8.4A Approval of the Request to Refurbish the Historic Wharton Studio Building
located in Stewart Park — Resolution
I have included Jeanne Leccese's resolution for the Ithaca Motion Picture Project. While I
think the resolution is fine, it implies that a lot of work has been shifted to Common Council to
produce a development agreement that sets out the terms of a deal between the city and some
legal entity that want to take control of the former Wharton building with the intention of turning
it into a community asset (museum and tourist destination) in the middle of a city park. Only
Council can enter into an agreement that gives a private entity property rights or interest in city
land so this would have to go to Common Council anyway. Only the New York Legislature can
de -park land so that the city can enter into a private arrangement for land that exists within a
park.
Both of these bodies will need a detailed plan and a legal agreement to consider before they
would agree to any legislation authorizing a deal. It would start with a detailed description of
what is planned, a cost estimate for the work proposed, details on who is responsible for what
costs, the financial arrangements for the exchange of property interests, provisions related to
income from operations if any, a time line for when things will be planned, built, or otherwise
accomplished with termination clauses for failure to follow the schedule, a duration period for
the arrangement, escape clauses for the parties, responsibility for the cost of relocating DPW
operations out of the building, and many other things I am not thinking of at the moment.
If I have misunderstood and this is a resolution of support for the idea while they seek grants
and fund raising to further develop the concept, not to implement the concept, I apologize.
8.5A Recommendation for Changes to water ang sewer rteaulanvn anur wcai
Ordinance for a More Restrictive Standard — Resolution
I have included the resolution requested by the City's plumbing inspector who wants changes
to the City's plumbing requirements. I think we should pass the resolution requesting Common
Council to make the requested changes, but I think that we need a better solution for
maintaining and operating those systems which the Board of Public Works is responsible for
under the City's Charter. In the past we happily passed our own "legislation" to modify parking
regulations, speed zones, or water and sewer requirements. That has been determined to be
inappropriate and all legislation must be passed by the elected legislative body of the city. I
think we need to construct a system whereby the legislative body passes legislation calling on
the Board to develop "rules and regulations" for the systems the Board is responsible for
overseeing. Then we will set out to adopt rules and regulations rather than passing legislation.

I will need to work with the Mayor, City Attorney and City Clerk to develop a program that
everyone is comfortable with and keeps the eventual work for everyone to a minimum. In my
concept of the City's Charter, they developed a Board of Public Works to have a body which
could become educated in and then deal directly with the operational issues that arise in many
of the city's operating systems without taking the time of Common Council. If everyone agrees
then converting the old DPW "legislation" into new "rules and regulations" will be the best way
to go.
9.1 Appeal of Water Bill for 119 Heights Court
I have reviewed this claim. Staff followed a reasonable and responsible path to try and help the
property owner. The problem was inside the property and when fixed, the problem was
resolved. The property owner is responsible for the water once it is delivered to her property.
The claim should be denied.
9.2 Appeal of License Fee for Use of City -Owned Property, the Old Agway Location
on Taunhannock Blvd., Tax Map 41-1-
You may read Mr. Flash's appeal of the invoice for use of city land. He feels that his prior
arrangement, which has now lapsed, was fair and should be continued. He does not want to
be folded into the city wide program developed for fair market return after a New York State
audit. I see no reason to continue the very favorable terms under a lease that was never
intended to extend for years. You would have to find this use as an exception to the city -wide
policy for license in order to grant the appeal.
9.3 Application for Mobile Vending in Downtown Ithaca
Attached is an application to conduct mobile vending, submitted on a form used for cart based
mobile vending on the Commons. As Mr. Vico said at the Board's meeting June 4, 2012, 1
turned down his request to conduct truck based mobile vending on city streets in 2011
because the city does not have a program for such vending. He is aware that nothing has
changed to date, except that the board has expressed interest in the city having such a
program. This appears to be his attempt to force the issue. He made private arrangements
last year, and again this year. I take his actions on June 4th and his request to be put on the
BPW agenda as an appeal for the board to overturn my decision not to issue a permit.
9.4 Appeal of the Determination of the Transportation Engineer Regarding Hart
Hotels' Request for Off- Street Drop on for the Proposed Conference Center
The owner of the Holiday Inn would like to appeal the decisions of the Transportation Engineer
concerning street access (curb cuts) for his new conference center and hotel. We have had
numerous discussions, with one more attempt this week. Tim, at my direction, is setting out to
protect the safety of the street operation as well as the capacity of this public asset. The
Holiday Inn already has an unusual number of curb cuts. Curb cuts reduce curb length (on
street metered parking), represent a conflict zone (vehicles entering and leaving) for traffic Flow
including pedestrians and bicycles, and reduces street capacity and safety. This is accepted
and expected, but becomes unreasonable if driveways are too numerous, too wide, or are
poorly located. Mr. Hart will appear to represent his case. Tim is still in discussions and can
update you then.

9.5 Possible Discontinuation of Yard Waste Fee
I was not aware that there was a committee discussing eliminating the yard waste fee, but here
it is. The only thoughts I have are: that yard waste does cost money to pick up so recovering
a fee from the users seems reasonable, and yard waste is becoming more valuable to the
various composting operations that have sprung up as part of our local efforts to reduce costs,
reuse material and develop sustainable practices. It may be possible to, at some point, shift
the cost of pick up from the generators of the waste material to the users of the waste material
who need it as part of the compost recipe. I would not recommend doing that until the market
has developed. We have budget obligations to produce revenue for this operation.
9.6 Parkin Systems Manaaer
This is a place holder but I don't believe we will get to this item on the agenda. The position
will be on the City Administration Committee agenda this month and I want the Board to be up
to date on the proposal to put a dedicated manager in charge of this multi- million dollar service
the City provides, in an effort to reduce the loss from city-wide parking operations, and
eventually to produce a positive revenue stream from providing this service.

8.4A Approval of the Request to Refurbish the Historic Wharton Studio Building
located in Stewart Park — Resolution
WHEREAS, there is a renewed interest by both the public and private sectors to revitalize
Stewart Park, as evidenced by the Cayuga Waterfront Trail, the Stewart Park Rehabilitation
Action Plan, the new Friends of Stewart Park organization, and other volunteer efforts to
refurbish facilities, and
WHEREAS, Stewart Park is home to the historic Wharton Studio Building which served as a
vibrant motion picture production studio during Ithaca's heyday as a center of East Coast silent
film production during the early 1900's, and
WHEREAS, the former studio is one of only a handful of silent movie production studios still
standing in the U.S., and
WHEREAS, the Ithaca Motion Picture Project has proposed to rehabilitate the historic Wharton
Studio Building in Stewart Park and transform it into a regional motion picture museum with
educational and cultural programs related to film and multi- media, featuring a permanent
exhibit focusing on Ithaca's silent film history, and
WHEREAS, the City of Ithaca is desirous of and committed to building on already existing
efforts to improve facilities in the park and to ensure the park is a more enjoyable place for the
public to enjoy, now, therefore be it
RESOLVED, That the City of Ithaca's Board of Public Works endorses the idea of refurbishing
the historic Wharton Studio Building, and be it further
RESOLVED, That the Board of Public Works encourages Common Council to support Ithaca
Motion Picture Project's plans for the Wharton Studio Building to create a new cultural,
educational and touristic destination in Stewart Park.

8.5A Recommendation for Chances to Water and Sewer Reaulation and Local
Ordinance for a More Restrictive Standard — Resolution
Resolution 1
Recommendation for changes to the Water and Sewer Regulations pertaining to the
updating of plumbing licensing terms and clarifications, and the inclusion of the
requirement for house (building traps) when connecting to the City sewer system.
WHEREAS, the Examining Board of Plumbers wants to more accurately state the terms of
licensing for the installation of water or sewer services within the City, and
WHEREAS, the Examining Board of Plumbers for the City of Ithaca, under the authority of
Article 4 of NYS General City Law, has created a new license category of Water and Sewer
Installer to replace the outdated "sewer layer' license, and
WHEREAS, house (building) traps have been required by the City since the first Plumbing
Code written in 1929, and the current version of the New York State Plumbing Code has
prohibited the installation of house traps unless required by the local authority, and
WHEREAS, the Water and Sewer Division wishes to continue the use and installation of house
traps on sewer services within the City by specific inclusion into the Water and Sewer
Regulations, now therefore be it
RESOLVED, That the Board of Public Works recommends that Common Council amend
Chapter 348 -29 Sanitary Sewer Services, Section E as follows:
All installations of service drains or sewers between the curb and the building shall be made by
a Plumber- Plumbing Contractor or sewer layer Water and Sewer Installer licensed by the
Examining Board of Plumbers or any homeowner working on his/her own single - family
residence.
and, be it further
RESOLVED, That the Board of Public Works recommends that Common Council amend
Chapter 348 -29 Sanitary Sewer Services, by the inclusion of a new Section J as follows:

Local Ordnance for a More Restrictive Standard to NYS Plumbing Code pertaining to the
plumbing ventilation requirements of building connected to the City sanitary collection
system
WHEREAS, changes to the 2010 NYS Plumbing code allowed the use of alternate venting
devices called Air Admittance Valves on plumbing stacks and the elimination
of relief venting requirements for other Air Admittance Valves in buildings 4 stories or less, and
WHEREAS, the Chief Inspector of Plumbing and the Examining Board of Plumbers for the City
of Ithaca has reviewed the use and installation of such devices, and
WHEREAS, the result of unventilated sewer gases in the plumbing system that occur as the
result of the use of air admittance valves is a health and safety concern which the City of
Ithaca wished to address and remedy, and
WHEREAS, local conditions exist that make house traps, which are required to be installed in
all City building sewer services, function improperly by causing sewer gases to be forced out of
the Fresh Air Inlet of the house trap when air admittance valves are used without proper air
ventilation causing health and sanitary concerns, therefore be it
RESOLVED, That the Board of Public Works recommends that Common Council make a local
ordinance requiring all plumbing systems connected to the public sewer system to have
ventilation that can remove sewer gases from buildings and allow for the admission and
emission of air throughout the piping system within buildings, and, be it further
RESOLVED, That the Board of Public Works recommends that Common Council amend the
City of Ithaca Building Code, Article IV Plumbing, Section 146 -22, Definitions by adding the
plumbing definition of a vent system as follows:
Vent System. A pipe or Pipes installed to provide a flow of air to and from a drainage system
in order to provide a circulation of air within such system to protect trap seals from siphonage
and backoressure and to remove the accumulation of sewer gases within the building.

RESOLVED, That the Board of Public Works recommends that Common Council amend
the Water and Sewer Regulation, Chapter 348 -29 by adding three new Sections K, L, and M
pertaining to the installation of vents in the plumbing systems connected to the City sewer
system as follows:

Petition to Ithaca City Water Board
Re: Excess water services provided to 119 Heights Court
BACKGROUND
1. I, Jaclyn Klein, not the owner of 119 Heights Court, also known as Ithaca City, SWIS: 500700 TaxID: 8: 5-3.
2. I purchased the house in 2004 and, due to unemployment,) decided to rent the house to a Cornell professor,
his wife and two small children since December of 2010.
3. I notified the Town of Ithaca that I will be residing with my parents and correspondences should be sent to
their home: 180 Haines Road, Bedford HBIs, NY.
FACTS
4. On April 24, 2012, I was verbally notified by an employee of the water department that my house has been
using a lot of water and that my next bill will be $5,210.
5. I requested a copy of my March 2012 bill and learned that I had an absurdly high use of 117 units which
equals 87,750 gallons (each unit is 750 gallons). The charge was $1,11852.
5. I have not received my June bill yet but have been told that injust the first 34 days my bill is at $5,210. This
means that my next consumption will be over 545 units which equals over 408,750 gallons.
6. My total excess liability is likely to be over $6,000.
7. 1 had no knowledge that the house was using excess water. There were no signs of abnormal water use.
CLAIMS
1. FAILURE TO CONTACT OWNER
8. Water department notified me, after I inquired about the bill, that a letter was sent to 119 Heights Ct in
March. The town did not send a letter to my updated mailing address which I left with the town and my renters
did not inform me of a letter.
9. Furthermore, the water company has my cell phone number, but waited until April 24th to call me.
10. 1 should have been notified as soon as they realized that the bill reached some unreasonable number.
Instead, they called me when it reached over $5,000.
11. This failure caused massive environmental waste and financial hardship to me as the owner.
2. FAILURE TO INVESTIGATE HIGH WATER USE
12. Water department did not investigate why 119 Heights Ct was using so much water. They allowed the high
use to continue for over 124 days.
13. This failure caused massive environmental waste and financial hardship to me as the owner.
3. FAILURE TO TURN OFF THE WATER
14. Water department failed to turn off the water after realizing that the house was consuming excess amounts
of water for a prolonged period of time.
15. This failure caused massive environmental waste and financial hardship to me as the owner.
EVEN IF THE NOTIFICATION PROCEDURE ESTABLISHED
BY THE WATER BOARD IS RATIONAL, A CHARGE OF THIS AMOUNT IS UNCONSCIONABLE
16. I received zero enrichment from the 496,500 gallons that the water meter claims I used in 124 days.
18. This water bill is more than 2% of the value of the house.
19. This bill is nearly my entire year's worth of taxes.
20. I simply cannot afford to be billed for the equivalent of over 150 homes worth of water.

The tech from the water department re-read your meter today. It appears that consumption is back to
normal. The hourly consumption dropped dramatically on Wednesday.
He will check it again on Monday, to make sure it still looks okay. Assuming it is, the next step, if you want to
go that route, is to ask the Board of Public Works if an adjustment is possible, although normally, where the
water is used and enters the sewer system, they ask that the bill be paid. Please contact Kathy Gehring at
kaehrina(alctvofitham.oro if you want to pursue the appeal. Again, whether you want to pursue the appeal or
not, we can discuss payment arrangements, and should, since the account is set up to be paid automatically
from your bank account.

Jackie,
I wanted to respond to you in writing, to confirm what we have discussed today.
There is 7.81 gallons of water in a cubic foot. Water and sewer are billed in units of 100 cubic feet. Your bill
resulting from the March 5th reading and dated March 20th was for 11700 cubic feet, or about 87,500 gallons
of water. We sent a letter on March 5th, to you at the property address, to say your account had appeared on
our leak report and was showing consumption five times your normal. The bill was also sent to this address.
When we again read the meters in your area on April 18th to check for leaks, we discovered the issue had
not been resolved and consumption was higher yet, prompting the water department to contact you directly.
The consumption for this reading was 24800 cubic feet, or about 185,500 gallons of water. You indicated a
plumber checked out your property, and two toilets were replaced on April 25th. We re-read your account
today, and found an additional 4000 cubic feet of water has been used. We can't tell if the water was used
before or after the toilets were replaced; we will re -read this again tomorrow to determine if the issue has
been resolved.
I can understand your concern about the size of the bill. I would be horrified if I received a bill for $270011
(The $5,210 number is based on no resolution to the problem that is musing these numbers before the next
bill.) Unfortunately, as I said on the phone, an eighth inch leak will generate consumption of 100,000 gallons
in a month, or about 13300 cubic feet. A fourth inch leak will generate consumption of 400,000 gallons in a
month, or about 53400 cubic feet. Your consumption for the period from March 5th to April 18th falls
somewhere in between. It does not take much to generate this size bill.
So, this is what I propose going forward:
1. We will re -read the meter, to see if the mater has been resolved. If it hasn't, please discuss your options
with our water department, such as working with a plumber, or testing the meter. Resolving the issue is the
first thing that needs to happen.

2. The Board of Public Works can review your request for an adjustment to the bill. An e-mail from Kathy
Gehring in the Superintendent's office indicated she had requested documentation from the water
department, and expected a formal request would go to the Board in May.
3. Depending on the Board's decision, we can discuss payment arrangements, to make sure it is still your
wish that the payment be made by an automatic debit from your account, or to set up some sort of
installment arrangements.
4. You indicate you are not receiving mail at this property. Is there a better address, so that the bills and
notices are sent directly to you?

Dear Mayor Myrick
I have a major problem. Since purchasing my house in 2004, my water bills have averaged between $60 and $150. My
March water bill was $526.50 to purchase 8.7 million gallons of water and another $592.02 to dispose of 8.7 million
gallons in the Ithaca sewers (for a total of $1,118.52). Furthermore. I received a call from the water department
yesterday that 1 will soon be receiving another water bill of $5,210, or 40.8 minion gallons of water— for just 34
days!
As you can see, I really need your help with my water problem.
Not realizing a problem because the water is on automatic payment, I already paid the March bill of $1,118.52. The town
said that the nest bill is currently at $5.210 so my total liability is likely to be over $6,000.
When the town called me, they told me that there is nothing I can do because the water entered and left the house through
the meter, which they determined is in working order.
The water department said the past bill and upcoming bill is likely caused by a running toilet.
However, it's impossible for a private residence to use 11.700 units of water in 90 days (the March bill), let alone
roughly 54,500 units for the upcoming bill. This is equal to 8,775.000 gallons and 40,875,000 gallons respectively. Even
if the house sprang an enormous leak where three gallons of water poured out of the house every second for 90 days, it
still would not equal my March water bill. This is equivalent to three Old Faithful geysers — and no, I do not have a
geyser in my backyard. And for the upcoming bill, it gets crazier!
As you can see, this situation is absurd. I did not use this water. I have had no physical signs of a water problem at my
house. I got zero enrichment from the water the meter claims I used. Yet the town is billing me for a lake.
The impossibility of the water usage aside, l believe the town of Ithaca should have notified me as soon as they realized
that the bill reached some unreasonable number. Instead, they called me when it reached over $5,000. They told me that
they mailed a letter to the house in Mach. 1 am currently living at my in -laws and my renters did not inform me of a
letter. Furthermore, the water company has my cell phone number, but waited until yesterday to call me.
I believe that the water /sewer department should have notified me earlier. This is not only a financial problem for me but
if this single toilet really did run this water it is a huge environmental waste problem that should have been addressed
earlier.
This water bill is more than 2% of the value of the house. I simply cannot afford to be billed for the equivalent of over
15.000 homes worth of water.
The water department says they cannot help me. As a constituent. I umd you help in adjusting this bill.

There have been a number of a -mails Dying around about this account. It appears this will go to the Board for renew, so wanted to
let folks know sane things Ms. Walker doesn't mention. The water department got her cell phone number from the tenant, when
they discm erred on 4/18 that the slb»bon discovered in March had not been resoNed. In addition, the tenants say they have been e-
mailing Ms. Walker for a month to tell her the toilet was running all the time, and asking her If they should shut the water off to t.
They said she told them rho, because t would be a small amount added to the bill.
