Maple Avenue, Cornell Street, and Oakwood Lane, and
WHEREAS, the Maple Avenue tank was originally constructed in 1911 and the Cornell
Street and Oakwood Lane Tanks were constructed in 1936, and
WHEREAS, the last complete paint job on each tank was conducted in the late 1990’s,
and
WHEREAS, each tank is currently not in compliance with Occupational Safety and
Health Administration regulations pertaining to worker safety and access, needing
safety rails, proper venting, accesses, ladders, etc., and
WHEREAS, preliminary project cost estimates were made based on actual recent cost
experience for the rehabilitation of the Sheldon Road Tank (a 1936 vintage tank
identical to the Cornell Street tank) owned and operated by the Bolton Point Water
System, and
WHEREAS, a Capital Project request for $825,000 for City of Ithaca water tank
rehabilitation was made in 2007, which covered anticipated project costs of $275,000
each for three (3) Steel Tanks, and
WHEREAS, in 2007 approximately one third of the initially requested capital
improvement funding was approved for said project in the amount of $350,000, and
WHEREAS, approximately $75,000 has already been utilized to cover contracted
expenses including professional inspection services, professional design services, and
for DPW Crews performing site preparation and grading at each location, and
7
October 6, 2010
WHEREAS, it was anticipated that additional funding above and beyond the planned
$825,000 might be necessary once detailed interior tank inspections were performed
and all deficiencies and needs for the rehabilitation of all three tanks were known, and
WHEREAS, the City of Ithaca contracted with Tank Industry Consultants (TIC) for
professional inspection services in August of 2009 to identify specific internal and
external structural, surface, safety, and other improvement needs for each tank, and
WHEREAS, the City of Ithaca solicited Request for Proposals for professional
engineering design and bid services and later contracted for such services with T.G.
Miller Engineers & Surveyors, P.C. on May 10, 2010, and
WHEREAS, TIC & T.G. Miller revealed several unforeseen improvements vital to the
rehabilitation of each tank, including: complete roof replacement, extensive structural
repairs to existing support members, additional steel repairs than to those originally
anticipated, and mandatory usage of costlier low volatile solid paint technology to meet
recent health department regulations, and
WHEREAS, staff recommends and it is desirable to enter into a contract for a
rehabilitation project on each tank for inclusive surface preparation, repainting, roof
replacement, general repairs, and safety updates, and
WHEREAS, the City of Ithaca advertised for bids for the City of Ithaca Water Tank

Rehabilitation giving a total project authorization of $2,004,645, and be it further
RESOLVED, That the $1,654,645 amendment will be funded from the issuance of serial
bonds.
Superintendent of Public Works Gray explained that the original budgets for these
projects were created four years ago, and were based on routine maintenance
inspections that had been conducted fifteen years ago. Upon recent inspection of the
tanks, the roofs were found in need of replacement as well. He further stated that has
resulted in increased construction costs. He further noted that recently adopted code
changes will improve worker safety but are more expensive to implement.
8
October 6, 2010
Alderperson McCollister questioned whether the future use of the tanks had been taken
into consideration (ie. potential new housing development in the vicinity of the tanks)
and whether there were cost saving opportunities available with the Town of Ithaca.
Superintendent Gray responded that the City and Town each have independent water
systems and that possible future uses of the tanks has been taken into consideration.
He further noted that the elevated water storage provides the City’s gravity fed
distribution system.

Communications Facilities - Resolution
By Alderperson Coles: Seconded by Alderperson McCollister
WHEREAS, various municipalities in Tompkins County have received applications for
permission to construct cellular communication facilities (including roof-based antennae
and towers) within their borders (and, in some cases, on municipal property), and some
of these applications have elicited substantial public concern or opposition, and

October 6, 2010
WHEREAS, at the same time, some municipalities have areas where cell coverage is
desired but it is substandard or absent, and
WHEREAS, to date, each municipality has acted on its own, each with its own local
ordinance regarding cell towers, and sometimes seeking expert consultation to evaluate
a particular applicant’s need or other assertions, and
WHEREAS, recognizing their shared interests and concerns, several municipalities
have decided, through the Tompkins County Council of Governments (TCCOG), to
explore the possible benefits of a more coordinated approach to the issues surrounding
cellular communications, and
WHEREAS, the participating municipalities want to learn about the current status of
local jurisdiction in this area, and to determine whether some type of coordinated,
intermunicipal approach could enhance their ability to focus cell tower siting at the most
appropriate and least disruptive locations, and
WHEREAS, in addition, some participating municipalities may want outside advice on
whether their individual ordinances should be revised and updated, and
WHEREAS, in December, 2009, the participating municipalities (nine interested
TCCOG members) issued an RFP (Request for Proposals) for legal services to advise
them on these issues, and received four qualified responses, and
WHEREAS, upon consideration of these proposals and phone interviews with two of the
applicants, the law office of Silverberg Zalantis, of Tarrytown, NY, was selected by

Discussion followed on the floor clarifying that the portion of sidewalk between East
Green Street and “Butterfly Alley” would be included in the smoke-free zone.
Alderperson Myrick stated that he is opposed to this amendment as he thinks the law
would be clearer and easier to enforce if the smoke-free zone was extended to the East
Green Street curb similar to Cayuga Street, Seneca Street, and Aurora Street on the
primary Commons.

Amending Resolution
By Alderperson Rosario: Seconded by Alderperson Cogan
RESOLVED, That the following Whereas Clauses be added to the beginning of the
Ordinance to reflect the intention of the legislative changes:
“WHEREAS, the Common Council of the City of Ithaca determined and resolved by its
adoption, on April 7th, 2010, of an ordinance (now, Chapter 280 of the City of Ithaca
Municipal Code, entitled "Smoking, Outdoor") that creating smoke-free zones in certain
public spaces, where children and/or adults are likely to be present or concentrated,
and/or where persons can not readily escape from exposure to tobacco smoke, will
protect the health, safety and welfare of the residents of our community; and
WHEREAS, since the aforementioned ordinance went into effect, on August 1, 2010,
the public and business owners in the vicinity have noted, and members of Council and
City staff have affirmed through on-site visits and tours, an appreciable increase in the
concentration of active smokers at the most westerly border of the smoke-free area
created for the inner portion of the Commons, in effect increasing the public's exposure
to the hazards of second-hand smoke in this location; and
WHEREAS, although the easterly and northerly border areas of the aforementioned
smoke-free zone have apparently been working as Common Council intended, the
Planning and Economic Development Committee determined during its September 17,
2010, meeting that expanding the smoke-free zone to cover only the remainder of the
western portion of the Commons could result in displacing those currently smoking in
that area to the aforementioned northerly and/or easterly border areas, resulting in
similar, problematic concentrations of smoking in one or both of these areas; and
WHEREAS, the Planning and Economic Development Committee, during its
aforementioned meeting, voted unanimously that the most effective approach to protect
the health, safety and welfare of the public would be to expand the current smoke-free
area created for the inner portion of the Commons to the entirety of the Commons (as
defined below), an approach with which the Council agrees; now, therefore, be it”

Alderperson Coles absent from vote
Alderperson McCollister stated that although she had been considering supporting this
legislation, she will oppose it due to the amount of time that has been spent on this
issue by both staff and Common Council. She also voiced her concern about the
unintended consequences that could occur as a result of the expansion of the smoke-
free zones such as clustering of smokers on West State Street near the State Theater
and other businesses.
Alderperson Zumoff stated that he would oppose the legislation due to the potential for
unintended consequences. He suggested that the smoke-free zones revert back to the
original recommendation of the playground and outdoor dining areas.
Alderperson Cogan responded to comments made about a phrase he used in a recent
interview describing the expansion of the smoke-free zone as a “social experiment”. He
clarified that he was referring to the fact that no one could predict what would happen
when the original legislation and smoke-free zone designations became effective.
Similarly, no one can accurately predict where smokers will relocate once the entire
Commons becomes a smoke-free zone.
42
October 6, 2010
Alderperson Coles referenced an article in Prevention Magazine that described how
communities that have restricted smoking have realized a 27% reduction in related
diseases.
Alderperson Rooker applauded the quick response of the Planning and Economic
Development Committee in amending this legislation and providing relief to the
business owners who were negatively affected by the original legislation.
Alderperson Rosario stated that he was pleased that the Planning & Economic
Development Committee was able to consider this item, but noted that a process issue
was identified concerning the timing between Committee meetings and Council
meetings that will need to be addressed in the future.
