A number of citizens and other public officials T•rere also present.
Mayor Shaw opened the l;ieeting for the transaction of such business
as might properly come before the Council before final adjournment.
He then addressed the Council and visitors and expressed his
appreciation for the cooperation of the officers and employees of the
City and of the many citizens T►ho have given much time and thought to
city affairs, and expressed the hone that such cooperation and
support Tloulcl be continued.
He then addressed 1'ayor Cook and T-rith appropriate remarl-s tendered
him the l•:ayors badge of authority as head of the Police Department,
and the gavel as a symbol of his authority as Chairman of the Council,
and other Boards.
In accepting the Symbols of Authority Mayor Cook pledged his be
efforts for the continued efficiency in the conduct of city affair
and recognized the talents and faithfulness to duty as shoTTn by
lv ayors previously holCdna the office.
He thanked retiring Alderman P_acDaniels, Hulse, Button, Hall,
A arsons and expressed the hope that the ne- Council T-►ould. Ttork
toether for the continued best interests of the City.
He then took his seat as Chief Executive of the City and called
she new Council to order.

for the position of City Chamberlain for the term ending December 31,
1955. There being no further nominations, it T-ras regularly moved
seconded and carried that Alderman Adams cast 1 unanimous vote for
her election to the position, and she was declared duly elected.

present agreement, the First National Bane iB required to deposit
q200,000.00 in approved collateral to secure deposits and the
Tompkins County Trust Co. is required to deposit w300,000.00. He

First National Q200,000.00 in U.S, Treasury Bonds and 4p,1,4600000.00
in U.S. Treasury Bonds in a safe deposit box in the Tomn'_;ins County

He further reported that these changes affecting employees
under the Board of Public Works have been discussed and approved by ,
the Board, and that on recommendation of the Committee, the Board
also approved the following change in the Compensation Plan covering
the position of principal Clerk.

that at the time the 1leT-! Compensation schedule -as prepared that it
was understood that the salary of w6000.00 authorized for H.C.Thorne
would cover the part time duties as Building Commissioner as well as

ROGER BAIFIELD DEATH Alderman Holman called attention to the death
of Roger Banfield-T•ho has served faithfully in the Fire Department
for 3 years, and ,.rho 1-Tas respected and admired by all -Tho knew him.
Mayor Cook suggested that a suitable resolution be spread upon
the Minutes of this Feeting and a cony sent to Yrs. Banfield.

'THEREAS, 1're, the members of the Common Council of the City of
Ithaca, are deeply grieved to learn of the passing of Roger Banfield,
and
f IREAS, we, the members of the Common Council, as represen-
tatives of all the people of Ithaca, ,,Tish to express our sympathies
at this time.
NOW,THEREFORE, BE IT RESOLVED;
That this Common Council hereby records its deep sorroT-T and
regret at the death of Roger Banfield. He leaves behind him
memories long to be cherished by all t-rho knelt him; his devotion to
duty, his friendly nature, and his love of children will long be an
inspiration to other citizens of Ithaca.. His passing removes from
our City one of our finest public servants.
AND BE IT FURT14ER RESOLVED:
That a copy of this resolution be spread upon the minutes of
this Common Council and that a copy thereof be sent to his widow.
FIRE UQMMISSIONER Alderman Holman reported that the Committee on
relations f-rith the Fire Department unanimously recommend the
appointment of Raymond 'heaton to the office of Fire Commissioner
to succeed Louis E. Cool.
The T;ayor thanked the Committee and assured them the
recommendation tTould receive consideration.

The single matter cleared up at the conference s-ras that this
is not a part of the neT•r State Building Code, as many had
thought. The Code Commission still plan, I believe, to draft
Part II of the State Code, under the name of MULTIPLE D!1'EL•LIFG
LA.. But they aid not draft this MULTIPLE RFSIDE��CE LA':T. It
is entirely separate, overlapping, and in a measure contrary
to the aims of the Code Commission. No v,ronder there is con-
fusion.
I T,ras informed in Albany last Friday that the Eitchell Committee,
sponsors of the ne- la',, travelled during 1950 and early 19510
holding so-called "hearings" throughout the state. I T,Tas given
to understand that some of this Committee and our former Yayor
had a meeting at the Ithaca Hotel, but I have not verified this.
Certainly nobody in the Building Dept., or concerned T•rith the
various phases of building inspection had any notice of such
4hearings'', or information that such laT•rs T•*ere contemplated. It
Trould seem that such a vital and far-reachinFr subject should have
had the ?•Tidest publicity. And the lack of publicity and local
study creates a truly alarming situation.
Besides our oT-rn concern in the matter, you Trill also find concern
and resentment among Plumbing Inspectors, Fire Chiefs and other
enforcing officers, not only here, but over a ,ride area. The
full implication of the lai-r cannot be understood until it is
put to test, of course, but advance study of it convinces us
that i,<r -Till nearly, if not quite, double our ,,ork of inspection,
that it T-Till entail a great deal of unproductive paper. -'work,
that much needless hardship T.TIll be imposed upon OT•Tners of
dT•rellings almost a.nyrhere, housing more than V-To families. The
neT•r la- applies to the entire state, both city and county, •Tith
the exception only of NeT-r York City and Buffalo.
The felling among delegates to the conference T-Tas that the total
effect of such a 19.7- is to greatly deprive localities of the
privildge of Home -rule T,rhich they feel is their right, and
greatly increase the 'cork and cost of administration, ,-rithout
corresponding improvement in conditions.

-Gentlemen:
On February 6,7,8, I attended a meeting of the historians of the
state held In cooperation 'i-Tith the Association of Tolms. The emphasis
in outlining the duties of local historians, eras placed on the
(protection of records.
Since returning, I have made an inspection of the records of the city,
suplementin� an inspection which I made some years ago 14hile State
Supervisor of Public Records. The principal records are housed in
the municipal building and the library building. According to the
Chief of the Fire Dept the burning of the Municipal building 'vrould
create a 2 to 22 hour fire, the library building a 3 to 4 hour fire.
The vault in the Municipal building is partly outside the main
structure has double steel doors. It is possible that this vault
't-ould protect ist contents in a. V-ro hour fire especially since the
fire department is so near. The so called National Bank vault in
the office of the City Chamberlain Is,, -tell constructed but its
location T,ould subject it to an intense heat for a long period,. The
result of a total fire could mean the destruction of valuable records,
All other safes in ure by the city are -,-*holly inadequate in the
protection of their contents. The most serious condition is in the
office of the City Court There the safe is out of order,the door
cannot be closed and there is little protection of the records

Recently, unsuccessful searches have been made for historical
records. These records are probably stored in boxes or packages in
corners of attics or basements, unprotected
The cost of proper equipment to protect the records of the city in
the present t•rooden structures t-rould be so large that it is not
advisable at this time. Also, practically the same condition
exists in the other sub- 01visions of the county. I therefore
suggest that a committee of officials of the City of Ithaca confer
I•rith the Board of Supervisors and propose that the office of
County Clerk be provided 'pith an outfit for microfilming records
and that arrangements be made by '-hich important records of the city
be taken at frequent intervals to the court house, microfilmed and
returned. The microfilms to be retained in proper protection for use
of the City of Ithaca
When such arrangements have been made I suFgest the follo,ring Man
for protection of the records of the city.
That all city records be divided into three classes
1. All useless records.. That application be made to the proper
state department for permission to destroy them
2 Records which may be needed for future reference. These to be
microfilmed. The microfilms protected in the court house and
the originals placed in class I.
3 All important records. These to be microfilmed. The microfilms
kept in proper protection in the court house and the originals
returned and there given proper protection

T INUTES Minutes of the preceding Yeeting �-rere duly approved.
DE' -''ITT HISTORICAL SOCIETY Mr. Glen Norris, representing the
DeWitt Historical Society together with several directors, ?•sere
present and requested the Council to appropriate funds to carry
on the t,rork of the society.
He stated that since the death of Yrs. Smelzer ,-,ho served
as Curator without pay, the Society is left in a difficult
position, and that it will be possible to secure the services of
a retired school teacher to serve as Curator provided funds are
available.
He requested the City to appropriate r3750.00 and stated that
the County will be requested to provide a similar amount
City Historian Stevens called attention to the educational
features connected T-pith the Y useum maintained in the Old Court
House and recommended Council approval of the request.
The Mayor promised due consideration and referred the
Matter to the Finance and County Relations Committees for
consideration.
6 FIRE STATION The Clerk reported that on recommendation of
the Buildings and Grounds Committee, the Board of Public `Jorko
has approved the plans for the #6 Fire Station and recommends
that construction be started this Fall and ".'inter, folloT.Ying the
general plans prepared by the Architect.
Alderman Holman reported on the 17eetings T-rith various
interested Committees and stated that general approval of the
plans was expressed and it -,-as moved,

to officially approve the budget, fix the tax rate, levy the
taxes and make appropriations.

clerk shall prepare a -t-yarrant on the City Chamberlain for the
collection of said levy, and the Mayor and City Clerk hereby are
authorized and directed to sign and affix the Corporate Seal to
such warrant and forthwith to file the same T•iith said Roll j•rith
the City Chamberlain, and
BE IT FURTHER RESOLVED, that upon the execution and filing
of said warrant and tax roll T,rith the City Chamberlain, the
amounts of the City Tax set opposite each and every property shall
thereby become tax liens, due, payable and collectible in accor-

SALARY RANGE - SUPT. OF PUBLIC WORKS Alderman Hall reported
that four mem ers of the Finance Committee met and discussed the
Y,atter of amending the Compensation Plan in regard to the salary
range for Superintendent of Public Works and the immediate
Increase in salary of the Present incumbent to ",?'10,500.00 as
requested by the Board of Public 11orks.
He stated that the committee members present T•tere agreed
that the salary range should not be changed at this time but
did agree and recommend that the salary for Superintendent of
Public 'lorks be raised to the maximum of the present range, and
it was moved,

the Board of Pubic Works has considered at length the petition for
the annexation of the Pyle property adjoining the east city line

pr-unosed agreement between the City and Board of Education covering
u-e of City Agencies and facilities for the collection of school
taxes and for approval of the appointment of the City Chamberlain
as Treasurer of the City School District. He stated that the
agreement provides for an annual payment of 3138.50 by the school
district, an increase of "745.90 over last year.

,-ould like to get the unclaimed bicycles that have been collected
by the Police Dept. for use by underprivileged children. He
stated that several cities have been Contacted and it has been
found that the City may adopt an ordinance permitting disposal of
such property for charitable purposes or sale at auction.
The Mayor referred the Matter to the Charter .& Ordinance
Committee to T-rork frith the Youth Bureau and City Attorney in the
preparation of such an ordinance.
APPOINTMENT- CIVIL SERVICE COMMISSIONER The Payor announced the
appointment of Mrs. Elizabeth N. Albright to the position of Civil

a reduction in funds would necessitate the preparation of nell
plans, an added expense, and that a smaller building l-rouldrnot
adequately Accomodate anticipated future use of the building.
Alderman Dickens expressed the opinion that the original plans
should be approved and accepted and the building erected as soon
as possible.
Upon quostioning,..Chief Travis stated t1at in preparation of the
plans duel consideration liras given to probable future needs as t,►ell
as for present needs and that only necessary installations were
Included in the plans.
Fire Commissioner Clapp urged approval of the plans as prepared
and called attention to the conditions of ,the present building and
the need of more adequate facilities.
After: further discussion the City Attorney ruled that it 1^rould
be proper to vote on the original resolution approving construction
of the building from plans approved by the Committee and
appropriating 522,182.00 from Contingent Funds 14hieh together frith
$44,318.00 in Capital Reserve Fund #2 11111 provide w66,500.00 for

public intoxication, both (flied -Ithin a few hours after release,
from causes having no bearing on the use of intoxicants.
The Commission urges that, for the protection of the prisoner
and also for the protection of those responsible for his detention,
every person to be detained for public intoxication be given a
medical examination as soon as possible after arrest.

to emergency in the Fire Department due to the critical illness of
Assistant Chief Herman C, Frantz, and stated that the Committee
recommends the appointment of a 2nd. Assistant Chief in the Depart—
ment.
He stated that since the Charter does not provide for such an
afficer the Municipal Civil Service Commission *ill not hold an
examination for the position until Charter Amendment,
Mr. Clapp, Chairman of the Fire Commissioners explained the
seriousness of the situation and requested the Council to
authorize a temporary appointment at a salary range of �,3800.00—

shoot on the nell rifle range in Burns Road ?rill be held Friday

recent publicity relative to ball playing in De?Fitt Park and
expressed the opinion that it should be stopped.

It was reported that the Board of Public 111orlcs has agreed to defer
its decision on requests for increases pending the establishment
of a policy by the Common Counoll on 1•rages and salaries in all
departments and unanimously ad;_o ted the follotring resolution.
"RESOLVED, that this Board rrespeetfully request that employees
under the Board be given the eAme consideration as all other
employees as regards salaries, "rages, vacation and other similar
benefits."
The Mayor gave the Aldermen opportunity to ask questions in
regard to the requests and called upon Department Heads present to
further explain their requests,
Police Commissioner,Powers, Chamberlain Lull, City Judge Casey
and Fire Commissioner Clapp responded and I'r. Clapp stated that
the Fire Commissioners are sympathetic ,,ith the request filed by
the Paid Firemans Association and recommend, that the Chiefs
salary be increased to �5000.00
Alderman 14ilkinson took exception to the thought that salaries
and wages are subordinate to other finances of the City and
expressed the opinion that the questions involved are too big for
the Finance Committee alone.
The Yayor announced that the requests trill be turned over .to l-x-
Finance Committee which he is confident can and till make definate
recommendations to -,the Council.

of meetings of the Committee during -budget _preparation and that

removal, ho,Tever, to take place only upon approval
by the mayor of the findings of said boards Any
member of the Ithaca Fire Department so appointed

of any company of said department.

HISTORY OF MAYORS City Historian Stevens T-ras present and reported
on the progress of T-rork on the "History of I:ayors" Trhich he has

1. Should the idea be expanded to include any other city officials
2. Funds for salary of a part time Stenographer
Mr. Stevens stated that increased duties in the Youth Bureau
mares it difficult to use the services of the Stenographer from
that department, and suggested that authority be given to hire a
part time Stenographer at 15.00 per Treek.

BUS SERVICE - SOUTH CENTRAL AREA A letter from Langford F. Baker,
President of the Titus Area Civic Organization 'tTas presented
requesting cooperation in bringing; about bus service to the South
Central area of the City.
The Mayor stated the matter would be considered later in the
meeting when the report of the Mass Transportation Committee was
discussed.
SPCA - REQUEST FOR FUNDS A letter from the officers of the SPCA
Trras presented setting forth the financial situation of the society
and requesting the City to appropriate `1500,00 annually to the
society.
Alderman Porter suggested that a special committee be appointed
to consider the matter of care and licensing all domestic animals
kept in the city.
The Mayor appointed Alderman Porter, Scott and Decker to the
special committee and referred the matter to that committee and the
finance committee.
DOG CENSUS A letter from Tars. Frederic?. Solmsen, President of the
SPCA -was presented suggesting that the society T.*ould be T-Tilling to
ta'e over the enumeration of dogs this year.
The matter was referred to the special committee,
AM ISTICE DAY APPROPRIATION A letter from i`,r. `.f alter S. !Toolf,
Chairman of the Armistice Day Committee 1-Tas presented tha.niking the
City for former appropriations of 250.00 and- requesting that
4500.00 be appropriated for the year 1953.

DE vITT HISTORICAL SOCIETY APPROPRIATION_ A letter from 71. G.
Norris, President of the DeWitt Historical Society was presented
thanking the City for the appropriation of �;375.00 for the year
1952 and requesting an appropriation of N750.00 for 1953.
The matter was referred to the Finance Committee.
REPORT - CITY PROSECUTOR A report of the activities of City
Prosecutor Roger B. Sovercool for the period April 1 to August
1952 t,ras presented and ordered filed.
YOUTH BUREAU DIRECTORS MEETING A letter from Edgar D. Sebring Jr.,
Director of the Ithaca Youth 13ureau Teas presented requesting
permission to attend_ a meeting of Youth Bureau Directors to be held
in Albany on 11ovember 18, 1952.

He stated that since the report 14as submitted, Ithaca Railvays
has requested and been granted an increase of 1 cent in fares and
he expressed the opinion that the Public Service Commission should
be requested to hold a hearing on the subject.
The E.a.yor stated that he wrote the Commission on October 22nd,.
requesting a hearing on the matter of fare increase and under date
of October 30th. received a reply stating that after careful
consideration to the requested increase in fare and in vieT.r of
losses noTr bein. sustained by the Company, the Commission ',--ras of
the opinion that the increase should. be granted, but that if the
City desires a public hearing on the increase, the Commisssion will
be glad to consider it.
The matter of requesting a hearing Teas discussed at length but
no action was ta),len.
CITY FISTORIA11 — SECRrTARY The Mayor suggested that action should
ta tahen on City Historian Stevens request for authority to employ
a part time Stenomray-)her to help in the »rena.ra.tion of data for

BUDGET. 1� The Mayor announced that the meeting eras called
primarly to receive the budget requisitions for 1953. He gave those
present an opportunity to speak but announced there T,rould be no
discussion until the requisitions are studied by the Finance
Committee,
Mr. D. J. OtConnor, business representative of the Machinists
Union and Harry Leach, president of the Union requested serious
consideration of taage increases and other benefits -v,rhich have been
previously requested of the Board of Public Iforks and referred to
the Council without action.
Sergeant R. C. Wilkinson of the Police Association spoke in
behalf of the Police Department and urged approval of the request for
an increase of $500,00 for members of the Association.
There being no others present who 1rrished to be heard the Mayor
announced it was in order to refer the budget requisitions to
the Finance Committee and it was moved,

VICIOU_DOGS Mr. Richard L, Pollock of 517 N. Tioga St. called
attention to recent difficulties in reference to a vicious dog
harbored at an address in No Aurora St. He stated that -hile City
Judge Casey states that the dog has been satisfactorily taken care of,
he felt that the Council should enact an ordinance that 't-could force
o-ners to keep vicious dogs off the streets at all times.
The Mayor referred the matter to the Charter and Ordinance Committee
for study and recommendation.
SALARY INCREASE ... FIREI17,Q Driver Herbert Redfield. -Lyon of the Paid
Firemens Assoc, urged he Council to grant the �500.00 increase in
3aiary as requested by letter from the Association, He called
a'i;tention to circumstances that sets this service apart from other
city service,
The Mayor assured Mr. Lyon that every consideration 'r•rill be given
the matter by the Finance Committee and Council.
N. Y STATE ASSESSORS ASSOC MEETING A letter from Assessor Thorne
i=ras presented requesting permission to attend an Executive Board I
meeting of the N. Y, State Assessors Association to be held in
Albany on December 5th. 1952.

COAXIAL ,Is V3 , CABLE LINEQ It was reported that the Board of Public
Works has requested theouncil to enact such ordinances deemed
necessary to permit installation of coaxial cable in city trees and
to protect users in the matter of charges for such service.
The Mayor announced that discussion of the matter T•rould be
limited at this time since it r-Yould be referred to the Charter and
Ordinance Committee for study and prompt action.
Mr,, Taylor of the Taylor and Pierce Co. explained the manner in
t-rhich the cable is installed and that a charge of 6P65.00 plus $200
monthly is made for each installation.
Mr, Don Price of the Electric Co..stated that his Company does
not oppose installation of the cable but feels that precautions
should be taken to protect the city and its citizens. He called
afl-tention to the National Safety Code under T•rhich utilities operate
and offered to cooperate i-Tith the Committee in the preparation of
an ordinance.
Mr. Lee Post of the N. Y. Telephone Co. stated that his company
Is also Milling to cooperate -ith the Committee and T•rith the
television contractors but emphasized the importance of adherence
'co the National Safety Code and offered to provide copies of the
code for the Committee.
He called attention to two installations T,hich have come to his
attention, one where the cable is in actual contact with telephone
lines and another too near a power line
The Mayor assured those present that prompt action ?-could be taken.
rARKING METER CONTRACT The Clerk called attention to the fact that

adjustments for 1953 has not been discussed by the Oommittee and

is of the opinion that any change in the amount of fines for traffic
violations is a matter to be settled by the City Judge and therefore
has referred the matter to him,
He also stated that the suggestion made by Alderman Gallagher that
the prohibition of left turns at all times at State & Cayuga Sts.
be studied has been turned over to the Traffic Engineer for study.
INDONESIAN OFFICIALS The Mayor welcomed a group of government
officials from Indonesia who are in this country to observe our
Democratic government in operation,
Mr, Roosdiono, spokesman for the group, thanked the Nayor for the
opportunity of attending a meeting of the Council and gave a very,
Interesting description of the principals of government in their
country,
LOCAL L&I — RE CITY OFFICERS Alderman Gibson presented a proposed
Local Lary which T•rould restore the custom of choosing Aldermen from
the various Wards.

OF TH^ ITHACA CITY CHARIER
Section 1., Section six of the Charter of the City of Ithaca as
last amended is hereby further amended to read as follo7°rst
06, The Officers of said city shall be as folloTrs: A
mayor, and a city judge, to be elected on a general ticket by
the qualified voters of the city; two aldermen and one supervisor
from each Trard, to be elected by the qualified voters of the cit-y
residing in each T•rard, respectively; a city attorney, a city
prosecutor, a city chamberlain, an assessor, ti-ro associate
assessors, six commissioners of public T,rork, three fire comm—
issioners, a commissioner of buildings, a police commissioner,
such members of the police force, general and special, and such
constables, as in the judgment of the common council may be deemed
necessary, and such officers as are hereinafter, or by the
general laTis of the state, authorized and provided, all of Trhom
shall be appointed by the mayor, except as otherTrise herein or
by said general laT•rs provided, The same person may be so
appointed to hold one or more of said offices at the same time,
A city clerk, a deputy city clerk and a superintendent of public
T•rorks shall also be officers of the city and shall be appointed
by the Board of Public Works, hereinafter provided. Before any
person shall be so appointed to one or more of said offices, the
Common Council, except as otherwise provided. for, shall fix the
maximum rate of compensation to be paid for joerforming the
duties of each of said offices, which maximum rate shall not be
changed during the incumbency of the appointee next thereafter
appointed thereto. The Common ouncil may also, prior to each
of such appointments, prescribe the duties of such officers in
addition to and not inconsistent Trith the duties prescribed by
this act, except as otherTrise provided for; and, subject to such
provisions of the Common Council and to the provisions of this
act, the Mayor shall prescribe the duties and fix the rate of
compensation of all officers appointed by him.

NINUIES Minutes of the preceding meeting were duly approved,
SANITARY CODE — COUNTY HEALTH DIST A copy of a proposed sanitary
code for the Tompkins County Health District r,ras presented together
?•rith a letter from Dr. R.. H. Broad, Commissioner of Health.
The letter requested prompt consideration of the Code by the
Council so that action iTill not be too long delayed.
The matter t,ras referred to -the, Health Committee of the Council for
prompt attention,,
TRANSFER OF FUNDS The Clerk suggested that the sum of '1200.00 be
transferred from budget account ,134, Building Commission to budget
account #111 Assessor since the Assessors account r,Til*l be overdratm
in that amount due to action of the Council in combining the salary
of the Assessor and Building Commissioner under the position of
Assessor.
