MINUTES: Ithaca Community Police Board
PLACE: Second Floor Conference Room, City Hall
TIME & DATE: October 28, 1994 at 2:30 p.m.
PRESENT: Commissioners Sarachan, Seligmann, Teasley.
Chief McEwen, Deputy Chief Barnes, Mayor Nichols,
Alderperson Shenk, PBA President Gray.

ABSENT: Commissioners Edmonds, Nelson.
1 . Commissioner Seligmann called the meeting to order.
2. Approve Minutes of Meeting of September 23, 1994
by Commissioner Teasley, seconded by Commissioner Seligmann.
RESOLVED, That the minutes of the September 23, 1994 Community Police
Board Meeting be approved with the following addition under #7 Old
Business: Commissioner Edmonds reported that Captain Haus has been
convening the Training Committee meetings and he didn't really have
anything new to report on. Discussion followed about funding for training
programs. Commissioner Teasley noted that she is not a part of this
subcommittee.

3. Report from Common Council: Alderperson Shenk noted that a public
hearing on the proposed curfew ordinance was held and it doesn't look
like there will be a curfew anytime soon.
4. Comments from the Public: Mayor Nichols noted that the City of Ithaca
has received the federal grant to hire 3 new officers as part of the
Community Oriented Policing Service "COPS" program. He asked the
Community Police Board to think of ways implement this program of the
community and the police working together.
Mayor Nichols discussed the Community Police Advocates program,
noting that the Community Dispute Resolution Center has requested
$12,000 in funding for next year. Discussion followed about this program.
Chief McEwen felt that the concept of this program is good but still has a
few problems especially with the advocate's interactions with the
community. He suggested that each advocate do a ride along.

Mayor Nichols asked the Community Police Board for help in finding new
members.
5. Report of the Chief: Chief McEwen discussed the new Shopping Cart
Ordinance, noting that this was the brainchild of Carol Reeves and
Barbara Blanchard. He noted that Wegman's has provided signs for all
the stores. Discussion followed about policing this ordinance.
Chief McEwen noted that he has not heard anything from the Federal
Government yet regarding the community policing grant.
Chief McEwen invited the Community Police Board to attend the police
department's budget meeting with Common Council on November 22,
1994 at 7:30 pm in Common Council Chambers.
6. Comments from PBA President: PBA President Gray noted that the PBA will
be holding their election of officers on November 8th and that he is
running for President unopposed. He noted that the PBA has invited the
Community Police Board to attend the beginning of this meeting to get
acquainted with everyone.
PBA President Gray thanked the Community Police Board for giving the
officers notice when complaints are closed. He noted that the officers
appreciate knowing what is going on with the complaints.
PBA President Gray asked that the PBA receive a copy of the Community
Police Advocates' report.
7. Old Business: Mayor Nichols passed out a section of the City of Ithaca
Code (attached) regarding attendance at meetings. The Community
Police Board will incorporate this in their by-laws.
Discussion followed about liaison and committee appointments. The
Community Police Board will review a list of various committees
(attached) and discuss this further at their November meeting.
8. New Business: Commissioner Seligmann noted that Officer Christopher
DePerno was named Officer of the Year.
9. Adiournment: The next meeting of the Community Police Board is
scheduled to be held on November 18, 1994 at 2:30 p.m. in the second
floor conference room of City Hall. The Community Police Board
adjourned into Executive Session at 3:51 p.m.

§ 4-25 ADMINISTRATION OF GOVERNMENT § 4-26.1
B. Unless otherwise provided by the Common Council, any
agency, board or commission appointed by the Mayor
and receiving city funds on a budgeted basis shall
conform to the rules and policies of the city on personnel
administration, procurement and other administrative
procedures generally applicable to units of the city gov-
ernment.
§ 4-26. Changes and new appointments.
All changes and new appointments required by this chapter
shall be made as soon as practicable after its adoption.
§ 4-26.1. Creation of vacancies. [Added 10-27-1993 by L.L.
No. 7-1993]
A. When any member of a board, commission, committee,
council or agency, holding office by appointment of the
Mayor, fails to attend three (3) regularly scheduled
meetings of such board, commission, committee, council
or agency in any calendar year, unless such absence is
for good cause, the office may be deemed vacant for
purposes of nomination and appointment of a successor.
B. If such member fails to attend three (3) such regularly
scheduled meetings in a calendar year, the Chairperson
(or if the Chairperson fails to so attend such meetings,
any member of the board, commission, committee,
council or agency) shall so inform the member and the
Mayor. The Mayor shall write the member requesting
either an explanation of the reasons for the member's
nonattendance or a letter of resignation. If the member
does not respond to the Mayor within twenty(20) days of
the Mayor's letter to the member, with an adequate
explanation for his or her absences and assurances of
ability to attend future meetings on a regular basis, it
shall be deemed that the office is vacant for purposes of
nomination and appointment of his or her successor. If

such member responds to the Mayor with an adequate
explanation of the reasons for his or her absences and
assurances of ability to attend future meetings on a
regular basis, no further action will be taken.
§4-27. Effect on civil service status and rights.
The civil service status and rights of all city employees and
their beneficiaries shall not be affected by the adoption of this
chapter.
§4-28. Transitional provisions.
The Common Council, on recommendation of the Mayor,
shall determine and provide for any necessary matters involved
in the transition to this chapter.
§4-29. Continuity of authority.
Any proceedings or other business undertaken or commenced
prior to the effective date of this chapter shall be conducted and
completed by the city unit responsible therefor under the
Charter or this chapter.
§4-30. Judicial notice.
The courts shall take judicial notice of this chapter and of all
legislation adopted or promulgated pursuant to it.
§4-31. Construal of provisions.
This chapter shall be construed liberally to effect its objects
and purpose.
