RE: 113 Glen Place, East Hill Historic District, Declaration of Lead Agency
RESOLUTION: The resolution was moved by M. R. Tomlan and seconded by B. Suber.
WHEREAS, State Law and Section 176.6 of the City Code require that a lead agency be
established for conducting environmental review of projects in accordance with
local and state environmental law, and
WHEREAS, State Law specifies that for actions governed by local environmental review, the
lead agency shall be that local agency which has primary responsibility for
approving and funding or carrying out the action, and
WHEREAS, the proposal to demolish a structure within the East Hill Historic District,
designated a local historic district and listed on the National and New York State
Registers of Historic Places, is a "Type I" Action pursuant to CEQR which
requires review under the City's Environmental Quality Review Ordinance; and
WHEREAS, the proposal to demolish the garage at 113 Glen Place, East Hill Historic District
is subject to the review and approval of the Ithaca Landmarks Preservation
Commission, now, therefore,be it
RESOLVED, that Ithaca Landmarks Preservation Commission does hereby declare itself lead
agency for the environmental review of the proposed demolition of a designated
historic resource.

113 Glenn Place, East Hill Historic District -Positive Declaration
RESOLUTION: The resolution was moved by B. Suber and seconded by K. Foley
WHEREAS, an application for approval of a Certificate of Appropriateness to demolish the
garage on the site of 113 Glen Place has been submitted to the Ithaca Landmarks
Preservation Commission, (ILPC), and
WHEREAS, the proposed action appears to be a Type I Action under the City Environmental
Quality Review Ordinance and the State Environmental Quality Review Act, and
WHEREAS, a Long EAF, Parts 1, 2, and 3, has been completed, and
WHEREAS, the ILPC, as lead agency, has reviewed the application materials including the
letter dated October 12, 2001, accompanying photographs and the demolition
permit application, and
WHEREAS, identified impacts include impacts on the neighborhood's visual character and
impacts on historic resources and
WHEREAS, the Conservation Advisory Council has been given the opportunity to comment
on the LEAF although no comment has been received, and
WHEREAS, appropriate environmental review has been conducted, now, therefore be it
RESOLVED, that the Ithaca Landmarks Preservation Commission has determined, as set forth
in Part III of the LEAF, that the proposed action will result in a significant
environmental impact, and the preparation of an Environmental Impact
Statement is required before further decisions can be made concerning the
proposal, and be it further
RESOLVED, that a Positive Declaration for purposes of Article 8 of the Environmental
Conservation Law be filed according to the requirements contained in Part 617
thereof.

Dear Mr. Hull:
Enclosed are the resolutions adopted by the Ithaca Landmarks Preservation Commission, (ILPC)
at the meeting held Thursday, December 13, 2001 and a completed copy of the Long
Environmental Assessment Form, (LEAF), Parts I, II and III, upon which the ILPC based its
declaration of positive impact. Notice of the positive declaration has been filed in accordance
with requirements of the City of Ithaca Municipal Code, Chapter 176, Environmental Quality
Review, (CEQR).
Draft Environmental Impact Statement, DEIS
The determination of a positive impact sets in motion a process that, in addition to requirements
of the Ithaca Landmarks Preservation Ordinance,must also meet requirements of the City
Environmental Quality Review Ordinance. The next step is the preparation of a draft
Environmental Impact Statement addressing potential impacts identified in the LEAF. Impacts
identified in the LEAF were limited to impacts on visual and historic resources. The DEIS may
be prepared either by the applicant or by the lead agency. Attached is a list from CEQR
indicating minimum content of the DEIS. As part of this process the ILPC will consider whether
or not denial of the Certificate of Appropriateness causes the property owner an economic
hardship. Information necessary for the ILPC to make a determination of hardship will also be
part of the DEIS. Enclosed is a list of information required by the ILPC to evaluate the hardship.
Upon completion the lead agency, ILPC,makes a determination about whether the DEIS is
"adequate for public review". The lead agency must file notice of completion and adequacy in
accordance with the requirements of environmental law. The minimum public comment period
starting from notice of completion is 30 days.
Final Environmental Impact Statement, FEIS
The lead agency is responsible for preparation of the Final Environmental Impact Statement,
FEIS, which includes the DEIS, substantive comments raised by the public and response to
public comment from the lead agency. Once submitted the lead agency must file notice of
completion in accordance with requirements of CEQR. There is a required 10 day comment
period following the notice of completion. The ILPC then has up to 30 days to make its final
decision regarding the application.
