SPECIAL MEETING
CITY OF ITHACA CIVIL SERVICE COMMISSION

Present: Chairman Martin, Commissioner Cooper, Executive Secretary Pezdek
Chairman Martin called the meeting to order at 12:15 P.M.
ELIGIBLE LISTS--DEPUTY FIRE CHIEF
Chairman Martin moved that the following eligible lists for Deputy Fire Chief,
No. 68-343 and No. 74-872, Prom. Seconded by Commissioner Cooper.
The Commission reviewed the lists then voted: Motion carried.
Chairman Martin adjourned the at 12:18 P.M.

PUBLIC HEARING
CITY OF ITHACA CIVIL SERVICE COMMISSION
July 13, 1987
Present: Chairman Martin, Commissioner Cooper, Executive Secretary Pezdek, Lilly
Wilson,Reporter, WHCU Radio.
The Public Hearing was called to order at 3:38 PM by Chairman Martin.
The Notice of Public Hearing was read by Commissioner Cooper.
"Please take note that pursuant to Section 20 to the Civil Service
Law, of the State of New York, the City of Ithaca Civil Service
Commission will hold a public hearing on July 13, 1987 at 3.35 P.M.
in the Second Floor Conference Room, City Hall , 108 East Green Street,
Ithaca, New *York, to amend its Rules as follows : To remove from
Appendix B to Rule IV, Non-Competitive Class the following positions
Dog Warden, Drafter, Garage Attendants, Nutrition Program Supervisor
and Senior Drafter because they are no longer used and to add to the
same Appendix the following Tree Trimmer, Working Supervisor-Bridges,
Working Supervisor-Sanitation.
In addition, the Commission also desires to amend Appendix C to Rule V
Labor Class by removing the position of Sanitation Men because this
position is no longer used and to add the following titles to this
Appendix Parking Lot Attendants and Senior Laborers.

changes are invited to attend and be heard,"
RESOLUTION TO OPEN THE PUBLIC HEARING - Chairman Martin.
Resolved that the public hearing be opened. Seconded by Commissioner Cooper.
Motion carried.
There were no persons present to address the Commission on the above matters .
RESOLUTION TO CLOSE THE PUBLIC HEARING - Commissioner Cooper.
Resolved that the public hearing be closed. Seconded by Chairman Martin.
Motion carried.
The public hearing was adjourned at 3:45 P.M. by Chairman Martin.

Chairman Martin called the meeting to order at 3:46 P.M.
NEW BUSINESS
APPROVAL OF MINUTES
Commissioner Cooper moved that the Minutes of the June meeting be approved.
Seconded by Chairman Martin. Motion carried.
APPENDIX B RULES CHANGES
Chairman Martin moved:
"WHEREAS, The City of Ithaca Civil Service Commission has
held a Public Hearing on July 13, 1987 pursuant to Section
20 of the New York State Civil Service Law to amend its
Rules for the Classified Civil Service of the City of Ithaca,
by deleting and adding various positions in Appendix B to
Rule IV Non-Competitive Class :
NOW, THEREFORE BE IT RESOLVED, That the following position
titles be deleted from appendix B to Rule IV Non-Competitive
Class: Dog Warden, Drafter, Garage Attendants , Nutrition
Program Supervisor and Senior Drafter because they are no
longer used and to add to Appendix B to Rule IV Non-Competitive
Class the following position titles : Tree Trimmer, Working

Commissioner Cooper moved:

Rules for the Classified Civil Service of the City of Ithaca,
by deleting and adding various positions in Appendix C to
Rule V Labor Class :
NOW, THEREFORE BE. IT RESOLVED, That the following position
title be deleted from Appendix C to Rule V Labor Class :
Sanitation Men because it is no longer used and to add to
Appendix C to Rule V Labor Class the following position
titles : Parking Lot Attendants and Senior Laborers. "
Seconded by Chairman Martin. The Commission voted. Motion carried.
PARK RANGER NEW POSITION DUTIES STATEMENT AND POSITION SPECIFICATION
Chairman Martin presented to the Commission a New Position Duties Statement
and a Position Specification for Park Ranger and Moved that they be approved
and that the position be placed in the Non-Competitive Class. Seconded by
Commissioner Cooper.
The Commissioners reviewed the documents then voted. Motion carried.
Mr. Pezdek said that a Rules change would be necessary for the position to
be placed into the Non-Competitive Class.and that a public hearing would
have to be held in conjunction with the next meeting.
SENIOR CLERK NEW POSITION DUTIES STATEMENT - IHA
Commissioner Cooper presented a New Position Duties Statement for the position
of Senior Clerk for the Ithaca Housing Authority to the Commission and moved
that it be approved and placed in the competitive class. Seconded by Chairman
Martin.
The Commissioners reviewed the Statement. Mr. Pezdek gave background on the
request to the Commission. Following this the Commission voted. Motion carried
TYPIST NEW POSITION DUTIES STATEMENTS FOR THREE POSITIONS AT THE SCHOOL DISTRICT
Chairman Martin presented to the Commission three New Position Duties Statements
for three Typist positions at the Ithaca City School District - one full-time 10mo. in
the English Department at the high school , one full-time , 10mo position in the
17ams's
•
Coordinator of Computers Office and one half-time position,lOmo. in the Social
Studies Department of the high school- and moved that they be approved and
placed in the Competitive Class. Seconded by Commissioner Cooper.
The Commissioners reviewed the accompanying letters and the Statements . These
positions are presently Teacher Aide positions and are improperly classified.
Following the review of the materials the Commission voted. Motion carried.
CORRECTION TO POLICE OFFICER ELIGIBLE LIST No. 62-930
Executive Secretary Pezdek stated to the Commission that he have been contacted
by Mr. Brian P. Bailey who had taken the Police Officer Examination last December.
Mr. Bailey was wondering why he had not received a report on his score. He had
received other reports because he had cross filed for this examination. Upon
checking the computer printout of the grades Mr. Pezdek said that he did not
find Mr. Bailey's grade. It had not been reported to us. He called the Examinations
Division and they upon checking found the records and Mr. Bailey's grade and realized
that it had not been reported to Ithaca.
The State has reported Mr. Bailey's grade as 84 which would place him tentatively
at number 63 on the Police Officer eligible list.
Commissioner Cooper moved to place Mr. Brian P. Bailey on the Police Officer
Eligible List No. 62-930 with a score of 84 at the tentative 63rd position
to correct the error made by the Examinations Division. Seconded by Chairman
r .. Martin. The Commission voted. Motion carried.
ELIGIBLE LISTS
Commissioner Cooper moved that the following eligible lists be established effective
July 13, 1987 and that they be in effect for one year unless exhausted sooner:
Youth Development Program Supervisor, No. 74-166, Prom. ; Youth Development Program
Leader, No. 67-077; Payroll Clerk, No. 1987-5; Fire Lieutenant No. 74-871, Prom. ;
Assistant Fire Chief, No. 74-870, Prom. ; Principal Clerk, No. 74-242, NCP, and
Typist, No. 1987-6. Seconded by Chairman Mattin.
The Commission reviewed the eligible lists and then voted. Motion carried.
OLD BUSINESS
CIVIL SERVICE/PERSONNEL CONSOLIDATION
Commissioner .Cooper reported to the Commission that she had attended a Common Council
meeting on July 8, 1987 and had addressed Council on the matter of the consolidation
of the Civil Service Office with the Personnel Department.
She requested that the statement which she gave before Common Council be made part
of the minutes of the Commission. Chairman Martin agreeded. Her statement is as
follows:
"The Ithaca Civil Service Commission possess statutory authority to administer
Civil Service Law in the City of Ithaca, the City School District and the
L--- Housing Authority. Included within the Commission's authority are the power to
adopt rules for proper Civil Service Administration in such areas as position
classification, jurisdictional classification, probationary tern upon appointment
or promotion, examinations and establishment and certification of eligible lists.
The major role of the Commission is to assure that the provisions of Civil
Service Law and Rules are properly administered. To a great extent the
Commission relies upon its Executive Secretary to administer the Civil
Service system within policies determined by the Civil Service Commission.
The Rules of the City of Ithaca Civil Service Commission, Rule number 2
authorizes the Commission to appoint a Secretary. This rule has the force
and effect of the law.
The proposal before the city's Common Council , in effect, usurps the legal
authority of the Commission to appoint its staff. Without questioning the
capabilities, the issue is whether or not the City recognizes the legal
authority of the Commission to appoint its own staff.
Mr. Baker was appointed by the Mayor to be Personnel Administrator for the
City. The jurisdiction of the Civil Service Commission extends beyond the
City to the Ithaca City School District and the Housing Authority. The
Commission did not have any vote whatsoever in Mr. Baker's selection. We
possess the legal right to appoint our staff.
Should the Common Council adopt the proposal the Commission is not obligated
to select the Personnel Administrator or anyone else to conduct our business.
We may, if the proposal is adopted, decide to operate without a Secretary and
not delegate any of our authority to anyone. We do not welcome such a
condition, particularly since the administration of Civil Service in the
City of Ithaca was rated very good by the New York State Department of Civil
Service. This is the second highest rating that can be received in the State.
We believe Civil Service to be well administered and if there are any
concerns we ask that they be brought before the Civil Service Commission.
We have been receptive to the needs of department heads, employees and the
public in the past and we expect to do so in the future. In May, the
Commission held a special meeting to give the public and City employees the
opportunity to comment on the proposal . Of those people who attended and
commented, nobody was in favor. The Commission then made the decision, on
record, to oppose the proposal .
In closing, I must once again emphasize the Commission's legal authority to
appoint it's staff which cannot and should not be usurped by action of City
Council . "
The Commissioners stated that they were willing to meet with members of Common
Council to discuss the matter.
ANNOUNCEMENTS

Clerk, No. 1987-5 and Library Clerk, No. 1987-6.
2. Copies the NYPE Reporter were distributed.
3. Copies of the Center for Women in Goverment reports on recruiting women and
minorities for the uniformed services were distributed.
