=TE CHANGE - b,d. SENECA STREET Mayor Comfort announced that in
accordance with a notice published in the Ithaca Journal on December
14, 21 and 30, 1942, any person interested in the proposed zone
change in W. Seneca Street would be heard at this time. No one
appeared in opposition and it was moved,
By Alderman Adams, seconded by Alderman Rottmann:
Resolved, that the recommendation of the Planning Commission
be adopted; and further that the official zone map of the building
zone ordinance be and the same hereby is amended by a change in the
zoning from "A" Residential to Commercial that part of the north
side of W. aeneca Street, running from Meadow Street on the west to
Plain Street on the east, such area being bounded on the north by a
line one-half way between Seneca and Buffalo Streets; this change
to take effect upon publication.
Carried and Approved by the Mayor.
APPOINTIZNT - CITY CHAMBERLAIN IrIayor Comfort announced that it
would be in order at this time for the Council to appoint a City
Chamberlain in accordance with the provisions of the City Charter.
By Alderman Perry, seconded by Alderman Shurger:
Resolved, that C. A. Snyder be appointed City Chamberlain for
the ensuing term of one year.
There being no further nominations, the motion was unanimously
carried.

REGULAR MEETING DATE
By Alderman Gillette, seconded by Alderman Shurger;
Resolved, that the regular meetings of this Board be held on
the first Wednesday of each month at 5:00 P.M. in the Council
chambers in City Hall. Unanimously Carried and Approved.
Alderman Vail entered the Council chamber at this time.
ACTING MAYOR Mayor Comfort announced that it was in order at
this time to nominate and elect an Acting Mayor.
Alderman Gillette nominated Alderman Gibb.
Alderman Bangs seconded the nomination, and it was moved,
seconded and carried that the nominations be closed and a vote
taken, and Alderman Gibb was declared duly elected Acting Mayor.

-ANNUAL REPORT - DOG WARDEN The annual report of the Dog Warden
rus read by the Clerk.

Resolved, that the report of the Dog Warden be received and
placed on file. Carried.
POLLING PLACE - 16T DISTRICT 3RD WARD The Clerk reported receipt
of a letter from the e-cretary-of the First Congregational Church
advising that the a u:11 ,polling place in that Church would not be
available in the future. .
The matter was referred to Alderman Gillette for attention.
VIE=ARE DEPARTMENT PROPERTY - 423 E. LINCOLN STREET The Clerk re-
purted that at a meeting of the Board of ublic vorks held December
9, 1942 a letter from Welfare Director, John H. Post, was presented
suggesting that the City might want to acquire the property at 423
E. Lincoln Street which has been taken over by the Welfare Depart-
mont.
The letter stated that the property was acquiredat a fore-
closure sale to protect funds advanced to the former owner, and that
tree sum of $935.00 has been invested. Attention was called to the
fact that the porch of the house is partly within the street limit
and while the house can be rented to some advantage, it is badly in
need of repairs.

The Clerk further reported that the Board of Public Works
recommends the purchase of the property and removal of the build-
ing.

Resolved, that the matter be referred to the Committees on
Relation with the Board of Public Works and Board of Welfare for
study and recommendation. Carried.
CITY HALL - HEATING PLANT The Clerk reported that since converting
the City ITall heatIng plant for the use of coal, two sections of
the old boiler have cracked and that it may be found necessary to
replace the entire boiler since it is over thirty years old. The
estimated cost of replacement will be $950.00.
It was suggested that since it may be necessary to place an
order for the boiler at once, that authority should be granted at
this time.

Resolved, that the matter be referred to the Finance Committee
with power. Unanimously Carried.
PROPOSED CHARTER AMENDMENT RE WATER MAIN EXTENSION Attorney Powers
reported that after two or three years efforts, the Board of Public
Works has succeeded in inducing users of water outside the City
limits to form water districts and in recommending the regulation
of future water main installation outside the City, directed him
to prepare a Charter amendment limiting future extensions and passed
the following resolution;
"Whereas, this Board has negotiated and completed contracts
with various water districts for the supply of various areas out-
side the City of Ithaca, and
Whereas, it is the sense of this Board that future extensions
of mains outside of the City for the purpose of supplying addition-
al services should be made only in organized water districts in
order to avoid problems relating to cost and ownership of mains,
cost of leakage, and liability for damage and repairs, except in
unusual circumstances, and that the merits of an unusual case should
be passed upon by the Common Council as well as by this Board.
Novi Therefore Be It Resolved, that this Board recommends adop-
tion of the following amendment to Section 142a of the City Charter
and requeststhe City Attorney to submit to said Council a local
law in proper form covering such amendment."
PROPOSED AMENDMENT
Except in duly organized water districts, no further extension
0' water mains for the purpose of supplying additional outside ser-
v ces shall be made or permitted by the Board of Public Works unless
the same shall have been approved by a majority vote of the Common
o,1.ncil.
Section 2. This Local Law shall take effect immediately.

Resolved, that the recommendation be and hereby is approved
and the proposed amendment tabled until the next regular meeting
of the Council. Carried.
BLANCHE RUSSELL - DAMAGE CLAIM Attorney Powers reported that on
D�cember3O3 1942 action was started on the claim for damages
filed by Mrs. Russell at the Council meeting held October 8, 1942.
He stated that a statement of actual damages has been filed
by Attorney LoPinto in the amount of $702.70.
He stated that there is no question of damages and very little
question of liability since the City Engineer has reported that a
sction of the concrete sidewalk at 601 W. Clinton Street was
broken and raised approximately four and one-half inches by the
rots of a large elm tree, and he recommended settlement of the
claim since loss of the case if it goes to trial would probably
greatly increase the cost.
By Alderman Adams, seconded by Alderman Vail:
Resolved, that the recommendation of the Attorney be accepted,
and settlement authorized for a sum not to exceed $702.70.

Common Council -5- January 63, 1943
J. G. NEEDHAM - DAMAGE CLAIM City Attorney Powers reported that
action has been started on a claim for damages filed with the Board
of Public Works and rejected by that Board on December 101 1941,
He stated that the claim in the amount of $137.46 was filed after
a collision between Prof. Needham's car and a City garbage truck
and that the matter is somewhat complicated since the driver of the
truck is now in military service.
The matter was referred to the City Attorney for further
negotiations.
SCHOOL FOR PLANNING AND ZONING OFFICIALS Mayor Comfort announced
that a 'raining Sch6ol for -Planning an Zoning Officers and
Municipal Employees under the direction of the Mayors Conference
is to be held in Buffalo on January 28, 29 and 30, 1943 and he
recommended that Zoning Officer - Bldg. Commissioner Thorne be
authorized to attend.

Resolved, that H. C. Thorne be authorized to attend the
School at City expense. Carried.
"JfEETING - MUNICIPAL SECTION - N.Y.S. BAR ASSOCIATION Alderman
Adams reported that a meeting of the Municipal Sect on of the N.Y.S,
Bar Association will be held in New York on January 22 and 23, 1943
and it was moved

Resolved, that City Attorney Powers be authorized to attend
the meeting at City expense. Carried.
EXTRA SPACE - ASSESSOR'S OFFICE Mayor Comfort reported receipt
of a request from Assessor borne for additional space in which
to install the graphotype machine now located in the Water building.
He stated that due to the weight of the machine, it is
necessary to place it on a solid foundation and that such space
is available in the basement of the Library building and could be
arranged at comparatively small expense, and it was moved

IiL"ACA RAILVuAY INC. PETITION Mr. Stewart of Ithaca Railway Inc.
r�resented a petition requesting permission to change and extend
,'!Le existing bus line in the East Hill section. It was reported
t'iat the routes are already being used under temporary permission
,,2anted by the Public Service Commission but that a hearing riiust
be held after which the Common Council must approve or disapprove
the change.

Resolved, that the petition of Ithaca Railway Inc. be received
ana that a public hearing thereon as provided by law be held at
t1ae next regular meeting of the Council on the 3rd day of February,
1943 at 5:00 o'clock P.M. at which time all persons interested in
such matter shall be given an opportunity to be heard, and

be given by publishing and mailing notices thereof as required by

FLOOD CONDITIONS - FALL CREEK SECTION The Mayor announced the
meeting was called at the request o the Finance Committee which
met with the Water Committee of the Board of Public Works to dis-
cuss the policy of charges to property owners for pumping cellars
which have been flooded due to the ice jam in Fall Creek.
The Mayor explained that the Board of Public Works feel
that the Water Department which is pumping the cellars should not
stand the expense of the work and he asked the Council to decide
the matter,
After discussion, the Alderman agreed that the cost of pumping
cellars due to the present emergency should be a general city charge,
and it was moved,
By Alderman Gillette, seconded by Alderman Adams:
Whereas, by reasons of natural causes beyond the control of
the City of Ithaca, an ice jam in Fall Creek caused the flooding
of cellars in the homes of residents of a substantial area near
said creek and in the vicinity of N. Cayuga Street in said City,
which condition is threatening the health of such residents and
the safety of their property,
Now Therefore Be It Resolved, that it is the sense of this
Council that since January 6, 1943 an emergency has existed in this
area affecting and endangering the public health and safety of the
City of Ithaca and justifying the use of the available equipment
and labor forces of the City in the pumping of cellars and allevia-

Be It Further Resolved, that this Council hereby authorizes
uhr' Board of Public Works to use such men and equipment as it may
have available for the purpose of meeting such emergency by the
pumping of water from cellars to prevent extinguishment of fires
in the area affected, the necessary cost thereof, of January 6,
1943 and so long as theamergency may exists to be a charge upon
Ll)e general funds of the City to be appropriated by this Council
i'rom monies not otherwise appropriated or allocated, and
Be It Further Resolved, that nothing contained in this resolu-
tion and authorization shall constitute any assumption of liability
on the part of the City of Ithaca or any of its departments,
offices or employees.

special meeting held January 22, 1943 were duly approved.
PUBLIC HEARING - CHANGES IN ITHACA RAILWAY BUS ROUTES Mayor Comfort
opened the public hearing duly advertised for this t me to hear any
persons interested in the application filed at the meeting held
January 6, 1943 by Ithaca Railway Inc. for consent to change and ex-
tend the bus routes in the East Hill section. No one appeared in
opposition to the petition, and it was moved,

Whereas, a public hearing has just been concluded with no
appearance in opposition to the application of Ithaca Railway Inc.,
Now Therefore, Resolved, that consent be granted as requested,
but subject to such rules, regulatitlhs and ordinances as are now in
effect or may hereafter be adopted.

ANNUAL REPORT - SINKING FUND COMMISSION The annual report of the
Sinking Fund Commission for the year 1942 was read by the Clerk.

Resolved, that the report be accepted and placed on file.

ANNUAL REPORT - SEALER OF WEIGHTS & MEASURES The annual report of
the Sealer of Weights & Measures for the year 1942 was read by the
Clerk.

Resolved, that the report be received and placed on file.

CUSTODIAN - VOTING MACHINES The Clerk reported that due to the
death of Ogden C. Kerr, a new custodian of voting machines is to be
appointed by the Election Commissioners, and that a candidate for
the position has inquired about the source of instruction in the
operation and maintenance of the machines.

Resolved, that the City Clerk be directed to ascertain if it
will be possible to secure instruction by a factory representative.

Common Council -2- February 3, 1943
LEASE - CITY OFFICES, LIBRARY BUILDING The Clerk reported that
for various reasons and particularly to facilitate compliance with
the provisions of the "Victory Tax", the janitor service for the
City offices in the Library building should be furnished by the
Library Association, and that a supplemental agreement has been pre-
pared and approved by the Association whereby the wages amounting to
$624.00 formerly paid for janitor service will be added to the
rental paid the Association, and that they will assume all responsi-
bility for janitor service.
By Alderman Gibb, seconded by Alderman Bangs:
Resolved, that the supplemental agreement be and hereby is in
all respects approved, and the Mayor and City Clerk authorized and
directed to execute the agreement on behalf of the City.
Unanimously Carried and Approved.
AUDIT By Alderman Gibb, seconded by Alderman Shurger:
Resolved, that the bills audited by the Finance Committee
be and the same hereby are approved and ordered paid. Carried.
EXTRA SPACE - ASSESSOR'S OFFICE Alderman Gibb reported that space
in the Library building in which to install the graphotype machine
can be secured without additional rental and that cost of the
necessary partitions and wiring will be approximately $100.00, and
since the matter was referred to the Finance Committee with power,
the work has been approved by that Committee.
BICYCLE ORDINANCE Alderman Shurger reported that the Police
Committee and r. Jones of the Board of Education have met and dis-
cussed the proposed bicycle ordinance, and he stated that School
authorities as well as the Veterans of Foreign Wars havo agreed to
aid in the issuance of licenses and in the administration of the
ordinance.
Alderman Adams of the Charter and Ordinance Committee stated
that a registration fee of 25� is proposed which will cover the
cost of supplies and administration, and since the preparation of
an ordinance entails considerable work he suggested that a dis-
cussion of policy by the Aldermen would help in the preparation of
such an ordinance.
During discussion, it was agreed that the license should be
-,-;-,sued for the period of one year, and it was moved,

Resolved, that this Council approve in principle the idea of
licensing bicycles and direct the Charter and Ordinance Committee
to prepare an ordinance to be presented at the next meeting.

rCLLING PLACE - FIRST DISTRICT, THIRD WARD Alderman Gillette re-
-orted that C. L. Kulp, Supt. of Schools, has agreed to permit use
,)f either the Central School or the Junior High School as a polling
glace for the First District of the Third Ward which was formerly
located in the First Congregational Church.
VICTORY GARDEN PROGRAX. Welfare Director J. H. Post requested that
arrangements be made to use City owned vacant lots for gardens
during; the coming season.
He stated that a Committee is working to secure as many
locations as possible for use of residents to help out in the im-
pending food shortage.
By Alderman Adams, seconded by Alderman Rottmann:
Whereas, it is the sense of this Council that the use of City
owned property by private individuals for the planting of victory
gardens is a proper public purpose in view of the anticipated short-
age of foods and in view of the recommendation of various Federal
and State agencies in connection with the planting of such gardens.
Now Therefore Be It Resolved, that the request be referred to
the Board of Public Works with the recommendation that such per-
mission be granted. Unanimously Carried and Approved.
APPROVAL OF RESOLUTION ADOPTED AT SPECIAL MEETING OF JANUARY 22 1943

Resolved, that the resolution adopted at the special meeting
held January 22, 19433 be and hereby is in all respects ratified,
confirmed and formally adopted.

CHARTER AMENDA:ENT - WATER MAIN EXTENSION Attorney Powers announced

A LOCAL LAW amending the Ithaca City Charter with reference
to limiting the extension of water mains for services outside said
City.

BE IT ENACTED BY THE COMMON COUNCIL OF THE CITY OF ITHACA AS
FOLLOWS;
Section 1. Section 142a of the Ithaca City Charter, as enacted
by Chapter 465 of the Laws of 1932, is hereby amended by adding a
new sentence at the end thereof to read as follows:
Section 2. Except in duly organized water districts, no further
extension of water mains for the purpose of supplying additional
outside services shall be made or permitted by the Board of Public
Works unless the same shall have been approved by a majority vote
of the Common Council,
Section 3, This Local Law shall take effect immediately.

VOTING IMCHINES - CUSTODIAN The Clerk reported receipt of a letter
from the automatic Voting Machine Corp. recommending that the new
custodian be sent to the factory at Jamestown for instructions in
the service of voting machines.
It was also reported that the Election Commissioners will
probably appoint two new custodians and the matter of instructions
will have to be settled after the appointments are made.

Resolved, that the matter of instructions for the custodians
be referred,to the City Clerk with power. Carried.
SIDEWALK CLEANING ASSESSMENTS In accordance with the provisions
of 6ectioF 136 of the City Charter a list (herewith appended) of
120 unpaid charges for cleaning sidewalks during the year 1942 was
certified by the Clerk.

to be cleaned in accordance with provisions of the City Charter, and

1942 approved
Now Therefore Be It Resolved, that the said assessments
amount of $141.73 for cleaning sidewalks, as finally approved
filed be and they are in all respects approved and confirmed,
are hereby levied against the respective persons and property
in the respective amounts set forth in said schedule, and it
hereby directed and ordered that such assessments be included
City tax for the year 1943 to be collected in the same manner
subject to the same penalty and procedure as a City tax.

AUCTION SALE - CITY PROPERTY Attorney Powers reported that the
City has perfected title to ten pieces of property, five of which
are vacant lots in Floral Avenue.
He stated that it was felt that a portion of the lots abutting
Floral Avenue should be retained to permit widening the street at
some future date, and that this would make the balance of the lots
useless except to adjoing property owners who are not interested in
purchasing the property at this time, and it was agreed that these
lots should not be offered for sale. r
It was also agreed that no bids should be accepted for the re-
maining five parcels for less than the amount standing against them,

PROPOSED CHARTER Ai.iE;NDItENT Attorney Powers reported that at the
request of Council members he prepared the following proposed Local
Law amending the City Charter in regard to the powers of the Board
of Fire Commissioners respecting firemen's relief funds.
PROPOSED LOCAL LAW
A LOCAL LAIPI TO AI4END THE ITHACA CITY CHARTER REGARDING THE
POItiERS OF THE BOARD OF FIRE COMI,'iISSIONERS RESPECTING FIREMEN'S RE-
LIEF FUNDS.
Be it enacted by the Common Counsil of the City of Ithaca as
follows:
Section 1. Sec. 166 (8) of the Ithaca City Charter, being
Chapter 503 of the Laws of 1908, as amended by Chapter 512 of the
Laws of 1921, is hereby superseded as follows:
Sec. 166 (8) ... to be trustees of all monies now constituting
"the active firemen's relief fund" together with one-half of all
monies that may hereafter be received by the City of Ithaca as a
fire department tax on premiums on policies of foreign and alien
fire insurance companies pursuant to Sec. 553 of the Insurance Law
(except the amount payable under the provisions of such law to the
Firemen's Association of the State of New York) together with any
other monies, gifts or property whatsoever acquired for relief or
benefit purposes, to be accumulated as a relief fund for sick,
indigent or disabled firemen, with power to draw upon such fund for
temporary relief and benefits only, as said board shall determine;
said monies shall not be used for any other purpose. Said board
shall have full power and authority to invest such funds in any in-
vestments legal for trust funds under the laws of the State of
New York. At the close of each fiscal year and at such other times
as the Common Council shall require said Board of Fire Commissioners,
as such trustees, shall submit to the Common Council a detailed
accounting of such fund.

Sec. 2. That said Sec. 166 of the Ithaca City Charter be
further amended by adding thereto a new subsection to be designated
Sec. 166 (8a) to read as follows:

Sec. 166 (8a) ... to be trustees of all monies now constituting
the veteran volunteer firemen's relief fund and to pay the interest
thereon to the Veteran Volunteer Firemen's Association of Ithaca
annually. Said Board is further authorized to pay from the principal
of such fund, from time to time, such amounts as it may deem necess-
ary or desirable for the relief of any sick, indigent or disabled
member of the Veteran Volunteer Firemen's Association of Ithaca, but
the total amount so paid to any one member shall not exceed the sum
of $200.00; such expenditures from principal shall be made, however,
only upon the written recommendation of the Board of Trustees and
President of said Association. Said Veteran Volunteer Firemen's
Association of Ithaca is hereby authorized to adopt any further
regulation or restriction relating to the expenditure of the princi-
pal of such fund, not inconsistent herewith, as it may deem desirable
for the preservation of the fund and for the purpose of limiting
properly the amount to be withdrawn and the use thereof. Said Board
of Fire Commissioners shall also pay to the Veteran Volunteer Fire-
men's Association of Ithaca on March 1st and September lst of each
year one-half of all monies received by the City of Ithaca pursuant
to the provisions of Sec. 553 of the Insurance Law of the State of
New York as a Fire Department Tax on premiums on policies on foreign
and alien fire insurance companies (except the amount payable under
the provisions of such law to the firemen's association of the State

CIVIL SERVICE CLASSIFICATIONS Attorney Powers reporting for the
Secretary of the Municipal ivil Service Commission reported that
the Municipal Service Bureau of the State Department of Civil Service
has completed the personnel survey in this City and has submitted a
report, which is on file in the City Clerk's office where it may be
examined at any time.
He stated that the local Commission has accepted the report and
given tentative approval and recommends that the Common Council take
similar action, after which the procedure will be to give each em-
ployee an opportunity to review the survey and file objections if any,

BICYCLE ORDINANCE - ADOPTION Alderman Adams presented a proposed
ordinance providing for the licensing of bicycles and regulating
their use, and it was moved,

by adding thereto a new section to be known as Section 11, Chapter IV
as fellows:

CITY ORDINANCE
Chapter IV, Section 11
PROVIDING FOR THE LICENSING OF BICYCLES AND REGULATING THEIR
USE.
A. Definitions
(a) A "bicycle' shall include any vehicle consisting of an arx
rangement or combination of two wheels, one following the other,
supported by a frame, propelled by the feet acting upon pedals.
(b) "Operator". That person who is actually engaged in the act
of propelling, guiding or handling the vehicle at any given time.
(c) "Owner". That person, firm corporation, company or associa-
tion in whose name the title of said vehicle is vested.
B. Regulation of bicycles
The parent of any minor child and the guardian of any ward shall
not authorize or knowingly permit any such child or ward to violate
any of the provisions of this article.
C. License Required
On and after May 1, 1943 no person shall operate any bicycle
upon any street, alley or public highway in the City of Ithaca, New
York, unless such bicycle shall be licensed as herein provided, and
shall display the required license plate, The licensing provision
of this section shall not apply to any non-resident owner or operator
of a bicycle operating the same through the City in a continuous
journey.
D. License, Application and Issuance
(a) Application for a bicycle license and license plate shall be
made to the Chief of Police upon a form provided by the City.
(b) The Chief of Police, upon receiving proper application there-
for, shall issue bicycle licenses, & renewals thereof, which shall
be effective until the 30th day of April next succeeding.
(c) The Chief of Police shall not issue a license for any bicycle
when he knows or has reasonable ground to believe that the applicant
is not the owner of or entitled to possession of such bicycle.
(d) The Chief of Police shall keep a record of the number of each
license, the date issued, the name and address of the person to whom
issued, and the number of the frame of the bicycle for which issued,
and a record of all bicycle license fees collected by him.
E. Fees
The annual license fee shall be Twenty-five cents to be paid with
the application or renewal thereof. All license fees collected under
this Ordinance shall be paid to the general fund of the City of
Ithaca.
F. Attachment of License Plates
(a) The Chief of Police, upon issuing a bicycle license, shall
also issue a license plate bearing the license number assigned to
the bicycle, the name of the city, and the expiration date thereof.
(b) The Chief of Police shall cause such license plate to be
firmly attached to the rear mudguard or frame of the bicycle for
which issued in such position as to be plainly visible from the rear.
(c) No person shall remove a license plate from a bicycle during
the period for which issued, except on a transfer of ownership or
in the event the bicycle is dismanteled and no longer operated upon
any street of the City.
G. Inspection of Bicycle„ Equipment
The Chief of Police shall cause an inspection to be made of each
bicycle before licensing the same, and shall refuse a license for
any bicycle which is in unsafe mechanical condition, or which is not
equipped as provided by the Laws of the State of New York.

Every person engaged in the business of buying or selling new or
seccnd hand bicycles shall, within ten (10) days after a sale or
purc,aase, make a report to the Chief of Police of every bicycle pL;r-
chased rr sold by such dealer, giving the name and address of the
persoci from whom purchased or to whorr, sold, and the description of
such bicycle by name or make, the frame number thereof, and the num-
ber of ,,he license plate, if any, found thereon.
J. Transfer of Ownership
Upon the sale or other transfer of a licensed bicycle, the lic-
sensee shall remove the license plate and shall either surrender the
same to the Chief of Police, or may upon proper application, but
without payment of additional fee, have the plate assigned to another
bicycle owned by the applicant.
K. Removal of Numbers
No person shall wilfully or maliciously remove, destroy, mutilate
or alter the number of any bicycle frame licensed pursuant to this
section.
L. Destruction of Plates
No person shall remove, destroy, mutilate or alter any license
plate, seal, or registration card during the time in which such plate,
seal or card is operative. Nothing in this section shall prohibit
the Chief of Police from stamping numbers on the frames of bicycles
on which no serial number can be found or on which the number is
illegible.
M. Traffic Rules
(a) Traffic Laws applied to persons riding a bicycle. Every per-
son riding a bicycle shall be subject to the provisions of the
Ordinances of the City of Ithaca and the Statutes of the State of
New York applicable thereto.
(b) Reckless Driving. No person shall operate a bicycle in a
manner or at a speed which unreasonably interferes with the free and
proper use of the public highways or sidewalks or unreasonably en-
dan ers the users thereof.
fc) Clinging to Vehicles. No person riding upon any bicycle shall
attach the same or himself -to any other vehicle on the roadway.
(d) Riding in a Group. Persons operating bicycles upon a roadway
shall ride single file in the business district, and not more than
two abreast except on paths or parts or roadways set apart for the
exclusive use of bicycling.
(e) Carrying Articles. No person operating a bicycle shall carry
any package, bundle or article which prevents the rider from having
full control of his bicycle.
(f) Parking. No person shall park a bicycle upon any street or
sidewalk except against a building or at the curb, in such manner as
to avoid the obstruction of vehicular and pedestrian traffic.
(g) Riding on Sidewalks. No person shall ride a bicycle upon a
sidewalk within the business district. No person ten or more years
of age shall ride a bicycle upon a sidewalk in any district. When-
ever any person is riding a bicycle upon a sidewalk, such person
shall yield the right of way to any pedestrian and shall give audible
signal before overtaking and passing such pedestrian.
N. Penalties
Violation of this Ordinance shall constitute disorderly conduct,
and, in addition to the penalties provided therefor, the court may
order the removal and detention of the license plate from such per-
son's bicycle for a period of not to exceed ninety days and/or the
impounding of such person's bicycle for a period not to exceed ninety
days.

of the property at 423 E. Lincoln Street, owned by the Welfare Depart-
ment in order to remove the building, as recommended by the Board of
Public Works.
He stated that the property is rented to advantage at this time
and that it does not seem necessary to remove the building for the
purpose of widening the intersection.

SIDEWALKS CURB AND GUTTERS ASSESSIdENTS LEVIED The Clerk reported

1943 in regard to assessments for the installation of sidewalks in
East and West State Street and South Corn Street, and for the in-
stallation of curbs and gutters in various sections of the City, and
that th lb Board finally approved the assessments as levied on March
10, 1943, and recommended same to the Common Council for confirma-
tion.

installation of sidewalks and curbs and gutters in various streets
on March 10, 1943, and after a public hearing held on March 24, 1943

approved said assessments, and filed a schedule thereof withthe
Common Council for confirmation,
Now Therefore Be It Resolved, that the said assessments in the

be and they are in all respects approved and confirmed and the City
Clerk directed to prepare a warrant on the City Chamberlain in
accordance with such schedule for the collection of said assessments

or portions thereof, remaining unpaid after the expiration of six
months from the date of said warrant, the City Chamberlain shall add

CHARTER AMENDMENT - SECTION 166 (8) FIREMEN'S RELIEF FUNDS Attorney
Powers announced that the required time has elapsed since the pro-
posed amendment to the City Charter presented to the Common Council
and should be voted upon at this time.
A LOCAL LAW TO AMEND THE ITHACA CITY CHARTER REGARDING THE
POWERS OF THE BOARD OF FIRE COMMISSIONERS RESPECTING FIREMEN'S RE-
LIEF FUNDS.

Be it enacted by the Common Council of the City of Ithaca as
follows:

Section 1. Sec. 166 (8) of the Ithaca City Charter, being
Chapter 503 of the Laws of 1908, as amended by Chapter 512 of the
Laws of 1921, is hereby superseded as follows:
Sec. 166 (8) ..* to be trustees of all monies now constituting
"the active firemen's relief fund" together with one-half of all
monies that may hereafter be received by the City of Ithaca as a
fire department tax on premiums on policies of foreign and alien
fire insurance companies pursuant to Sec* 553 of the Insurance Law
(except the amount payable under the provisions of such law to the
Firemen's Association of the Otate of New York) together with any
other monies, gifts or property whatsoever acquired for relief or
benefit purposes, to be accumulated as a relief fund for sick,
indigent or disabled firemen, with power to draw upon such fund for
temporary relief and benefits only, as said board shall determine;
said monies shall not be used for any other purpose. Said board
shall have full power and authority to invest such funds in any in-
vestments legal for trust funds under the laws of the State of
New York. At the close of each fiscal year and at such other times
as the Common Council shall require said Board of Fire Commissioners,
as such trustees, shall submit to the Common Council a detailed
accounting of such fund.
Sec. 2. That said Sec. 166 of the Ithaca City Charter be
further amended by adding thereto a new subsection to be designated
Sec. 166 (8a) to read as follows:
Sec. 166 (8a) ... to be trustees of all monies now constituting
the veteran volunteer firemen's relief fund and to pay the interest
thereon to the Veteran Volunteer Firemen's Association of Ithaca
annually. Said Board is further authorized to pay from the principal
of such fund, from time to time, such amounts as it may deem necess-
ary or desirable for the relief of any sick, indigent or disabled
member of the Veteran Volunteer Firemen's Association of Ithaca, but
the total amount so paid to any one member shall not exceed the sum
of $200.00; such expenditures from principal shall be made, however,
only upon the written recommendation of the Board of Trustees and
President of said Association. Said Veteran Volunteer Firemen's
Association of Ithaca is hereby authorized to adopt any further
regulation or restriction relating to the expenditure of the princi-
pal of such fund, not inconsistent herewith, as it may deem desirable
for the preservation of the fund and for the purpose of limiting
properly the amount to be withdrawn and the use thereof. Said Board
of Fire Commissioners shall also pay to the Veteran Volunteer Fire-
men's Association of Ithaca on March lst and September 1st of each
year one-half of all monies received by the City of Ithaca pursuant
to the provisions of Sec. 553 of the Insurance Law of the State of
New York as a Fire Department Tax on premiums on policies on foreign
and alien fire insurance companies (except the amount payable under
the provisions of such law to the firemen's association of the State
of New York). Said Board shall have full power and authority to
invest such funds in any investments legal for trust funds under the
laws of the State of New York. At the close of each fiscal year,

claim for damages to his car in the amount of $8.00 was filed with
the Board of Public Works on March 24, 1943 by Harold E. Beach of
R.D. #1, Ithaca, N. Y.
He stated that the damage was caused by a collision with a
City truck March B. 1943, and after investigation is convinced that
it is a just claim and recommended settlement.

AUCTION SALE - CITY PROPERTY Chamberlain Snyder reported that the
auction sale of 5 pieces of property on which the City had perfected
title was held on March 29, 1943 and that the five pieces sold for
$2434.33, which was '472.80 in excess of the amount invested by the
City for taxes and other expenses.

Resolved, that the bills audited by the Finance Committee

TRAFFIC REGULATIONS Alderman Shurger reported that parking in W.
Seneca Street between Taughannock Blvd. and the Lehigh Valley Rail-
road tracks creates a serious hazard, and he recommended that park-
ing be prohibited on the north side of the street.

the east side of Taughannock Blvd. between Seneca and Buffalo Streets,

Welfare Department has decided -To change from voucher to cash relief
on May lvt, since rationing has made it difficult to use the voucher

FIRE ALARM SIGNALS Alderman Gillette reported that due to present
blackout regulations it seems to b , to give more audible
signals in case of fires.
It was suggested that a call system. for day time fires similar
to the on,, used in case; of night fires might be worked out, and the
matter was referred back to Alderman Gillette for further considera-
tion and report.
ANNUAL FINANCIAL REPORT The Clerk distributed copies of his annual
financial report for the fiscal year ending December 31, 1942.

CIVIL SERVICE COMMISSION - SECRETARY Civil Service Commissioner
Matthews appearea before the Council and reported that at a meeting
held by the Commission this afternoon, that Mr. J. F. O'Connor has
asked to be relieved of the duties as Secretary to the Commission.
Mr. Matthews also reported that the Commissioners feel that
in order to take proper advantage of the very fine survey and
classification schedule submitted by the State Department of Civil
Service, and to comply with the Civil Service Law, it will be
necessary to employ a Secretary who will be able to give full time
to the work for the next six to twelve months and several hours
daily after the new system is properly set up, and recommend that a
salary of $600.00 annually be approved by the Council.

Buffalo Streets, and requesting payment of $62.40 which is the
estimated cost of repairs to the Berger car.

FIRE ALARM SIGNAL Alderman Gillette reported that there seeris to
be no possible way to give more audible signal in case of fires due
to present blackout regulations.

an acute need for this type of capital improvement, and
WHEREAS, it appears desirable in the interest of sound economy
and for the purpose of avoiding the necessity of issuing bonds and
incurring expense and interest obligations at such time as this
type of improvement may be possible, to establish a Capital.Rescrvc
Fund for such purpose,
NOW THEREFORE BE IT.RESOLVED, pursuant to Section 6c of the
General Municipal Law of the State of New York:
1. That there be and hereby is established a Capital Reserve
Fund for the construction, reconstruction or replacement of a type
of capital improvement, to -wit, bridges in the City of Ithaca, which
sum shall be known and designated as "City of Ithaca, Capital Re-
serve Fund No. 4, Bridges," which fund may be referred to as
"Capital Reserve Fund No. 4".
2. That there be and hereby is appropriated to such fund the
sum of 450,000.00..
3. That the City Clerk be and he hereby is directed to deposit
such fund, as soon as monies may be available after the collection
of City taxes for the year 1943, together with such other amounts
as may be appropriated to such fund from time to time, in one or
more of the Banks or Trust Companies designated as depositories
of the funds of the City of Ithaca; the monies ir'i such fund so
deposited shall be kept in a separate bank account.
4. That the City Clerk be and he hereby is authorized to in-
vest the monies in such fund in the obligations of the State of Now
York or the Federal Government in such manner and at such times as
may from time to time be determined by this Council; any interest
earned or capital gains realized on the monies so deposited or in-
vested shall accrue to and become a part of such fund, and the
separate identity of such funds shall be maintained, whethor its
assets consist of cash or investments or both.
5. That the City Clerk shall keep a separate account of the
fund hereby established in the manner provided by Section 6c, par.
10 of the General Municipal Law of the State of New York.
6. That expenditures shall be made from such fund only by
authorization of this Council and only for a specific capital im-
provement of the type for which this fund is created, viz. bridges.

place such equipment,together with additional items of equipment,an(

current financing program of the City at such time as this type. of
capital expenditure may be possible, to establish a Capital Reserve

a tax rate of 4p14.80 for all general City purposes, and a tax rate
of :';4.81 on pension, bonus and insurance exempt property for all
highway purposes. He suggested that it was incumbent on the Council
at this time to officially approve the budget, fix the tax rate,
levy the taxes and make appropriations. '

upon, be and the same hereby are finally approved, adopted and con-

insurance, and that the tax rate for general City purposes for the
fiscal year 1943 be and the same hereby is established and fixed
at $14.80 per :'1000. of taxable valuation as shown, certified and

Roll thereby making a total tax levy, as near as may be, of

their respective net taxable valuations at the rate of ?14.80 per
$1000, of such taxable valuations,and
BE IT FURTHER RL�OLVED, that the City Clerk be and he hereby
is directed. to extend and apportion the City tax as above, and that
upon the completion of the extension of said Roll the Clerk shall
prepare a warrant on the City Chamberlain for the collection of said

directed to sign and affix the Corporate Seal to suc'a warrant and

PUBLIC LIABILITY INSURANCE - WELFARE DEPARTNM;NT PROPERTY The Clerk
reported that a letter from P. W. Wood & Son, quoting a price for
public liability insurance on property acquired by the Welfare De-
partment was referred to the Council for attention.
A prise of {;1.00 per property for 5-10 limit was quoted, but
no mention made of a minimum premium and it was felt that further
information in regard to the number of properties held by the
Welfare Department and the probably cost should be obtained before
action is taken, and it was moved

a resolution requesting the Council to appropriate the necessary
funds estimated at $255.00.

REAPPRAISAL - CITY 04vT1ED BUILDINGS The Clerk reported that at a
meeting of the"hoar of Public VVorks held June 23, 1943, the matter
of reappraisal for fire insurance purposes, of all City owned build-
ings was discussed and referred to the Common Council for attention.
It was reported that the Board of Education has recently
authorized such a reappraisal and Mayor Comfort suggested informa-
tion on the matter might be secured from the N.Y.S. Fire Insurance
Rating organization in Syracuse.

A LOCAL LAW PROVIDING FOR UNIFORM ACCIDENTAL DISABILITY BENEFITS
FOR POLICEMEN AND FIREMEN OF THE CITY OF ITHACA.
Be it enacted by the Common Council of the City of Ithaca as
follows:
Section 1.. The Ithaca City Charter, as enacted by Chapter 503
of the Laws of 1908, is hereby amended by adding thereto a new
section to be known as Section 219a, which shall read as follows:
Secion 219a. ACCIDENTAL DISABILITY, POLICEMEN AND FIREMEN
1. Purpose. Whereas members of the Ithaca Police Department
and paid members of the Ithaca Fire Department are officers of the
City of Ithaca within the meaning of the Workmen's Compensation Law
of the State of New York, and therefore are not entitled to benefits
under the provisions of such law, and whereas no uniform provision
exists for the payment of medical and hospital expenses iricurred
by such policemen and firemen as the result of injuries sustained
in the discharge of their duties, and whereas the provisions of
the Civil Service Law relating to employeest retirement for accident-
al disability does not satisfactorily protect firemen -and policemen
against accidental disabilities of a temporary nature, now therefore
it is hereby deemed necessary and desirable to establish a uniform
procedure for accidental disability benefits for policemen and paid
firemen.
2. Benefits. Any member of the Ithaca Police Department and
any paid mem er of the Ithaca Fire Department who is injured in the
performance of his duties, or who is taken sick as the result of
the performance of his duties, so as to necessitate medical treat-
ment, shall be retained on the Dcpartment's payroll and shall be
paid the full amount of his regular salary or wages during the
period of disability arising from such injury or sickness; but the
payment of such wages or salary shall not extand over a period of
more than six months nor beyond the time whan such employee shall
obtain from the State Retirement System approval of his application
for accidental disability retirement, whichever event shall occur
earlier. In addition to the salary or wages so paid, the Common
Council shall audit and pay all proper bills for medical treatment
and hospital care necessitated by such injury or illness. It shall
be the duty of the Chief of each of said departments to cause a
physical examination of each member of his department claiming dis-
ability under this section at such times as he may deem advisable,
and such Chief shall certify payrolls including the name of such
member only when he shall have on file in this office the certifi-
cate of a competent physician to the effect that such member is
actually disabled from the performance of his customary duties.
3. All sums required to be paid pursuant to the provisions of
this section shall be charged against and paid from the general
funds of the City of Ithaca.
4, Repayment. In the event that any such injury or illness
shall be caused by the negligent or tortious act of a third person,
and in the event of a recovery by the injured member from such third
person, such member shall repay to the City of Ithaca the amount of
all benefits paid hereunder. t'.henever it shall appear to the
satisfaction of the Common Council, upon the application of such
member, that the amount recovered from such. third person is in-
sufficient to repay the amount of benefits received hereunder, or
that the amount remaining after such repayment will be insufficient
adequately to compensate such member for the injuries received, the
Common Council shall have power to fix and determine the amount to
be repaid by such member. The injured member may be required to
execute a subrogation agreement, assignment, or such other document
as may be required by the Chief of the Department or by the Common
Council to effectuate the provisions of this section, as a condition
precedent to the receipt of benefits hereunder.
5. Authority of Common Council. The Common Council shall have
power, by resolution, to adopt additional regulations not incon-
sistent herewith, governing accidental disability benefits and pro-
cedure.
Section 2. This Local Law shall take effect immediately.

A LOCAL LAW PROVIDING A UNIFORM SICK LEAVE PROCEDUR4' FOR THE
OFFICERS AND EMPLOYEES OF THE CITY OF ITHACA.
Be it enacted by the Common Council of the Citv of Ithaca as
ollows:
Section 1. The Ithace City Charter, as enacted by Chapter 503
of the Laws of 1908, is hereby amended by adding a new section to
be known as section 219b, which shall read as follows:
Section 219b. SICK LEAVE FOR OFFICERS AND EMPLOYEES
1. Purpose. A uniform provision for sick leaves, applicable
alike to all -departments of the City of Ithaca, is hereby deemed
necessary to insure proper and adequate sick leave benefits for the
officers and employees of the city, to prevent inequities among the
several departments, and to avoid unnecessary absenteeism and other
abuses.
2. Annual Sick Leave. Every officer and employee of the City
of Ithaca, except seasonal employees, who shall have completed at
least one year of continuous service, shall be entitled, during
each succeeding year, to two weeks leave of absence while actually
disabled by illness or physical injury, and shall be allowed the
same compensation as if actually employed. In the case of per diem
or hourly wage employees, a "week" shall be deemed to consist of
five eight -hour days and compensation shall be computed accordingly,
using the employee's regular per diem or hourly rate.
3. Accumulation of Unused Benefits. At the end of each year
of continuous employment, the number of days of sick leave not
actually used during the year by each officer or employee shall
accumulate to his credit until such accumulated total shall equal
16 weeks; no sick leave benefits beyond 16 weeks shall be permitted.
Any officer or employee whose continuous service shall be :interrupted
by reason of ordinary leaves of absence, military leaves, or
separations from service by reason of the abolition of his position
or other involuntary cause beyond his control and without his fault,
shall be entitled, upon his return or restoration to service, to
the same accumulated sick leave as he had to his credit at the date
of his separation from service. But an official or employee absent
for any period exceeding three months shall not gain additional
sick leave oredit during any such period of absence from duty.
t All officers and employees of the city who upon the effective
date of this local law shall have been continuously in the service
of the city for one year shall be credited with cumulative sick
leave for prior years at the rate of two weeks per year for each
year of continuous service, not exceeding seven years, except that
an employee shall not receive sick leave credit for his first year
of service. From such cumulative credit shall be deducted sick
leaves received during such period, except that no deduction shall
be made for sick leaves during which the officer or employee re-
ceived no compensation.
4. Administration.
(a) Records, It shall be the duty of the administrative head
of each department to keep an accurate record of all sick leaves,
and sick leave accumulations in such form as the Common Council
may prescribe.
(b) Notification. Any officer or employee who is unable to
re,jort for duty because of illness or physical disability shall
imr,ediately notify his department head of that fact and shall state
the nature of his illness or disability and the name of the attend-
ing physician, if any; when the officer or employee is unable so to
report, a responsible person may make the report in his behalf.
In the absence of such report, unless waived by the department head
for good cause, time lost shall not be considered sick leave and
such employee shall receive no compensation therefor.
(c) Certificate of disability. No continuous sick Leave ex-
ceeding three days shall be allowed except upon the certification
of a physician to be filed with the department head not later than
fourth day, stating the nature of the illness and probable period
of disability. The department head may require such certificate in
any other case.

(d) FalseeRRepresentations# Any false representation made by
any officer or employee in connection with a claim for sick leave
benefits shall be deemed a just cause -for disciplinary proceedings
under the Civil Service Law and Rules, and in addition to other
penalties such portion of his accumulated sick benefits as may be
deemed proper may be cancelled.
5. Exceptions. No employee who suffers injuries in the course
of his employment and is entitled -to benefits under the provisions
of the Workmen's Compensation Law, shall be entitled to sick leave
benefits hereunder for the period of his disability arising from
such injury. The period of disability resulting from such injuries
shall not be charged against the sick leave to which such employee
may be entitled.
6. Authority of Common Council, The Common Council shall have
power, by resolution, to adopt additional regulations, not incon-
sistent herewith, governing sick leaves and sick leave procedure.
Section 2. This Local Law shall take effect immediately.

TAX REFUND City Attorney Powers presented a claim filed by
da E. in the amount of $25.80 for a refund of City
taxes, fees and redemption fees paid by Mrs. Mereness on property
in Adams Street for the years 1936 to 1942 inclusive.
Mr. Powers expressed the opinion that the assessment was in-
valid and recommended tha-t.the claim be paid.

REAPPRAISAL - MUNICIPAL BUILDINGS The Clerk reported that a recent
reappraisal of Board of Education buildings was made by representa-
tives of the Company which writes the insurance on the buildings
assisted by a local builder representing the H. A. Carey Co. and
that the special agents who made the appraisal for the City in 1941
recommend a ten percent increase in fire insurance coverage as
adequate at this time. -

Section 10 The Ithaca City Charter, as enacted by Chapter 503
of the Laws of 1908, is hereby amended by adding a new section to
be known as section 219b, which shall read as follows:
Section 219b. SICK LEAVE FOR OFFICERS AND EMPLOYEES
1. Purpose. A uniform provision for Sick leaves, applicable
alike to al departments of the City of Ithaca, is hereby deemed
necessary to insure proper and adequate sick leave benefits for the
officers and employees of the city, to prevent inequities among the
several departments, and to avoid unnecessary absenteeism and other
abuses.
2. Annual Sick Leave. Every officer and employee of the City
of Ithaca, except seasonal employees, who shall have completed at
least one year of continuous service, shall be entitled, during
each succeeding year, to.two weeks leave of absence while actually
disabled by illness or physical injury, and shall be allowed the
same compensation as if actually employed. In the case of per diem
or hourly wage employees, a "week" shall be deemed to consist of
five eight -hour days and compensation shall -be computed accordingly,
using the employeets regular per diem or hourly rate.

3. Accumulation of Unused Benefits. At the end of each year
of continuous employment, the number of days of sick leave not
actually used during the year by each officer or employee shall
accumulate to his credit until such accumulated total shall equal
16 weeks; no sick leave benefits beyond 16 weeks sh&.11 be permitted.
Any officer or employee whose continuous service shall be interrupted
by reason of ordinary leaves of absence, military leaves, or
separations from service by reason of the abolition of his position
or other involuntary cause beyond his control and without his fault,
shall be entitled, upon his return or restoration to service, to
the same accumulated sick leave as he had to his credit at the date
of his separation from service. But an official or employee absent
for any period exceeding three months shall not gain additional
sick leave credit during any such period of absence from duty,
All officers and employees of the city who upon the effective
date of this local law shall have been continuously in the service
of the city for one year shall be credited with cumulative sick
leave for prior years at the rate of two weeks per year for each
year of continuous service, not exceeding seven years, except that
an employee shall not receive sick leave credit for his first year
of service. From such cumulative credit shall be deducted sick
leaves received during such period, except that no deduction shall
be made for sick leaves during which the officer or employee re-
ceived no compensation.
4. Administration.
(a) ec� ords, t shall be the duty of the administrative head
of each department to keep an accurate record of all sick leaves,
and sick leave accumulations in such form as the Common Council
may prescribe.
(b) Notification. Any officer or employee who is unable to
report for duty because of illness or physical disability shall
immediately notify his department head of that fact and shall state
the nature of his illness or disability and the name of the attend-
ing physician, if any; when the officer or employee is unable so to
report, a responsible person may make the report in his behalf.
In the absence of such report, unless waived by the department head
for good cause, time lost shall not be considered sick leave and
such employee shall receive no compensation therefor.
(c) Certificate of disability4 No continuous sick leave ex-
3eeding three days shall be allowed except upon the certification
of a physician to be filed with the department head not later than
fourth day, stating the nature of the illness and probable period
of disability, The department head may require such certificate in
any other case.
(d) False Representations. Any false representation.made by
any officer or employee in connection with a claim for sick leave
b�.nefits shall be deemed a just cause for disciplinary proceedings
u_zder the Civil Service Law and Rules, and in addition to other
iPenalties such portion of his accumulated sick benefits as may be
deemed proper may be cancelled.
5. Lxceptions. No employee who suffers injuries in the course
of his employment and is entitled to benefits under the provisions
of the Workmen's Compensation Law, shall be entitled to sick leave
benefits hereunder for the period of his disability arising from
such injury. The period of disability resulting from such injuries
shall not be charged against the sick leave to which such employee
may be entitled.
�. 6. Authority of Common Council. The Common Council shall have
power, by resolution, to adopt additional regulations, not incon-
sistent herewith, governing sick leaves and sick leave procedure.
Section 2. This Local Law shall take effect immediately.

He stated that the Board of Public Works has approved and

so far advanced, it was felt that the amendment should be acted
upon at the earliest possible date.

the calendar year; and each such employee who, on January 1 of any
year, shall have completed three years of continuous service, shall
be entitled to a vacation of two weeks during the calendar year.
Regularly granted leaves of absence not exceeding three months and
military leaves shall not be deemed to be an interruption of con-
tinuous service. Vacation time shall not be accumulated from year -
to year. Vacations shall be granted during the year 1943 on the
basis of continuous service determined as of January 1, 1943.

arrived to do the dredging in Fall Creek and that it will be
necessary to call a special meeting at a later date to approve an
agreement with the State and to provide funds in the form of a
certified check payable to the State to insure payment for the work.

accumulation of sewage and debris and as a consequence thereof
undesirable and unsatisfactory conditions are created which may be
detrimental to the health of -the residents of the City of Ithaca
generally and, in particular, of the men who are training for
military purposes and who live within the limits of the City of
Ithaca, and
Whereas, Mayor Comfort has discussed the matter with officials
of the Government of the State of New York and has negotiated a
contract with Thomas E. Dewey, Governor of the State of New York,
for the purpose of leasing to the City the necessary equipment and
to furnish operating personnel for the project of dredging the
mouth of Fail Creek adjacent to Stewart Park where it flows into
Cayuga Lake, and
Whereas, said Mayor Comfort has presented to and has filed with
the Common Council of said City a proposed form of contract for the
purpose aforementioned, now, therefore,

authorized and directed (1) to execute and deliver the said proposed

MINUTES . The minutes of the regular meeting held August 4, 1943 and
of the special meeting held August 6, 1943 were duly approved.
RE'UEST FOR STREET LIGHT INSTALLATION Mrs* Chisholm, chaperone
at the Sigma Delta Tau sorer ty, at—T15 Ridgewood Road appeared
before the Council and requested the installation of a street light
in that section. She was informed that the request would be re-
ferred to the Board of Public Works for consideration.
PETITION RE PARKING IN COLUMBIA STREET A petition bearing the
signatures of nine property owners was presentedXfflal'gition
of parking on the south side of Columbia Street �bora and
Hudson Streets.
It was reported that Chief Marshall has investigated the re-
quest and recommends prohibition of parking as requested.

Resolved, that Chapter VI, Sec. 2f "No Parking" of the City

POLLING PLACE - GOLDWIN SMITH HALL A letter from Robert E. Treman
was presented suggesting that the polling place for the Fourth
District of the Fifth Ward now located in Goldwin Smith Hall be
changed, due to the difficulty of reaching the polling place.
It was pointed out that this location was considered the most
central for the district and the only one available on the campus.
It was suggested, however, that Mr. Treman might be in a position
to aid in securing a more suitable location and it was moved,

PUBLIC LIABILITY INSURANCE -WELFARE DEPARTiTNT PROPERTY The Clerk
reported receipt of a quotation for public liability insurance on
property acquired by the Welfare Department amounting to a flat
premium of $22.50 for standard limits of $5000-$10,000 for one year,
with renewal based on the number of properties owned at the time
of renewal.
At the present time the 'A"elfare Department holds title to
fifteen properties.

Resolved, that the Welfare Department be authorized and directed
to procure public liability insurance coverage as outlined above.

PURCHASE OF LOTS APPROVED The Clerk reported that after investiga-
tion by a committee consisting of the City Attorney, City Engineer
and City Assessor, the purchase of twenty lots adjacent to VanNattas
dam and owned by the County was recommended to the Board of Public
Works, and that the Board approved the recommendation and has re-
quested the Common Council to appropriate the sum of $200.00 for the
purchase of the lots.

CLERK � CITY CHAMBERLAIN'S OFFICE Mr. Snyder reported that Mrs.
Tottey, a Clerk in the hamberlain's office, wishes to resign and
he asked permission to hire a Clerk in her place.

Resolved, that the Chamberlain be authorized to employ a
Clerk on a temporary basis, subject to the approval of the
municipal Civil Service Commission pending the establishment of an

Resolved, that the bills audited by the Finance Committee

FIRE; INSURANCE -. 14UNICIPAL BUILDINGS Mr. Gibb reported that the
nance Co Eee has found a great discrepency between assessed
and insurance valuations on municipal buildings and he recommended
that the two rolls be referred to a committee for reconciliation
of values before further recommendations are made.

Attorney Powers' memorandum to the Iviayor and Common Council were

To the Common Council of the City of Ithaca:
The petition of Cornell University respectfully shows upon
information and belief:
1. That on or about the lst day of April, 1943, the assessors
of the City of Ithaca completed and filed the tax roll for the year
1943. That the roll so filed included the following entries:
207 - 215 Fall Creek Drive
irreg. 335 x 120 Apts. 163 250 3 100000. 25,000. 35,000.
225 Fall Creek Drive
irreg. 142 x 100 Res. 183 250 4 41500. 10,500. 15,000.
2. That between April 15 and May 1, 1943; following Grievance
Day, said roll was finally completed and filed, the foregoing items
remaining unchanged thereon.
3. That the assessments of the two properties above described
were erroneous and improper in that said properties were on April
1, 1943 used for educational purposes within the meaning of Section
4 of the Tax Law of the State of New York and were entitled to
exemption from taxation; that both of said premises on April lst,
1943, were owned by Cornell University and were used for girls'
dormitories, and the proper City authorities were so notified.
4. That thereafter the 1943 City tax was duly levied and said
roll was extended against said properties as follows:
207-215 Fall Creek !Drive $518.
225 Fall Creek Drive $222.
5. That the amount of said levies has been paid under protest,
together with a 6% penalty thereon, amounting in all to the sum
of $784.40.
Petitioner respectfully submits that it is entitled to a re-
fund of the amount so paid and that your Common -Council is author-
ized to make such refund pursuant to Section 35, Par. 236 of the
Ithaca City Charter, Section 56 (a) of the Tax Law and Section 16
of the County Law.
Aherefore petitioner prays that the said sum of $764.40 be
refunded.

Memorandum to Mayor and Common Council:
In the preparation of the 1943 assessment roll, an error was
made as to two properties of Cornell University, one known as 207-15
Fall Creek Drive and the other as 225 Fall Creek Drive. Prior to
1943 these properties were properly taxable. Prior to April 1,
however,,•they were converted into girls' dormitories following the
use of Sage College for the housing of Navy per8onnel and the dis-
continuance of Sage as a girls' dormitory. A number of changes of
this same nature occurred and these two properties were overlooked.
The assessor advises me that he has investigated both properties
and finds that they were used as girls' dormitories on April 1, 1943
and should therefore have been on the exempt list.
The error was not discovered until after the 1943 City tax had
been levied and this Council had lost jurisdiction of the tax roll.
There was no way to correct the roll.
Section 35 Par. 36 of the Ithaca City Charter gives to the
Common Council the same powers with reference to the assessment roll
as the Board of Supervisors of a County. Section 56 (a) of the Tax
Law and Section 16 of the County Law gives to the Board of Super-
visors powers to "cause to be refunded to any person the amount
collected from him of any tax erroneously or improperly assessed or
levied."
The tax, with a 6J penalty, has been paid by the University,
and it is my opinion that the University is entitled to a refund on
the basis that the properties, as of April 1, 1943, were used as a
girls' dormitory and were therefore exempt from taxation under the
provisions of Section 4 of the Tax Law.

ported thatatar•ecent meeting of the Local Coal Dealers Association,
he was requested to appoint a coordinator or investigator to aid in
handling requests for coal deliveries.
He stated that due to the extreme shortage of coal, that unless
certain cases are investigated, some citizens may suffer real hard-
ship during the coming winter, and that he has appointed Donald A.
Stobbs as Coal Coordinator who has agreed to accept the appointmen,;
without compensation except for necessary expenses which have been
estimated at '1p50.00 per month.

cy orders of coal and generally supervising the distribution of
available supplies to the end that individual hardship and suffering

Donald A. Stobbs, Sanitary Inspector of the City of Ithaca, who has

APPROP-RIATION FOR BOILER - CITY HALL HEATING PLANT The Clerk pre-
sented the following communication from Acting ity Engineer Cass
in.regard to the boiler in the City Hall heating plant:

The older of the two boilers in the City Hall heating plant
recently burst. A water pressure test shows both the front and
back sections cracked.
Estimates indicate comparative repair or replacement costs as
.fellows:
Replace front and back sections on the present boiler $355.00
Replace the boiler less the grates and base 4800.00
Replace the boiler complete $875.00
This present boiler has been in service for 13 years or approx-
imately one-half of its normal life, With the individual approval
of all members of the Board of Public Works I have ordered a complete
new boiler. This boiler will be a duplicate of the other new one
with interchangeable grates.
The budget for City Hall is not sufficient for repairs of this
nature or in this amount. Inasmuch as the Common Council meets
before the hoard of Public Works a request should be made to the
Common Council for $900.00 to be placed in the City Hall budget
account to take care of this work.

PURCHASE OF CAR FOR POLICE DEPARTMENT AUTHORIZED Alderman Shurger
reported that the Police ommittee after investigation recommends
trading in the old Dodge and Hudson cars toward a new Dodge for the
Police Department*
He stated that the Dodge has been run over 100,000 miles and
the Hudson between 60,000 and 70,000 miles and both cars are in bad
condition, and that W. T. Pritchard has agreed to furnish a new
Dodge car for the sum of $482.00 making an allowance of $1000.00
for the two old cars.

installed at that place.

By resolution of the Board of Public 'Nelfare at the
regular meeting on November 15th, I was instructed to ask the
Council for permission to have transferred from the unexpended
balance in the home relief account $3,500 to the old age assist-
ance account - this amount being needed to care for the December
payroll.
Increased cost in food, rent, fuel, boarding home cases
and medical has caused us to exceed our estimate in old age for
1943 to the extent of the amount we are requesting. There is an
unexpended balance of approximately $25,000 in the home relief
account.
We hope that we may be accorded this permission.

and has requested authorization to retun the proceeds from the sale
of the lockers to the Stewart Park Trust Fund, until such time as
suitable lockers may be purchased,

A LOCAL LAW RELATING TO THE ASSESSOR A dD S 0R'3
OF THE CITY OFF IT4IACA, THEIR POVvERS AND FiUT1h S,
Be it enacted by the Common Council of tI-n Cit` of Ithaca as
follows
Section 1. Section 19 of the Ithaca City "Harter, being
Chanter 503 of the Laws of 19083, as last amended. by Chanter 387
.f the Taws of 1920, is hereby amended to read as follows;
Assessor and associate assessors; their powers and duties,
Tale assessors in office when this act goes into effect shall serve
during the remainder of the term for which they were appointed.
Thereafter as their several terms expire, successors shall be ap-
pointed to serve for the regular torm of three years. The asso-
-yate assessors shall not at any time both belong to tfte same po-
litical party. It shall be the duty of the assessor with the aid
cf the associate assessors to prepare and file with the city clerk
on or befor6 the first day of March in each year, an assessment -
roll of all the taxable and exempt real property in said city.
Upon completion of said roll, the assessor shall give notice of
the time and place when and where the assessor and associate: as-
sessors will sit for hearing grievances and reviewing the assess-
ments therein, and such grievance day shall not be later than the
fifteenth day of March in each year. Such notice shall be pub-
lished at least three times in the official newspaper designated
n:zrsuant to Section 232, and shall also be posted in twenty public
and conspicuous places in the City of Ithaca at least ten days be-
fore the day specified therein. The assessment -roll, after such
hearing and review, shall be completed, certified and filedw:Lth
cho clerk of the said city on or before the twenty-fourth day of
Apri_1 in each year. The assessor shall possess all the powers and
authority of town assessors and be governed by the general statu`
relating thereto so far as applicable. He shall perform the duties
required of him in relation to the assessment of property in the
city for the purposes of levying taxes imposed either under the
provisions of this act or by the board of supervisors of Tompkins
County. He shall make four copies of the assessment -roll, one of
which shall be kept in his office, one furnished to the city
chamberlain for the collection of city taxes, one furnished to the
',card of supervisors for the collection of state"and county taxes
^.nd one furnished to the board of education for the collection of
:drool taxes. The associate assessors sh�.11 assist the assessor in
preparation of the assessment -roll and shall act with the as-
,_e scr as a board of revision, equalization and grievance, each to
,< Equal power with the assessor in altering and changing assess-
i,_nt.s by a m,,,jority vote. The salary of the assessors and the term:l
of payment shall be fixed by the common council.
Section 2. This Local Law shall take effect immediately.

Ithaca City Charts, being Local Law No. 1 of 1943_ has authorized
a bonus to the officers and employers of the City of Ithaca to
comp nzate for fluctuating living costs arising from the existence
of the present war emergency, which bonus is 15% of the regular
salary or wages of officers and employees receiving up to and in-
cluding $2500 40 per year, and 5% as to officers and employees
receiving in excess of$2500.00 per year, and
WHEREAS it is the sense of this Council that such bonus pay-
ment should be continued in view of the continuance of the war
emergency,
NOW THEREFORE, BE IT RESOLVED that the bonus to employees
to compensate for fluctuating living costs arising from the exist-
ence of the present war emergency, be continued at the rate of 15a
for all officers and employees receiving up to and including
$2500,00 per year,, and at the rate of 5% for all officers and em-

AUCTION SALE OF CITY PROPERTY POSTPONED The Clerk reported that after
advertising the sa nk at auction oa part of Lot 37 at the inter-
section of Elmwood Ave. and Valley Road., authorized by the Common
Council on November 3, 19430 it was found that the use of the'property
is restricted and that the sale advertised for December 15, 194.3 was
postponed to December 29, 1943 pending further investigation.
It was explained that the deed to the city restricts the use of
the property to park purposes and since it is the intent to extend
Elmwood Ave, at some future date it was felt that permission should
be secured from the grantors to use the property to the best advantage,
of the city.

Gentlemen;
The several city departments have made such careful preparat=on,
Df' Vao4 r budget requisitions for 1944 that the work of the Finance
�ca;ictee has been greatly reduced.
_n several cases, the requisitions submitted for approva
"-)een materially reduced from those of last year. The increases to to

Fire Department Here the considerable increase is mostly acccuntad.
for by the request to replace two pieces of old equipment viz.,
'cook and Ladder and ,# 5t s antiquated pumper, both new pieces requir-
ing $25,850,00. This matter was thoroughly discussed with the Fire
Commissioners and the Fire Chief, and after hearing the facts is
fully recommended by this committee.
To partially offset this amount, a decrease of $3350.00 in
salary requisitions was recommended and approved.
Under Control of Council The slight increase of Y89.58 is entirely
accounted for by bonus and salary adjustments, offset by decreases
in several items, and entirely wiped out by a reduction of �`100,00
in the requested increase in one salary.
Debt Service This amount is mandatory and not susceptible of alter-
ations. 'r,ithout an unforseen emergency requiring an issue of new
bonds; the debt service payment reduces steadily during the next fiv_
years.
Construction and Permanent Improvements The increase here is due
largely to the �?85 0,00 appropriated as the city's share of the ex-,
pense for Engineering Services in connection with the program of
bridge replacements of which the State contributes a like amount.
Items 4 and 5 are approved tentatively though it is not certain
this work can be carried out, in which case these amounts should be
transferred later to reserves.

the required paid force by two drivers, it being driven and co ntrollu
by one man.
Finally the tontat-live budget as herein amended is,submitted for
your approval, with the understanding that the present tax rate of
}14.80 will be maintains for the year 1944.
