ADJOURN 4, ITHACA BOARD OF FIRE COMMISSIONERS MARCH 11, 2008 MINUTES PRESENT: Commissioners Romanowski, Williams, Gilligan, Alexander and Farlow; Common Council Liaison Robin Korherr. I. Chair Romanowski called the meeting to order at 1802 hrs. II. Approval of Minutes: Chair Romanowski made a motion to approve the minutes of the February 2008 meeting with one correction. In the first paragraph, change the first 8 to a 1. The sentence should read: "One check was issued to vets and 8 were issued to the volunteer companies." Seconded by Comm. Gilligan. Carried unanimously. III. Additions /Deletions to the Agenda: - NFPA Resolution - Surplus Disposal - 2% Distribution IV. Correspondence: None V. Membership Changes: None VI. Miscellaneous Reports: - Town of Ithaca — See Chair Romanowski's written report in the Minute Book; - Audit — was reviewed and approved; - Tompkins County Fire Advisory Board — no report VII. Department Reports: A. Chief's Report (see complete report in the Minute Book). Chief Wilber offered highlights of his report and answered questions as follows: - The Department continues to work on filling the positions in the office. - Fire Fighter Thomas Yaglowski has announced his retirement, effective May 1, 2008. A request to fill the vacancy is being prepared now. - On March 4, 2008 the county paging system was moved from the 2GHz to the 6GHz microwave tower -to -tower network. On March 11, 2008, the ITHACA BOARD OF FIRE COMMISSIONERS March 11, 2008 — MINUTES PAGE 2 - system crashed leaving only the paging system working. There are plans to do a field test, but radios are still needed to do that. - SAFER Grant — There has been no word on a report. - Child Safety Seat Grant — There has been no word on a report. - Carbon Monoxide Detectors - A proposal has been submitted and we are awaiting word on the funding. - Arson Investigation: Fire Investigator Chris Hamilton will report to the Tompkins Country Fire and EMS Chief Officers' Association at their March 13, 2008 meeting. - Predisaster Grants — No word. AC Guy VanBenschoten has sent out emails to inquire about the status. - Efforts continue for the addition on the Training Center. Funding is still needed at this point. - Explorer Post — ICSD has approved the program. FF Patrick Sullivan continues to work on the program. Currently he is talking with GIAC, local churches, etc. - Chief Wilbur and Deputy Chief Parsons met with Cornell police about the audible alarms. The meeting was positive. Curt Ostrander is putting in the budget for additional campus police. Audible alarms are needed. An inventory of alarms will be done to decide which alarms need to be replaced, repaired, etc. B. Fire Prevention Report — Deputy Chief Parsons was not present. (see complete report in the minute book) C. Deputy Chief's Report — (see complete report in the minutes book) Deputy Chief Dorman offered highlights of his report and answered questions as follows: - Received official information on the 2008 fire fighter exam. The applications are due by May 7, 2008 and the exam is schedule for June 14, 2008. The existing list will be used through July and the new list created ITHACA BOARD OF FIRE COMMISSIONERS March 11, 2008 — MINUTES PAGE 3 from the June testing will replace it. Testing is done every 2 — 3 years depending on the openings. - The pre -bid meeting to discuss the 2 pumpers is March 27, 2008 at 2:OOpm and the bid opening on April 17, 2008 at 2:OOpm. VIII. Old Business — None IX. New Business — NFPA Proposal - A proposal was presented by LT Chris O'Connor that outlined the need for more funding to support the needs of the Department for turnout gear. A review was requested by the City Attorney. The proposal also deals with how a Department chooses gear and when to take items out of service or to send out for repairs. It also suggests maintaining records on the gear. Older gear is still being worn because it hasn't been retired. Gear has been vastly improved in the last 10 years. $110,000 was requested for replacement and only 40% was approved for replacement. If the same amount is approved for the next 2 years, it would take 3 years to get every fire fighter in fully updated gear. - Protective Equipment Surplus Proposal — LT O'Connor presented a proposal on surplus gear. This gear is out dated and too small to fit any of the current fire fighters, nor is it likely to fit any future fire fighters. It was suggested that the Explorer Program might use the items due to the fact that they would not be used in a "real" fire. Chief Wilber wasn't sure if the sizes would be appropriate, so it was suggested that just the hats and jackets could be used to make the membership feel that they were a part of something special. It was also suggested that the gear be retained for training and marked with a "T" so that it would not be used in a fire. NFPA standards directly effects us through OSHA. In this particular case, OSHA does not reference this situation. X. Executive Session ITHACA BOARD OF FIRE COMMISSIONERS March 11, 2008 — MINUTES PAGE 4 The Board entered into a lengthy Executive Session to discuss the legal ramifications. The Board resumed open session. Chief Wilbur suggested an amendment to the proposal. Topic is tabled until next month. XI. 2% Money Distribution Comm. Gilligan read the Board of Fire Commissioners draft letter to the Captains in regard to the 2% distribution. After some discussion and wording changes, a motion was made by Comm. Gilligan and seconded by Comm. Williams to send the revised version of the 2% letter to all the Companies prior to their April meetings. Motion passed with 4 voting in favor and 1 abstention. A long discussion on the letter modifications continued while trying to agree on verbiage. XII. Hearing no other business, the meeting adjourned at 1940 hrs. Respectfully submitted, Randy L. LIFE SAFETY DIVISION Administration 1) Career Personnel Report a) See Deputy Chief Dorman's report. b) The Human Resources Department provided us with lists and candidate information for both the Financial Management Assistant position and the Administrative Assistant Position. As the next step in completing this process, we are currently reviewing applications and will conduct interviews soon. C) The Physical Performance Assessments (PPA) for 15 candidates who responded to the canvass for the position of fire fighter are scheduled for 12 APR 08. Applicants successfully completing the PPA will appear on the certified list of eligibles from HR/Civil Service. nee we receive that list, interviews can be scheduled. Currently there is one vacancy, one impending vacancy, and two new positions to fill after 01 JUL 08. 2) Operating Budget Status a) Please review the reports provided by Office Manager Dianne McGrady. 3) County Communications and 911 Program a) Paging System: the transition to the new paging system did not go smoothly. Among other things, a malfunctioning low band base station at the Ithaca College tower impeded diagnosis of the problems. The transition effort continues. b) 800 MHz System: Three separate sessions of what is now the first of a series of train - the - trainer programs was delivered the week of 23 MAR 08. This session focused primarily on technical aspects of the new equipment. Actual use and operational procedures must still be presented. C) IFD equipment specifications: DFC Tom Parsons has drafted a plan that would facilitate the Ithaca Fire Department's final specifications for talk groups and other operational programming of user equipment. Despite standing requests to access the equipment to allow this planning to be completed, to date that request has not been filled. DFC Parsons' plan lays out a process for finalizing that work, which is pending receipt of equipment from the County for testing. An Equal Opportunity Employer with a commitment to workforce diversification." co 4) Grants and Donations a) 2007 Grants: An application for a 2007 SAFER grant was submitted. The application requested four additional fire fighters. There has been no word on an award. [Same report as last month.] b) Child Safety Seat Grant: The grant was submitted last month and we are awaiting word on its status. [Same report as last month.] C) Carbon Monoxide Detectors: Discussions with Wa1Mart and with the Women's Fund of the Community Foundation have created the possibility of donations and funding that will allow us to include carbon monoxide detectors along with the smoke detector program. A proposal has been submitted and we are awaiting word on the funding that will be awarded as a result. [Same report as last two months]. d) SWAT /CINT /CP Vehicle: Discussions continue on developing funding for this vehicle, but the City has not made a commitment to fund it as yet. [Same report as last month.] e) Smokeless Tobacco /Polaris Grant: An application was submitted to the Smokeless Tobacco Institute for a Polaris 4 X 4 ATV -type vehicle. This is the second application for this program. We just learned we did not receive an award this year. f) Assistance to Fire Fighter's Grant (AFG): Grant applications for 65 new self contained breathing apparatus (SCBA) and a utility vehicle for hazardous materials were submitted on 04 APR 08. While there were several proposals received for various grant projects, a keystroke error in the 2008 budget resulted in SCBA becoming a priority. That error dropped a zero from the unit price for replacement air cylinders. Rather than the actual $750 per cylinder price, the unit price the budget was based on was $75. New SCBA will resolve this problem by acquiring both the SCBA unit with cylinder, but an extra cylinder as well. The utility vehicle for haz mat specifies a Chevrolet Suburban type vehicle for use in rapid response to local, countywide, or regional hazardous materials situations. With a vehicle equipped with detection and sampling equipment, this rapid response will facilitate assessment and resource need identification. The AFG program this year allowed two different projects to be identified and requested. 5) Strategic Funding for Firefighters (S4F) The S4F group will convene as soon as possible to approve a status report. [same report as last month.] 6) City -Town Fire Contract Negotiation The next date for a meeting between the City and Town has not been set. The meeting held 13 MAR 08, continued the discussions already initiated. In the meantime, the Common Council and Town Board have extended the MOU to authorize continued services to 30 SEP 08. Fire Prevention Bureau 1) Please see Deputy Fire Chief Parson's report of Fire Prevention Bureau activities for the month of March. Safety Section 1) Protective Equipment Maintenance Standard Resolution At the last meeting, the Board requested clarification regarding various policy aspects of the proposed resolution. Unfortunately, I was unable to take any action on this resolution. OPERATIONS DIVISION Response 1) Monthly Call Report See distributed reports for 2008, year -to -date, and the seven -year summary of response data. 2) Emergency Management a) Emergency Management Exercise: No report. b) Pre - Disaster Mitigation Grant: Starting in 2002, the City of Ithaca engaged in a project to develop a pre- disaster mitigation plan. This plan is required to insure eligibility for future mitigation grants. As of 04 JAN 07, we have been advised the grant application has been submitted to FEMA for final review and action. This is the last step for this grant and we are still waiting to hear what the decision will be. [Same report as prior months.] C) FEMA deployments: Reimbursement for June -July 2006, deployments to Tioga and Broome Counties is in the works at this point. Forms required to transmit payment have been received and are being processed now. Support 1) See Deputy Chief Dorman's reports for APR 2008. 2) Training Center Reports n a) Usage report not available for this month. b) Training Center addition project: Additional funding to support this initiative has not been secured as yet. Effort continues to identify funding sources. Training 1) See report from DC Dorman. VOLUNTEER SERVICES DIVISION Recruitment and Retention 1) Explorer Post: The Ithaca Paid Fire Fighters' Association, IAFF Local 737, has advised me they are not in favor of the formation of an Explorer Post. Although efforts to determine interest and feasibility continue, various obstacles have appeared that are slowing this process. Service 1) Summaries of Service Hours: A resolution to address the issue of service and training hours was distributed for the Board to consider at the February meeting. A request to send this resolution, along with appropriate background information, to the eight volunteer companies and the Ithaca Veteran Volunteer Firemen's Association, has not been completed as yet. 2) Fire Police The Fire Police Unit must finish its organization and prepare for deployment before further discussions can be held regarding this initiative. Code Enforcement Division: The Codes Enforcement Division received 21 complaints in the month March. There were 14 complaints closed out, and 18 complaints that still remain open for March and previous months. The Code Enforcement Division performed 90 inspections or re- inspections. There were 456 violations that were cited, and 62 violations that have been corrected. In the month of March the Code Enforcement Division inspected 35 buildings at Cornell University, which accounted for the larger number of inspections and violations cited this month. We have yet to perform the re- inspections on these buildings; so many of the violations have not been listed as corrected. The Code Enforcement Division issued 12 operating permits for occupancies, 11 certificates of compliance for fire and property maintenance inspections, 9 fire alarm system certificates, 2 alternative fire suppression system certificates and 1 standpipe system certificate. The Codes Enforcement Division issued 9 parking violations: 4 Fire Lane / Fire Hydrant Violations, 3 Handicap Parking Violations, and 2 Prohibited Areas Violation. Green Street Ithaca, NY 14850 RE: 2% MONEY Dear Bob: I understand that the Board is planning on discussing the 2% money at its April meeting. Cayuga Hose Company No. 1 has been in existence for over 175 years, serving the City of Ithaca Fire Department. We still have active members, mostly older. However, we also have some younger members. All our members have served and continue to serve our Company well since its inception. I believe that the closing of No. 7 fire station was a loss to the community, and the start of the decline in the number of volunteers in the fire companies. Company No. 7 served the community well: helping to pump our cellars when flooding was a problem in Fall Creek; sponsoring parties for children; and hosting breakfasts and dinners. The excuse for closing it ,was. that it was too expensive to keep open. My personal belief is that Chief Olmstead wanted a paid fire department. Why don't we have more young members? We have had young members who were signed up for Fire Training and would wait at the training site on the scheduled day, only to have it cancelled. Eventually no Fire Training was offered at all to volunteers. A few of our members are pursuing joining the Fire Police, so that they may continue to serve the Ithaca community, I am currently out of town until May 2, and because of the importance of the issue of 2% money, I am hereby requesting that the Board of Fire Commissioners postpone its discussion of this topic until the May meeting. Due to the Board of Fire Commissioners indecisive action to establish what the word "active" means. Now is the time to define the true meaning, so all will know and do what the board requires. The "active status" in my opinion has to be decided by the board of fire commissioners fairly and mailed to each company Captain, so everyone knows and can go by one defined standard. In the Ithaca Fire Department Volunteer Handbook on page 11, it clearly describes "active status" for volunteer firemen and as I got older and disabled, l could not enter a burning structure, so I filled out a reclassification request, so I could remain in "active status" it was approved by the Fire Chief. For 185 years our company No. 2 has had meetings, a officer structure, attended fire training. This memorandum states that there may be a delay in the distribution of 2% funds to the Volunteer Fire Companies pending the outcome of a review by the Board regarding "...what criteria should be used for determining whether a Volunteer Company is providing the appropriate type and level of service to the area served by the Ithaca Fire Department to justify that company receiving a share of the 2% foreign fire insurance funding." Under existing state laws and past Iegal decisions regarding the distribution of such funds, we do not believe the Board has the authority to delay the distribution of 2% funds to the Volunteer Companies. We further believe, that current and past Board of Fire Commissioners have not acted effectively to maintain the Volunteer Component of the Ithaca Fire Department. Decisions and policies by the Department's Administration, have been consistently implemented to undermine the viability of the volunteer component of the Ithaca. Fire Department apparently with the support or tacit approval of the Board. Until approximately the year 2000, Volunteers and Bunkers were actively recruited and training was provided to them, however, over the last five or six years the lack of any new member training being available has effective stopped willing members of the community from providing volunteer services to the City and Town of Ithaca. The most recent example of this lack of support and failure to utilize willing volunteers to provide a valuable service to the community, is the delay in activating the fire police. A group of 8 to 10 individuals committed to serve as Fire Police has been trained and have been waiting to be called to service since January. Over the last 2 months no apparent effort has been made by the Department and Fire Commissioners to utilize this group of "active" Volunteers. We believe that the Board should work to make sure that the Fire Police are put into service without further delay. We also think that the Department's training officer should be tasked by the Fire Chief, at the direction of the Board, to assure that adequate training opportunities are made available for existing volunteers and that the training officer develop a program for training a new cadre of volunteers and bunkers to serve the community. Once these opportunities for training are available, the Volunteer Companies will be able to begin a recruiting effort that will eliminate the need for the Board to conduct its "review of 2% funds."
