The Board of Public Works meets on the second, third and fourth Wednesdays of the months at 4:45 p.m. All meetings are voting
meetings, opening with a public comment period. Meeting agendas are created from prior public input, Department operating, panning
issues, and requests made to the Superintendent The Board reserves the right to limit verbal comments to three minutes and to request
written comments on lengthy or complex issues. This information may then be used to create committee agendas, with the speaker or
author invited to attend.

8.4A Columbia Pedestrian Bridge Rail Options —Discussion
The options have been narrowed down to two for the handrail on the rehabilitated bridge. We
can proceed with the current project which has a new bicycle height hand rail at 4' -6 ", which
requires no action on the Board's part, or we can propose that an updated version of the 8'
chain link fence that was removed from the bridge during demolition be installed. The budget
figure for restoring a new 8' fence is $100,000 for the modified design, fabrication and
installation (split $15,000 and $85,000). This will require a budget modification and approval
by Common Council. The current project budget is attached, showing the fixed federal grant,
the Cornell transportation grant (which is also fixed), and the city portion, as well as budgets
for Water and Sewer work being done while the bridge deck is open.
8.413 Special Requests from Ithaca Festival — Discussion
The Ithaca Festival is considering a Masquerade Ball for Friday evening of the Festval and
would like permission to use the park until midnight, past the 10 pm closure time. The
Superintendent has the power to grant an exemption under the provisions of 336 -8 of the City
Code. The attached proposed resolution supports the granting of the exemption, and
coordination with the Special Events Committee.
8A. Tabled Items
8A.1 Approval of Decorative Chain in Front of Monuments in DeWitt Park
(See meeting agenda for April 13, 2011)
The Board considered and tabled an item to install decorative chain in front of monuments in
Dewitt Park. Engineering staff discussed this item the following morning and suggested that
consideration be given to other deterrent methods, where items are installed along the edges
or projections where skate boarders or others "grind" an edge by sliding along it with their
recreational equipment (usually a board or a bike). They are also known to wax the surface to
improve the ride, but the wax darkens and discolors the surface. Some of the items available
extend back from the edge, making it unattractive to ride the horizontal surface in a more
conventional manner, or to sleep in that location which was also a concern of some who
wanted to protect the monuments. Some examples are attached for your consideration as an
alternative approach to chains.
9.1 Appeal of Snow Removal Bill for 205 Thurston Avenue — Discussion
The appeal and my notes on it are in the agenda for April 13, 2011. We have copied the
section of the City Code that applies here for the discussion on maintenance of curb lawns,
Item 9.4.
9.2 Stewart Park Master Plan — Update (20 min.)
Rick Manning has asked for a chance to update the Board on the Stewart Park Master Plan.
Apparently in the process of doing their work, they have come up with an immediate project
which they would like to discuss. Attached are their e-mail about the recommended garden
restoration as well as the Board minutes and some notes from their last appearance before the
board on January 20th, 2010.

9.3 Sidewalk Work Plan 2011 — Discussion
Lynne Yost has provided the current list of Priority Work used by the Streets and Facilities
Division to plan their sidewalk work. We will provide work plans for both operating divisions
next week.
9.4 Curb Lawn Gardens — Discussion
The Board (Claudia Jenkins, I believe) has requested a chance to talk about curb lawn
gardens that appear every year in various neighborhoods. Without knowing exactly what the
issues are, we have provided a major portion of Chapter 178, Exterior Property Maintenance,
which has provisions that seemed to apply. There is also a provision about not blocking vision
at comers of intersections which we will provide.
9.5 West End Parking — Discussion
Attached are notes I requested from Tim Logue on West End Parking which cover the other
areas where we were considering implementing paid parking. These notes were handed out
at our meeting of April 13, 2011, and are attached here. The last discussion of these parking
areas occurred at the Board's December 8, 2010 meeting. I have attached a map showing the
locations of West End parking from that meeting. We should arrange for this paid parking at
the same time we have an agreement for Inlet Island.
9A For Your Information Items
9A.1 Cornell Local Roads Program Highway Superintendent School at Ithaca
College
The Cornell Local Roads Program has an extensive list of workshops they run annually which
can be very educational (and inexpensive) if it is on a topic of interest to you. I have attached
a recent flier covering their spring offerings. More can be seen on their web site
(www.clrp.comell.edu /). The item I thought some might find interesting is the annual School for
Highway Superintendents they run for the Association of Towns each June at Ithaca College.
The agenda is not currently available for 2011 but usually contains a lot of Department of
Public Works related information and is a chance to learn about issues without an impact
directly on one of your neighbors.
9A.2 Horses in Stewart Park
Following our discussion on April 13, 2011, 1 took care of the request for pony rides as part of
the Sunday activities at the Ithaca Festival. The letter is attached.
9A.3 Dragon Boats at the Docks in Cass Park
Attached is a copy of the ad placed in the local paper for the boat slip lottery at the human
powered boat dock in Cass Park. Following a discussion with a representative of the only
other paddling association I knew of who might be interested in the slips, I issued a temporary
permit for the Dragon Boat Club to occupy that space while we await the lottery results. The
temporary permit is almost identical to last years permit, with the addition of reference to the
lottery results.

WHEREAS, Currently, the City of Ithaca and project consultants (LaBelle Associates,P.C. and
Trowbridge &Wolf Landscape Architects LLP) are working on a project to rehabilitate Columbia
Street Pedestrian Bridge over Six Mile Creek, and
WHEREAS, the Columbia Street Pedestrian Bridge over Six Mile is located in the City of
Ithaca and connects the west side of Six Mile Creek at Giles Street to the east side at Ferris
Place, and
WHEREAS, The project consists of rehabilitation of the Columbia Street Pedestrian Bridge
over Six Mile Creek (including removal and replacement of the bridge deck, railing, bridge
seats, bearings, and abutment backwalls; rehabilitation of wingwalls and abutment stems;
structural steel repairs and painting of structural steel; and aesthetic enhancements to the
approach plazas), water and sanitary sewer main removal and replacement and modifications
to other existing utilities, and
WHEREAS, up on the Board of Public Works request, the City of Ithaca together with project
consultants has recommended Custom Pedestrian Bridge Fencing System (8 ft high) on the
bridge and
WHEREAS, the proposed Custom Pedestrian Bridge Fencing System (8 ft high)
implementation includes design and fabrication of a post extension system that would be
connected to the top rail of the proposed woven steel mesh panels bridge railing system in the
current contract documents, and
WHEREAS, the woven steel mesh panels would be replaced with a stainless steel wire rope
and mesh system (attached) which would be more aesthetically pleasing and will be built of
virtually maintenance free materials, and be it further
RESOLVED, That, as part of Columbia Street Pedestrian Bridge Rehabilitation Project, the
Board of Public Works here by approves the implementation of 8 ft high Custom Pedestrian
Bridge Fencing System on Columbia Street Pedestrian Bridge, and be it further
RESOLVED, That, the City of Ithaca Board of Public Works recommends that the Common
Council to increase the bridge share(CP#743) of the Columbia Street Pedestrian Bridge
Rehabilitation Project in the amount of $100,000 for the out of scope work included in the
project.

8.4B Special Requests from Ithaca Festival — Discussion
WHEREAS, the Director of the Ithaca Festival has approached the Board of Public Works for
permission to have extended hours in Stewart Park on Friday evening, June 3rd, 2011 in order
to organize a Masquerade Ball which would run from 9 pm until 12 am, now therefore be it
RESOLVED, That the Board of Public Works supports the concept of expanding the activities
of the Ithaca Festival to include a Friday night dance in Stewart Park and recommends that the
Superintendent, in consultation with the Special Events Committee, grant the application for
exemption from the park closing time as requested.

Hi Kathy,
You had asked me to remind you about having stewart park project scheduled
for april bpw meeting. We would like to do an informational presentation
later in the month. We do have one specific request however. The Parks
commission has recommended that $10,000 of a $27,000 fund, the Stallman
Memorial Rose Garden fund, be used to renovate the Memorial Flagpole Garden
in Stewart Park. Info about this fund, from Steve Thayer is provided below.
We will be discussing this again at this month's parks commission, with a
plan to review. It would be great if BPW could vote on this as well. This
is a project we would like to implement this year, preferably by the 4th of
July, which is the 90th anniversary of the dedication of Stewart Park.
It there are any discussions needed prior to this meeting, at a staff level,
please let me know as well. I could also submit some drawings in advance of
meeting. Most should be ready early next week.

Since both of you have asked about the Stallman Fund. Here are the facts as
researched by myself and the City Attorney's Office:
A trust fund was established by Council in early 2003 at the request of the
Last Will and Testament of Mariam Stallman for the care and maintenance of a
Rose Garden in Stewart Park. As per the Will, the fund was established at
$60,000. However, the Estate only had $26,791.20 in remaining funds. The
Trustee therefore proposed that the remaining funds in the Estate be given
to the City for uses in landscaping and maintenance in Stewart park. The
City received the funds in early 2003 and established the trust fund. The
account currently has $27,500. The funds are required to be used for
landscaping and maintenance in Stewart Park, so there is some flexibility on
uses of the funds.
The requirement to use the funds is such that the Ithaca Parks Commission
must be consulted on the use of the funds and the BPW would need to approve
the appropriation of funds. The request for funds would go to the
Controller's Office for approval and to the Chamberlain for the cutting of
the checks. Common Council does not need to have involvement unless a
totally different request for the use of the funds is proposed.

Stewart Park Rehabilitation Action Plan
Project Update and Grant Support Request

Stewart Park Building Rehabilitation Feasibility Study
The Stewart Pork Rehabilitation Action Plan was funded by the Strategic Tourism Planning Board (County Roan Tax) Tourism
Capitol Grant program. One of the key recommendations of the Stewart Park Rehabilitation Action Plan is to conduct a followup
study of park buildings to determine building program, develop measured drawings, conceptual designs, phasing plans, con
estimates and illustrative models in sketch up (see attached example of orrhrteet work)

• Large pavilion renovations
• IMPP Building renovations /additions
• New DPW Maintenance Building
• Concession building evaluation
• Tea Pavilion evaluation
• Carousel building and storage assessment

Stewart Park Building Rehabilitation Action Plan Summary
The Stewart Park Rehabilitation Action Plan was funded by the Strategic Tourism Planning Board (County Room Tax)

INDICATIONS OF PLANNED WORK: Approximately two to four weeks prior to the work, repair
plans will be painted on the sidewalk and driveway in pink paint, with areas indicated for owner billing.
Approximately 3 days prior to the work, a notice will be posted at the property, indicating an expected

responsibility for the maintenance, repair or replacement of said facilities; and
WHEREAS, such proposed easement instruments, including maps showing the
easement areas, have been provided by Wal -Mart (through its counsel, Harter, Sewest
& Emery, LLP) and have been reviewed by the City Attorney and by the Superintendent
and/or his designees, and are in a form that is agreeable to them; now therefore be it
RESOLVED, That the Board of Public Works hereby accepts such water and sewer
easements from Wal-Mart. on behalf of the City of Ithaca, and authorizes the Mayor,
upon consultation with the City Attorney and the Superintendent (as needed), to
execute easement instruments for the same, in a form that is substantively the same as
the drafts provided to the City on January 19, 2010, as well as any other. related,
required documentation.

Stewart Park Rehabilitation— Presentation
Landscape architect Rick Manning joined the Board for their discussion of this item. He
provided an update of the Stewart Park Rehabilitation Plan, explaining that a $15,000
grant was received several years ago for the study of rehabilitation of the buildings and
parkland. He further explained that in 2009 a significant volunteer effort was
undertaken to repaint the main pavilion. He stated that multiple City staff assisted in the
effort to repaint, acquire the paint, and assist in recruiting volunteers.
Mr. Manning further explained activities planned for 2010, including the completion of
Phase 3 of the Cayuga Waterfront Trail, a clean -up of the waterfront in Stewart Park,
continued painting of the buildings, the creation of a "Friends of the Park" organization,
and submission of grant applications for further rehabilitation projects, including a
sculpture art trail within the park. He requested a letter of support from either the Board
or Common Council to assist in obtaining the grants.
Discussion followed on the flow regarding a private organization applying for a grant to
work on city -owned property, ensuring that the proposed changes to the park are
approved by the city, and that a feasibility study be completed. Commissioner Tripp
expressed her disapproval of a sculpture art trail in Stewart Park. Commissioner
Wykstra expressed his support for the rehabilitation plan and requested that this same
presentation be provided to Common Council. The Board agreed to include this item on
the agenda for the February 10, 2010 voting meeting.
Water Treatment Plant Client Committee vs Stakeholder Group — Discussion
Supt. Gray explained that the client committee is the Board of Public Works, while a
stakeholder group is a larger community group that participates in discussions and
makes recommendations.
Mayor Peterson explained that she would name an ad hoc client committee to work on
the water treatment plant project. She further explained her opinion that the Board of
Public Works is a board and will function as a board, and the client committee would
work on separate issues.
BPW Membership Duties& Responsibilities — Discussion
Mayor Peterson stated that she had not received any further applications for
membership on the Board of Public Works. Discussion followed on the floor regarding
recruiting new members for the Board.

"solid waste" shall not include properly prepared and stored recyclables or collectible yard
wastes, or properly stored and maintained composting materials. An object shall be presumed
to be discarded or rejected solid waste when the object is stored, placed or left on the grounds
or exterior of the property in the view of neighbors or passersby under circumstances which
meet any of the following criteria:
A. The object produces an offensive smell.
B. The object is of a type designed for interior use or made of materials which are suitable
only for interior use and the object is left outside and exposed to the weather.
C. The object has reached a degree of dilapidation or disrepair that can reasonably be
presumed to render the material unsuitable for or incapable of being used for its original
intended purpose or some other reasonable purpose.
D. The object is left, placed or stored in a manner which appears likely to cause injuries
§ 178 -3. Standards for grounds and exterior property.
It shall be the duty and responsibility of all owners of property in the City of Ithaca to ensure
that:
A. All grounds on the exterior of the premise are kept free from solid waste and any litter
that has been cast, blown, thrown, put, placed, or accidentally dropped on the grounds,
bushes, or in trees, and allowed to remain on the grounds, bushes, or in trees for 48
hours, is removed. [Amended 2 -5 -2003 by Ord. No. 2003 -4; 4 -7 -2004 by Ord. No.
2004 -7; 6 -1 -2005 by Ord. No. 2005 -101
B. All garbage, when stored outside, is completely contained in nonabsorbent, watertight,
durable containers having a tight- fitting lid in place. Plastic bags are not considered
durable containers. Strong, waterproof plastic bags may be used to place garbage at the
curbside on the evening before scheduled collections or may be taken to an approved
refuse disposal sight. Garbage containers, whether they contain garbage or not, shall have
a tight - fitting lid in place at all times. Tight - fitting lids shall be placed back on all
garbage containers as soon as possible after garbage collection and, in any event, on the
same day as collection. Any garbage remaining after scheduled pickup must be removed
from curbside as soon as possible after garbage collection and, in any event, on the same
day as collection. Garbage containers shall not be stored in front yards or any other yards
that have frontage on a public street unless all yards on the property have frontage on
public streets. Prohibited storage areas include the area between the sidewalk and curb.
Composting materials, so long as they are maintained as defined by this section, shall not
be considered garbage. It is presumed that the contents of any garbage bag or plastic bag
or garbage can is garbage. [Amended 4.7 -2004 by Ord. No. 2004 -7; 9 -1 -2004 by Ord.
No. 200415; 6 -1 -2005 by Ord. No. 2005 -10]
C. Solid waste, other than garbage stored in proper containers and in the locations described
above, and other than recyclable materials stored in accordance with § 178 -3K below, is
not stored in the public view, except that construction and demolition debris related to an

ongoing construction project with a valid building permit may be stored in the public
view for not more than 30 days. Reusable household discards may be placed at curbside
on special scavenger days designated by the Department of Public Works, but unclaimed
discards must be removed by the property owner by the deadline set by the Department.
Residents may place reusable materials on the tree lawn for purposes of informal
scavenging, not to be observable for more than two successive days. [Amended
6-1 -2005 by Ord. No. 2005.101
D. No more than one unlicensed motor vehicle may be stored in the public view in a side or
a rear yard, and such storage shall be in compliance with § 325 -20. If there is no side or
rear yard, one unlicensed motor vehicle may be stored in the front yard in compliance
with § 325 -20. However, this section shall not apply to a motor vehicle which constitutes
solid waste as defined in § 178 -2 above, nor shall it apply to licensed car dealers in
nonresidential zoning districts.
E. Grass, weeds or other vegetation on grounds and exterior property are maintained so that
the height of the vegetation is limited to ten inches, except for trees, bushes and other
vegetation planted, maintained or kept for some ornamental or other useful purpose.
Natural woodlands shall be considered an ornamental or useful purpose. Premises
situated at street intersections or on curved streets shall be kept in such condition as to
give a clear and unobstructed view of the intersection or curve. [Amended 2 -5 -2003 by

F. The area along public rights -of -way adjacent to or on the property, including but not
limited to the area between the front property line or sidewalk and the curb or street
pavement, is maintained in a reasonably clean and sanitary condition free of garbage
and/or solid waste, with any grass, weeds and brush in said area cut or trimmed in
compliance with § 178 -3E above. The planting of annuals and perennials in these
sidewalk areas shall be allowed, but the planting of trees or shrubs in these areas shall
not be permitted without the approval of the Superintendent of Public Works. Premises
situated at street intersections or on curved streets shall be kept in such a condition as to
give a clear and unobstructed view of the intersection or curve.
G. Trees, shrubs or other vegetation are pruned such that they will not obstruct the passage
of pedestrians on sidewalks. The maintenance of City trees, including trees between the
sidewalk and curb, must be left to the Department of Public Works.
H. Fences and walls are maintained in a safe and structurally sound condition
1. Steps, walks, driveways, parking spaces, and other similar paved areas in sidewalks,
driveways, and tree lawns are maintained so as to afford safe passage under normal use
and weather conditions. [Amended 2 -5 -2003 by Ord. No. 2003 -4]
I. Sidewalks; snow and ice. [Amended 12.7 -2005 by Ord. No. 05 -25; 2 -6 -2008 by Ord.
No. 2008 -1]
(1) Sidewalks shall be free from snow and ice for the full paved width of such
sidewalk, except within 24 hours after the beginning of a snowfall. Failure to
comply shall be punished as provided in § 178- 10A(2). Each day that a violation
continues shall be considered a separate offense.

(2) For properties that abut the intersection of two streets, the sidewalks shall include
that portion of the sidewalk that runs to the curbline of any street and shall include
any access ramps therein. (See § 285 -5.)
(3) When snow and ice on any sidewalk within the time period specified in Subsection
J(1) above is frozen so had that it cannot be removed without injury to the
sidewalk, it shall, within the time specified in Subsection J(I) above be strewn and
kept strewn with ashes, sand, sawdust or other suitable material, so as to be no
longer dangerous to life and limb. As soon as practical thereafter, the sidewalk
shall be completely cleared of snow, ice and other materials strewn thereon, as
provided in Subsection J(1).
(4) Whenever any sidewalk is not kept free from snow and ice as defined in
Subsection J(1), the Superintendent of Public Works or his or her designee may
clear the sidewalk so that it is free from snow and ice and shall notify the City
Chamberlain of the expense incurred by the amount of labor equipment and
materials used. The minimum charge shall be $50. The City Chamberlain shall
promptly present to the owner of any parcel so cleared a bill for the removal of
snow and ice, as certified by the Superintendent of Public Works. If not paid
within 30 days, the cost thereof shall be assessed against the property, added to its
tax and become a lien thereon, collectible in the same manner as delinquent City
taxes. Appeals from this section shall only be permitted if written notice of appeal
is received by the Ithaca City Clerk within 45 days after the mailing of the bill
from the Chamberlain, and such appeals shall be taken to the Board of Public
Works.
K. Recycling containers and recyclable materials shall not be stored in front yards, or any
other yards that have frontage on a public street, unless all yards on the property have
frontage on public streets. If recyclable materials are stored in plastic bags, such bags
must be made of clear plastic. Recyclable materials placed at curbside before a scheduled
collection may not be in plastic bags. This prohibition against the use of plastic bags at
curbside shall not apply to collectible yard wastes m long as the provisions of Code
§ 196 -3C(1) are met.
L. All provisions regarding dumpsters set forth in Code § 325 -29.3 are met
§ 178-4. Standards for exterior structures.
It shall be the duty and responsibility of all owners of property in the City of Ithaca to ensure
that:
A. Exterior structures are kept free of garbage, unless stored and completely contained in
durable, nonabsorbent, watertight containers having a tight - fitting lid in place. Plastic
bags are not considered durable containers. It is presumed that the contents of any
garbage bag or plastic bag or garbage can is garbage. [Amended 4-7 -2004 by Ord. No.
2004 -71
B. All construction and demolition materials and debris, related to an ongoing construction
project with a valid building permit, is located on exterior structures or in yards and in

public view for no longer than 30 days. Materials that are not part of a valid constmction
project authorized by a building permit shall not be stored in public view and shall be
deemed solid waste for the purposes of this chapter. [Amended 4-7 -2004 by Ord. No.
2004.7]
C. Any exterior stmctums that are defaced with graffiti do not remain so defaced for a
period longer than 20 days, provided that, if the subject graffiti can reasonably be
interpreted as being hateful or derogatory towards any person or any group of persons by
virtue of their actual or perceived race, color, religion, age, disability, marital status,
sexual orientation, military status, or national origin, then the property owner may
request that the City remove the graffiti at no expense to the property owner.
D. No furniture shall be permitted on any roof that has not been specifically designed for
occupancy and does not have guardrails meeting the State Building Code requirements at
the time of construction. Roofs shall be kept free of solid waste.
§ 178 -5. Responsibilities of agents delegated by property owners. [Amended 4-7 -2004
by Ord. No. 2004 -7]
Property owners who do not reside in Tompkins County or one of its contiguous counties
must file an agency agreement with the City Building Department designating an agent to be
responsible for all of the responsibilities outlined in this chapter, and to accept service of
process on behalf of the property owner. Property owners residing within Tompkins County or
one of its contiguous counties may delegate the responsibilities outlined in this chapter to an
agent so long as, at the time of any violation of this subsection, an agency agreement is on
file in the City Building Department. The property owner and agent shall both be liable for
violations of this chapter, and the City may bring an enforcement action against either the
property owner or agent, or both. If a property owner who does not reside in Tompkins
County or one of its contiguous counties fails to file an agency agreement with the Building
Department within 60 days of the effective date of this chapter, or if the agent designated does
not accept service or denies agency, then the City Clerk shall be deemed to be the owners
agent for the limited purpose of accepting service of process on behalf of the owner and
service by mail shall be deemed complete upon mailing by first class mail in the name of the
owner to the address of the property. All agency agreements shall be in the form specified by
the City Building Department and shall contain at a minimum the following information: the
identity of the owner and the agent, the owners and agent's addresses and current phone
numbers, the property or properties the agent is accepting responsibility for, the beginning and
ending date of the agreement, and the signatures of both the property owner and agent, along
with each party's date of birth. The agent must be a resident of or maintain business in
Tompkins County. Post office boxes will not be accepted as addresses for agents. The owner
shall be responsible for informing the Building Department, in writing, of changes to the
owners and agent's addresses and telephone numbers that occur after the owner files the
agency agreement with the Building Department. The property owner may not designate a
residential tenant as the agent pursuant to this section, except where such designation is
contained in an employment agreement between the property owner and the tenant. The
employment agreement shall not be contained in the lease agreement between the property
owner and the tenant, and the tenant's acceptance of designation as the agent shall not be a
condition of the lease agreement.

§ 178 -6. New construction.
For new construction of multiple dwellings, commercial buildings, and office buildings,
facilities for the storage and collection of solid waste and recyclable materials shall be subject
to and meet the requirements of Code § 276- 7A(12).
§ 178 -7. Notification when City intends to correct violation; snow or ice and graffiti
removal; hearings for contested notices or billings; failure of property owner to comply.
[Amended 2 -6 -2008 by Ord. No. 2008 -1]
A. Except as otherwise specified in this subsection, in any case in which the City intends to
correct a violation of this chapter and then bill the property owner for the correction of
the violation, the Building Commissioner or his/her designee shall notify the owner of
the property and, where relevant, the registered agent who has assumed responsibility as
outlined in § 178 -5 of this Code, in writing, of any violation of this chapter.
B. In the case of a violation of § 178 -31 (i.e., failure to clear snow or ice from a sidewalk),
notice of such violation or of the City's intention to remedy the violation shall not be
required prior to the clearing of such snow or ice by direction of the Superintendent of
Public Works, as provided for in § 178- 3J(4); in that case, the bill for such clearing from
the City Chamberlain as provided for in said subsection shall constitute notice of the
violation and shall also state that the property owner may contest the billing by making a
written request for a hearing before the Board of Public Works in the manner provided
for below.
C. Any other notice required by this section shall be served in person or by mail to the
address appearing on the City tax roll, requiring such person, within a time specified in
such notice but in no event less than five days from the service or mailing thereof, to
comply with this chapter and to cause the grass, brush or solid waste to be cut back or
removed or, if graffiti, to have the same removed so as to comply with this chapter. In
the event that graffiti removal is ordered during the winter months, then, upon receipt of
a written request from the property owner or agent within the time specified in the notice
for removal, the Building Commissioner may, in his or her discretion extend the
compliance period. Such notice shall also state that the property owner may contest the
finding of the Building Commissioner by making a written request to have a hearing on
the matter held at the next regularly scheduled meeting of the Board of Public Works.
D. Any request for such a hearing must be mailed and postmarked or personally delivered to
the Building Commissioner within the five -day compliance period (or, in the case where
the City has billed the property owner for removal of snow or ice from a sidewalk,
within five days of the mailing of such bill), and any such written request for a hearing
shall automatically stay further enforcement concerning the alleged violation pending
such hearing. The decision of the Board of Public Works, by majority vote, shall be
binding, subject to any further judicial review available to either the City or the property
owner.
E. Upon the failure of a property owner to comply with the requirements of § 178 -3J of this
chapter, or with the notice of violation of any other provision of this chapter (or,
alternatively, to request a hearing as aforesaid within the time limit stated in such notice,

or upon a Board of Public Works' determination, after such a hearing, that a violation
exists), the Building Commissioner shall refer the matter, by memorandum, to the
Superintendent of Public Works, who shall cause such premises to be put in such
condition as will comply and shall charge the cost thereof to the owner of said premises,
including a charge of 50% for supervision and administration. The minimum charge to
the property owner for such work shall be $50. Bills rendered for such services shall be
handled in the manner prescribed by § 178 -3J of the Code.
§ 178-8. Board of Zoning Appeals exemptions.
In cases where the Board of Zoning Appeals finds that a property is of such size or of such
topographical characteristics as to make compliance with this chapter impractical or a
financial hardship to the owner, the Board may grant an exemption (or a partial exemption to
the extent dictated by the special circumstances) from the requirement_ Similarly, if the Board
finds that there exists a situation involving desirable plant species or animal habitats deemed
worthy of preserving, it may grant an exception from the requirements.
§ 178 -9. Liability for area between sidewalk and curb. [Amended 2 -5 -2003 by Ord. No.
2003 -4]
Property owners shall be liable for any injury or damage resulting from or caused by reason
of omission, failure or negligence to maintain the area between the sidewalk and the curb of
the street in the manner described in § 178 -3F and to maintain steps, walks, driveways,
parking spaces, and other similar paved areas in sidewalks, driveways, and tree lawns in the
manner described in § 178 -31.
§ 178 -10. Enforcement. [Amended 12 -7 -2005 by Ord. No. 05 -21]
A. Civil penalties.
(1) Any property owner and/or agent who violates any provision of this chapter or of
§ 325 -29.3, except those provisions specified in Subsection A (2) below, shall be
liable for a civil penalty of $50 for the first violation at a property within a
twelve -month period, $200 for a second violation at the same property within a
twelve -month period, and $300 for a third or subsequent violation at the same
property within a twelve -month period.
(2) Any property owner and/or agent who violates any provision of § 178 -3E, G, 1 or
J, or any of the provisions in § 178 -31F regarding grass, weeds, brush, plantings, or
obstruction of views, shall be liable for a civil penalty of $40 for the first violation
at a property within a twelve -month period, $60 for a second violation at the same
property within a twelve -month period, and $100 for a third or subsequent
violation at the same property within a twelve month period.
(3) Each violation of this chapter or of § 325 -29.3, and each day during which a
violation continues, shall be deemed to be a separate violation.

(4) The City Attorney or his or her designee may commence an action or special
proceeding against the violator in a court of competent jurisdiction to collect these
penalties, together with costs, disbursements and recoverable attorneys' fees, and/or
to compel compliance with or restrain by injunction any such violation.
(5) When the City Attorney obtains a judgment in an action or proceeding under this
section either against the property owner or agent, or both, in addition to the
appropriate methods for enforcement of judgments established in the Civil Practice
Law and Rules, such judgment for penalties may constitute a lien, be a lien on the
subject property and on the rents therefrom, or may be collected in the manner of
any other civil judgment.
B. Appearance tickets and appeals. Notwithstanding any contrary Code provision,
appearance tickets may be issued by the Building Commissioner and/or Commissioners
designee(s) charging violations of this chapter or of § 325 -29.3 whenever there is
probable cause to believe that said violations have occurred. Any rights to administrative
appeals to any board or commission of the City of Ithaca mentioned elsewhere in this
Code shall not apply as a condition precedent to issuing an appearance ticket charging a
violation of this chapter or of § 325 -29.3. Any right to an administrative appeal from a
decision or determination of the Building Commissioner or other City official with regard
to the above Code chapter and section shall apply only in cases in which the City intends
to correct the violation and seek to charge the property owner or agent for the costs of
correction.

This letter is a follow up to your request of April 6, 2011, to have horses in Stewart Park
for pony rides provided by Painted Bar Stable on Sunday, June 5, 2010, for the Ithaca Festival.
As you know, the Board of Public Works discussed your request at their meeting on April 13,
2011. Since last years inclusion of these rides as part of your event appears to have been
successful and trouble free, I am granting permission under Section 336 -12 of the City Code
with the following conditions:
1. Painted Bar Stable provides a certificate of liability insurance to the Superintendent of
Public Works listing the City as additional insured;
2. A plan for restoration of the lawn is provided to the Superintendent should the horses
damage the lawn /sod in any way;
3. A plan for prompt manure removal is also provided to the Superintendent; and
4. Information is provided to the Superintendent explaining the stable's experience in
providing pony rides in crowded locations, away from their home stable.
In addition, please see that the areas in use are left in the same or better condition than
that in which they were found, as is consistent with your Special Events Agreement with the
City. In future years, you may include this request in your Special Events Application, if you
wish. By copy of this letter, 1 am alerting the Mayor, the City's Parks Division, the Police and
Fire Departments of this request.

RE: Chapter 170, Sect. 170 -5E, City Code
Dear Alan:
Per the above -noted section of the Ithaca City Code, I hereby grant permission to the
Ithaca Asian American Association (IAAA) for temporary use of the southern most dock at Cass
Park for up to twenty (20) days, effective Saturday, April 16, 2011. The following conditions
apply:
• The IAAA agrees to immediately vacate one or both dock faces once the lottery results
for these dock spaces are known, should the IAAA not be awarded one or both spaces in
that lottery.
• The IAAA acknowledges that the premises being utilized by IAAA is a public park and
that, as such, the City cannot and does not offer exclusive use to the IAAA. The general
public may use the dock for their owner recreational purposes, such as walking along the
dock or fishing.
• The IAAA agrees to use the premises for no other purpose than to dock its dragon boats
to the dock, launch the boats from the dock, and to keep a small utility cabinet adjacent to
the dock for storage of equipment. The IAAA agrees to equip the boats and storage
cabinet at its own cost and expense, and accepts full responsibility for disposal of trash
generated on or in the vicinity of the dock and will remove all trash at its own expense.
The IAAA shall obtain liability insurance in the amount of one million dollars
($1,000,000) and shall add the City to said liability insurance policy as an additional
insured during the period of this permit. A copy of the Certificate of Liability Insurance
must be sent to the Superintendent's Office and will be made part of this permit.
The IAAA agrees to defend, indemnify, and hold the City harmless from any and all
claims of any nature whatsoever arising out the IAAA and the Dragon Boat Club's use of
the area
