Resurfacing
Assessments ayor Bergholtz announded that he had invited the
members of the Board of Public Works to ,feet at this
time with the Council to discuss the proposed change in
the Law which has reouired since :larch 29th that property
owners abutting a street that is resurfaced shall pay
30% of the cost of such I_aprove::lent.
The following i_ie-mbers of the Board of Public
7orks mere present: ans,:::errill,Rwihsey, _�iller,Sat doZ;
also Engineer Eustance and Foreseer Baker.
The mayor opened the discussion of the problem by
reading the following resolution which he explained had
been prepared by himself wit,) the aid of the City
Engineer with the idea of bringing about the change in
this Law that he understood :lost of the Alder;,ian favored
and he believed was also favored. by ;.lost of the taxpayers.
RESOLVED: that a local Law be prepared amending
Sec.154 of the Charter of the City of Ithaca so that wmrk
done in improving streets by resurfacing Yith sheet
asphalt ::ianufactured at the Ithaca City plant, on exist-
ing higil type pave>aent of brick or concrete, be a charge
against the City as a whole, and that no part of the
expense of the surface or the incidental work of
regrading curbs, be assessed against the abutting property
owners. However, it is understood in making the Motion,
that work involving; the repaving of a street with a
superhor type of pavement such as brick, asphalt or
concrete, after bituminous or water bound macada:i, that
the assessment shall be figured as a new paving proposi-
tion , , but when levied there shall be deducted the
amount paid at the time of the original assess::ient.
There was a general discussion,during which Engineer
Eustance explained from a practical vie,7 point what this
proposed change r7ould acco-.lplish.
The :.. ayor then as.Led the i_1e.:bers of the Board of
Public works to express their views by voting infon:ially
on the proposed resolution.
Coy_i:.iissioners--Evans,r,eri:ill and :tiller votod to
favor the resolution; Co-.i.iission: rs Runisey and Sairdon
declined to vote on the proposition as presented.
It was then E'oved by Aldor.:ian Causer: seconded by
Alder:_a-1 Hoff,,ian that the resolution as presented by the
.,.-,ayor be ap-oroved and adopted.
The :.ayor asked for discussion of the resolution
and called on the Cor_i:_his ioncrs to express their views.

Attorney Tromal agreed that the -clan. of asscss_ient

recounended no change,pointing out that the change would
make an increase in the general taxes inevitable.
He also stated that he know of no legal gray to refund
as se s spent s that had already boon paid.
Speaking of the resurfacing done last year, the
. ayor pointed out, and some Aldermen agreed, that it was
understood when this wore was authorized and ::.coney
appropriated that no assess: ent would be levied. After
some further general discussion, the question was called
and the 7ayor authorized the Clerk to make a record
vote which was as follows:

City Attorney Treman suggested that the desired amond—
ment be referred to the Comnittee on Charter and Ordinance
for preparation, as it was not clear to him just what
was desiro .

seconded and carried, that the Committee so act with
the cooperation of the Engineer and Attorney.
Emergency
Eessage Hayor Bergholtz submitted the following Emergency
M essage and proposed Local Law.
OFFICE OF THE 1AYOR AND COn ON COUNCIL OF THE
CITY OF ITHACA, NEW YORE.
WHEREAS, it appears that Section �J of the Ithaca
City Charter does not permit at the present tine the
deposit as collateral for city deposits in depositories,
of bonds such as are permitted under Section 145 of the
County Law as collateral for sililar county treasurer
deposits, and
WHEREAS, one or more depositories of the City of
Ithaca Irish to furnish such security rather than an
undertaking of individual sureties or of a corporate
surety, and
WHEREAS, it appears to _.iy satisfaction that the
interests of the City of Ithaca require the permission
of alternate forms of undertakings or sureties similar
to those provided in Section 145 of the County Later.
NOW THEREFORE, in accordance with the provisions of
Section 13 of the City Hose Rule Law and by virtue of
the authority confor-red on me, I do hereby certify as to
the necessity of invediate passage of the Local late
entitled, "A Local Law to Amend the Ithaca City Charter
in Regard to Bonds Required of Bank Depository", a copy
of which is hereto attached.

Bank VA Local Law to Amend the Ithaca City Charter in Regard
Depository to Bonds Required of Bank Depository.
BE IT ENACTED by the Cai on Council of the City of
Ithaca as follows :
Section 1. Section 33 of the Ithaca City Charter,
being Chapter 503 of the Laws of 1908 as anended, is
hereby amended to read as follows:

"Sec.33 At its first regular meeting in oach year
the co -.non council shall designate one or norc banks or
trust companies in said city as the depository of all
moneys received by the city chonberlain, and nay agree
with such bank, banks or trust companies upon a rate of
interest per anhun to be paid on _.coneys so d: nositcd.
Each such depository so designated shalt'., for the
benefit and security of the city, and before rocciving
any such dovosits, cxecute to the city a good _-,_-id
sufficient undertaking, with two or __oro su dies, or
with one or :.core sup cty co`:1panies autihorizo& to do
business in :T07 YoX State, or with deposit of bonds as
collateral thereto as hereinafter provided, such under --
takings in any event to ha approved as to fora and
amount and sufficioncy by the Com •on Council. Such under-
taking shall bo conditioned for the s-.fc-kcwping and
payment, on the order or wi',"Tra,nt of said city cha:_iberlain
or upon other lawful authority, of all such deposits
and the agreed interest tiho con, -and it shall_ be the
duty of tZe city clerk to file; such underta, ing of each
such depository in his office. It shall bo the duty of
the city chamberlain to deposit all funds bclo_nZi.ng to

or depositories, and his failure so to do will bo a

the Mte of Yew York, or of any county, town, city,
village or school district in the State of Yew York

said bonds may be registered bonds in which event there
shall be delivered either atoquate irrevocable authoriza-

Of the City of Ithaca to transfer the said bonds or any
substitution therefor on the books of the registrars

therefor and in the event of default on such u_idertahing
of such depository and the consequent necessity to

require the countorsiln iture of the mayor, city cler!)
and city ch.-, hcrlain to be effective, or such bonds may
be coupon bonds. The required amount of such securities
v y be v• riod fron tine to tine by the Co non Council.
Any such bonds so deposited shall be kept by the city
chaAbe-rlai n in a safety deposit box in sorb bank, trust
co._1pa-_ay, or safety deposit company in the city of Ithaca,
and the City Chamberlain sh.2 l retain the key to such
box and have sole access t:hepoto.

and spread of such levy the clerk shall prepare a warrant
on the City Chamberlain for the collection of said levy and
the 11,iayor and City Clerk are authorized and directed to

RESOLVED, that upon the execution and filing of said
Warrant and roll, the amounts of city tax sat opposite
each and every property shall thereupon become tax liens
collectible in accordance with law.

City Clerk to borrow not to exceed $50,000 in anticipation

be required before the tax collection period is reached,
THEREFORE RESOLVED: that the said resolution
be and the same is a:aended to read $100,000 instead
of $ 50, 000.
