions of Interest to Committee
None.
