The Board of Public Works meets on the second, third and fourth Wednesdays of the months at 4:45 p.m. All meetings are voting
meetings, opening with a public comment period. Meeting agendas are created from prior public input, Department operating, planning
issues, and requests made to the Superintendent. The Board reserves the right to limit verbal comments to three minutes and to request
written comments on lengthy or complex issues. This information may then be used to create committee agendas, with the speaker or
author invited to attend.

7.1 Bridge Means Restriction Special Update by Cornell University
Cornell University goes before the Planning and Development Board on November 22, 2011.
This is a special update prior to that presentation.
8.1A Recommendation to Divest Unused City Property — Resolutions
This item will be a follow up to the Board's discussion on November 9th. Since that discussion
has not taken place as of this writing, I don't know exactly what the content of the resolutions
or recommendations will be. Common Council has adopted a budget for 2012 that includes
revenue from some sales of surplus property so we do need to work through recommendations
for Council.
8.1113 2012 Trash and Yard Waste Disposal Rates— Resolution
Council is interested in bring the budget for solid waste into balance. It has run a deficit for
years. I believe that it will require a number of steps to accomplish this, but the first step is to
recognize that yard waste has a cost to handle and dispose of properly. In a way, it's a
measure of our success that recycling part of any solid waste budget has grown so large that
we have to charge for it rather than subsidize it from the trash disposal tags. It is also a
measure of the number of options people have. If they can use your free recycling system and
someone else's lower trash disposal fee (who does not have a recycling component), you have
a problem with your budget.
8.2A Appeal of Sidewalk Assessment for 105 Worth Street — Resolution
Staff has provided background information and a recommendation on the protest being
considered here.
8.3A To Amend the Vehicle and Traffic Schedules to Change Parking Regulations on the

8.1B 2012 Trash and Yard Waste Disposal Rates— Resolution
WHEREAS, the Board of Public Works has reviewed and discussed information from the Solid
Waste Division and the Chamberlain's Office regarding trash tags, and
WHEREAS, the Common Council has accepted the recommendation in the Mayor's 2012
Budget Narrative stating that trash tag rates should remain at the 2011 rate, and
WHEREAS, the Common Council has accepted the recommendation that a new yard waste
disposal fee be established, now therefore be it
RESOLVED, That the Board of Public Works hereby retains the purchase price of the 35 lb.
trash disposal tag at $3.50 per tag, effective January 1, 2012, and be it further
RESOLVED, That the Board of Public Works hereby establishes a yard waste disposal fee of
$1.50 for each bag or bundle of not more than 50 lbs. of yard waste, effective January 1, 2012.

The Chamberlain's office needs to order trashtags to finish out this year. It is our
understanding that the approved 2012 Budget does not include an increase in tag rates.
We would like to order a sufficient supply to cover the remainder of 2011 and 2012.
For your information, we are looking at multiple vendors for our new supply. At least
one of the companies produces the tags in sheets of five rather than six. We would like
the flexibility in any resolution the Board passes to allow us to consider sheets of tags in
some other number.
Both Dan Spencer and Ray Benjamin indicate they would prefer a tag system for yard
waste instead of a bag system. If the Board agrees, it will likely be most economical to
order the yard waste tags at the same time as the trashtags.

We need to get some resolutions together for the Board.
We don't have enough trashtags to last through the end of the year. We need to order these in the next week or so. I don't want to
place the order if we are going to do something different from last year, and, if we are going to charge for yard waste using a tag, it
would be most economical to order those tags at the same time. If we are going to use bags instead, we need to get the system set
up and the outside vendors on board.

Here are the rates proposed as part of the approved 2012 Budget:
Trash tags remain the same
A 1.50 per 50 Ibs for yard waste (this is a new fee and needs to discussed at the BPW)
Water rate: $4.50 per 100 cubic feet
Sewer rate: $5.06 per 100 cubic feet
Parking rates:CPI increases for permits where applicable
All rates should be approved by the BPW soon.

8.2B Appeal of Sidewalk Assessment for 105 Worth Street — Resolution
WHEREAS, Robert E Terry, owner of 105 Worth Street, received a 2010 sidewalk assessment
for sidewalk work completed adjacent to his property, and
WHEREAS, Robert Terry received sidewalk defect notices in 2007, 2008, 2009 and
communicated with staff regarding his concerns before and after the work, and
WHEREAS, Robert Terry filed a written appeal on 12/31/10 asking to remove the 25%
surcharge and another written appeal on 4/1/11 asking for the full assessment to be waived or
the sidewalk to be completely replaced, and
WHEREAS, staff met with Robert Terry on site, and reviewed information provided by him
regarding the appeal, now therefore be it
RESOLVED, That the Board of Public Works recognizes that City forces completed the
sidewalk replacement work in accordance with City specifications, and be it further
RESOLVED, That each protest reason was considered as shown in the Sidewalk Assessment
Protest Summary for this address, and be it further
RESOLVED, That the Board of Public Works hereby denies the request to revise the sidewalk
assessment for 105 Worth Street.

SIDEWALK NOTICE OF DEFECT
LOCATION: 105 -107 Elmwood Ave
TAX PARCEL #: 85. -1 -1
City of Ithaca has inspected the condition of the public sidewalk along the street at this
address. At this time of inspection, the following sidewalk was found to be defective:
TREE DAMAGED WALK:
50 square feet of 4" thick sidewalk
0 square feet of 6" thick sidewalk
0 grind locations
OTHER DAMAGED WALK:
0 square feet of 4" thick sidewalk
0 square feet of 6" thick sidewalk
0 grind locations
This location is on the City's repair list and will remain on the list until the repair work is
completed by you or by the City. At the first opportunity, all defective sidewalk found at
this location at the time of the work will be replaced. City of Ithaca Code requires that
sidewalk repairs made by City of Ithaca be billed to the owner at cost plus 25 %.
You are encouraged to hire a contractor to do your repairs. Obtain a sidewalk permit so
the location can be removed from City of Ithaca's repair list when work is completed.

square feet of sidewalk needed to be replaced, but that all of the repairs were related to tree damage and
would not be billed to them. They received a bill dated August 4, 2011 for 25 square feet of 6" sidewalk
repair totaling $403.13.
I spoke to Mr. Terry on the phone. He would like to contest the bill, because he said that had he known
some of the repair would be billed to him, he would have made other arrangements to make the repair.
I have attached a copy of the invoice, and the 2007 notice.

You have probably observed that Ithaca's sidewalks are rebuilt on an ongoing basis. One reason
for this is Ithaca's sidewalk repair and inspection program- At the time of inspection, the
deteriorated sidewalk at 105 -107 Elmwood Ave. consisted of the following:
TREE DAMAGED WALK (by current policy, the city assumes expense for this repair):
50 square feet of 4" thick sidewalk
0 square feet of 6" thick sidewalk
OTHER DAMAGED WALK (for which you are responsible):
0 square feet of 4" thick sidewalk
0 square feet of 6" thick sidewalk
The City is exercising its option to complete the necessary repairs and has tentatively scheduled
your property for work tMs year. You will be billed for your portion of the expense plus an
additional 25% administration fee required by the City Engineer. Please note that some
inspections were done several years ago and sidewalk condition will be reevaluated based on
current conditions at the time of construction. It is possible more sidewalk will be replaced than
the quantities listed above.

In 2011 we issued two bills to each property owner. One bill covered the period of
January 1 St to March 31St, using the old tax -based formula. The other bill covered the
period of April 1 St to March 31 ", using the rates as established by the Board and the
appraisals.
339 Elmira Road- old Salvation Army parcel
The bill starting April 1" was ultimately expunged because the Salvation Army
building was demolished, and they are no long using the right of way for parking. Jeffrey
Uotila, the owner of the property, is appealing the bill for the period of January 1" to
March 31 St. He contends he never used City property, his lessee did, and the building has
been gone for some time, with no use of City property. He would like the other bill
expunged. I have attached his request and a copy of an e -mail from Lynne Yost.
210 Hancock Street- old P & C site
We charged for 2 loading docks that extended into the City right of way. The
docks were demolished in April/May, 2010. We expunged the fee for April 1 s' to March
31 St, but the owners are asking us to expunge the bill for the 1St quarter of 2011. I have
attached documentation from the owner.
344 Elmira Road- Garcia's
The owner contended that we were charging him for property used by
MainesSource. Tom West took some measurements and wrote a memo regarding the bill
as attached. He believes the bill is correct, but makes a recommendation to sell the right -
of -way along Route 13 to the respective users.

I recommend that Mr. Uotila's appeal be granted and the license fee expunged.
Neither Mr. Uotila nor his tenant (if any) are actively using City right of way. There are
curb cuts and an abandoned asphalt parking area within the right of way.
I strongly recommend that the Board direct the immediate construction of sidewalk
across the frontage of 339 Elmira Road. This work was originally directed by the
Board of Public Works in the mid 2000's. In deference to imminent development at
the site sidewalk construction was deferred. However there has been no further
development of the site to date and this is the only portion of Elmira Road that remains
without a sidewalk.

Hi Debbie - Tom has all my files on license fees. My understanding is that either Tom or someone else in
the Engineering Office will take over my responsibilities. Tom or Bill can tell you who.
Tom, the issue is that the building is vacant so the parking in the ROW is not being used. I can't
remember if the building owner asked to discontinue the lease and if so, when that occurred. Expunging
the fee is consistent with the history of committee decisions. I have no strong personal opinion either way- -
I'm also comfortable with a rule book approach (did they ask to discontinue the license? when? if not - bill
them.).

I recommend that the owner's appeal be granted and the license fee expunged. The
owner has removed loading docks that occupied City right of way.
Plans developed for the renovation of 210 Hancock Street illustrate construction of a
trash area, stair way and at -grade loading platform at the rear of the building. These
facilities will occupy City right of way and will require the issuance of a license to use
the property. I recommend that staff re -visit the site upon completion of renovations of
210 Hancock Street to determine the area used for these improvements.

I recommend that the Board of Public Works decline the owner's appeal of the license fee
for 344 Elmira Road. The owner feels that the amount of land he is using is over-

Apparently a number of us have received phone calls from Marty McElwee, owner of 344
Elmira Road, regarding his license fee for use of city land. Mr. McElwee feels that the
amount of land he is using is over - estimated. I have found some of the work that Lynne
Yost did to determine how much area McElwee is using and I'think I understand how the
number of square feet was derived.
I went to the site today and measured from the south property corner.to the edge of
driveway nearest the sidewalk; it measures approximately 40'. Basedxupon that
measurement and the rationale that the driveway should not be considered a "licensed
use" of the right of way I calculate that Mr. McElwee is using 2300 sf.
If we include the additional parking area in front of the triangular addition then the total area
he is using measures 2955 sf. Although these conclusions are not based on an accurate
survey they are based upon field verification of the parcel. I recommend that Mr. McElwee
be assessed a fee based upon 2955 sf. At $1.10 per sf that's $3,250.50 (pretty close to the
$3,236.70 Lynne calculated).
Alternatively, a more enthusiastic recommendation would be to simply sell the portion of
the right of way that Mr. McElwee is using to him. The general appraised value of
commercial property along Elmira Road is $10.00 per square foot (refer to appraisal of 334
Elmira Road by Midland Appraisals, 2003). Mr. McElwee could be offered approximately
3700 sf abutting his front property line for a price of $37,000. Cost of a survey would be
about $1,000 and there would be filing fees. The City would realize an additional $555 per
year property tax without doing any paperwork, mailings, etc. The property is of little use to
the City.
