The meeting was called to order by Jean McPheeters at 1:37 p.m.
APPROVAL OF MINUTES
Joan Russell made a motion to accept the minutes of the November 1989
meeting. Seconded by Tom West. Motion carried.
INTRODUCTION OF NEW MEMBERS
Jean McPheeters welcomed new members Chris Abbuhl, Brenda Kuhn and
George Hagood to the Affirmative Action Advisory Committee.
By way of introductions, Ms. McPheeters asked everyone to give a brief
synopsis of themselves (i.e. name, place of employment, and the length
of time on the Affirmative Action Advisory Committee) .
Jean McPheeters gave some background information on the Affirmative
Action Advisory Committee. The Committee has been successful in
implementing a Sexual Harassment Policy as well as updating the
Affirmative Action Plan. She stated the Committee's interest in the
statistics that are received when individuals apply for employment
with the City of Ithaca. The Committee is -also interested in training
employees and Department Heads in different areas of affirmative
action.
GUEST SPEAKER - MAYOR BEN NICHOLS
Ms. McPheeters introduced Mayor Nichols. Mr. Nichols welcomed the new
community members and hope all take an active part on the Committee.
Mayor Nichols wanted the Committee to know that he will do all he can
in furthering affirmative action in the City of Ithaca. He has
already had contact with some Department Heads and received their
ideas on the matter. He feels a meeting should be set up with
himself, Department Heads and a representative from the Affirmative
Action Advisory Committee. This meeting would discuss effective ways
of recruiting prospective minority candidates and the major part
Department Heads play in this recruitment.
Jean McPheeters asked Sam Cohen if he would represent the Affirmative
Action Advisory Committee in this meeting, especially since he has had
much experience in creating and implementing a minority recruitment
policy in the Youth Bureau. Sam Cohen answered in the affirmative.

The discussion led into the difficulties the City has in getting the
public to apply for competitive positions. George Hagood raised a
question as to the availability of training prior to the examinations.
Personnel Administrator Valerie Walker stated the City Personnel
Department is not allowed to participate in training individuals since
we are responsible for giving the exams. Cassandra Nelson mentioned
the informational sessions she has throughout the year explaining the
examination process. She has had classes taught to help applicants in
certain phases of the test. Mr. Hagood, then, inquired about ways to
make taking exams more easier. For example, a practice test could be
given before the actual civil service exam. Ms. Walker stated that
New York State Civil Service will not allow anyone to use the actual
booklets , even older ones, because they use the questions
periodically. Ms. Walker mentioned the CSEA Test Preparation booklets
that can be obtained in the Personnel Department for different parts
of some exams. These can be very helpful.
Ms. McPheeters stated the process can be very long when applying for a
competitive position. There is at least a month from the time one
applies for the exam to actually taking it. Then there is usually a
three to four month waiting period for the exam results. Another
month can be added on to that if a physical is required.
Ms. Walker spoke on provisional appointments. If an Eligible List is
not in existence, an individual can be hired provisionally. This is
with the understanding that he/she must successfully pass a civil
service exam and be in the top three or be reachable on the List. The
individual has to be on an Eligible List to be hired permanently; with
the exception of lower level positions in the Department of Public
Works that do not require an examination.
Jean McPheeters asked Personnal Administrator Walker about the exam
process for handicapped individuals . Ms . Walker stated that a
handicapped person can have an exam waived if he/she can perform the
duties of the position with reasonable accommodations. This is done
on an individual basis. There are no exemptions for any other
protected class.
Chris Abbuhl feels there should be a mechanism whereby Department
Heads should have to make public, the reason(s) they did not hire the
other candidates, especially if minorities are involved. This method
would not take away their right to hire the best qualified candidate
but would be just one way we could monitor the hiring process as it
relates to affirmative action. Tom West added that if Department
Heads knew they would have to account to someone after each hiring
decision, it may encourage them to take a better look at hiring a
member of a protected class if they were equally qualified.
Mr. Hagood talked briefly about the outreach approach. About how we
should have a central location where individuals could apply for jobs.
Ms . Walker stated that we have been out in the community with
informational stations . We received many applications for
examinations but many failed to appear to take the test. Valerie
Walker mentioned the Crossfiling of applications between the City and
the County.

After Mayor Nichols reiterated his position as far as affirmative
action is concerned, Co-Chair McPheeters thanked him for his comments.
SEXUAL HARASSMENT POLICY REPORT
Personnel Administrator Valerie Walker reported that after she and
Jean McPheeters attended several meetings of the Human Services
Committee, they were finally able to get the Sexual Harassment Policy
approved. It has also been approved by Common Council. The Sexual
Harassment Policy has been distributed to all employees and Department
Heads, with a cover letter listing a contact person for each area.
Ms. Walker is now in the process of setting up training sessions for
City employees. The training sessions will show how to handle sexual
harassment complaints. The Department of Labor will do a training
session at no cost to the City. She will keep the Committee abreast
of any developments as they occur.
TRAINING INITIATIVES FOR 1990
Jean McPheeters feels much training is needed in areas of sexual
harassment, human awareness and civil service examination process. It
could be costly but without them policies are no good.
Ms. McPheeters asked Sam Cohen if he would give the Committee an
update on how the Youth Bureau affirmative action recruitment program
is progressing.
Mr. Cohen mentioned the day long training session all employees were
encouraged to attend. Since the session, the Youth Bureau has set up
a Multicultural Action Committee (MAC) . This Committee is responsible
for recruitment within their department. They have created a
recruitment list consisting of names of local churches, agencies and
colleges. The methods they use in recruiting are written material,
telephoning and word of mouth. They have had good results.
Mr. Cohen said the only difficulty they have encountered, so far, is
with the civil service examination process. Because of that process,
they have lost at least one minority employee.
Ms. McPheeters will talk with Carolyn Peterson and get her ideas on
possible training sessions for the employees.
The next meeting is scheduled for Wednesday, February 14, 1990.

The meeting was called to order by Co-Chair Cohen at 1 : 40 p.m.
APPROVAL OF MINUTES
Co-Chair Cohen wanted to make a change in January's meeting minutes.
Under the section "Training Initiatives for 1990" , he wanted the part
"all employees were encouraged to attend" to read "all employees were
mandated to attend" .
Jean McPheeters made a motion to accept the January 1990 meeting
minutes with the above change incorporated. Seconded by Mr. Cohen.
Motion carried.
STATISTICAL REVIEW
Personnel Administrator Valerie Walker distributed the 1989
Statistical Reports. She went over each page with the Committee.
Ms . McPheeters noted that the percentage of minority employees
reflects the labor force percentage, that the distribution of minority
employees was spread through job levels and departments, and that 11%
of the new hires in 1989 were minorities. Ms. McPheeters stated that
she thought this reflected positively on the City. Ms. McPheeters
also noted that the percentage of female employees was low compared to
the work force statistics, and that most female employees were grouped
in the "Administrative Support" category.
Sam Cohen wanted to know what should be done now that we have the
Statistical Reports . Ms . Walker suggested taking them to the
Department Head staff meeting and the Human Services Committee
meeting. George Hagood said he would go with Ms. Walker to the Human
Services Committee meeting to present them with the Statistical
Reports.
Personnel Administrator Walker mentioned how difficult it is to
monitor application statistics because it is not mandatory for
individuals to fill out the Affirmative Action form. Chris Abbuhl
inquired about the keeping of handicap statistics. Ms. Walker stated
it was easier to monitor through departmental reporting. It is up to
applicants to state on the Affirmative Action form whether they are
handicapped. It was mentioned that some individuals who are

handicapped do not say so, because they do not want anyone to know.
Chris Abbuhl asked about the number of handicapped applicants that
have become employees. Ms. Walker stated that there is no way to
tell . Ms. Kuhn stated that it is difficult to obtain accurate
information as to the number of handicapped individuals available for
work.
George Hagood wanted to know if there were any ways to increase the
number of minorities hired. Brenda Kuhn said there is a negative
feeling among some handicapped individuals . They feel that an
employer would not hire them if they knew they were handicapped. Ms.
Kuhn feels there should be some way to educate the minority public.
Maybe this group can make it happen. Jean McPheeters asked Personnel
Administrator Valerie Walker if the City had a public relations
officer. Ms. Walker answered in the negative. A number of Committee
members expressed their thoughts about having more publicity when
advertising for positions . Valerie Walker mentioned the many
different agencies that already receive our announcements. Mr. Cohen
said the best way to contact people is by word of mouth. He said one
problem with this method is it takes a lot of time and energy. He
suggested having an office whose primary responsibility was
recruitment . Ms . McPheeters commended the Committee on their
suggestions but emphasized that we do not want to oversell because we
do not have enough jobs.
The Committee wants to look into training for Department Heads and
Senior Level Supervisors. They feel it may help them in giving more
support to newly hired employees. The first few weeks for newly hired
employees are crucial; it determines whether an employee will stay.
Jim Miller told the Committee about the high turnover rate among
minorities in the Department of Public Works. He feels the major
reasons for this high turnover are low. pay,- no fringe benefits (i.e.
health insurance, accumulated leave time, etc. ) and the job is dirty.
Also , other employers offer more in pay and benefits and the
individual works less. Mr. Hagood feels we should pinpoint the
reasons why minorities are leaving and work on these. Sam Cohen
suggested starting with the Department of Public Works.
Sam Cohen mentioned the Youth Employment Service that operates from
the Youth Bureau. This program hires out young people each summer
with City departments. They have training sessions for departments on
how to handle these kids. Jean McPheeters suggested having the Youth
Bureau help train some of the Department of Public Works staff and
other City departments. Mr. Cohen sees a problem with that. He does
not want anyone to think that the Youth Bureau's way is the right way.
He wants input from other departments. Ms. Walker said she will talk
with Larry Fabbroni to see if they offer any type of orientation to
new employees.

Ms. McPheeters updated the Committee on the letter she wrote to
Carolyn Peterson, Chairperson of the Charter and Ordinance Committee,
regarding possible changes to the City Charter that would allow the
Affirmative Action Advisory Committee to monitor departmental hiring.
To date she has not received a response from her.
INTERACTION BETWEEN CIVIL SERVICE LAW AND AFFIRMATIVE ACTION
Mr. Cohen expressed his concerns regarding problems faced with hiring
minorities and the civil service exam process. He says it defeats the
purpose of affirmative action when a minority applicant is hired and
does not score within the top 3 or is reachable on the Eligible List.
Mr. Cohen would like to see this rule changed or drastically expanded
to 10. He suggested recommending to Common Council the passing of a
resolution to be forwarded to the State regarding this change. Many
Committee members were in agreement with Mr. Cohen's suggestion.
Ms. Walker said there are some who want to increase the rule of three.
The State and the Union are traditionally against these changes
because they feel it will bring back nepotism. Jean McPheeters said
these suggestions may seem like a good idea now but may hurt us in the
long run. Mr. Cohen wants the change to affect only the local level .
He wants the system to be more flexible. Ms. McPheeters reminded the
Committee that changes to State Law affect all municipalities, not
just the City of Ithaca. Jean McPheeters suggested checking to see
what proposed legislation is already out there. Maybe we can tag on
to what is already in the works. Valerie Walker said she will check
with Marty Luster's office regarding what is already in the works.
Jean McPheeters mentioned the letter she received from Sean Killeen
regarding the posting process. Mr. Killeen was very concerned about
the Administrative Assistant to the Mayor position not being posted.
While the Committee is empathetic with Mr . Killeen's feelings ,
legally, there was not anything they could do since it is an exempt
position and hiring is at the sole discretion of the Mayor.

The meeting was called to order by Personnel Administrator Valerie
Walker at 1:37 p.m.
Due to the absence of a Co-Chair, Tom West volunteered to chair the
meeting.
APPROVAL OF MINUTES
This item had to be tabled because of a lack of quorum.
Ms. Walker asked to switch Item 2 (Outreach Recruitment for the
Firefighter Exam) with Item 3 (Sexual Harassment Policy - Union
Concerns) on the Agenda.
SEXUAL HARASSMENT POLICY - UNION CONCERNS
CSEA Administrative Unit President Bill Baker told the Committee that
the Sexual Harassment Policy was sent to their Regional Office Legal
Department in Albany. The attorneys in the Legal Department had an
objection to some of the language in the policy. A letter from the
Local CSEA to Personnel Administrator Walker read as follows:
"CSEA must advise you that we object to some portions of the
sexual harassment policy.
The policy states that the first thing a victim of sexual
harassment should do is confront ,the harasser directly and to
advise the harasser that his or her behaviour is not welcome. It
is believed that this may result in additional harassment by the
individual involved.
A victim of sexual harassment must be entitled to a procedure
which does not include a direct confrontation with the harasser.
Further, the policy states that a victim of harassment can
"appeal" a determination by the City, that the conduct complained
of does not constitute sexual harassment.

In fact, if an employee has been subjected to sexual harassment,
he/she is entitled to commence a lawsuit against the City for
failing to take prompt remedial action.
To describe a lawsuit against the City as an "appeal" will
confuse an employee regarding the fact that there are neutral
forms in which to litigate such issues and the fact that the City
can be found liable for failing to take prompt corrective action.
Therefore , we urge you to have the portion of the policy
suggesting "the victim confront the harasser" deleted, and that
the confusion concerning the word "appeal" be modified to spell
out that a victim has the right to file a complaint with the New
York State Division of Human Rights as well as commence a State
or Federal lawsuit. "
The Committee discussed the two objections made by the CSEA Legal
Department. The consensus of the Committee was that the language
". . .the employee confront the harasser directly. . . " could be made
clearer, to identify to employees that it is only an option to
confront the harasser directly, not a requirement.
Ms. Walker gave a little history on the Policy. She stated that this
step was not meant to be a part of the complaint procedure. It was
intended to be a suggestion for employees to use to deal with the
immediate situation. That by direct confrontation maybe the problem
could be settled without getting anyone else involved. Doug Vliet
agreed that the intent of the Policy was not to say that the
individual had to confront the harasser, but that it was just a
guideline. The individual can choose whether to confront the harasser
or go on to the next step. Mr. West mentioned a brochure on sexual
harassment from Cornell University that encourages, as a first step,
confrontation to get the harasser to stop. Mr. Abbuhl told of an
incident whereby after the harassed individual confronted the
harasser, the harassment did cease.
George Hagood asked Mr. Baker if there had been any problems to date
with these sections of the Policy. Mr. Baker answered in the
negative. Ms. Walker responded they just want to prevent problems as
much as possible in the future.
Mr. Baker said the Union is not suggesting that the Policy is good or
bad but that they just had objections to some parts of it. As a
whole, there is nothing wrong with the Policy. Their Legal Department
just wants to delete the section mentioned above and firm up the
section on the right of the individual to sue. In the Policy, it does
not mention this as an option without having to go through the
complaint process.

Mr. Abbuhl asked Ms. Walker how long the Committee had to respond to
the request. Ms. Walker stated it depends on what the Committee
wanted to do. If the Committee feels it is significant enough, they
may want to amend the policy. Should the Committee do so, to be
official, it has to be approved by Common Council. Brenda Kuhn asked
Mr. Baker what will satisfy CSEA. Mr. Baker was unsure. Maybe at
present it can just be put on record that CSEA expressed some
concerns.
Chris Abbuhl stated he would feel much better if they had more time to
look it over.
Mr. Abbuhl made a motion to have the record show that the concerns of
the CSEA Union were noted and discussed. Seconded by Brenda Kuhn.
Motion carried unanimously.
OUTREACH RECRUITMENT FOR FIREFIGHTER EXAM
Fire Chief Edward Olmstead and Marcia Lynch gave the Committee an
indepth view on the background of the Volunteer Firefighter Program as
well as the Bunker Program.
Chief Olmstead talked about the recruitment the City has done in the
past for Firefighter examinations. The City has put out materials
regarding the exams at Southside Community Center and GIAC. The Fire
Department has a staff member in charge of public education. This
individual goes into the schools to give the students a better idea of
what a firefighter does and how they, can become one. They also
participate in Career Day in the school system.

The meeting was called to order by Co-Chair Cohen at 1:37 p.m.
APPROVAL OF MINUTES (February and March)
Jean McPheeters made a motion to accept the minutes from the February
1990 and March 1990 meetings. Seconded by Brenda Kuhn. Motion
carried 6-0.
Mr. Cohen inquired about the concerns raised at the last meeting by
the CSEA Legal Department regarding the Sexual Harassment Policy. He
did not understand the action that was taken by the Committee.
Personnel Administrator Valerie Walker briefed Mr. Cohen on the issues
raised and the discussion that led to the Committee's decision. Ms.
Walker took this time to inform the Committee of the arrangements that
were being made for the Sexual Harassment Workshop scheduled for May
1990. As soon as the date is confirmed, notices will be sent out to
Department Heads and high level supervisors . Anyone on the
Affirmative Action Advisory Committee is welcome to attend.
DISCUSSION OF PENDING CIVIL SERVICE LEGISLATION
The Committee discussed the Pending Civil Service Legislation. The
bill of primary interest was A2890 which read as follows:
"Increase from 3 to 10 the number of persons eligible for
examinations for promotion or filling a vacancy in a competitive
class position."
Mr. Cohen has been interested in finding a bill that expands the Rule
of 3 . He, as well as the Committee, feels this change would be more
effective in the hiring of minority candidates. Ms. Walker stated
that this bill is proposed every year. The reason it has not passed
is because it does not have enough support. She further stated that
the local Civil Service Commission may not support this Bill.
The Committee talked about the many different scoring methods for
civil service exams but felt that expanding the Rule of 3 would
benefit the City of Ithaca the most.

Co-Chair Cohen made a motion that the Affirmative Action Advisory
Committee support Assembly Bill A2890 and recommend to Common Council
that they support this Bill as well. Seconded by Jean McPheeters.
Motion carried 5-1.
Mr. Cohen wanted to know the next step. Ms. Walker was unsure since
this is not a Budget and Administration or Charter and Ordinance
issue. She will send the Mayor, who chairs the Intergovernmental
Relations Committee, a copy of the resolution for them to consider.
Mr. Cohen suggested that their support be forwarded to the Local
Representatives and to those who sponsor the Bill.
Jean McPheeters suggested getting a copy of Assembly Bill A10071. Ms.
Walker said she will try to obtain a copy.
OTHER BUSINESS
RECRUITMENT
Personnel Associate Lisa Patz mentioned the Firefighter informational
sessions scheduled for Tuesday, April 16th at the Women's Community
Building (12:00 noon - 5:00 p.m. ) and GIAC (6:00 p.m. - 8:00 p.m. ) and
Wednesday, April 17th at the Women's Community Building (12:00 noon -
5:00 p.m. ) and Southside Community Center (6:00 p.m. - 8:00 p.m. )
This is to encourage more minorities to apply for the Firefighters
examination. There will be a Firefighter present to answer questions
that may arise.
Sam Cohen felt that there should be satellite offices placed around
the City for individuals to be able to obtain applications as well as
information regarding available positions. George Hagood suggested
having the announcements list locations where applicants could go to
for resource material on positions and/or examinations.

Brenda Kuhn asked to have the Disability Advisory Council added to the
agenda.
APPROVAL OF MINUTES
Chris Abbuhl made a motion to approve the minutes of the April 1990
meeting. Seconded by Brenda Kuhn. Motion carried 8-0.
DOMESTIC PARTNERSHIP ORDINANCE - DISCUSSION
Personnel Administrator Valerie Walker and Chris Abbuhl gave
background information on the proposal that was sent to the different
Committees of Common Council. The proposal will be on the next agenda
for the Budget and Administration Committee. They feel the Ordinance
will be referred to the Controller to look into the financial and
legal aspects of it.
Ms. Walker stated that technically employee benefits are a negotiable
item. That the City would need to talk with the Unions to see what
their stand is on this matter.
Sam Cohen wanted to know who would be affected by this Ordinance. Mr.
Abbuhl said it would apply only to employees of the City of Ithaca.
The City can create this status but has no influence on the private
sector or other governmental agencies.
Jean McPheeters said some insurance companies will not accept this
Ordinance even if the City passed it. Ms. Walker stated that Blue
Cross/Blue Shield's contract does not include benefits for domestic
partnerships. The best they can do now is to encourage the State
Insurance Department to sponsor state legislation to allow Blue
Cross/Blue Shield to enroll domestic partners.
Mr. Cohen wanted to know if the Committee had to take a position on
this Ordinance. Ms. Walker said only if they wanted to.
Chris Abbuhl will report back to the Committee on the outcome of the
Budget and Administration Committee meeting.

DISABILITY ADVISORY COUNCIL
Brenda Kuhn stated that the Mayor is in the process of forming a
Disability Advisory Council. This would be a Council which oversaw
and address concerns and issues of disabled individuals. What she
wants from the Affirmative Action Advisory Committee members are any
suggestions they may have on which City Boards or Committees would be
the best to work with as well as individuals who could act as
liaisons.
SEXUAL HARASSMENT AWARENESS WORKSHOP
Ms. Walker reported on the Sexual Harassment Awareness workshop held
Thursday, May 10, 1990. Mr. Frank Mesiah and Ms. Helen Cullinan
Szvoren, from New York State Department of Labor, did an excellent job
explaining what sexual harassment is and how to deal with it. Mr.
Cohen mentioned the handout received at the workshop and felt it would
be beneficial to distribute it to City employees. Ms. Walker said she
has received positive feedback on the workshop. She intends to
schedule future workshops on sexual harassment awareness to include
other employees.
STATUS OF ASSEMBLY BILL A2890
Sam Cohen asked Valerie Walker what the status of Assembly Bill A2890
(Increasing the Rule of 3) was. Ms. Walker said she talked with John
Johnson about this item being put on the agenda for the next Human
Services Committee meeting. She mentioned the discussion held by the
Civil Service Commission. One Commissioner supported the change, one
opposed it and the third opposed increasing it to 10 but would support
increasing it to 5. The Civil Service Commission did not take any
formal action. The CSEA union has spoken against this proposal. Ms.
Walker will get a letter out to Assemblyman Luster asking for his
support on this Bill.
FIREFIGHTER EXAMINATION RECRUITMENT
Ms. Walker reported that the Firefighter exam recruitment was a
success. We had a better turnout of applicants at GIAC and Southside
Community Center. She stated that the City intends to do a similar
recruitment for the Police Officer exam.
MEETING NEXT MONTH
The June meeting will be held in the Second Floor Conference Room of
City Hall on June 13, 1990 at 1:30 p.m.

Due to the fact that Chris Abbuhl was not present, this item will be

DISABILITY ADVISORY COUNCIL - DISCUSSION
Brenda Kuhn updated the Committee on the status of the Disability
Advisory Council . The Council has met with the Human Services
Committee and received advice as well as guidelines on possible
liaisons. They will meet again on June 19th. The final draft of the
proposal will be given to the Mayor to present at the July Common
Council meeting.
Ms. Kuhn wanted to know what the City 'procedure was in submitting
names to the Mayor for appointment to this Council . Sam Cohen and
Jean McPheeters agreed that if all the names are available, they
should be given to the Mayor at the same time as the proposal.
Brenda Kuhn asked members of the Committee what the procedure for
selection of liaisons is. Sam Cohen suggested making sure that the
Disability Advisory Council finds individuals they want to work with
from each organization. Ms. Kuhn said they have a good idea who they
want to work with. Mr. Cohen asked if she had anyone from the
Recreation Mainstreaming Program. Ms. Kuhn answered in the negative.
Mr. Cohen suggested she get in touch with Bill Ware.
Ms. Kuhn said most of the individuals on the Council have a disability
and live in the City of Ithaca. She named them all. Sam Cohen said
the Disability Advisory Council deserves more political support.
Brenda Kuhn wants to publicize this Council to the disabled community
to let them know that they have a place to come to make their
concerns/problems known. She also wants people, in general, to be
aware of the treatment of disabled citizens.

Ms. Kuhn said Mayor Nichols suggested she be the liaison for the
Affirmative Action Advisory Committee. She let it be known that if
anyone else wants to participate for the City of Ithaca, they should
give her a call. She needs any support she can get from the City.
Sam Cohen suggested getting a list of all the problems within the City
of Ithaca that affect the disabled community. Ms. Kuhn said Carol
Chock did a study a few years back on all the problems in the City
that had a direct bearing on disabled citizens. It was said that all
these areas had been corrected. Ms. Kuhn feels that best way to find
out is to have it checked out by disabled individuals.
OTHER BUSINESS
ASSEMBLY BILL 2890 (RULE OF 3)
Personnel Associate Lisa Patz mentioned that Personnel Administrator
Valerie Walker received a response from Assemblyman Luster regarding
Assembly Bill 2890. It read as follows:
"Thank you for your May 29th letter concerning Assembly Bill
2890. Please be assured that I will keep your comments in mind
when this bill reaches the floor for action.
Many thanks for having taken the time to write. "
AFFIRMATIVE ACTION
Jean McPheeters read a letter she received from Carolyn Peterson on
how the City of Ithaca is doing in connection with affirmative action.
The letter read as follows:
"Section 2.27 of our City Code states the following: "The
following officers of the City shall be appointed by the Mayor in
the manner provided herein: Superintendent of Public Works; Fire
Chief ; Youth Bureau Director: Building Commissioner; City
Controller; City Clerk; Director of Planning and Development;
City Chamberlain; Personnel Administrator; and Purchasing Agent. "
The procedure of such ::siring is then explained. Section 2.28
follows, stating: "Unless otherwise specified in this Charter or
the Ithaca City Municipal Code, and subject to the authorization
for such position (including terms of compensation) by Common
Council , all other City officers and employees shall be
appointed, disciplined and removed as necessary by the head of
the department in which the position is authorized. "
Additionally, the Mayor shall appoint all, members of the Police
Department.

You ask what the sentiment of the Charter and Ordinance Committee
would be about changing Section 2.28, suggesting a higher level
of review. Generally this would be Council or the Mayor. This
seems extremely cumbersome to me because adequate review would
necessarily include knowledge of the entire workforce of a
department, who applied for the job, what their credentials were,
and interview impressions. I would guess that Council or the
Mayor could not do this in a fair manner -- review would be
cursory at best and possibly not adequate at all. Perhaps your
committee had a different plan.
Perhaps the Mayor and AAA Council could be involved. We now have
statistical records ongoing so we can review a department's track
record. Frequent reminders to a department head about
affirmative action and hiring could take place -- by memos,
meetings, or other means. Do departments know that records are
kept? Emphasis on this (we're aware of your hiring record! )
(We're watching! ) could be stressed.
Please discuss these points and get back to me. "
Mr. Cohen suggested that Ms. Walker and/or the Mayor could mention
this issue at the Department Head's staff meeting. He felt when it
was discussed previously at the staff meeting, there was positive
feedback as opposed to years ago. Mr. Cohen felt the review of
statistics at Department Head meetings could be done on a regular
basis. Ms. Patz mentioned looking at areas where we know there are
problems.
Ms. McPheeters said she will respond to Carolyn Peterson suggesting
having this done at Department Head meetings. Sam Cohen said Ms.
Walker did mention the affirmative action statistical report at the
staff meeting.
Jean McPheeters said all department heads should be mindful of our
goals. Ms. Kuhn wanted to know who the Department Heads would have to
account to. Ms. McPheeters said it could be a part of their annual
evaluation. The Committee suggested instead of it being a part of
their annual evaluation it could be a separate one. Brenda Kuhn asked
if we could request the Mayor to do this. The Committee mentioned
that department heads can do a self evaluation aside from being
evaluated by the Mayor.
What the Affirmative Action Advisory Committee would like to do is
avoid situations where a minority is at the top of an Eligible List
and is overlooked or bypassed. They do not want to see discrimination
continue to go on.
Mr. Cohen asked Ms. Patz to talk with Personnel Administrator Walker
to see what can be done to about knowing the sex and nationality of
those on the Eligible List.

Sam Cohen reported that Mayor Nichols has sent a memo to all
Department Heads advising them that he will be implementing the
Department Head Performance Evaluation System this fall . Mayor
Nichols indicated that he will be including a review of each
Department Head's commitment to Affirmative Action goals in the
evaluations.
Personnel Administrator Saul explained the Department Head Performance
Evaluation System to the Committee.
The Committee expressed support for the inclusion of an Affirmative
Action evaluation in the Performance Evaluation System. Sam Cohen
asked the Committee to discuss the Affirmative Action Advisory
Committee's role in the evaluation process.

REVIEW OF EMPLOYMENT STATISTICS
Personnel Administrator Saul mentioned that notices were sent out to
Department Heads asking them to attend this meeting. She took the
time to thank those that were present.
Co-chair Cohen suggested going through each department's statistics to
see how they did in regards to affirmative action. Ms. Saul said we
should start with the Police Department's statistics. She invited
Deputy Chief Ecklund to join the Committee and to feel free to make
any comments.
Personnel Administrator Saul explained each EEO-4 job category and the
positions in the Police Department that were assigned to them. Mr.
Cohen said the statistics are self explanatory. Ms. Saul said the
problem with civil service testing is that it is difficult to get a
Police Officer list with minorities and women who are reachable. She
mentioned two ways the City is trying to reach a better pool of
minority and female candidates for the Police Officer exam. One is by
limiting applicants to those who reside within Tompkins County and the
other is by setting up recruitment tables at GIAC and Southside
Community Center. Personnel Associate Patz said she will be working
closely with Chief McEwen and Deputy Chief Ecklund with this
recruitment. Ms. Saul says both the Deputy and the Chief are
committed to affirmative action.
The Committee discussed the qualifications and the process applicants
have to go through to become a Police Officer. Mr. Cohen asked about
the turnover rate for this position. Deputy Chief Ecklund mentioned
that many retire or are promoted but very seldom do any resign. He
went on to say that the Police Department is considering hiring its
third female. Sam Cohen asked if he knew how anyone in the Police
Department feels about affirmative action. Mr. Ecklund said those in

the supervisory rank support it. He does not know how the other ranks
feel. Ms. Kuhn asked if he knew how the women Police Officers feel
about being the only two females. Mr. Ecklund said he does not think
it bothers them. They know what to expect and are treated equally.
Mimi Granger thought it would be good if they-had a woman detective.
John agreed. He went on to say that detective assignments are based
on a combination of experience , time in the department and the
ability. But first of all, there must be an opening.
Ms . Saul asked Deputy Chief Ecklund if there was anything the
Affirmative Action Advisory Committee could do to encourage or assist
them with affirmative action. Mr. Ecklund said any suggestions the
Committee had to offer will be greatly appreciated. The. Committee
'thanked Deputy Chief Ecklund for coming to the meeting.
The Committee proceeded to review the other Department's statistics.
Personnel Administrator Saul commended Youth Bureau Director Sam Cohen
in doing an excellent job in affirmative action. She wanted it noted
that it is the Youth Bureau that makes the City statistics look good.
The Committee discussed possible ways of being able to talk with
department heads about their statistics. It was the consensus of the
Committee to have Personnel Administrator Saul write a letter to the
department heads regarding any major accomplishments , outreach
recruitment efforts or obstacles they have experienced.
REVIEW OF AFFIRMATIVE ACTION GOALS
The Committee will discuss this item at next month's meeting.
DISCUSSION REGARDING SEXUAL DISCRIMINATION, AND RACIAL DISCRIMINATION
QUESTIONNAIRES
Personnel Administrator Saul said she spoke with Mayor Nichols about.
sexual and racial discrimination within the City of Ithaca. She is in
the process of designing an open end questionnaire that addresses
these issues. Once completed, it will go out to all females and
minorities. Brenda Kuhn asked if this questionnaire was going out to
handicapped employees as well. Ms. Saul said that it could. Ms. Saul
will update the Committee at the next meeting.

ISSUES CONCERNING DISABLED INDIVIDUALS IN CITY GOVERNMENT
Brenda Kuhn asked to have this item put on the agenda. She feels that
not only are we concerned with sexual and racial discrimination but we
are also concerned with handicapped discrimination. Ms . Saul
mentioned how difficult it is to obtain statistics on this type of
discrimination. She asked the Committee if they have any suggestions,
to please let her know.
Ms. Kuhn mentioned the American Disability Act and the effect it will
have on City government. The purpose of this law is to get employers
to make their buildings more accessible to disabled people and to
change physical features in, the� workplace to meet the needs of
handicapped employees. The City should take the lead in reviewing its
compliance with the American Disability Act and taking measures to
insure compliance.
The Committee expressed their concerns about the number of employees
who may already work for the City that have some kind of disability
but are uncomfortable in making their needs known. With the City
taking the lead in implementing these changes in the workplace as well
as training their employees, the Committee hopes this will alleviate
this problem.
Ms. McPheeters suggested writing a letter to the Mayor asking him to
put someone in charge of implementing any changes that are needed.
Ms . Saul mentioned that the Planning and Development Director
currently serves as the Section 504 Coordinator and the Superintendent
of Public Works is involved in all physical changes to City facilities
that improve accessibility. Ms. Kuhn said the Disability Advisory
Council is already looking into this and will help out wherever
possible.

Ms. McPheeters made a motion that a letter be written to Mayor Nichols
regarding the American Disability Act and the need to have someone in
City government in charge of implementing any changes required to meet
the guidelines of this law. This letter will state that the
Disability Advisory .Council as well as the Affirmative Action Advisory
Committee will assist the person recommended by the Mayor. Seconded
by Brenda Kuhn. Motion carried.
REVIEW OF EMPLOYMENT STATISTICS
The Committee reviewed the statistics from the remaining Departments
(Building, Planning & Development, Finance, and Department of Public
Works) . Ms. Saul said memos did go out to these departments asking
them for their comments regarding their accomplishments in affirmative
action, current outreach recruitment efforts, obstacles they face and
if they needed any assistance from the Committee. Responses from the
Building Commissioner, Planning & Development Director and the
Superintendent of Public Works were distributed in each members
packet.
Building Department: There is not much opportunity for growth in this .
department because of the low turnover rate. Ms. McPheeters noted
that even though statistics do not reflect it, the first woman Housing
Inspector has been hired.
Department of Public Works: The Committee feels this department could
make a conscious effort to recruit more minorities since there is a
tremendous turnover. It was suggested that the Department could get
some assistance from the Youth Bureau and the Personnel Department.
Ms. Saul said that Youth Bureau Director Sam Cohen was to meet with
Building Systems Supervisor Jim Miller regarding this matter. She
will check with Mr. Cohen on the outcome of this meeting. Ms.
McPheeters said that DPW could improve in their recruitment for
minorities if they follow the example of the Youth Bureau and
implement some type of recruitment program. Alice Green said she
would be willing to assist DPW wherever possible. Tom West asked why
the City only runs recruitment programs for exams and not for all
positions. Ms. Saul said the Personnel Department would be more than
willing to assist any department in recruiting but the first step must
be taken by the Department itself. She stated it has to be a joint
effort to be successful.
Finance Department: The Committee feels this department could improve
in their outreach for minorities. It is not a small department and
there is a high turnover rate. Ms. McPheeters feels this department
could consult with the Personnel Department for suggestions. The
Committee would like to see minorities hired in this department.

Planning & Development: The statistics do not show it, but the
position of Environmental and Landscape Planner was offered to an
Asian female. She has accepted the position. The Committee feels
this department has historically shown a commitment to hiring
minorities and has done a good job in their outreach recruitment for
openings in their department.
Ms. McPheeters asked Personnel Administrator Saul if she would draft a
letter to Mayor Nichols regarding their findings. Ms. Saul. answered
in the affirmative.

The meeting was called to order by Personnel Administrator Valerie
Saul at 1:40 p.m.
APPROVAL OF MINUTES
Sam Cohen made a motion to accept the minutes from the October 1990
meeting. Seconded by Jim Miller. Motion carried.
BIDDING PROCEDURE
Personnel Administrator Saul introduced City Controller Dominick
Cafferillo . The Committee invited him to speak on the bidding
procedure for City of Ithaca contracts.
Mr. Cafferillo stated that the City does not have its own Bidding
Procedure Program for City contracts. The City currently follows the
guidlines used by the State. Under this program ten (10%) percent of
the contract goes to Minority Business Enterprises (MBE) and two (2%)
percent to Women Business Enterprises (WBE) .
Mr. Cafferillo stated that it depends on the cost of the project on
whether it would be feasible for the City to enforce compliance with
the State's program. Otherwise, the contractor has to comply or
submit a waiver to the City detailing the reason(s) it can't meet the
guidelines. The waiver is sent to the State for a ruling. The
contractor has to comply with whatever the State rules.
Mr. Cafferillo briefly mentioned how difficult it is to find qualified
WBEs and/or MBEs in the area we need. Ms. Saul asked if the City
keeps a list of MBEs or WBEs when bids are received from them. Mr.
Cafferillo said there is no formal list.
Mr. Cafferillo said the City is looking into implementing its own
Bidding Procedure Program. He has already received information from
the State on their program. The State has also given him the name of
one municipality that is operating this program. He has yet to
contact them.

Ms . Saul thanked Dominick for discussing with us the bidding
procedures for City contracts.
REGULAR MEETING
Personnel Administrator Saul asked the Committee how often they would
like to meet. - It was the consensus of those present to have the
meeting every other month.
Jim Miller made a motion to have the Affirmative Action Advisory
Committee meeting every other month. Seconded by Sam Cohen. Motion
carried.
With no further business, the meeting was adjourned at 2:23 p.m.
