This information may then be used to create committee agendas, with the speaker or author invited toattend. 8.11A Award of Contract for Professional Services for Ithaca Youth Bureau Roof Replacement — Resolution See attached resolution for the award of the contract for the replacement of the roof at t 9.2 Recommendation to Approve Solar Libe!±y Lease Program I still need to become familiar with the Solar Liberty Lease Program. It is my understanding that a private party can enter into such leases because they can gain the advantage of tax credits and depreciation schedules that do not apply to a public entity. We get a reduction ir electrical costs and a reduction to our green house gas emissions which helps us make Page 2 progress to meet out future goals. This seems like a fairly modest proposal which helps introduce the technology and various approaches to providing and utilizing it. See our agenda for April 23, 2012 for the information package. The recycling was appropriately placed at the curb on the evening of Sunday, September 4 for the scheduled non-shaded week city recycling pick-up week for that location. It was not picked up. In spite of my calls to have it picked up that week, it was not picked up that week. Therefore it remained at the curb the following week and so was ticketed. Please let me know if this clarifies my previous letter of appeal. If not I will appeal to the Board of Public Works for a slot on their meeting agenda. Thank you. Green Street Ithaca NY 14850 Ph: (607) 274 -6580 Fax: (607) 272 -7348 November 29, 2011 RE: Recycling Violation #00015459 201 Highland Ave in response to your appeal on the above referenced violation, recycling collection is done by and according to the calendar set by Tompkins County Solid Waste Division. In the City of Ithaca collection is done on non - shaded weeks: For the month of September recycling weeks were the weeks beginning on September 5th and September 19th, 2011. You are being charged for leaving recycling at the curb during the week of September 12th, 2011. Recycling that is left at the curb on the wrong day is. not collected. The crews attach a large fluorescent label to the material that indicates the problem. If material is still out the following day, the department picks it up and sends out a bill for the service as indicated on the sticker. This means that people who make an error when they set their recycling out have an opportunity to take it back in. The second day recycling pick up and the resulting service charge are required by City Code, but can be avoided if the rejected material is taken back in. If the pick up occurs, it is billed to the property owner to whom the service is provided. The City Code does not empower me to expunge a bill that is correctly issued. Our charge is to see that materials that are uncollected, for whatever reasons, are not left for an extended period. Common Council has reviewed and confirmed the 24 -hour grace period. For the above reasons, I am denying the request you made to us on November 28, 2011 to expunge your above - referenced violation dated September 13, 2011. Amount due through December 25, 2011 is $26.00. This decision may be appealed by appearing before the Board of Public Works. Please contact the Supt. of Public Works office at 274 -6527 to be placed on an agenda for their meeting. Your fine has been paid by the property owner, however, should you decide to appeal before the Board and if they grant you your appeal, the payment can then be refunded. She told me that it was out the week before for collection and missed by the recycling crew. We had Monday 9/5/11 off for Labor Day. This was to be picked on Tuesday 9/6/11. I then asked why either the tenant or herself didn't call the number that is in the recycling pamphlet and report a missed collection. She told me that she does not check on her properties each day and that she did call Leo Riley on either Thursday 9/8/11 or Friday 9/9/11. She told me that Leo told her that he didn't think I would be giving violations because of the flood and the state of emergency. She said he told her that they were two days behind collection because of the hooding. I toid her that the flood had nothing to do with the collection at 201 Highland Ave because the flooding started on Wednesday night 9/7/11 and they were not behind then. She told me Leo was supposed to contact me. This was the first I had heard anything about this. I have no idea it this was at the curb for collection on 9/6/11 or not. I only know there was a pile of cardboard at the curb on 9/12/11. A green warning sticker was placed on the cardboard for being out on a non recycling week. On Tuesday 9/13/11 it was still at the curb. I found a name. Picked it up and charged the property. At no time did anyone contact me about this. Therefore I am appealing to you. I will give my reason why. On Wednesday January 25, 2012 a orange warning sticker was placed on the side of the trash can at 519 Willow Ave. This stop is placed on the Franklin Street side or the property right next to the driveway. The sticker was marked for no tag. On the evening of Wednesday January 25,2012 when the trash had not been collected the can should have been removed from the curb. I will include section 196 -5 from the city code. On Thursday January 26, 2012 the can was still at the curb with no trash tag found. § 196 -5 Removal of uncollected materials. [Amended 6 -13 -2001 by Ord. No. 2001 -8I Where the Department or private hauler has not collected certain refuse and /or waste materials because those materials were not placed or prepared in accord with the provisions of this chapter and /or the private haulees requirements, the person responsible for putting those waste materials at or near a curb, sidewalk or street for collection shall remove those wastes from that location as soon as possible after the Department or private hauler has refused collection and, in any event, by the end of the designated collection day. A phone number to reach the Department of Public Works is printed at the bottom of each warning sticker. The trash can should have been taken from the curb and a phone call should have been made then. We have no way of knowing if the sticker found on the ground came from that can. We only know that no tag was on that can the day of or the morning after collection. The warning sticker on the can was placed facing the house and could clearly be seen. In this case we left the proper notice that is left for any other resident. Mr. Richardson states that he found his trash tag so he is not out that cost.
