The Board of Public Works meets unthe first, second and fourth Mondays of the months at 4:45 p.m. All meetings are voting meetings,
opening with a public comment period. Meeting agendas are created from prior public input, Department operating, planning issues, and

8AA Award of Bid for East Clinton Street Bridge Replacement and Prospect Street

We still do not have approval from the State for the low bidder. We are inserting this as a
placeholder and will modify the resolution if needed.
9.1 Construction Projects 2012
We thought it might be useful to review the current city-wide construction work program we are
facing in 2012. It is daunting and some of it is underway now. While some of the work may be
delayed or slide into 2013, 2012 will be a busy year in Ithaca. Larger maps will be available for
the meeting. The city-wide view does not display well at a small scale.
9.3 Request for Exemption from Use of City Property Fee for 1201 North Tioqa Street
Tsvi Bokaer appeared before the BPW on March 12th to request he be exempted from paying
a bill for use of city land. Please see my memo dated April 4, 2012. 1 would like to know how
the Board wants to respond.

keeps coming up does mean that the answer is not the one many people want to hear. There
are several ways to change things and, perhaps, get a different.answer. One is to change the
question by changing the controlling factors. A simple version would be to say "I don't care if
the intersections will drop to Level of Service F, can this work with two-way streets?" Does the
Board want staff to submit this project as a capital project in the 2013 budget request? If so
how large of a study do you want to request?

WHEREAS, a Project for Prospect Street Reconstruction and Replacement of the East Clinton
Street Bridge Project P.I.N. 375457 ("the Project") is eligible for funding under Title 23 U.S.
Code, as amended, that calls for the apportionment of the costs • be borne at the ratio • 80%
Federal funds and 20% non-federal funds; and
WHEREAS, that the Common Council authorized the City of Ithaca to pay in the first instance
100% • the federal and non-federal share • the cost of Scoping, Preliminary Design, Detailed
Design, and Right • Way Incidentals work for the Project • portions thereof; and
WHEREAS, that the sum of $494,000 has been appropriated (Capital Project #725 - $280,000

Re: Ithaca Road sidewalk and uphill bike lane
Engineering office staff, particularly Ass"t Civil Engineer Eduardo Torres, are
developing plans for a rehabilitation of Ithaca Road from Mitchell Street to
Dryden Road. The Streets & Facilities division will be doing the work this
summer. The scope of work was originally to rehabilitate the pavement, with
some minor curb and drainage repair. In our field reviews, staff would like to
pursue three changes that are slightly beyond a rehabilitation of the street in-
kind. We would like to: 1) construct a sidewalk on the west side of the street
along the Bryant Park block; 2) modify the curb alignment at the intersection
with Bryant Avenue and Fairmount Avenue; and 3) prohibit parking at all times
on the street in order to stripe an uphill bicycle lane.
In anticipation of this project, we sent the attached letter to all residences along
the street on February 10, 2011. We received a few responses, but not more than
five. On January 31, 2012, we sent out an email (also attached), which was
forwarded to neighborhood email lists, that included a few alternatives for
changes. At the time, we were looking at the intersection of Ithaca Road and
Elmwood Avenue, too, because over the years, I've received complaints about
the crossing there. Based on feedback from these communications, we would like
to pursue the above three changes. We are also looking for a minor change to the
crossing at Elmwood that does not require changing any curb alignments.
Drawings are attached for your review. I would like to discuss the project with
you at your meeting on April 9ffi. If you amenable to the changes, I will prepare a
resolution for your meeting on April 23rd.

As you may know, the Department of Public Works is looking to repave Ithaca Road between Mitchell Street and
Dryden Road this summer. Though we do not have GD endless budget, we do have some opportunities to make
some improvements besides pavement. We are looking at the following 3 things and we are interested in
your feedback before going to the Board of Public Works for direction. There are some details that I'm not going
to cover in this email, so please feel free bocall or email me if you have questions about anything.
1. At the intersection of Elmwood Ave and Ithaca Rd. we are looking to improve the cr0S5vva|ha. Attached is
pdf of concept showing the proposed location of crosswalks at the intersection and the curb realignment under
consideration. We would remove the existing on]S3w8|k On the northern leg of the intersection and the long
diagonal one on the south leg. Sliding these down the hill a bit helps with sight distances and these
crosswalks would shorten the crossing distance. At first we were only looking at crosswalk "A" but more
recently, we've been thinking about adding both "A" and "B."
2. There iSm} sidewalk along the west side of the street along the park, forcing pedestrians tU either cross the
busy street or to walk all the way around. Additiona|ly, at 'the intersection of Ithaca Rd and Bryant/Fairmount
/at northern point of Bryant Park), there is lot ofuDd8fined, open pavement, which tends to keep speeds high,
especially the turn onto Bryant from ]th8C8 Rd. We are looking t0 both extend 8 sidewalk along the eastern
edge of the park with a tree lawn comparable to the rest of the street and do something to close down the
intersection. Attached are three alternatives. Alt #1 separates Bryant Ave from Fairmount Ave; sidewalks
and crosswalks would go through the hatched 8n8aS (not shown On drawing). Alt #2 closes access to/from
Ithaca Rd and connects Bryant Ave to Fairmount Ave. Alt #3 keeps access in one intersection, albeit onna|!er
than the existing one.
3. We are |QOk1Og at extending the uphill bicycle |8n8 from where it ends OO Mitchell Street VptOthe
intersection at Dryden Rd. This would require the nannov8| of on-street parking in this stretch, though it is not
currently used ail that much due to the prohibition against parking between 9am and noon for the WO 0& 200
blocks and the Z hour restriction for the 300 block. VVe wrote to all the residences on the street last year,
mentioning that we were looking at this. We only got a few responses and they were mixed on this particular
point. I think it makes a lot of sense from a broader transportation perspective. It might make sense to ask the
8PVV for special permission to OUOw residents on Ithaca Rd to buy residential parking permit to help lessen the
impact of removing the on-street parking.
VV8 also spent 8 little time looking 8t the intersections at either end Ofthe project. The 5 corners isOn our list
for improvements - the traffic signal |3 past its useful life and itiS not a pedestrian friendly spot, despite all the
people walking here. We are interested in the idea of rebuilding the intersection as a roundabout (like the one
down at Albany/Spencer/Old Elmira), however, such a project is out of our scope and budget (for that matter
addressing the intersection at all is out ofour scope), sovvewill have to pursue it another time. Cornell does
have this intersection on their list of places they are willing to invest as part of the Cornell/Community
Transportation Initiative.
At the other end, at Mitchell St, though we considered a number of things, we have settled back into keeping

the curbs were they are and restriping the centerline more appropriately and adding /replacing warning signs for
the curve with recommended speed signs. Though the intersection is not ideal, it does not have much of a crash
history and we didn't see compelling reason to add scope of work to address much.

the BPW agenda for a meeting in February, but we have not picked a date yet.

Request To Not Pay For Use Of City Land
The Board of Public Works was approached at its meeting of March 12, 2012 by Tsvi Bokaer as
the General Partner of Fall Creek Associates to request that he be exempted from paying a bill he
had received for use of city land. Fall Creek Associates had entered into an agreement to
redevelop and use the city land adjacent to his property as part of the site plan approval in 1986
as he was redeveloping the lot that had been an old abandoned P&C market. The loss of Fall
Creek Pictures as primary occupant has resulted in a significant reduction of use and income
from the property. Mr. Bokaer would like a "temporary exemption" from use of the land and the
bill for that use.
We have started down this road before. Attached is the most recent request as well as a 2010
request which started a review of the issues then. It is my understanding that Mr. Bokaer was
required to obtain use of the land in 1986 in order to develop the land in the manner he was
proposing. It is my understanding that he could only stop paying for the use of the land if he
agreed to change the permitted uses (zoning) of the property. He has not requested that to my
knowledge. The 2010 response from the building department was that they would have to know
what land use he was proposing in order to know what the parking requirements were, which
was not exactly a response to the question I was asking. I guess I would tell you the cost of
paying for the land use is the cost of keeping the option to use the land as he has historically. If
he wants to stop paying for and using the land, then he gives up that option, and the land use
shrinks. He would like the option at no cost.
The second question that came up both times is that when he stops using the land he should
restore it. His response was to provide pictures of the land before he redeveloped it to show it is
as good or better than it was then. My response is that if he had not agreed to use and pay for the
land when he did his original development, he would have been required to put in sidewalk,
plantings, and curb as part of the site plan approval in 1986. We would expect the land to revert
to that condition as it represents the acceptable previous condition at the time of his

development. He bypassed that step and went directly to developing it for parking and paying
for that use.
If the Board wants to consider the request of Mr. Bokaer, I will request determinations from the
Planning Department and Attorney's Office of what would be required to suspend the use,
assuming that is even possible. There are probably ramifications for a grandfathered use that
could expire. There is the possibility that the Planning Board would downgrade the allowable
land uses to match the available parking and current zoning and Mr. Bokaer would have to
reapply for a variance or other accommodations if he wanted to restore the same level of land
use. It is possible that the city could choose not to renew the use of city lands and eliminate the
parking due to safety or neighborhood concerns. Several of these would bring up the question of
restoring the land which will have its own legal determination.

My name is Tsvi Bokaer. I am a Fall Creek Associates, LLC partner. As
such I have paid for the past 25 years the fees for the usage of a strip
of land that belongs to the City along the West Side of our property at
1201 -1215 N. Tioga Street, Ithaca.
As you know, that parking strip was granted to the old N. Tioga P &C
since the mid -50's, and we used it as per City's code, in order to
accommodate the Off Street Parking requirements when the 300 seat
FallCreekPictures movie theaters opened its doors in 1086.
As you also know, FallCreekPictures closed its doors in June 2009. I
am enclosing a copy of the 2009 Invoice for the rental of that strip of
sidewalk that belongs to the City which we have paid in full. With this
letter, I am requesting that you refrain from charging us for usage of
the same strip for the time being since the movie theaters are now
closed, and since we do not have a need for additional Off Street
parking at this time.
While our property has now been vacant for close to a year, I would
like to assure you that we will inform you and your Dept. of our needs
for additional Off Street Parking once we will secure a new Tenant for
the FallCreekPictures space. Please, take the time to respond to this
request in writing so that we may have it for our records and our

The forwarded memo and its attachment have to do with the Fail Creek Associates (Tsvi Bokaer)
property at the end of Tioga Street. He is asking to have the fee for parking on a stip of city street ROW
be eliminated since they don't need the parking at this time.
It is my understanding that the parking is a requirement for the development of the land in its current
form, and that he is required to have the parking available. Whether his building is occupied or not is not
the city's issue (though it may be of interest). If he wants to give up the parking he needs to get the zoning
changed to eliminate the need for the parking? This is actually a question, even though it looks like a
statement.
If he was to give up the parking I would expect it to be restored to curb lawn, complete with trees and
grass, at the land owners expense. I don't think that is what he wants to do. I think he is hoping we will
reduce his current expenses and our revenues by suspending the billing.
I am willing to take his request to the BPW, but I would like to know if my understanding of the history
and his zoning obligations is correct. If you want to make a recommendation based on your Planning and
Development perspective I would be happy to forward that as well. My experiences over'the years would
not lead me to recommend this suspension for this property related expense, or for this owner unless the
land was first restored and the zoning variance eliminated.

This is Nick from Occupy Ithaca, sorry to bother you regarding this, but seem to be at sort-of a dead end.
Under direction from Bill Gray, I Stopped by City Hall early Tuesday morning and I met with a few people from
the Building Department regarding obtaining a "use variance" in order to allow for overnight camping of security
personnel within the two tents specified in the permit application. "Skip" Schell and Gino Leonard| were both
emtnenn*|y helpful in trying to determine the correct process and/or paperwork tufile. After brief meeting with
Mr. Leonardi and a follow-up call, he was able hodetermine, with guidance from the Building Commissioner,
that it is impossible to apply for or obtain a "use variance" for the event because camping is not permitted
within the city limits.
Later that afternoon, I met briefly with Bill Gray and herecommended that I email you regarding the permit and
ask for guidance astothe next steps I must take in order to obtain the use variance that I require. So that's, in-
essence, the rut that I am stuck in. As Mr. Gray pointed out to m*, this entire process is something that the City
of Ithaca is not familiar with, and therefore finding my way through the bureaucracy is understandably going to
be a challenge in this case... not just for me, but for everybody involved. I am copying Bill Gray's office onthis
email so that, perhaps we can open up a discussion as to the possible next steps. I look forward to hearing from

We remember the study very well, and Amy even remembered the year and project number. That's scary.
What xve recall is that the two most compelling reasons for not converting entirely were (1) Cayuga St
(between Green and Seneca ): congestion/loading operations, queuing and sp0back.
(2) Seneca/Aurora intersection: congestion- v/c ratio, spillback into "tuning fork" etc.
What exactly would you want to convert, both or just A urora?
Initially, my thoughts are that conversion of Cayuga would likely have significant and unacceptable
impacts .... even ifit was for only one year. Its not only motorist operation and safety but Cayuga has significant
ped activity as you know, and conversion to two-way will impact safety for all users.
Conversion of Aurora alone may be less detrimental to operations, however complexity of turning fork
intersections limit options for signal phasing/coordination changes.
If conversion of Aurora is only considered, updating counts and running new analyses considering inputs from
TranoCAD and resources, the cost would benn more than $10k.
Otherwise, you are doing a larger, more comprehensive downtown circulation study again, that could be
upwards to $80kto$40k.

to two way traffic Well, the topic has come back around. This time the impetus is our Clinton/ Street

South Hill. Our Board of Public Works has expressed a strong interest in the idea and though we've circulated
your study bit, they would like a fresh look.
I was wondering if you would be able to put together a cost estimate for budgeting purposes on what it would
take to update the study with new traffic counts, a consult with the TransCAD model (PM peak only) that the
ITCTC maintains, inputting data into Svnchno modeling (I can give you my current model) to understand the
impacts, and the recommendations for mitigations. We would have to put out a RFP for the study, so I don't
want you to spend hours and hours putting together a proposal level estimate, but I wondered if you could give
me a realistic number to take to Council to establish a capital project for the study.
