Thorne, Superintendent of Public Works The City's new Superintendent of Public Works, Mike Thorne, will attend his first Board of Public Works meeting. Enclosed is Mike's resume to provide some background information of his experience and education. He has jumped in feet first this first week with the ice jams in Cascadilla Creek and kept his head above water (pun intended!). Staff looks forward to working with Mike as he learns the City's policies and procedures. 7.1 Public Comment Regarding the Proposed Street Vending Policv This is the second of two public comment meetings regarding the proposed food truck/mobile vending policy. A Board discussion will follow the public comment period. 9.1 Appeal of Water Bill for 800 South Plain Street Ithaca Housing Authority has submitted an appeal of a recent water bill for 800 South Plain Street. This property contains two meters: a larger, high flow meter, and a smaller, low flow meter. Staff recommends a credit to this account because the flow test of the low flow meter showed the meter was not working properly, and the meter readings that were taken by computer and manually were inconsistent. 9.2 Request for Volunteers to Participate in the Sidewalk Past Work Credit Review Committee The new Sidewalk Law has gone into effect and our office has started receiving applications for past sidewalk work credit. There have been a few incidences where the application has been denied already. The City has an appeal process that the applicant can utilize through the Board of Public Works. Tim Logue is asking for volunteers from the Board to participate in the appeals committee, along with staff. Plain Street Aeet #: 5507732800 After performing a flow rate test on the low flow (1 inch) meter for this account, we found it to have a weighted average of 94.5 %. Slightly below the AWWA standards. We then started to compare the hard read to the computer reads. The hard reads where from visual inspections at various times over the last four years. A difference of 2494 HCF was found that was a consistent difference for the last several years. As per past procedure when a meter is changed out the hard read is used. This reading caused the exceptionally high September bill. As this discrepancy occurred several years ago and no way of discovering hov4I propose the following. The September bill is recalculated for 542 units. This would be a credit applied to the account for $19,053.6o. Respectfully, Barbara G. Plain Street. On the attached 10/21/2013 invoice the Ithaca Housing Authority was billed $24,654 for a reading of 2,407 units, which upon examination, is five (5) times higher than the usage indicated by the meter on the previous twelve readings. We paid the billed amount on September 27th with check #7031. We requested an investigation, and upon examination, it was determined that the meter was faulty; it was subsequently replaced on October 30tH We took meter readings every several days during the two (2) weeks following the new meter installation and verified that the reading on October 21st was in error. Please refer to the attached summary of meter readings taken just prior to and following the new meter installation. Based on this data, we have concluded that since the meter was replaced, we should have been billed for approximately $6,108 instead of the $24,654 that was on the October 21st invoice. We are formally requesting a correction of $18,546 on our account either in the form of a credit to the account or by issuance of a check for the same amount made payable to the Ithaca Housing Authority. One of the components of the law is that property owners are allowed to apply for a credit against the assessment based on past work on sidewalk construction or repair. We are processing these applications and there are a few cases where we feel we have to deny the application in accordance with the law, but also, in accordance with the law, the Board of Public Works might be willing to grant an appeal. For example, in one case, a contractor applied for a permit on behalf of the homeowner, and we verbally approved the work and had the permit ready to issue, but the contractor did not actually pay for or sign for the permit - meaning the permit was never actually issued. The contractor chose to proceed with the work. We don't have an issue with the work itself. However, according to the law, the homeowner is not eligible for the past work credit because no permit was issued. We should deny the application. On the other hand it seems a little unfair to "punish" the homeowner because of the contractor's poor choice. So far, with about 30 applications submitted, we have 2 or 3 possible appeal cases. We are expecting about 100 total applications to be submitted by the February 1st due date. I would like to create a little committee of one or two BPW commissioners and a few staff in order to review such cases and to prepare a recommendation to the Board for these appeals. I think committee discussions would make for a more efficient use of the full Board's time during your full meetings and allow us to fully debate the pluses and minuses of different types of cases. I am not able to make the meeting on Monday, but I believe Tom or Mike will be able to take a couple volunteers. I am thinking the commitment will be three meetings in February and /or March of about two hours each. The full Board should be hearing the appeals in March and early April.
