NOW, THEREFORE, the Owner and the Architect, for the considerations
hereinafter named, agree as follows:

Article 2. Time of Completion—The work to be performed under this Contract

formance of the Contract, subject to additions and deductions provided therein, in

Where the quantities originally contemplated are so changed that application of
the agreed unit price to the quantity of work performed is shown to create a hard-
ship to the Owner or the Contractor, there shall be an equitable adjustment of the

Article 4. Progress Payments—The Owner shall make payments on account of
the Contract as provided therein, as follows:

Article 5. Acceptance and Final Payment—Final payment shall be due----IQ-----------
days after substantial completion of the work provided the work be then fully
completed and the Contract fully performed.
Upon receipt of written notice that the work is ready for final inspection and
acceptance, the Architect shall promptly make such inspection, and when he
finds the work acceptable under the Contract and the Contract fully performed
he shall promptly issue a final certificate, over his own signature, stating that the
work provided for in this Contract has been completed and is accepted by him
under the terms and conditions thereof, and that the entire balance found to be
due the Contractor, and noted in said final certificate, is due and payable.
Before issuance of final certificate the Contractor shall submit evidence satis-
factory to the Architect that all payrolls, material bills, and other indebtedness
connected with the work have been paid.
If after the work has been substantially completed, full completion thereof is
materially delayed through no fault of the Contractor, and the Architect so certifies,
the Owner shall, upon certificate of the Architect, and without terminating the
Contract, make payment of the balance due for that portion of the work fully
completed and accepted. Such payment shall be made under the terms and con-
ditions governing final payment, except that it shall not constitute a waiver of
claims.

Article 6. The Contract Documents—The General Conditions of the Contract, the
Specifications and the Drawings, together with this Agreement, form the Contract,
and they are as fully a part of the Contract as if hereto attached or herein repeated.

Article 4. Progress Payments—The Owner shall make payments on account of
the Contract as provided therein, as follows:

in the work and of materials suitably stored at the site thereof up to the--------------------
day of that month, as estimated by the Architect, less the aggregate of previous

Article 5. Acceptance and Final Payment—Final payment shall be due-----10----------
days after substantial completion of the work provided the work be then fully
completed and the Contract fully performed.
Upon receipt of written notice that the work is ready for final inspection and
acceptance, the Architect shall promptly make such inspection, and when he
finds the work acceptable under the Contract and the Contract fully performed
he shall promptly issue a final certificate, over his own signature, stating that the
work provided for in this Contract has been completed and is accepted by him
under the terms and conditions thereof, and that the entire balance found to be
due the Contractor, and noted in said final certificate, is due and payable.
Before issuance of final certificate the Contractor shall submit evidence satis-
factory to the Architect that all payrolls, material bills, and other indebtedness
connected with the work have been paid.
If after the work has been substantially completed, full completion thereof is
materially delayed through no fault of the Contractor, and the Architect so certifies,
the Owner shall, upon certificate of the Architect, and without terminating the
Contract, make payment of the balance due for that portion of the work fully
completed and accepted. Such payment shall be made under the terms and con-
ditions governing final payment, except that it shall not constitute a waiver of
claims.

Specifications and the Drawings, together with this Agreement, form the Contract,

Dear Mr. Springer:
It is ray recollection that the different odd lots in the
Bergholtz Tract which were conveyed to vvrious parties by Mr.
Bergholtz or the Company were conveyed by reference to lot
numbers on a certain map. It is my understanding that as a
ratter of late, this is ordinarily construed a.s conveying fee
title to the center of the street adjoining; such lots, subject
to rights of way over any lands within the street. "The some
legal theory would apply as a matter of law, I believe, to the
conveyance to the City of the remaining portion of the Tract,
i�fhich in some cases would carry title to the middle of the
street opposite the odd lots owned by individuals, and in
other cases would carry title from both sides to the center
of the street, or ownership of the entire street subject to
rights of way. I would suggest that the legal phases of this
matter be taken up with City Attorney Thaler.
I believe it to be the sentiment of the Stewart Park
Commission that as opportunities present themselves to acquire
these odd parcels at mgupazAhLia rices they should be acquired
for the City so that the' p'`t1 c"`pro`p erty for the use as park
or playground should extend. from Fall Creek on the south
continuously to the head of the Lake. For this reason, I think
it inadvisable to convey the fee title to any part of the
Bergholtz Tract to the Town of Ithaca or any other party. Will
you please put this on the agenda for the next meeting of the
Stewart Park Commission?
I believe the matter of the maintenance of the Rosemary
Lane, and any question of liability in case it is not properly
maintained, should be determined by the City Attorney and the
Board of Public Works, perhaps in cooperation with the Town of
Ithaca Board. I would be very glad to discuss the matter with
Tyr. Thaler or with you if there is anything further which I can
do.

Dear Per. Treman:
Our company is attempting to locate in Ithaca and we have made a
survey of the available properties which might serve as a location
for the building of a modern plant. There are very few properties
suitable for our operations, and the only location that seems to be
satisfactory is the property which was purchased bJ• the Stewart Park
Commission and donated to the City of Ithaca. VVe refer particularly
to that property which is a corner location on the north end of the
city property, facing the Auburn road, and on the south side of the
street which turns off of the Auburn road to the entrance to Stew-
art Park.
We have discussed this proposition with several of the city officials
and they have advised that it will be necessary to go through defi-
nite channels and secure the approval of the various departments
before any decision can be reached. We do not want to formally
bring this to the attention of these departments unless we can feel
reasonably sure that it has the approval of the members of these
departments.
For your information, we would construct a modern bottling plant
similar to the plants we have constructed in this vicinity, which
should cost in the neighborhood of 050,000.00, and it would be neces-
sary to add an additional similar amount for equipment, etc. :'Fe
would need for our operations a frontage on the Auburn road of ap-
proximately 150 feet with 200 feet in depth and would be willing to
pay approximately $7500.00 for this property.
Will you kindly advise us of the attitude of the commission relative
to the sale of this particular lot.

'there are a number of items which should be considered by the commission.
hile it is no doubt too late in theseaso n to attempt a construction pro-
sram they should be discussed at this time and brought up again at a meet-
in&_early in the Opring,
1. Band Stand. For a number of years we have had a low wood band stand
at the rear off'' the tower sheltered by an awning. At the present time both
the platform and the awning are so rotten as to be unusable. It would seem
that there is a need for such a structure and a study should be made to
decide on type and location. Awning does not seem to be practical in the
occasional high winds.
Small boat dock. Small boating has been on the increase for several
years and prospects are for stillmore increase in the near future. YVe
should have an adequate dock for loading; and unloading to replace the one
lost in the flood.
Pavillion. A study should be made of Pavillion and bath house with the
idea of improving. The wood steps are in bad condition and should be
replaced with concrete, )--=--
Bathin4 Beach. Swimming at the park has always been in front of and
between the Pavillion and bath house. All summer we have a wash up
of debris from the lake which seems to be concentrated in this area only.
Opposite the picAic grounds there is a fine sandy beach and grass area
and no trouble with debris. We suggest for next season that the bathing
area be moved to this location.
