The Mayor opened the Public Hearing as advertised.

on the petition of Fay I. Giddings for permission to
Vehicle
change the route of the Motor Bus Line over certain
Route
streets in the City of Ithaca. No persons appeared in
regard tonsaid petition.

RESOLVED: that the petition of Fay I. Giddings
to amend his Motor -Bus -Line Franchise so as to change his
route over certain streets in the City of Ithaca, as set
out in his petition as filed be and the same is hereby
granted and approved, subject to the approval of the
Public Service Com:ission and subject also to such rules
and 'regulations for such service as the Common Council
has or may hereafter adopt by resolution,ordinance,or
otheiwise,*and be it further
RESOLVED: that said Fay I. Giddings be granted a
franchise to operate his said Motor Buses over the follow-
ing streets of the City of Ithaca:viz.,from the east
City line, over Dryden Road to Ithaca Road, to Mitchell
Street, to E. State Street, to Tioga Street, and to the
Ithaca Bus Terminal, and return, except that the petitioner
may, while and until the new concrete road from Varna
to Ithaca Road is completed and open to traffic, use as a,
detour route, University Avenue from the east City line
to Court Street, to Tioga Street, to the Ithaca Bus
Terminal and return.

The Mayor then introduced Mr. W. L. Johnson,
City
Assistant Director of the Employee's Retirement System
Employees
from the State Comptroller's Office at Albany, who
addressed the Council in regard to the features of the
Retirement System, and also explained the benefits to the
City in adopting the same.
After an informal discussion the following

RESOLVED: that the Common Council of the City of
Ithaca, and State of New York approve of the inclusion of
the officers and employees of the,City of Ithaca in the
New York State Employees' Retirement System, which system
tW provided for by Chapter 741 of the Laws of 1920, as
amended, being article 4 of the civil service lava and
which inclusion, together with conditions of same, is pro-
vided for by Chapter 591 of the Laws of 1922 as amended by
Chapter 708 of the Laws of 1923, being article 5 of the
civil service law, with full time service allowance as
provided in Chapter 140 of the Laws of 1930.11

Day The Mayor announced that the Veterans had in-
vited the Mayor and Aldermen to take part in the
annual Memorial Day services and parade,leaving
City Hall at 2 P.M., and proceed to the Cemetery.
Also announcing that Automobiles would be furnished.

RESOLVED: that the invitation be accepted

- A petition was received from property
owners in the 100 block of West Buffalo Street in
regard to restricting parking of cars, but Chief
Marshall advised that their wishes had already been
carried out and that the new time limit in this
block was working out satisfactorily.

Settlement
The Clerk reported that Charles Eastman who was
injured in May 1927 while working for the City and had
since been paid $15.39 weekly in accordance with awards
under the Workmen's Compensation Act and that he now
desired a lump sum settlement claiming permanent
disability.
The Clerk explained that he and the City
Attorney had reviewed, the case and wished to recomr_.end
a settlement of not to exceed $5,000. total, including
payments made, and asked for. advJkae� in regard to
the lump sum settlement.

RESOLVED: that the recom° endation be approved and
the matter of obtaining a. lump sum settlement with
the approval of the Commissioner be left with the

for the current year had been completed and showed a

R:+;SOLVED: that said assessments for resurfacing,
paving and curb and gutter construction in Cliff Street
from Hector Street to the City line and in State Street
i from Aurora. Street to Albany Street ba and the same are
hereby confirmed and levied in accordance with the maps
and schedules, as amended and approved by the Board of
Public Works and filed in the office of the City Clerk,
and be it further,
RESOLVED: that said assessments are hereby
declared due and payable from, this date of confirmation
and that on all such assessments or portions thereof
remaining unpaid after the expiration o.f six months from
this date, the City Chamberlain shall ad.d and collect
a percentage thereof at the rate of 6 per cent per annum,
and all properties having such assessments or portions
thereof remaining unpaid on November 1,1931 shall be in—
cluded by the City Chamberlain in the City Tax Sale for.
1931 in the manner provided by law, except and provided

The Clerk reported on his investigation of the
bills of Dr. Vose referred to him at a previous meeting
stating that they had been referred. to the City Attorney
in December 1928 and apparently no rer ort was ever
received or any action taken.

Percy The Clerk reported that the Board of public Works
Field had a;r�,proved the plans presented by Alderman Sammons on
behalf of the Baseball League for the erection of steel
Stand including Club House F-3.cilities a.t Percy Field,
with the i,ecoinmienda,tion that the same be anuroved by the
Com:-,on Council provided_ they can appropriate $6,000.
the estimated coat.
A'unough the Aldermen looked with favor on the
` proposal there appeared to be no funds available at this
time and. therefore'no action was taken.
The Clerk reported that it might be necessary
to borrow more money in anticipation of the
collection of City Taxes and recommended that
authorization be given to borrow not to exceed
850,000. in addition to that authorized at
a previous meeting;.

RESOLVED: that the Mayor and Deputy Clerk
be and they are hereby authorized to borrow, in
the name of the City of Ithaca, New York,.a sum
not to exceed $50,000. for current City expenses

..$50,000 authorized by similar resolution at a
meeting of march 5,1930.

or.locomotive engine, boiler, heater, or frog any
tar kettle or other machine, vehicle, property,
contrivance or receptacle.
If any person., firm (including each member or
partner thereof), or corporation (including each'officeV
manager, superintendent, and director thereof)..........,,
owning, operating, in charge of, or in control of env such
building or premises, boat, stationary or locomotive
entrine, boiler, heater, tar kettle or other machine,
vehicle,property,contrivance or receptacle, causes,
,suffers,allows or perraits dark or dense smoke or soot to
issue therefrom, or if any dark or dense smoke or
soot issues therefrom, within the Ci tv of Ithaca , in
violation of the provisions of the preceding paragraph,
-each such person and each such corporation, shall be
severally guilty of a violation of this ordinance ;
and each such emission of smoke or soot shall constitute
a separate violation,'
Each entssion of smoke or soot in violation of
this section shall be a separate of-fense on the part of
each firm, each such corporation_, and each such person
mentioned in the preceding paragraph.
Violation of this ordinance shall be deemed
to,be disorderly conduct.
