Commissioner Cooper wanted the minutes to show that: " Mr. Baker was aware we were to meet and I thought he was to be here for the Special Meeting on this position specification. " Commissioner Bantuvanis stated: "We invited him." Commissioner Cooper then directed the Executive Secretary to have the minutes show that the Commission did not act on the specification for Personnel Associate due to the fact that Personnel Administrator Baker did not attend the meeting. Commissioner Cooper then seconded the motion. The Commission voted. Motion carried unanimously. Commissioner Bantuvanis adjourned the meeting at 4:26 P.M. Department of Civil Service Jodi Lee. The Public Hearing was called to order at 3:45 P.M. by Commissioner Bantuvanis. The Notice of Public Hearing was read by Commissioner Bantuvanis: "Please take note that pursuant to §ection 20 of the Civil Service Law of the State of New York that the City of Ithaca Civil Service Commission will hold a Public Hearing at 3:45 P.M. in the Second Floor Conference Room, City Hall , 108 East Green Street, Ithaca, New York on October 13, 1987 to amend its Rules by adding to Appendix B to Rule IV Non-Competitive Class the position of Park Ranger - Seasonal . All citizens either for or against the change are invited to attend and be heard. " RESOLUTION TO OPEN THE PUBLIC HEARING .- Commissioner Cooper. Resolved that the Public Hearing be opened. Seconded by Commissioner Bantuvanis. Motion carried. There were no persons present to address the Commission on the above matter. 002 , RESOLUTION TO CLOSE THE PUBLIC HEARING - Commissioner Bantuvanis. Resolved that the Public Hearing be closed. NEW BUSINESS APPROVAL OF MINUTES Commissioner Bantuvanis moved that the minutes of the regular and special meetings in September be approved. Seconded by Commissioner Cooper. Motion carried. PARK RANGER - SEASONAL - RULES CHANGE Commissioner Bantuvanis moved: " WHEREAS, The City of Ithaca Civil Service Commission has held.a Public Hearing on October 13, 1987, at 3:45 P.M. in the Second Floor Conference Room, City Hall , 108 E. Green Street, Ithaca, New York, concerning the amendment of its Rules for the Classified Civil Service of the City of Ithaca by adding Park Ranger-Seasonal to. Appendix B to Rule IV, Non-Competiitve Class: NOW, THEREFORE BE IT RESOLVED, That the Park Ranger-Seasonal be added to Appendix B to Rule IV Non-Competitive Class. " Seconded by Commissioner Cooper. Motion carried. CIVIL SERVICE/PERSONNEL CONSOLIDATION Commissioner Cooper: "This is where we have lots of questions for Mr. Doyle. I'm not sure if we want an executive session. " Commissioner Bantuvanis: "It is fine with me if you want one. " Mr. Doyle: "I have major reservations about Common Council 's reogranization. The City has three things to do. The options are: first, to leave the Commission as it it now an independent body. Second, the City need not maintain civil service commission at all . The law permits a personnel officer operation which has all the duties and obligations of a Civil Service Commission. • 203 Commissioner Cooper: "However, if the city decides to go with the abolition, it , is my understanding that that takes one year. " Mr. Doyle: "Unless the city can convince the state legislature to waive the law. The City Charter would have to be amended and it would depend on the City Attorney's opinion on what type of referendum would be needed. " Since the Taylor Law the trend has been to personnel officers in counties." Commissioner Bantuvanis : "They handle everything?" Mr. Doyle' "Right. There are some combinations of personnel officers and civil service commissions. Nassau County has a civil service Commission covering 43,000 employees and also it has a personnel officer handling contracts, labor relations, greviences, etc. They are separate operations. Niagara Falls has an executive secretary who is the city's personnel officer. The functions are kept separate. Commissioner Bantuvanis: " Are you sure?" Mr. Doyle: "Yes . The third option is to abolish civil service and not appoint a personnel officer and then the county gets it, civil service, by default. " Commissioner Bantuvanis: "On failed candidates the personnel officer would see the grades. " Mr. Doyle: "The personnel officer would see them but he or she cannot tell the Mayor or who the person works for what the grade was. " •{ Commissioner Bantuvanis: "What is the common council fires?" Mr. Doyle: "Well , abolishing and firing are two separate things." Commissioner Bantuvanis : "Can common council abolish the executive secretary?" Mr. Doyle: "Yes. " Commissioner Bantuvanis : "If they doV' Mr. Doyle: "Then that leaves you with no one to handle your work. " Commissioner Bantuvanis : " How do we get an executive secretary?" Mr. Doyle: " A volunteer or you do i.t yourselves." Commissioner Cooper: "In terms of the merger, I don's think we were asked to be part of the merger. We have not been notifLed of their action. We were operating in a vacuum. We were being asked to adopt a job classification for the Personnel Associate. " Mr. Doyle: "Only civil service can do that. It is your responsibility. Jurisdictional questions are solely civil service not the personnel officer or mayor or common council . Issues about qualifications for candidates for examinations for competitive and other classes as non-competitive is solely the responsibility of the commission. Sometime you will develop derogatory information about candidates. Once they are employed they are under the personnel officer. At that point they come under the personnel officer and he can do further background checks, checks on citizenship, etc. ' 204 r • Commissioner Bantuvanis: "For instance, if information were not available on mental problems is the information available?" Mr. Doyle: "No. Information not available or not qualified or qualified. You the commission make the determination. Not the personnel officer or mayor or common council . Civil Service determines qualified or not qualified. If an appointing officer develops information on a candidate on his own then he can bring it to civil service for review for determination if a candidate is qualified or not. " Commissioner Bantuvanis: "The City of Ithaca wants to develop personnel associate and have them be the executive secretary to the civil service commission. " Mr. Baker: "That's right. If the personnel associate will be the executive secretary depends on what functions we are talking about. " Commissioner Cooper: Whose responsibility would it be to mail out agendas, notify candidates, disqualifications, put them together write them etc.?" Mr. Baker: "The Office of Personnel would be. " Commissioner Bantuvanis : "You would delegate someone?" - Commissioner Cooper: "Someone would be here to take minutes?" Mr. Baker: "Yes." Mr. Doyle: The resolution of council is vague. There is no authority for the merger. In Niagara Falls there is a clear distinction of function. If there is a cooperative effort between civil service and the personnel office that is fine. " Commissioner Bantuvanis: "The commission will be in last. " Mr. Doyle: "Given with one hand and taken away with the other. " Commissioner Cooper: "I need to see the resolution. " Commissioner Bantuvanis: "I have one. " Everyone reviewed common council 's resolution of September 2, 1987. Mr. Doyle remarked that section number one of the resolution was good. However section three of the resolution is in conflict in combining the functions and responsibilities of the Office of Civil Service with those of the Personnel Department. Commissioner Bantuvanis : "That's what we said before. " Commissioner Cooper: "That's right. " Mr. Doyle: "I don't know what that section three of common council 's resolution means. " Commissioner Bantuvanis: " Where do we stand?" Mr. Doyle: "I think you have to ask some questions. " • 205 Commissioner Bantuvanis : " We should write a letter to the Mayor." Mr. Doyle: "To whoever sponsored the resolution." Commissioner Cooper read the first amending resolution. Mr. Doyle: Was there a vote on that?" Commissioner Cooper: "There were threeoayes- and-seven nays. " Mr. Doyle: "So much for that amendment. " Commissioner Cooper read the second amending resolution: " By Alderperson Schlather: Seconded by Alderperson Killeen RESOLVED, That item (2) of the RESOLVED paragraph be amended to read as follows: "the position of Executive Secretary to the Civil. Service Commission is abolished effective January 1, 1988. " Commissioner Bantuvanis: "Changing the date." Commissioner Cooper: "That's all,. " Mr. Doyle: From your prospective you have to know how you are going to fullfill your obligations under civil service law. The City could remove all money from the commission. However, the State could have a few words on that. it could say cut bait and fish or get out of the . . . " Commissioner Bantuvanis: "Could the State Commission write a letter?" r " : Mr. Doyle: "I would be the one writing the letter. The State Civil Service Department would like clarification. " Commissioner Cooper: "That's what we want. " Commissioner Bantuvanis: "If Mr. Doyle would write and we would write on how we are to fullfill our responsibilities then maybe we will get an answer." Commissioner Cooper: "I don't feel we should make a decision on Personnel Associate, We are working in a vacuum." Commissioner Bantuvanis : " Who is the attorney who was to be here?" Commissioner Cooper: "Paul Bennett. " Mr. Doyle: "If he has a problem, have him call me anytime." Commissioner Cooper: "Did you get any phone calls?" Mr. Doyle: "A few months ago, I got a call from the City Attorney. I traced the the history of the Commission back to 1906. He wanted to know when it was started. " Commissioner Bantuvanis: "How was it established?" Mr. Doyle: "Who knows how it got started. I found that the Mayor appointed three commissioners. Cities were not obligated,in 1906 to have a commission. 1941 was when the State became interested. My staff might have had conversations I am not aware of. " c'T'o • Commissioner Cooper: "According to the Rules Civil Service appoints the Executive Secretary. " Mr. Doyle: "That is pretty common. Whoever is there appoints,whether the Police Chief or the Fire Department Chief. They have the power to appoint. Civil Service has it, the Police Chief has it and the Fire Chief has it. They can't impinge on your responsibility to classify. What the State is worried about is will the situation get nasty. You have the responsibility to classify. The School District chips in on your costs. Bill are they interested in that?" Mr. Baker: "The City is interested in keeping the fee from the City School District. " Mr. Doyle: "There is a formula a fee structure. School District employees vs. City employees. It is in the Education Law. " Commissioner Cooper: "We also cover the Housing Authority." Mr. Doyle: The issue involves civil service and the city. The monies are in the Education Law. Chapter 2506, Section 17 I believe. On that issue the Board of Education might pull the strings. There is no similar provisions for counties. Just cities get reimbursed. " Commissioner Bantuvanis: "I was at one meeting. I wonder if any of these issues were raised?" Commissioner Cooper: "No. I think they feel they are within the confines of the law. " Commissioner Bantuvanis: "What about the other ramifications?" Mr. Doyle: "They need to be clarified. The where with all needs to be clarified. The personnel office is a management function. " Commissioner Cooper: " I have looked at civil service as a watch dog. " Mr. Doyle: We try to provide service and also audit you. State Civil Service is undergoing review. Civil Service might be abandoning its neutral role. There is a proposal to combine civil service with the Governor's Office of Personnel Relations. The public is left out in the cold. If this thing goes through, who do I send examination results to. Lets get down to the nitty-grity. " Commissioner. Bantuvanis: "Personnel?" Mr. Doyle: "They can't see examination results. " Commissioner Bantuvanis: "Why doesn't the Mayor abolish the Commission?" Mr. Doyle: " It is his choice. It could be that the City wants to respect the Commission. " Commissioner Cooper: " I addressed the Common Council about this. Only one member called me at home about this. There are too many questions to be answered here. I am not being paid. and I can't do it. 207 • Commissioner Bantuvanis: "He also called me - Mr. Hoffman. " Mr. Baker: "Ted for informational purposes -there was a twenty page report. Common Council selected option four. The report clears the air on who does what. The ball is you your court. You have to decide who you want to do your functions." Commissioner Bantuvanis: "You don't see conflict between the two?" Mr. Baker: "No. I have done both in my other jobs. " Commissioner Bantuvanis : "Why don't they abolish us?" Mr. Baker: "I don't know. " Commissioner Cooper: ""If we say the new Personnel Associate is totally responsible for civil service functions, what percentage of time will be spent on civil service duties?" Commissioner Bantuvanis: "We wouldn't have one person to do it all day in and day out. " Mr. Baker: "You don't need it. " - Mr. Doyle: "Municipal Service provides service. We only have four people to cover forty agencies. Anything done at the local level helps us. You have responsibility for certain functions. You have to make sure you have the where with all to accomplish your duties. They can abolish and go with a personnel officer to do both. " {. ` Commissioner Cooper: .."We are still back to where we were The letter must be written. L We could both resign." There was discussion. The twenty page report was reviewed. Mr. Baker: "Page six outlines the options. " Mr. Doyle: " You don't think there is a mis-conception on who is responsible for what?" Mr. Baker: "I don't think so. We now have capability to audit a whole department. " Mr. Doyle: "I think you need to think. You need to think about those things you can't delegate. Examination results is one area. Application review and background checks .is another. Doing audits and collecting information on duties of jobs - personnel can help you. " Commissioner Bantuvanis : "Did the Personnel Associate job specification go through common council?" Mr. Baker: Yes. and they authorized me to hire at step two on the plan for those not representated by a union." Commissioner Bantuvanis : "It was created without us approving it?" Mr. Baker: "Yes. " Commissioner Bantuvanis: "Is that legal ?" 208 Mr. Baker: "You have authority to title and classify a position. Can appoint pending classification. It is not uncommon to do that. " Mr. Doyle12 "As a technical matter common council can't create the position without civil service classifying. It is not legal . It is a non-entity. " Commissioner Bantuvanis : 'Should we notify them?" Mr. Doyle: "The Commission has an obligation to act expeditiously. " Mr. Baker: "I need to move forward. I have five collective bargaining agreements to negotiate and have been heavily involved in the hiring of a new Police Chief, and the interviews involved. " Commissioner Bantuvanis: "We held a special meeting. You were out there in the office. Then you left. " Mr. Baker: " I don't want to get into a pissing match with you now unless you want to. I did what you asked me to do and I revised the job spec. " There was discussion on Mr. Baker's being expected at the special meeting. Commissioner Cooper: "It was very hard for us to work on it without you at the special meeting.'' Mr. Baker: Where there any questions on the job spec.?" Mr. Doyle: "Does common council create a position without civil service approval?" Mr. Pezdek: "Very rarely." Mr. Doyle: "The person in the position cannot be paid if civil service has not classified the position." Commissioner Bantuvanis: "We have to get together and get the letters done. " Commissioner Cooper: "Yes." Commissioner Bantuvanis: "May we go on? Do we have any more to discuss?" Commissioner. Cooper: "We can go on. " PERSONNEL ASSOCIATE POSITION SPECIFICATION The Commission and Mr. Doyle reviewed the °Personnel Associate position specification. Mr. Doyel : "What is public service laws? Is that Civil Service Laws?" Commissioner Bantuvanis : " Is there a special law for that?" Mr. Baker: "It is .a broad statement. There are public sector laws ." Mr. Doyle: "Why not say interprets laws. and rules etc.?" Mr. Baker: The position would not speak for the Commission. It will provide direction." 7 209 Mr. Doyle: "I would if I were Personnel Officer. There are some pretty big departments in the state that have personnel officers, and they administer the law. -�; If they screw up the State Commission rights the wrong. There can't be two interpretations of the law. The relationships have to be clarified. The city has a responsibility to give personnel what it thinks it needs in the way of help. It is the Commissions responsibility as to what it adopts as the offical specification. Not what common council or the school districts adopts." Mr. Baker: "I am supportive of competitive class. " Commissioner Cooper: "I think it should be competitive. Bill , clarify something for me. Is the person working as liaison mainly to the civil service commission?" Mr. Baker: "No. You would be seeing them and me and clerical support. It will play a key role. " Commissioner Cooper: "Does your job spec state you have civil service responsibility?" Mr. Baker: "No. Specific language prohibiting." Commissioner Cooper: "In the first specification for Personnel Associate, wasn't that here in it?" - Mr. Baker: "The position may do job audits, administer examinations, etc. The position will support the commission and do a good job. " Commissioner Cooper: " Wouldn't you be working out of job spec if Civil Service -. ,, responsibilities are not in it?" Mr. Baker: "It must be looked at very broadly. Things can be added. " Commissioner Cooper: "It can be revised?" Mr. Baker: "Yes. " Commissioner Bantuvanis: "Does your job spec need to be revised?" Mr. Baker: "I am here to make things work for the City. Common council wishes personnel to provide support for the Commission. " Commissioner Cooper: "I want a person designated to do civil service matters. " Commissioner Bantuvanis : " What difference does it make one or three persons?" Commissioner Cooper: "It makes it difficult,for me on who. to call . " Mr. Baker: "Those things can be worked out. " Commissioner Cooper: "You were not hired to do civil service. It sounded like the Personnel Associate would absorb-. the Executive Secretary job functiions. Is that true?" Commissioner Bantuvanis "Someone in your office would provide clerical support?" Mr. Baker: "Yes. " Commissioner Cooper: "If you are going to do some of the Civil Service functions should your job specification be changed?" Mr. Baker: "Yes. Job specifications must reflect the job. " Commissioner Cooper? "In terms of common council- resolution, the Executive Secretary is abolished and everything is under one office. The duties and responsibilities will be absorbed into the Personnel Associate?" Mr. Baker: "Three people will be providing support. I will , the new Personnel Associate will . Would you be more comfortable if the Personnel Administrator was the one responsible?" Commissioner Cooper: "That's not an issue." Mr. Doyle: "That specification is broad enough. This issue is is it being created in Personnel Office. Do, you want it?" Commissioner Bantuvanis : "What does common council want of us? I am back and forth on this issue." Mr. Doyle: "You do it yourself. I can't do it from Albany." Mr. Baker:. "The job specification is broad. It will serve personnel department. Spparately you should pursue the other issue. Divorce the two. " - Commissioner Cooper: "You have already started." Mr. Baker: "You have to classify either today or next month. " Commissioner Bantuvanis : "If we don't adopt, we are sending a message to common council . " Mr. Baker: "If you don't,you are sending a message to common council ." Commissioner Bantuvanis : "What do you want to do?" Mr. Doyle: " Could I make a suggestion? You might want to approve the title and the minimum qualifications. The law permits this and hold the rest in abeyance. That would assist in recruiting. " Commissioner Cooper: "Not act on the body of the spec until we get clarification?" Mr, Doyle: "You can. I assume Bill has enough work for the position. " Commissioner Cooper: "I move to adopt the title of Personnel Associate and the minimum qualifications of: Graduation from a New York State registered or regionally accredited four-year college or university with,a, Bachelor's Degree and two years of professional experience in personnel work including either recruiting, interviewing, job classification, labor relations or job evaluation. " Seconded by Commissioner Bantuvanis: The Commission voted. Motion carried. ENGINEERING TECHNICIAN - NEW POSITION DUTIES STATEMENT Mr. Pezdek gave the Commission the background on the request from City Engineer Gray for this request. 211 He stated that Mr. Jager, a Senior Engineering Aide was appointed to the position of EngineeringTechnician first. Then he received the papers r- provisionally appointing Mr. Bouchard to the second position authorized by Common Council . Then he recieved a third set of papers appointing Mr. Miller to the position of Engineering Technician. Mr. DeBell and Mr. Miller are Senior Engineering Aides who received their appointments as Engineering Aides from eligible lists. - He informed the Commission that only two positions had been authorized by Council for Engineering Technician and not three. Therefore, he ruled that Mr. Bouchard since he had no civil service status was not entitled to be appointed provisionally to one of the two positions authorized, but rather he could be appointed temporarily pending classification by the Commission. As an aside, he mentioned that when council created the two Engineering Technician positions they abolished two Engineering Aide positions which were not in the authorized budget. The position of Engineering Aide had not been used in years. Mr. Pezdek further stated that his decision was based on the letter of comparability of the positions of Senior Engineering Aide and Engineering Technician which he had received in reply to his request on whether or not the Senior Engineering Aides had to take an examination to be promoted to Engineering Technician. The letter stated that the Senior Engineering Aides did not have to take an examination to be promoted. The letter was a result of the DPW re-classification survey. Mr. Doyle pointed out to the Commission that since the title Engineering Technician was a result of the re-classification survey that if all five of the Senior Engineering Aides were promoted there would be no difficulty. But, since the Commission did not promote all five of them in the survey but chose rather to go with the Superindentent of Public Works recommendation that he be permitted to pick and choose who to promote that the two individuals promoted would have to take an examination. The other choice was to was to promote all five and order an examination for the New Position. Mr. Pezdek asked if the examination could be promotional if one had to be held. Mr. Doyle said that the promotional examination was the way to go, for the two. However, Mr. Doyle stated that he wished the Commission to address a letter to Municipal Services on this matter and recommended to the Commission that the matter be tabled for the time being until a ruling from the state could be obtained. Commissioner Cooper moved to table the request for a New Position Duties Statement for an Engineering Technician. position. Seconded by Commissioner Bantuvanis. The Commission voted. Motion carried. MINIMUM QUALIFICATIONS ADDITION FOR POLICE CHIEF, DEPUTY POLICE CHIEF, POLICE CAPTAIN AND POLICE SERGEANT Commissioner Bantuvanis moved: that in order to be in conformity with the Civil _ Service Law Article 4, Section 58.1b that the present minimum qualification listed in the position specifications for Police Chief, Deputy Police Chief, Police Captain and Police Sergeant be numbered number one and that a second mimimum qualification to be numbered number two be added to each of the above specifications as follows: 2. Notwithstanding the provisions of any other section of law, general , special of local , in political subdivisions maintaining a police department serving a population of one hundred fifty thousand or less, no person shall be eligible for appointment nor shall he or she be appointed to any rank above the rank of police officer unless he or she has been appointed a police officer from an eligible list established according to merit and fitness as provided by section six of article five of the constutution of the state of New York or has perviously served as a member of 212 the New York state police. Seconded by Commissioner Cooper: Motion carried. RESINSTATEMENT OF MR. BRIAN WILBUR AS DEPUTY FIRE CHIEF The Commission reviewed the documents on the request for the reinstatement after resignation of Mr. Brian Wilbur as .Deputy Fire Chief. In addition, the Commission read the reinstatement rule - Rule XVIII. At the suggestion of Mr. Doyle who pointed out that this rule would have be be amended _to accomplish a reinstatement, Commissioner Cooper moved that a public hearing be held in November 1987 to amend Rule XVIII to permit reinstatement of individuals from other jurisdictions to positions for the City of Ithaca and further that the matter of the reinstatement of Mr. Wilbur be tabled until such a time as the New York State Commission approves the Rule change. Seconded by Commissioner Bantuvanis. Motion carried. Mr. Doyle remarked that the request for this rule change might prove interesting since he belived that the State Commission had never considered such a request before. It could well have state wide implications if approved. RULES CHANGES IN THE NON-COMPETITIVE CLASS AND THE LABOR CLASS Mr. Pezdek informed the Commission that the State Commission had approved its request to amend its Rules by placing Parking Lot Attendants and Senior Laborers in the Labor Class - Appendix C and that Working Supervisor - Bridges and Working Supervisor-Sanitation had also been approved for placement in the Non-Competitive Class Appendix B to the Rules. Seconded by Commissioner Cooper. Motion carried. Mr. Doyle reminded ! the Commission that the Parking Lot Attendants and the Senior Laborers would have to serve a probationary period because the specifications were new and the classification assignment was also new, in order to meet the requirements of the Civil Service Law. 213 Commissioner Cooper directed the Executive Secretary to so notify the appropriate appointing authority. r LATE RECIEPT OF CANVASS LETTER FROM MR. GARY HERRMAN YOUTH BUREAU DIRECTOR CANDIDATE Mr. Pezdek presented to the Commission Canvass Letter of Mr. Gary Hermann together with a letter from him stating his reason for the late return of the canvass letter. 7 The Commission reviewed Mr. Hermann's letter and the canvass letter and its date of reply. Commissioner Bantuvanis moved that the canvass letter of Mr. Gary Herman be accepted and his reply listed on the eligible list for Youth Bureau Director due to the fact that he was away attending a professional conference and could not reply in a timely manner. Seconded by Commissioner Cooper. Motion carried. LIBRARY CLERK - FALL CREEK SCHOOL - NEW POSITION DUTIES STATEMENT Commissioner Bantuvanis presented to the Commission a New Position Duties Statement for the position of Clerk at the Fall Creek Elementary School and moved that it be approved in conformity with the Civil Service Specification for Clerk. Seconded by Commissioner Cooper. The Commission reviewed the New Position Duties Statement and the memorandum then voted. Motion carried. ELIGIBLE LISTS Commissioner Cooper moved that the following eligible lists be established effective October 13, 1987 and that they be in effect for one year unless exhausted sooner: Water/Wastewater Treatment Plant Operator/Trainee, No. 1987-7 and Plan Review Officer, No. 68-936. Seconded by Commissioner Bantuvanis. lv Mr. Doyle suggested to the Commission that they consider establishing eligible lists for four years and explained the reasons for his recommendation. The reasons were that a list would be available for that time period unless exhausted or unless anothe^examination were ordered and then the resulting eligible list would supercede the list established for four years. In addition, such a policy would be less work for the Commission and its staff. The Commission discussed the proposal made by Mr. Doyle. Commissioner Bantuvanis then withdrew her second and Commission Cooper withdrew her motion and moved that the following eligible lists be established for four years unless exhausted sooner: Water/Wastewater Treatment Plant Operator/Trainee, No. 1987-7 and Plan Review Officer, No. 68-936. Motion carried. 214 • ABOLITION OF POSITION SPECIFICATIONS NO LONGER USED Executive Secretary Pezdek presented to the Commission a list of position specifications no longer used. He explained that the positions on the list had not been used in some time and that most of them were very old and out of date. The Commission reviewed the list then directed Mr. Pezdek to circulate the 7 list to appointing officers with a memorandum to the effect that the Commission was considering their abolition and wished comments on any that should be retained. The public hearing on amending Rule XVIII was not held since the Commission could not meet on the regularly scheduled day. It will be held December 14, 1987. NEW BUSINESS APPROVAL OF MINUTES Commissioner Bantuvanis moved that the Minutes of Public Hearing and regular meeting for October be approved. Seconded by Commissioner Cooper. Motion carried. MR. WILLIAM R. BAKER VICE PRESIDENT C.S.E.A. ADMINISTRATIVE UNIT - ENGINEERING TECHNICIANS Commissioner Bantuvanis asked Mr. Baker to address the Commission. Mr. Baker said that he was here to find out why there was confusion regarding the Senior Engineering Aides and the Engineering Technician positions. He stated that he had followed the re-classification survey of the Department of Public Works from the beginning and that he wanted to know why Mr. Santora received a letter notifying him that his position would be changed from Senior Engineering . Aide to Engineering Technician, and then it didn't happen. He said he had a copy of hte letter from Mr. Ciprioni of the Municipal Service Division stating that the Senior Engineering Aides could become Engineering Technicians without examination and that all five of the Senior Engineering Aides received a final notification that their positions would remain as Senior Engineering Aides. 217 , 0 -• Mr. Baker stated further that the problem began July first when the City hired a non-city employee to become an Engineering Technician. He also stated that the City, meaning the Commission, did not follow the recommendat- ion from Albany and now a test must be given to the two Senior Engineering Aides who have been promoted to Engineering Technician. Commissioner Bantuvanis asked: "A test is now required for Mr. Santora?" Mr. Baker replied: " A test is now required for all Senior Engineering Aides who have been promoted. " Mr. Baker went on to say that the whole problem could be eliminated if the original recommendation were followed. The problem is that there are still three classed as Senior Enginrreing Aides and that all of them have been with the City for many years. As a result of what has happened the union has filed grievances. Commissioner Cooper asked: "When were the grievances filed?" Mr. Baker replied: "The first was filed on August 21, 1987 when the whole deal with Bouchard came about, and the second grievance was filed on- October 21, 1987. He also said that he had some other things that he would like to add which is that he called Mr. Ciprioni and talked with him about the whole business and that Mr. Ciprioni said that he should a freedom of information request, and further that he was being stonewalled by the City Attorney on the request. ICommissioner Bantuvanis asked Mr. Pezdek what has happened: Mr. Pezdek told the Commission the history of the freedom of information request including what has happened today namely that City Attorney Nash had called and asked if .I had released any documents to Mr. Baker. I told Mr. Nash. that I had not because there was no time to do so yesterday. Mr. Nash said that I was not to release any documents and that he would be down from his office to see me. Mr. Nash came to the office shortly after 3:00P.M. and I explained to him that I had not released any documents.. Mr. Nash called Mr. Ciprioni who advised him to contact the Freedom of Information Office in Albany for advise. Mr. Nash then called the office and after the phone called stated that he would have to review each document from the re-class survey and then took the documents back to his office, and that this was the second time. Mr. Nash wrote two memos. Mr. Baker then said: " That's all I have to say. I wanted to bring the matter to your attention. " Commissioner Cooper asked Mr. Baker: "Were you notified about the meeting where the Senior Engineering Aides were left as aides?" Mr. Baker replies: "No. I wasn't. " �- Commissioner Cooper then asked: "If all five were promoted then there would be no examination?" Mr. Pezdek replied: "Yes. That's correct."
