tion submittedby the City Attorney be and the same is

correspond with the Governor in regard to an Emergency

BE, IT E'NTACTED by the Common Council of the City
of Itiaaca., as follows : V
Section 1. Section-135 of Chapter 503 of the
Laws of 1908 entitled "An Act to consolidate and revise
the several acts relative to the City of Ithaca" (being
tihe Ithaca Cit-.- Charter) as amanded by local lair No 3,19�5,
is hereby amended by addinE; to the seconc_ and third sentences
thereof so that the second and third sentences of
Section 13F as a,landed shall read as follows :
The owner or owners of the property along or in
front of Ifni ch a sidewalk is to be built or rebuilt, shall,
upon xequest in writing to the Superintendent of Public
dorks, be given permission to build, repair or -rebuild such
sidewalk without expense to the City, in conforrnity,hotivever,
to all t-e requirements of the Board as to the time of
building, repedring or rebuilding, material to be used
therefor, grace and location thereof, and .;anr_er and method
of construction. The Boarc_ of Public Works,upon such notice
as it shall determine, may require the owner or owners
along, in front of, or abutting any street,hi`'hway,al7_ey,
or other public place in the City,to construct or build
or repair a sidewalk or sidewalj,;s on,along, or over such
streets,highways,alleys,or other public _places, on which
said respective properties may extend or abut. If such
requirements are not complied_ with,the Board_ of Public IV
Works may Bake such sidewalk conform therewith at the
ex -dense of the owner or owners, and such expense shall be
ad-ed to and form a part of the next City Tax levied and
assessed_ on such abutting property."
Section 2. This local lac, shall take effect
immediately.

RESOLVED: that the foregoing amendment to the
Ithaca City Charter, is hereby a-oproved and designated as
Local Lace No.l, 19319and the same be laid on the table
until the next regular me-eting.

1,4ayor Bergholtz rep_ orted that he had taken urn
with the State Denar-ment the matter of charging the State
for server and other services furnished by the City
to some of the Coi:1_e e.Builc.ings particularly those
outside the City limits, and that he was advised to have
a survey mrd.e of tie cost etc., and submit the same as a
claim, or obtain an Act by the LeJislature c.Thich would
authorize the payment for such services. He recom,.ended
that he be authorized to employ an expert to obtain the
necessary data and on,motion of Aldermen Sa�,irions and
Hines the reco .-endation was ap-oroved and authorization
grant e d.

The Clerk reported that the resolution authoriz-
ing a Bond Issue at the preceding meeting- failed
to have a two-thirds vote as required by the
General .Mnmcipal Law and suggested that the same
be offered again.

WHEREAS, the Board- of Public Works has sub-
mitted to the Common Council a recoanendation and
request that funds be provided in the sum of
$25, 000. for new construction and permanent improv-
ments consisting of storm sewer construction and,
WHEREAS, the expense of such construction
and imarotement cannot be defrayed out of the
ordinary revenues and- tax levy, now therefore be U,
RESOLVED:.that the Common Council hereby
approves the recommendation of the Board. of Public
Works and the proposed storm sewer construction and,
pursuant to powers and authority in the Common
Council vested, by Art. 2-A of the General City Law
and Section 3, Chap. 1 of the City Ordinances
relating to the exercise of such powers, does
hereby authorize the issuance of obligations of
the City of Ithaca, N.Y.,in the sum of $25,000.
for the express purpose of constructing story sewers
in and along streets in the City of Ithaca,N.Y.,
and. the proceeds of such issue shall be arrnlied
toward this specific object as setforth in and
in accordance with the recom::endation submitted by
the Board of Public Wor >s, and be it further,
RESOLVED: that said bonds shall be issued
in the name of and upon the credit of the City of
Itha.ca•, County of Tompkins, State e of New York, and.
shall be executed by the Mayor under the Corporate
Seal of said City and countersigned by the Ctty
Clerk thereof and the fait:_ and credit of. said
City of Ithaca are hereby pleded for the payment
of the interest and principil on said bonds,
and be it further,
RESOLVED: that there shall be included from
time to time in each annual Budget and Tax Levy a
sum sufficient to. provide for the payment of the
interest and pxincipil on said bonds as the same
shall become due, and be it, further,
RESOLVED: that the obligations be issued
in the form of coupon bonds in the denomination of
$1, 000. each with the nxivileg e of registration
thereof both as to -principal and interest,and be
designated as City of Ithaca,New York
Improvement Bonds Series -'1HA and be dated
January first,1932 as date of issue,and bear
interest sesi-annually on the first days of
January a.nr. July in each year, and be sold at not
less than par and accrued interest; and be it further,
RESOLVED: that said bonds shall be numbered
serally from 1 to 25 inclusive and_ shall nature
in serial n Mber 15,000, in each of the years
1942 to 1946 inclusive,and further,
RESOLVED: , tha.t tie date of sale, and all
other provisions of saic_ Bonds,shall be fixed
and determined by the Common Council at such future.

of the General 11unicipal Law the City Clerk as chief

Theatres
Congressman Henry appeared before the Council
as a representative of Cornell Theatres,Inc. and" '
requested that the City Ordinance regulating Sunday
Observe;nce be amended so as not to limit the time
of motion picture entertainments to certain hours
after 2 P.M. but to permit such exhibitions at any
Ordi- time after 2 P.M.

Amended RESOLVED:that the first paragraph of
Sec. 15 Chap. II of tine City Ordinances be and the
same Hereby is amended to read as follows and to
take effect upon publication.
Sec. 15-SUNDAY OBSERVANCE. On,punday no.person
shall 3ubltply bry out or noisily proclaim for sale
any newspaper, article of food,or other thing. No
circus, theatrical representation or public show of
any kind shall be given in the City of Ithaca, on
Sunday,' with the exception however, that baseball
games, ;foot ball games, and motion picture entertain-
ments and exhibitions, are hereby permitted on
Sunday`after 2 o'clock in the afternoon.

Voting Mayor '
Machine
A communication was received from the Automatic
Voting 'Machine Corporation making'the City an offer
in corinection with remodeling the present type of
voting; 'machines, but no action was taken.,
Spiritualist ±
Meetings Chief Marshall requested the Council to
express its views in regard to the proposed
Spiritualist meeting in view of the City Ordinance
prohibiting mediums, fortune tellers,phrenologists'
etc., stating that in his opinion the ordinance did
not contemplate the prohibition of Spiritualist
meetings.
Mr. Swick and Mr. Erway were present and
explained that the meetings were to be conducted"
in a sifniliar manner as their regular meetings at'
Freev,..ille and would be held at the K. P. Hall
and that 11r. Cutler would conduct othe services.
The Council decided that such meetings would
not come within the meaning of the present ordinance
and made no objection tonthe meeting proposed.
The Clerk reported that the Stewart Park Com-
mission had passed the following resolution and had
requested the Clerk to submit the same to the Common
Council for its approval.
