Commissioner Bantuvanis called the meeting to order at 11:06 am.
PUBLIC HEARING ON PROPOSED AMENDMENT TO RULE XIV (PROBATIONARY TERM) OF
THE CIVIL SERVICE RULES
Commissioner Bantuvanis made a motion to open the public hearing on the
proposal to amend Rule XIV (Probationary Term) by replacing all
existing probationary periods with the following: (1) for every
permanent appointment from an open-competitive list and every permanent
appointment to a position in the non-competitive, exempt or labor
class: a probationary term of not less than eight (8) nor more than
fifty-two (52) weeks; and (2) for every permanent appointment from a
promotion list: a probationary term of not less than eight (8) nor
more than (26) weeks. Seconded by Commissioner Desch. Motion carried
3-0.
No one appeared to speak on this proposed amendment.
Commissioner Bantuvanis made a motion to close the public hearing.
Seconded by Commissioner Desch. Motion carried 3-0.
PUBLIC HEARING ON PROPOSED AMENDMENT TO RULE XVIII (REINSTATEMENT) OF
THE CIVIL SERVICE RULES
Commissioner Bantuvanis made a motion to open the public hearing on the
proposal to amend Rule XVIII (Reinstatement) by extending the period of
time during which a former employee may be reinstated to his/her former
position or similar position without further examination, without
requiring the approval of the State Civil Service Commission, to four
(4) years. Seconded by Commissioner Desch. Motion carried 3-0.
No one appeared to speak on this proposed amendment.
Commissioner Bantuvanis made a motion to close the public hearing.

APPROVAL OF MINUTES
Commissioner Desch made a motion to approve the minutes of the June 8,
1998 meeting. Seconded by Commissioner Perko. Motion carried 3-0.
NEW BUSINESS
Resolution Adopting Amendment to Rule XIV (Probationary Term) of the
City of Ithaca Civil Service Rules
Commissioner Desch made the following motion:
WHEREAS, the City of Ithaca Civil Service Commission duly advertised
and held a public hearing on September 14, 1998 for the purpose of
amending Rule XIV (Probationary Term) of the City of Ithaca Civil
Service Rules by revising the probationary terms for positions under
the jurisdiction of the City of Ithaca Civil Service Commission and,
WHEREAS, the Ithaca Civil Service Commission took public comment on the
proposed amendment into consideration, and
WHEREAS, the Ithaca Civil Service Commission supports the proposed
amendment, NOW, THEREFORE, BE IT
RESOLVED, that Rule XIV (Probationary Term) of the City of Ithaca Civil
Service Rules be amended as follows:
a. Replace existing Section 1 (a) , 1 (b) and 1 (c) with the following:
1. Probationary Term
(a) Except as otherwise provided herein, every permanent
appointment from an open-competitive list and every permanent
appointment to a position in the non-competitive, exempt or labor
class shall be for a probationary term of not less than eight (8)
nor more than fifty-two (52) weeks.
(b) Every permanent appointment from a promotion list shall be
for a probationary term of not less than eight (8) nor more than
twenty-six (26) weeks. '
b. Renumber/re-identify current Section 1 (d) as Section 1 (c)
c. Delete current Section 2
d. Renumber current Sections 3 - 9 as Sections 2 - 8.
Motion seconded by Commissioner Perko. Motion carried 3-0.

Resolution for Amendment to Rule XVIII (Reinstatement) of the City of
Ithaca Civil Service Rules
Commissioner Perko made the following motion:
WHEREAS, the City of Ithaca Civil Service Commission duly advertised
and held a public hearing on September 14, 1998 for the purpose of
amending Rule XVIII (Reinstatement) of the City of Ithaca Civil Service
Rules and,
WHEREAS, the Ithaca Civil Service Commission supports the proposed
amendment and there was no public comment against the proposed
amendment, NOW, THEREFORE, BE IT
RESOLVED, that Section 1 of Rule XVIII (Reinstatement) of the City of
Ithaca Civil Service Rules be amended to read as follows:
"1. a) A permanent employee who has resigned from his/her position
may be reinstated without examination within four years from the date
of such resignation in the position from which he/she resigned, if then
vacant, or in any vacant position to which he/she was eligible for
transfer or reassignment. In computing the four-year period within
which a person may be reinstated after the resignation, the day the
resignation takes effect, any time spent in active service in the
military or naval forces of the United States or of the State of New
York, and any time served in another position in the civil service of
the same municipality shall not be considered. In an exceptional case,
the Commission may, subject to the approval of the State Civil Service
Commission, for good cause shown and where the interests of the
government would be served, waive the provisions of this rule to permit
the reinstatement of a person more than four years after resignation.
For the purpose of this rule, where an employee on leave of absence
resigns, such resignation shall be deemed effective as of the date of
the commencement of such leave.
b) An employee that is laid off from the civil service of a
municipality shall be eligible for reinstatement in the same manner as
an employee who had resigned."
Motion seconded by Commissioner Desch. Motion carried 3-0.
Decision Whether To Offer the Police Officer Examination
Audrey Cooper, Chair of the GIAC Board and former Civil Service
Commissioner, addressed the Commission regarding the proposal to offer
the Police Officer examination this December. Ms. Cooper spoke against
offering the examination, stating that offering a new examination will
work against the City' s workforce diversification efforts. Ms. Cooper
stated that five out of the eleven candidates on the current City list
are currently protected class members. Ms. Cooper stated that it has
taken time for these candidates to become reachable, and they deserve
the opportunity to be considered for appointment. Ms. Cooper reminded

the Commission that the current list is only one-and-a-half years old.
Ms. Cooper noted that a tremendous amount of time is needed to conduct
an extensive outreach recruitment program for the new exam, and that
sufficient time does not exist for such an effort. Ms. Cooper
summarized her comments by reiterating that she feels the request for a
new exam conflicts with the City' s Affirmative Action Plan. Ms. Cooper
asked the Commission for the reason for ordering a new exam when
qualified diverse candidates are on the existing list. She requested
that a new exam not be given, and that the existing list be retained.
Marcia Fort, Chair of the City' s Affirmative Action Advisory Committee,
also spoke against the request for a new Police Officer exam. Ms. Fort
noted that outreach recruitment efforts for a new exam would have to be
extensive, but the filing deadline for the examination is just six
weeks away. Ms. Fort noted that this is not a sufficient time period
for a successful outreach recruitment effort. Ms. Fort further noted
that the current list provides diversity. Ms. Fort expressed her
concern regarding the impact that holding a new exam would have on the
community. Ms. Fort noted that many protected class candidates
struggle to pass the test and wait extended periods of time to become
reachable. Now, a year and a half after the last exam, protected class
candidates are becoming reachable and the Commission has been asked to
throw the list out and replace it with a new list. Ms. Fort stated
that the Affirmative Action Advisory Committee requests that the
current list be retained and that the protected class candidates on the
current list be afforded the opportunity to be considered for
appointment.
Diann Sams, the mother of one of the candidates of color on the
existing Police Officer list, spoke against holding a new exam. Ms .
Sams explained to the Commission how historically difficult it has been
for candidates of color to pass the exam, then wait for long periods of
time to become reachable. Ms. Sams noted that one of the directives
given to the new Director of Human Resources is the development of a
test preparation program to assist diversity candidates in improving
their performances on civil service tests. Ms. Sams noted that there
is not sufficient time to develop and implement such a program for the
December examination.
Schelley Michell-Nunn, Director of Human Resources, said she discussed
the Mayor' s request for a new Police Officer exam with him. Ms.
Michell-Nunn stated that the Mayor raised the issue of the new City
residency rules and felt that the new rules, which do not apply to the
existing list but would apply to a new list, could help the City' s
diversification efforts. Ms. Michell-Nunn stated that she agreed with
Ms. Fort' s and Ms. Cooper' s statements regarding effective outreach
recruitment programs. Ms. Michell-Nunn stated that six weeks is not
enough time to conduct an effective outreach effort for the Police
Officer examination.
The Commission reviewed the current Police Officer list and asked
Deputy Director of Human Resources Saul questions regarding the list.
After further discussion, Commissioner Desch made a motion to retain
the existing Police Officer list and not offer a new Police Officer

examination in December 1998. Seconded by Commissioner Perko. Motion
carried 3-0.
New Position Duties Statements and Adoption of Job Descriptions: GIAC -
GIAC Director and Deputy GIAC Director
The Commission reviewed and discussed two New Position Duties
Statements from GIAC and the proposed job descriptions for GIAC
Director and Deputy GIAC Director.
Audrey Cooper, Chair of the GIAC Board, summarized the agency
reorganization. Ms. Cooper noted that the new job descriptions for
GIAC Director and Deputy GIAC Director reflect the job duties that the
current GIAC Coordinator and Assistant GIAC Coordinator have been
performing for years. Ms. Cooper asked that the Commission take this
into consideration and waive examinations for the current incumbents.
Deputy Human Resources Director Saul explained to Ms. Cooper that the
local Commission does not have the authority to waive exams, but that
the local Commission can advise the State Civil Service Department that
they support efforts to waive the examinations based on the previous
examination histories of the incumbents.
Commissioner Perko made a motion to classify one position as Greater
Ithaca Activities Center Director and adopt the job description as
proposed. Seconded by Commissioner Desch. Motion carried 3-0.
Commissioner Desch made a motion to classify the other position as
Deputy Greater Ithaca Activities Center Director and adopt the job
description as proposed. Seconded by Commissioner Perko. Motion
carried 3-0.
New Position Duties Statement: Ithaca City School District - Senior
Typist
The Commission reviewed and discussed a New Position Duties Statement
from the Ithaca City School District (IHS - Athletics Office) .
Commissioner Desch made a motion to classify the position as Senior
Typist. Seconded by Commissioner Perko. Motion carried 3-0.
New Position Duties Statement: Ithaca City School District - School
Lunch Cook
The Commission reviewed and discussed a New Position Duties Statement
from the Ithaca City School District (Alternative Community School) .
Commissioner Perko made a motion to classify the position as School
Lunch Cook. Seconded by Commissioner Desch. Motion carried 3-0.

New Position Duties Statement: DPW - Engineering Office - Junior
Engineer
The Commission reviewed and discussed a New Position Duties Statement
from the City Engineer' s Office. Commissioner Perko made a motion to
classify the position as Junior Engineer. Seconded by Commissioner
Desch. Motion carried 3-0.
New Position Duties Statement: Ithaca Fire Department - Fire
Lieutenant (temporary)
The Commission reviewed and discussed a New Position Duties Statement
from the Ithaca Fire Department for a temporary, six month position.
The position will allow for the replacement of a Fire Lieutenant who is
currently on disability leave and who will remain on disability leave
until his retirement in March 1999. Commissioner Perko made a motion
to classify and authorize a temporary Fire Lieutenant position in the
Ithaca Fire Department for the period September 14, 1998 through March
14, 1999. Seconded by Commissioner Desch. Motion carried 3-0.
Revision of Minimum Qualifications: Director of School Facilities and
Operations III
Deputy Director of Human Resources Saul explained to the Commission
that the recent recruitment effort for the Director of School
Facilities and Operations III vacancy and exam resulted in an unusually
high percentage of disqualified candidates. In response to this, Ms.
Saul and Ithaca City School District Director of Human Resources and
Labor Relations Michael Cuddy reviewed the minimum qualifications and
agreed that they were too restrictive for the skills needed to succeed
in the position. Ms. Saul and Mr. Cuddy are proposing that the
existing minimum qualifications be replaced with the following:
A. Graduation from a NYS registered or regionally accredited college or
university with a Bachelor' s Degree in Civil Engineering or a related
field with similar course curriculum, and two (2) years of full-time
paid experience, or its part-time paid equivalent, in the design,
construction, maintenance, repair, renovation or inspection of
buildings, related facilities or structural construction projects, at
least one (1) year of which must have been in a supervisory or
administrative capacity; or
B. Graduation from a NYS registered or regionally accredited college
with an Associate' s Degree in Construction Technology, Engineering
Science or a related field with similar course curriculum, and four
(4) years of full-time paid experience, or its part-time paid
equivalent, in the design, construction, maintenance, repair,
renovation or inspection of buildings, related facilities or
structural construction projects, at least two (2) years of which
must have been in a supervisory or administrative capacity; or

C. Graduation from high school or possession of a high school
equivalency diploma and six (6) years of full-time paid experience,
or its part-time paid equivalent, in the design, construction,
maintenance, repair, renovation or inspection of buildings, related
facilities or structural construction projects, at least two (2)
years of which must have been in a supervisory or administrative
capacity; or
D. An equivalent combination of training and experience as defined by
the limits of (A) , (B) , and (C) .
Commissioner Desch made a motion to replace the existing minimum
qualifications for Director of School Facilities and Operations III
with those proposed above. Seconded by Commissioner Perko. Motion
carried 3-0.
Cancellation of Director of School Facilities and Operations III
Examination
Deputy Director of Human Resources Saul advised the Commission that she
cancelled the Director of School Facilities and Operations III
examination originally scheduled for September 12, 1998 in order to
allow candidates to be evaluated under the new qualifications that were
adopted at today' s meeting. The Ithaca City School District will fill
the current vacancy provisionally in accordance with the newly adopted
qualifications, and the examination will be offered at a later date.
Ms. Saul stated that normally the Commission would have been asked to
vote to cancel the examination prior to the scheduled exam date, but
the Commission' s meeting schedule did not allow for this to happen in
this particular case. Commissioner Perko made a motion supporting Ms.
Saul' s decision to cancel the September 1998 Director of School
Facilities and Operations III examination. Seconded by Commissioner
Desch. Motion carried 3-0.

Commissioner Bantuvanis made a motion to go into executive session to
discuss civil service examination matters. Seconded by Commissioner
Desch. Motion carried 3-0. During executive session, the Commission
