Box 6435 Ithaca, New York 14851-6435 Re: Zoning Determination for 742 Cascadilla Street Dear Mr. Brainard: I am in receipt of your November 29, 2016 letter, and December 9th and 16th emails, regarding the Maguire Dealerships property at 742 Cascadilla Street, which I now understand to be a request for a zoning determination. 742 Cascadilla Street is currently zoned as I-1, “Industrial,” which includes motor vehicle sales and service as a permitted use for existing buildings or structures. Expansion of the current building or new construction will require site plan review under Chapter 276 of the City Code or, if necessary, approval from the Common Council under the processes set forth in the City’s Temporary Mandatory Planned Urban Development ordinance. As you know, motor vehicle sales and service may no longer be a permissible use at 742 Cascadilla Street after the City rezones that area in the coming months. Should such rezoning occur, motor vehicle sales and service at the property would thus be limited to that which commences as a prior non-conforming use before the change in zoning. Thereafter, Maguire would require a variance to expand its prior non-conforming motor vehicle sales and service use.
